  • 근로자의 안전을 위해 산업안전보건법이 개정되어 2020년 1월 1일부터 시행되었다. 이 개정 사항에서 산업안전보건법의 보호범위 확대 및 산재예방 책임주체 확대 등의 많은 사항들이 개정되었다. 뒤이어 시행된 중대재해처벌법은 사업 또는 사업장, 공중이용시설 및 공중교통수단을 운영하며, 안전 보건 조치 의무를 위반하여 인명피해를 발생하게 한 사업주, 경영책임자, 공무원 및 법인의 처벌 등을 규정함으로써 중대재해를 예방하고 시민과 종사자의 생명과 신체를 보호함을 목적으로 한다. 비교 결과로는 산업안전보건법이 근로자의 안전 및 보건을 유지 증진시키는데 목적이 있었다면, 증대재해처벌법은 좀 더 넓은 범위의 생명과 신체를 보호한다는데 그 역할을 두고 있다.

Technological Trends in Safety Solutions for Construction Equipment (건설장비의 안전 솔루션 기술 동향)

  • Negative perceptions of the construction industry are prevalent due to the high accident rate at construction sites. Recently, with the gradual change of the perception in industrial safety, the demand for improving the safety level of construction sites has increased. Accordingly, the government is preparing various safety-level measures such as the Serious Disaster Punishment Act and support for industrial safety management costs. In addition, private industries are incorporating various safety equipment in the sites. This paper introduced the current status of safety sensors and solutions currently applied to construction equipment and industrial vehicles. The technology development direction suitable for construction equipment was introduced by comparing the operating environment of automobiles and construction equipment. and the need to develop performance standards to protect and revitalize the market for safety devices for construction equipment was suggested.

The Introductin of the Special Act on Port Safety in South Korea: First-year Results and Future Tasks (「항만안전특별법」시행 1년의 성과와 과제)

  • Objectives: The successful implementation of the Port Safety Special Act is a very important matter. Now that one year has passed since its introduction, this study aims to review the achievements so far and identify future tasks. Methods: The provisions of the Special Act on Port Safety were analyzed and the latest literature related to port safety management was reviewed. In addition, an in-depth interview was conducted with a business owner. Results: The achievements over the past year are as follows. As business operators took greater responsibility for safety management, blind spots in safety were resolved to an extent. Specialized training for the port unloading industry was provided, and a safety management system was established for unloading docks. In addition, the Ministry of Oceans and Fisheries was able to intervene in the prevention of safety accidents at ports through the deployment of port safety inspectors. In 2022, the port industry accident frequency and death rate declined compared to the previous year. Conclusions: The "Port Safety Special Act" has become relatively well established in the port industry over the past year. However, since the Serious Disaster Punishment Act was implemented in January of the same year, there is a limit on determining what is necessarily the effect of the Special Act. Future tasks include unifying contracts centered on cargo handling companies, supporting safety management costs, increasing the number of port safety inspectors, producing reliable port disaster statistics, and cooperating between the Ministry of Oceans and Fisheries and the Ministry of Employment and Labor.

  • Occupational safety obligations are also applied to on-the-job workers in the education field, and as the work that the education system was not prepared for approaches to reality, difficulties in responding arise and at the same time, it is necessary to establish a safety and health management system at universities. In this study, through a group survey of university safety officials, the application of the Industrial Safety and Health Act, the Serious Accident Punishment Act, the Higher Education Act, and the Laboratory Safety Act, which are closely related to university safety and health management, was identified, and the issues identified as problems were effectively addressed by the university. A plan to improve safety management was suggested.

Effects of the Safety and Health Management System on Safety and Health Management Level and Accident Indicators in Construction Industry (건설업의 안전보건경영시스템 인증이 안전보건관리수준과 사고지표에 미치는 영향)

  • This study examined the certification effects of safety and health management system (SHMS) on the establishment level of SHMS and accident statistics in construction industry. This study obtained the establishment level of SHMS for 106 construction companies surveyed from our previous study. In addition, three major accident statistics (mortality rate, accidental mortality rate, and injury rate) for the companies were collected from the database in Korean Occupational Safety and Health Agency. The statistical analysis results revealed that the establishment level for SHMS certified companies was significantly higher than those for uncertified or certification preparing companies. Furthermore, SHMS certified companies showed significantly smaller accident statistics compared to uncertified or certification preparing companies. The results of this study support the positive effects of SHMS on reducing major industrial accidents in construction companies.

  • In accordance with the Act on Punishment of Serious Disasters, terminal operators are required to establish and operate a safety and health management system such as manpower and budget necessary for disaster prevention, and establish and implement measures to prevent recurrence in the event of a disaster. This is a study on how to use the port facility safety management system linkage to prevent safety accidents in port facilities due to the introduction of autonomous driving port equipment and to support decision-making promptly in case of safety accidents.

  • 본 연구는 건설현장 관리자를 대상으로 중대재해처벌법 인식이 건설업체의 경영성과에 미치는 영향을 실증적으로 확인하는 것이다. 최근의 사회적 이슈가 되는 중대재해처벌법이 건설회사 이미지 실추, 경제적 손실 등의 간접적인 손실뿐만 아니라, 최고경영자에게 직접적인 영향을 미친다. 또한 건설업체에서 중대재해 발생시에는 중대재해처벌법에 의하여 최고경영자의 구속등으로 기업의 업무연속성에 영향을 미치는 사회재난이다. 건설현장을 운영하는 기업의 사업주에게 중대재해로부터 실질적인 대처방안이 필요하며, 대안으로 건설현장 관리자의 중대재해처벌법의 위험성에 대하여 인식을 강조하여, 건설현장에서의 관리자가 주체가 되어 중대재해를 예방하고, 기업의 연속성을 확보하는 것이 필요하다.

  • 중대재해처벌법이 2022년 1월 시행됨에 따라 노동계, 경영계 등 사회적으로 큰 이슈가 되고 있다. 해당 법률의 목적인 중대 재해 예방은 생명과 신체를 보호함의 목적에 충족할 수 있도록 문제점을 분석하여 개선방안을 제시하고자 한다. 연구방법: 해당 법률의 주요 내용을 파악하고, 조항별 문제점을 분석하였다. 연구결과: 문제점으로는 1) 적용 사업장의 형평성의 문제, 2) 일부 법 조항의 명확성의 원칙 결여 문제로 크게 2가지로 분석되었다. 결론L법 시행초기인 만큼 시행착오가 있지만 해당 법률의 안착 및 목적에 부합하기 위해 노동계와 경영계를 비롯한 각 계의 노력으로 개정이 필요하다

  • The risk assessment under the Occupational Safety and Health Act was implemented in 2013, but since it is not mandatory, companies are operating it as a formality. Although legal obligations have been strengthened, such as the recent comprehensive revision of the Occupational Safety and Health Act and the enforcement of the Act on Punishment for Serious Accidents, the death rate has remained stagnant. Even if a risk assessment plan is properly established in order for employers to prevent industrial accidents through necessary measures, it is necessary to involve relevant workers so that they can understand and implement the contents of the risk assessment. In this regard, this study proposed applying efficient worker participation measures through on-site surveys to activate the participation of vulnerable workers in risk assessments. A Review of the Legal Responsibility of Dog Owners regarding Dog Bite Accidents - Focused on a Comparison with American Dog Bite Legislation - (개물림 사고에 대한 소유자의 법적 책임에 관한 소고 - 미국의 개물림 법제와의 비교를 중심으로 -)

  • In South Korea, the number of households that rear companion animal has been gradually increasing. With the rise of household dogs, the frequency of humans that are being bitten by another's dog has also increased. This type of accident, which is known as a dog bite accident throughout the United States. It can cause significant physical and emotional damage to the victims and may result in grave injuries or death. Dog bite accidents are serious public health problems and can cause immeasurable hidden costs to the community. South Korea has enacted several laws to address dog bite accidents, which include the Animal Protection Act, the Civil Act, and the Criminal Act. On March 20, 2018, the Animal Protection Act was amended to reinforce the current legislation. These amendments addressed the duty of care owed by a companion dog owner to society members and the punishment that an owner of a fierce dog would face in the event of a dog bite accident. Conversely, several states in the United States have enacted a single law that regulates the details regarding dog bite accidents, such as the type of dog or animal, the type of damage, the scope of compensation for damages, and the scope of recognition of liabilities. This paper is intended to review the present situation of dog bite legislation in several states in the United States, which have a variety of laws that address dog bite accidents, and compare them with current South Korean dog bite legislation. Through this research, this paper will discuss what issues may exist in South Korean's current dog bite laws, analyze the responsibility of companion dog owners, and provide solutions to any issues that are discovered.
