Purpose: The South African government is determined in alleviating poverty while encouraging job creation and protecting the disposable incomes of poor households. This article looks at the challenges that are facing the South African Social Security system and argues that the provision of income security is amongst the most practical expressions of a nation's cohesion and values. Research Design, Data and Methodology: There are seven proposals in the Social Security and Retirement Reform and these proposals are based on the following two principal objectives of the government, that is, to ensure a basic standard of living and to prevent destitution in old age or in circumstances of unemployment or incapacity partly or wholly through redistributive measures, and to encourage savings to provide for the replacement of income on retirement, disablement or death through long-term insurance arrangements. Results: This article evaluates these seven proposals, state old age pension, wage subsidy, mandatory participation in a national social security system for all, mandatory participation in private occupational or individual retirement funds, Voluntary additional contributions to occupational or individual retirement funds, reform of the governance and regulation of the retirement funding industry and reform of the tax system. Conclusion: This article concludes that the population size of South Africa has increased significantly to 51, 8 million in 2011 and therefore the time is right for bold new steps in improving income security of the poor and strengthening the fabric of social solidarity that binds all South Africans together.

Under the co-sponsorship of UNIDROIT and I.C.A.O., a preliminary draft Convention on International Interests in Mobile Equipment and a preliminary draft Protocol on Matters Specific to Aircraft Equipment has been prepared. The purpose of the Convention is to provide for the creation and effect of a new international interest in mobile equipment. The Convention's approach is quite novel in that it purports to create an international interest based upon the convention itself. The Convention is intended to be supplemented by Protocols, each of is intended to provide equipment-specific rules necessary to adapt the rules of the Convention to fit the special pattern of financing for different categories of equipment. To date, two sessions of governmental experts were held in Rome and Montreal. Korean delegations attended the two sessions. One of the members of the Korean delegation published a report on the first session. He expressed his objection to the so called self-help remedy contemplated by the current preliminary draft of the Convention which enables the holder of a security interest to repossess and dispose of the subject of the security interest by private sale rather than public auction on the occurrence of an event of default of the debtor. His view is based upon his understanding that under Korean law, the only remedy available to the holder of a security interest in mobile equipment, such as an airplane, is to apply to the competent court for a public auction. In my view, his understanding is not quite correct and is inconsistent with the current practice in Korea. Under Korean law, the parties' agreement for private sale is in principle valid unless there is an interested party who has acquired a security interest after the creation of the prior security interest or a creditor who has caused the subject of the security interest to be attached by a competent court. In this article, I discuss the current Korean law and practice relating to the enforcement of security interests by private sale in more detail.
The link between transnational environmental harm and national security has attracted new attention due to the environmental crisis such as climate change, nuclear accidents and, pollution. However, both domestic and international environmental regimes are still tied to the unsuccessful and unclear notion-sustainable development. The present author argues that environment should be considered as a security matter for the effective environmental protection. If, for example, a nation committed a serious environmental harm and the effects spans borderlines, and the source nation refuses to cooperate or compensate, would sustainable development still be an appropriate measure? Then, what would be the victim state's tool to protect its own security? The present author first looks into the possibility utilizing UN Security Council. But due to its limited legality and effectiveness in this environmental matter the present author would like to propose a non-traditional but a not-brand new method. This new method reflects two new trends both from international law and security areas. First, this approach clearly moves from the military focused security concept to broader security concept. Second, this is also a shift from traditional international law to transnational law. With these two new approaches, we will find a more suitable answer both for securing national environmental security and for protecting environment.
The purpose of this study is to investigate about security service history during the 1st and 2nd Republic. The 3rd Republic, one of the important periods, deserves special emphasis until now. But Compared with 1st and 2nd Republic, the 3rd Republic is inferior. Although security service history excluded the 1st and 2nd Republic. This research focused on the two points about the chief of the presidential security and the law of presidential security special order. Firstly, the chiefs of the presidential security in 1st Republic were Kim, Jang-Heung Seo, Jung-Hak Kim, Kuk-Jin Kwak, Young-Joo. Secondly, The law of presidential security special order be specified in Korean presidential security for the first time. Before the 1st Republic already recognized the importance of security services when they adopted the first security service regulations on December 29, 1949, which comprised 25 articles. But this law was only focused on presidential security and promulgated the law more than 10 years ago than law of the office of the Presidential Security in 1963. Deplorable in this law was declared by statute on July 7, 1953 from the 1st Republic, but repealed in 1960 after the 2nd Republic. Thirdly, 2nd Republic established the presidential security organization with the new government has been formed. In spite of this organization can not be kept for a long time, 2nd Republic attempted to professional forms of presidential security organization. During the recent years, cyber attacks have been increasing both in the private sector and the government. Those include the DDOS cases in 2009, the Blue House cyber attack, bank hackings etc. Cyber threats are becoming increasingly serious. However, there is no basic law related to cyber security at present, and regulations related to cyber security are scattered in various domestic laws. This can lead to confusion in the application of the law and difficult to grasp the regulations related to cyber security. In order to overcome this situation, the bill on the prevention and countermeasures against cyber crisis was initiated in 2006, but it has been abrogated. Since then, it has been repeatedly proposed, but it has been abrogated repeatedly due to the overlapping of existing laws and concerns about infringement of personal information. The most recent initiative was the National Cyber Security Act, which was initiated by the government in January 2017. The act focuses on resolving the absence of a basic law related to cyber security, strengthening its responsiveness in the event of a cyber security crisis, and fostering security strength. Therefore, this study seeks to contribute to the establishment of National Cyber Security legislation as a basic law of cyber security by examining the necessity of National Cyber Security legislation through comparative legal analysis with existing domestic laws related to cyber security and suggesting policy implications.
