The United Nations Convention on the Law of the Sea(hereinafter referred as "the Law") adopted in 1982 was enacted on November 16, 1994. South Korea, China, and Japan signed and ratified the Law, respectively. These three countries announced their domestic laws relating to Exclusive Economic Zone(EEZ) with reserving their applications. The enactment of the Law and announcement of EEZ inevitably brought new order on the seas. The New Fishery Agreement based on the Law with EEZ was concluded between South Korea and Japan and ratified by each country′s parliament. Another New Fishery Agreement between South Korea and China is also going to be concluded in near future. The New Fishery Agreements, however, do not include regulations relating to the marine scientific research, the protection of the marine environment, and so forth, which are essential for the States to fully implement the Law According to the New Fishery Agreements, it is impossible for the Coastal States to excercise their jurisdiction. Because the agreement of delimitation ocean boundaries among the three countries are not easy to settle, provisional agreements can only be concluded. Thus, many problems including the sovereignty over Dok-do between South Korea and Japan and delimitation of EEZ between South Korea and China can be arose anytime. This paper investigates the problems and possible counter measures in legal excercise on the seas by South Korean Government. The above mentioned problems introduced by the New Fishery Agreements include potential problems in the Middle Sea Zone, Provisional Zone, and so forth. In this paper, only the legal aspect of the Zones will be discussed excluding the law enforcement and the economic aspect of the Zones.
The fishing vessels operation is a kind of maritime profit-making activities, which are complicatedly integrated by the basic and supplemental fishing activities with navigation. The Fishing Vessels Act of Korea defines the character of fishing vessels and gives a legal status to them, and this Act itself is linked with the allied public laws including the Ships Act of Korea. For this reason, the legal status of fishing vessels as Korean flagged ships by the public law is analogous to the general commercial vessels. And the specific character of ownership of the fishing vessels by the Korean Maritime-Commercial Act as a privated law is analogous to the general commercial vessels, nevertheless the Chapter 4(Carriage of goods) and the Chapter 5(General average) of this Act do not apply to the fishing vessels except the fish carriers. A fishing vessel possesses the legal status as a Korean flagged ship by having it registered and putting it on record under the provision of national law, however the principle of genuine link is an important factor for acquisition of nationality. Especially, the basic rules by the Law of the Sea those are attended with the distant-water fishing vessels operation at the overseas fishing ground are summarized as follows ; Firstly, the rights of navigation and fishing activities on the high seas are fundamentally recognized to all states, but the freedom is restricted according to the international legal order aiming at protection of reasonable interests of other states and conservation of the living resources and marine environment. Secondly, in the EEZ or EFZ the freedom of navigation is recognized, but fishing activities are exclusively ruled by the national law of the coastal state. Thirdly, foreign fishing activities are prohibited but the right of innocent passage is recognized in the territorial sea, while both activities are prohibited in the internal waters of the coastal state.
In this paper, an experimental study on sloshing problems in an independent B-type tank of STX Offshore and Shipbuilding Co. is described. Recently STX Offshore and Shipbuilding Co. introduced a new design of an independent B-type tank in order to reduce sloshing impact loads on LNG CCS. This tank has many internal members, so that sloshing flow and the resultant hydrodynamic loads are very different from those in typical membrane tanks. In this study, a series of sloshing experiment have been carried out for 1/50 scale model, and the main characteristics of sloshing load on the independent tank are observed. The properly scaled internal members such as swash bulkhead, center bulkhead and stringers have been installed in the test tank model, but sloshing pressures are measured on the tank walls only. The forced excitation signals have been generated by using the predicted ship motion in irregular sea states. The characteristics of sloshing loads on this tank have been observed in different filling levels with various heading angles, and sea states. In this paper, some key findings from the model tests are discussed.
Fish exportation using airplanes incurs sizable logistics costs (12,000KRW/kg), according for more than 45% out of the total export cost. Thus, it is unreasonable to quantitatively expand fish exportation by means of air transport. In addition, cases of failing to deliver fish at the right time to the right place occurs frequently due to the limited cargo capacity and insufficient cargo space of airplanes, especially during the peak season. Therefor, a technology that not only minimizes the logistics costs but also transports fish freshly and safely, in the case of long distance exportation to countries such as the United States and Taiwan, should be developed. In this study, a live fish container control system for long distance transportation was designed and implemented. Live flatfish (2,000kg) were selected as the target fish, were transported to the United States to analyze and verify the performance of the a live fish container control ystem and transportation ability.
Recently, as sea ice in the Arctic has been decreasing due to global warming, it has become easier to develop oil and gas resources buried in the Arctic region. As a result, Russia, the United States, and other Arctic coastal states are increasingly interested in the development of oil and gas resources, and the demand for offshore structures to support Arctic sea resources development is expected to significantly increase. Since offshore structures operating in Arctic regions need to secure safety against various drifting ice conditions, the concept of an ice-strengthened design is introduced here, with a priority on calculation of ice load. Although research on the estimation of ice load has been carried out all over the world, most ice-load studies have been limited to estimating the ice load of the icebreaker in a non-oblique state. Meanwhile, in the case of Arctic offshore structures, although it is also necessary to estimate the ice load according to oblique angles, the overall research on this topic is insufficient. In this paper, we suggest algorithms for calculating the ice load of managed ice (pack ice, 100% concentration) in an oblique state, and discuss validity. The effect of oblique angle according to estimated ice load with various oblique angles was also analyzed, along with the impact of ship speed and ice thickness on ice load.
When the international fisheries order changes following the UN Law of the Sea, the new regional fisheries order is forming among East North Asian states and era of Economic Zones is really coming. In those changes of foreign and domestic fisheries environment, to maintain sustainable growth of the industry in 21st century the North East Asian states plot adjustments to fisheries management, such as introduction of the TAC system and others. The TAC seems to be an appropriate systematic response especially because traditional functions of fisheries management have already demonstrated their limits in regards to fisheries sustainable development. Introduction of the TAC to the North East Asian fisheries not only resolves the inability of traditional fisheries management to develop the industry consequently, but also strengthens the EEZ and existing marine management systems. However, the TAC was born by thewestern industrial mentality, still contains persistent mistakes and is difficult to change. Therefore, its introduction to and implication in North East Asian region might cause numerous problems. From this point of view, introduction of the TAC system will disregard peculiarities of North East Asian fisheries, so main efforts should be concentrated on improving the functions of existing system via consecutive step-by-step approach. In addition, the TAC should be grafted into the existing fisheries system through cooperative management system, creating stable systematic ground and considering scientific and fisheries motives. Especially, TAC system, unlike the traditional fisheries' management system, is scientific, being systematically developed one, and needs to be gradually installed, considering its systematic character. Therefore, the TAC should better be introduced by systematic and scientific approaches, paying more attention to strengthening the existing fisheries system, but not immediately and in the form it is right now. Concluding, introduction of the TAC can not be made considering the outward factors deriving from the UN Law of the Sea without corrections.'h overcome limitations and ineffectiveness of traditional fisheries, most efforts should be concentrated on basic revision of 21st centuries' fisheries and strengthening the functions of traditional fisheries aimed to develop the leading business of marine industries.
This study aimed to review the reorganization of fisheries and the future tasks in accordance with the establishment of new fishery order in the Northeast Asian Seas. As the United Nations Convention on the Law of the Sea, which recognized the sovereign rights of Coastal States in a 200-nautical mile exclusive economic zone (EEZ), entered into force in 1994, the three countries of Korea, China and Japan ratified the United Nations Convention on the Law of the Sea in 1996 and started negotiations to establish a new fishery order consistent with the EEZ system. However, a conflict of interest occurred because of differences in fisheries between countries, negotiations many times have proceeded, resulting in the signing of fishery agreement between China and Japan in 1997, Korea and Japan in 1998, and Korea and China in 2000. Each fishery arrangement consists of a dual system of EEZ and provisional waters (middle waters, provisional waters). The two countries are engaged in mutual fishing based on coastal states in EEZ, and in the fishing operation under the principle of flag state in provisional waters. There are overlapping or ambiguous jurisdictions in the intermediate waters and provisional waters that are jointly available to both fisheries. The presence of these seas is a challenge to the establishment of a reasonable international fisheries management system for the entire Northeast Asian Seas. In this context, the challenges of the reorganization of the new fisheries order are as follows: 1) conversion to a fishery order for coexistence of fisheries, 2) expansion to an international fishery management system, and 3) establishment of a multilateral fishery cooperation system. Although the jurisdiction of their own waters has been expanded through the establishment of EEZ according to new fishery order, the need for mutual cooperation grows when considering the movement and migration of fishery resources, fishery management, fish consumption and trade. In addition to the fisheries cooperation between the governments, it is also necessary to revitalize the civil cooperation focused on fishermen who exploit fishing grounds together.

A semi-submersible offshore platform always operates under complex weather conditions, especially wind and waves. It is vital to analyze the structural dynamic responses of the platform in short-term sea states under the combined wind and wave loads, which touches upon three following work. Firstly, a derived relationship between wind and waves reveals a correlation of wind velocity and significant wave height. Then, an Improved Mixture Simulation (IMS) method is proposed to simulate the time series of wind/waves accurately and efficiently. Thus, a wind-wave scatter diagram is expanded from the traditional wave scatter diagram. Finally, the time series of wind/wave pressures on the platform in the short-term sea states are converted by Workbench-AQWA. The numerical results demonstrate that the proposed numerical methods are validated to be applicable for wind and wave simulations in structural analyses. The structural dynamic responses of the platform members increase with the wind and wave strength. In the up-wind and wave state, the stresses on the deck, the connections between deck and columns, and the connection between columns and pontoons are relatively larger under the vertical bending moment. These numerical methods and results are wished to provide some references for structural design and health monitoring of several offshore platforms.

Conventional maritime communication struggles to provide high data rate services for Internet of Things (IoT) devices due to the variability of maritime environments, making it challenging to ensure consistent connectivity for onboard sensors and devices. To resolve this, we perform mathematical modeling of the maritime channel and compare it with real measurement data. Through the modeled channel, we verify the received beam gain at buoys on the ocean surface. Additionally, leveraging the modeled wave motions, we estimate future angles of the buoy to use the Extended Kalman Filter (EKF) for design beamforming strategies that adapt to the evolving maritime environment over time. We further validate the effectiveness of these strategies by assessing the results from an outage probability perspective. focuses on improving maritime communication by developing a dynamic model of the maritime channel and implementing a Kalman filter-based buoy motion tracking system. This system is designed to enable precise beamforming, a technique used to direct communication signals more accurately. By improving beamforming, the aim is to enhance the quality of communication links, even in challenging maritime conditions like rough seas and varying sea states. In our simulations that consider realistic wave motions, you've observed significant improvements in link quality due to the enhanced beamforming technique. These improvements are particularly notable in environments with high sea states, where communication challenges are typically more pronounced. The progress made in this area is not just a technical achievement; it has broad implications for the future of maritime communication technologies. This paper promises to revolutionize the way we approach communication in maritime environments, paving the way for more reliable and efficient information exchange on the seas.
