Recently, the Supreme Court of Korea delivered a milestone judgment about air related multimodal transport. At there, the mattered cargo, some expensive jewellery, was transported from Qingdao, China to downtown office of consignee at Seoul via Incheon airport in Korea. As an air waybill was issued in this case, there was an air transport agreement between consignor and air courier operator. After arriving at Incheon airport, the shipment was transport by land arranged by the air courier operator, who was a defendant in this case. Upon arriving at the final destination, it was found that the jewellery was lost partly and based on circumstantial evidence, the damage presumed to be occurred during the land transport. As a subrogee, the insurance company who paid for consignee filed an action against the air courier operator for damage compensation. Defendant contended that Montreal convention should be applicable in this case mainly for limited liability. The lower court of this case confirmed that applying the limited liability clause under Montreal Convention is improper under the reason that the damage in this case was or presumed to be occurred during surface transport. It was focused on the Montreal Convention article 18 which says that the period of the carriage by air does not extend to any carriage by land, by sea or by inland waterway performed outside an airport. However, the Supreme Court overturned the lower court's decision. The delivered opinion is that the terms of condition on the air waybill including limited liability clause should be prevailed in this case. It seems that the final judgment was considered the fact that the only contract made in this case was about air transport. This article is for analysis the above decisions from the perspective that it is distinguishable between a pure multimodal transport and an expanded air transport. The main idea of this article is that under the expanded air transport, any carriage by land, sea or inland waterway only for the performance of a contract for carriage by air, for the purpose of loading, delivery or transhipment is still within the scop of air transport.
Eight different data sets are examined in order to gain insight into the surface heat flux traits of the East Asian marginal seas. In the case of solar radiation of the East Sea (Japan Sea), Coordinated Ocean-ice Reference Experiments ver. 2 (CORE2) and the Objectively Analyzed Air-Sea Fluxes (OAFlux) are similar to the observed data at meteorological stations. A combination is sought by averaging these as well as the Climate Forecast System Reanalysis (CFSR) and the National Centers for Environmental Prediction (NCEP)-1 data to acquire more accurate surface heat flux for the East Asian marginal seas. According to the Combination Data, the annual averages of net heat flux of the East Sea, Yellow Sea, and East China Sea are -61.84, -22.42, and $-97.54Wm^{-2}$, respectively. The Kuroshio area to the south of Japan and the southern East Sea were found to have the largest upward annual mean net heat flux during winter, at -460- -300 and at $-370--300Wm^{-2}$, respectively. The long-term fluctuation (1984-2004) of the net heat flux shows a trend of increasing transport of heat from the ocean into the atmosphere throughout the study area.

Sulfur dioxide (SO$_2$), ozone, total suspended particulates (TSP) and PM$_{2.5}$ were measured at Deokjeok Island in the Yellow Sea during April 1999 to June 2000. Although the emission amount of air pollutants is quite low in this small island of 36 km$^2$ with 1.4 thousand inhabitants, there are pollutant sources such as an oil -firing power plant and a wharf for ferryboat. The island is also influenced from the emissions from the greater Seoul area in the east and from China in the west. In order to characterize the pollutant variations due to interactions between transport and local emissions. the correlation between variations of SO$_2$ and ozone was investigated. Mass and ion concentrations of TSP and PM$_{2.5}$ were examined on selected episode days of positive and negative correlations between the two gaseous species in spring and winter. The effects of transport were pronounced on the days of positive correlation in spring with higher concentrations of ozone and PM$_{2.5}$. TSP concentrations were also high on these days because of high wind speeds. On the days of negative correlation in spring, frequent fog associated with low wind speeds facilitated SO$_2$ oxidation and increased sulfate accompanied with decrease in nitrate in PM$_{2.5}$ and chloride in TSP. This latter phenomena was noticeable since it showed that chemical composition of fine particles could be significantly altered not only during the transport but also by local environment.ronment.
The Yellow Sand Events observed over the Korean peninsula during 22-24 April, 1993 were examined using the synoptic data and GMS visible image to identify the transport path of the Yellow Sand and the main factor governing the duration of the Yellow Sand phenomenon. The 850 hPa convergence chart and the 700 hPa trajectory analyses of the air mass laden with Yellow Sand particles suggested that the Yellow Sand particles observed over Korea were probably transported from the Gobi Desert and the Loess Plateau. The duration of the Yellow Sand Events was about 35-40 hours rather shorter than normal as the high pressure system centered near the Mongolia region moved rapidly toward the Yellow Sea, which drove away the Yellow Sand particles over the Korean peninsula toward the Japan Islands, furthermore the low-level stratification of the air mass over the Korean penishula showed the unstable atmospheric condition leading to atmospheric diffusion of the particles. The trajectory analyses and the GMS visible image indicated that the long-range transport of the air mass laden with the Yellow Sand particles of this case was more dependent on the 700 hPa air flow than on the 850 hPa air flow.
Five episodes of the large-scale transport of air pollutants in East Asia and its inflow into the Korean Peninsula have been analyzed through satellite and ground observations. These episodes include regionally polluted continental airmass, which is created by the pollutants produced in the cities and the industrial regions in China, to land on or pass through the Korean Peninsula by way of the Yellow Sea. The analysis of the NOAA satellite observation data made it possible to create images by combining 3 channels of visible and infrared ray ranges and also to identify the distribution and the transport of the air pollution mass over the Yellow Sea. The ground observation data of the air pollutants gathered in Chongwon were found highly valuable in verifying the information in comparison with ones from the satellite. Especially, regarding the episodes of large-scale transport of the air pollutants, the difference of concentration between $PM_{10}\;and\;PM_{2.5}$ was found small with the increase of $PM_{2.5}$ value. The concentration of $PM_{10}$ in the episode of yellows and, however, was found much higher than that of $PM_{2.5}$. In the episode of 27 January 2006, the inflow of the regionally polluted continental air mass into the central and southwestern region of the Korean Peninsula was observed sequentially in the various ground observatories as well as by the satellite. The north-northwest airflow dissipated the clouds over from Mt. Halla in Jeju Island up to far downwind, reduced air pollution, and created von $K\acute{a}rm\acute{a}n$ vortex.

Long-range transport of air pollutants was simulated using Comprehensive Acid Deposition Model (CADM) and Yonsei University-Sulfuric Acid Deposition Model (YU-SADM). For the simulation, weather patterns that represent the four seasons were derived through a clustering analysis with 5-years of meteorological data. The simulation result showed that in spring, influenced by strong low pressure from China, air pollutants of moved to the Korean Peninsula. In summer, humid air moved into the Korean Peninsula across the Yellow Sea while the north pacific high pressure extended, making the concentration of air pollutants lower than that in the other seasons. In autumn, air pollutants were transported by the northwest wind caused by the movement of high pressure over the Yellow Sea, while in winter air pollutants were influenced by northwest winds from continental highs. The amount of air pollutants in each season showed that high amount of pollutants were transported in winter due to the strong northwest wind. The in-flows were 3 to 8 times higher than those of the other seasons, and out-flows were about as twice as high. The amount of wet deposition in summer and autumn increased significantly compared to the amount in the other seasons due to the increase of rainfall. Source-receptor relationship analysis for sulfur showed that 70 to 91 precent of the total deposition came from the self-contribution by the Korean Peninsula. In winter, contribution from China was about 25 percent of the total deposition which was higher amount than any other season.

Air pollutants($SO_2$, NOx, $O_3$ and aerosol number) were measured using an aircraft to investigate the characteristical features of long-range transport of sulfur compounds over the Yellow Sea for the periods of 26~27 April and 7~10 November in 1998. The mean $SO_2$ concentrations of April 26th~27th and November 7th~10th flight were 0.6~1.8 ppb and 0.5~8.3 ppb, respectively, and the sulfur transport was largely limited to the atmospheric boundary layer. Especially, $SO_2$ increased up to 8.3 ppb altogether with the increase of particle number concentraton especially on November 8, 1998. In addition, $O_3$ was remarkably decreased against the increase of $SO_2$and particle number concentrations. This enhanced $SO_2$ concentration occurred in the low level westerlies in association with the anticyclonic flow over Southern China and the cyclonic circulation over Manchuria. Aerosol analyses at Taean site also showed that sulfate concentration increased 2~3 times higher than those of another sampling days, which could suggest possible interactions between aerosol particels and tropospheric ozone. A rigorous evaluation will be possible after the more intensive measurements and quantitative analyses with detailed chemistry model including the postulated heterogeneous mechanism.
This research investigated the meteorologically relevant characteristics of high PM2.5 episodes in Busan. The number of days when daily mean PM10 concentration exceeded 100 ㎍/㎥ and the PM2.5 concentration exceeded 50 ㎍/㎥ over the last four years in Busan were 24 and 58, respectively. Haze occurrence frequency was 37.6% in winter, 27.4% in spring, 18.6% in fall, and 16.4% in summer. Asian dust occurrence frequency was 81.8% in spring, 9.1% in fall and winter, and 0% in summer. During summer in Busan, high PM2.5 episode occurred under the following meteorological conditions. 1) Daytime sea breeze. 2) Mist and haze present throuout the day. 3) Anti-cyclone located around the Korean peninsula. 4) Stable layer formed in the lower atmosphere. 5) Air parcel reached Busan by local transport rather than by long-range transport. These results indicate that understanding the meteorological relevance of high PM2.5 episodes could provide insight for establishing a strategy to control urban air quality.
As the Reublic of Korea revised the Commercial Code including 40 articles of air transport enacted newly on May 23, 2011, so Korea became first legislative examples in the Commercial Code of the developed and developing countries. I would like to explain briefly the main contents of my paper such as (1) history of enacting newly Part VI (air transport) in the Korea's revised commercial law, (2) legal background enacting newly Part VI (air transport) in the Korea's revised commercial law and the problems on the conditions of air transport, (3) every countries' legislative examples on the civil liability of aircraft's operator, (4) unlawful Interference Convention and general risk convention of 2009, (5) main contents and prospects of the revised Commercial Code for the liability of aircraft's operator etc as the followings. Meanwhile as the Aviation Act, Commercial Code and Civil Code in Korea and Japan did not regulated at all the legal basis of solution on the disputes between victims and offender for the amount of compensation for damage due to personal or property damage caused by aircraft accidents in Korea and Japan, so it has been raised many legal problems such as protection of victims, standard of decision in trial in the event of aircraft accident's lawsuit case. But the Korean Revised Commercial Code including Part VI, air transport regulations was passed by the majority resolution of the Korean National Assembly on April 29, 2011 and then the South Korean government proclaimed it on May 23 same year. The Revised Commercial Code enforced into tothe territory of the South Korea from November 24, 2011 after six month of the proclaimed date by the Korean Government. Thus, though Korean Commercial Code regulated concretely and respectively the legal relations on the liability of compensation for damage in the contract of transport by land in it's Part II (commercial activities) and in the contract of transport by sea in its Part V (marine commerce), but the Amended Commercial Act regulated newly 40 articles in it's Part VI (air transport) relating to the air carrier's contract liability on the compensation for damage caused by aircraft accidents in the air passengers and goods transport and aircraft operator's tort liability on compensation for damage caused by the sudden falling or collision of aircraft to third parties on the surface and so it was equipped with reasonable and unified system among the transport by land, marine and air. The ICAO adopted two new air law conventions setting out international compensation and liability rules for damage caused by aircraft to third parties at a diplomatic conference hosted by it from April 20 to May 2, 2009. The fight against the effects of terrorism and the improvement of the status of victims in the event of damage to third parties that may result either from acts of unlawful interference involving aircraft or caused by ordinary operation of aircraft, forms the cornerstone of the two conventions. One legal instrument adopted by the Conference is "the Convention on Compensation for Damage to Third Parties, Resulting from Acts of Unlawful Interference Involving Aircraft" (Unlawful Interference Convention). The other instrument, "the Convention on Compensation for Damage Caused by Aircraft to Third Parties" (General Risk Convention), modernizes the current legal framework provided for under the 1952 Rome Convention and related Protocol of 1978. It is desirable for us to ratify quickly the abovementioned two conventions such as Unlawful Interference Convention and General Risk Convention in order to settle reasonably and justly as well as the protection of the South Korean peoples.
In 1994, the North Korea indicated their intention to open up airspace. The air route passing through from Daegue FIR to Pyungyang FIR has established in 1996. The air transport cooperation between South and North Korea seemed to be reinforced at the event of President Kim, Dae-Jung's visit to North Korea by passing through a temporarily established Yellow Sea Airway in the year of 2000. The nature characteristics of air transport burdening of many circumstantial situations, however, have kept cooperation between South and North Korea from being facilitated till now. Recently as the more exchange between North and South Korea, the more frequent opportunities to discuss economic cooperation, which in sequence increased political credibility has been increased. The rail, road, and port reconnecting has realized which have been regarded impossible. Furthermore, it is expected to transport personnel and goods through South-North direct connected routes in the near future This study shows several meanings of air transport cooperation between South and North Korea. It will be far beyond simply partial air route connecting in this region, it gives great significance to realize economic cooperation and Northeast hub through air transport industry sector. This will be an exit for air transport industry have suffered limits derived from North Korea troubles and difficulties in growing as Northeast air hub. Namely, South-North air connection denote its meaning in providing opportunities Korea to be Northeast Hub and advanced country having globally competitive air transport industry To develop strategy for air transport cooperation between South and North Korea. they were developed by SWOT analysis on the basis of circumstantial analysis. These strategy need to be commanded properly to the changes of surrounded circumstances. The study result show it is desirable to apply phasal strategies by using strengths, weaknesses, threats and opportunities factors underlying analysis of inner and outer circumstances to cooperate in air transport sector.
