  • Generally there is no law and liability system which applies particulary to commercial space ventures. There are several international treaties and national statutes which deal with space ventures, but their impact on the liability of commercial space ventures has not been significant. Every state law in the United States will impose both tort and contract liability on those responsible for injuries or losses caused by defective products or by services performed negligently. As with the providers of other products and services, those who participate in commercial space ventures have exposure to liability in both tort and contract which is limited to the extent of the resulting damage The manufacturer of a small and cheap component which caused a satellite to fail to reach orbit or to operate nominally has the same exposure to liability as the provider of launch vehicle or the manufacturer of satellite into which the component was incorporaded. Considering the enormity of losses which may result from launch failure or satellite failure, those participated in commercial space ventures will do their best to limit their exposure to liability by contract to the extent permitted by law. In most states of the United States, contracts which limit or disclaim the liability are enforceable with respect to claims for losses or damage to property if they are drafted in compliance with the requirements of the applicable law. In California an attempt to disclaim the liability for one's own negligence will be enforceable only if the contract states explicitly that the parties intend to have the disclaimer apply to negligence claims. Most state laws of the United States will refuse to enforce contracts which attempt to disclaim the liability for gross negligence on public policy grounds. However, the public policy which favoured disclaiming the liability as to gross negligence for providers of launch services was pronounced by the United States Congress in the 1988 Amendments to the 1984 Commercial Space Launch Act. To extend the disclaimer of liability to remote purchasers, the contract of resale should state expressly that the disclaimer applies for the benefit of all contractors and subcontractors who participated in producing the product. This situation may occur when the purchaser of a satellite which has failed to reach orbit has not contracted directly with the provider of launch services. Contracts for launch services usually contain cross-waiver of liability clauses by which each participant in the launch agrees to be responsible for it's own loss and to waive any claims which it may have against other participants. The crosswaiver of liability clause may apply to the participants in the launch who are parties to the launch services agreement, but not apply to their subcontractors. The role of insurance in responding to many risks has been critical in assisting commercial space ventures grow. Today traditional property and liability insurance, such as pre-launch, launch and in-orbit insurance and third party liability insurance, have become mandatory parts of most space projects. The manufacture and pre-launch insurance covers direct physical loss or damage to the satellite, its apogee kick moter and including its related launch equipment from commencement of loading operations at the manufacture's plant until lift off. The launch and early orbit insurance covers the satellite for physical loss or damage from attachment of risk through to commissioning and for some period of initial operation between 180 days and 12 months after launch. The in-orbit insurance covers physical loss of or damage to the satellite occuring during or caused by an event during the policy period. The third party liability insurance covers the satellite owner' s liability exposure at the launch site and liability arising out of the launch and operation in orbit. In conclusion, the liability in commercial space ventures extends to any organization which participates in providing products and services used in the venture. Accordingly, it is essential for any organization participating in commercial space ventures to contractually disclaim its liability to the extent permitted by law. To achieve the effective disclaimers, it is necessary to determine the applicable law and to understand the requirements of the law which will govern the terms of the contract. A great deal of funds have been used in R&D for commercial space ventures to increase reliability, safety and success. However, the historical reliability of launches and success for commercial space ventures have proved to be slightly lower than we would have wished for. Space insurance has played an important role in reducing the high risks present in commercial space ventures.

메콩강 홍수위험분석을 위한 나이트라이트 위성영상 적용성 검토 (Application of nightlight satellite imagery for assessing flooding potential area in the Mekong river basin)

  • 아시아 지역의 인구증가와 하천주변 및 삼각주 평야 저지대의 인구밀도 집중으로 인해 우기 시 아시아의 많은 지역에서 홍수로 인한 대규모 인명 및 재산 피해가 발생하고 있다. 본 연구에서는 NOAA에서 제공하는 1992년부터 2003년까지의 나이트라이트 위성영상자료를 수집하여 인명 및 재산피해 정보와의 상호 공간분석을 통해 메콩강 유역의 홍수피해에 대한 분석을 실시하였다. 인명 및 재산피해 자료는 EM-DAT에서 제공하는 지역 공간분포자료를 활용하였으며, 메콩강 주하천 격자로 부터 모든 임의 격자의 떨어진 거리를 계산하여 해당 격자에서의 나이트라이트 강도와 인명 및 재산피해와의 상관분석을 수행하였다. 그 결과, 나이트라이트 강도가 클수록 홍수피해가 큰 것으로 분석되었으며, 특히, 하천으로부터 가까운 거리에서 나이트라이트 강도가 높게 나타났다. 이는 높은 나이트라이트 강도를 갖는 격자, 즉 인구밀집도가 상대적으로 높은 격자가 메콩강 하천주변으로 분포되어 있으며, 홍수피해와 양의 상관관계를 갖고 있음을 의미한다. 이와 같이 나이트라이트 위성영상정보는 에너지소비, 재해 등 다양한 공간분석을 통해 사회경제적 영향성 평가를 위한 대리변수로 사용이 가능할 것으로 판단된다.

편타성 손상으로 인해 발생된 경부통의 한의학적 치료에 대한 국내 연구 동향 (The Domestic Trends of Korean Medical Treatments for Neck Pain Caused by Whiplash Injury)

  • Objectives We attempted to investigate the trends of Korean Medical treatments for neck pain caused by whiplash injury by analyzing domestic clinical studies. Methods We searched for studies listed on Korean electronic databases (KTKP, OASIS, RISS, KMbase, NDSL, KCI, and National Assembly Library). Clinical studies were chosen according to the inclusion criteria. Subsequently, we compared and analyzed the data. Results The search yielded 35 studies, of which there were 12 randomized controlled trials (RCTs), 15 non-randomized controlled trials (NRCTs), 6 case reports, and 2 before-after studies. Among these, 54.7% of participants were in the acute stage of the damage period. Pharmacopuncture was used the most in main treatment methods. Only 14.3% of studies mentioned approval by an institutional review board (IRB) and only 8.6% of studies considered side effects. Conclusions There is some evidence that Korean Medical treatment is effective for neck pain caused by whiplash injury. Since all studies, however, were exposed to the risk of bias. Therefore, future studies of a higher quality are required.

Advanced peri-implantitis cases with radical surgical treatment

  • Purpose: Peri-implantitis, a clinical term describing the inflammatory process that affects the soft and hard tissues around an osseointegrated implant, may lead to peri-implant pocket formation and loss of supporting bone. However, this imprecise definition has resulted in a wide variation of the reported prevalence; ${\geq}10%$ of implants and 20% of patients over a 5- to 10-year period after implantation has been reported. The individual reporting of bone loss, bleeding on probing, pocket probing depth and inconsistent recording of results has led to this variation in the prevalence. Thus, a specific definition of peri-implantitis is needed. This paper describes the vast variation existing in the definition of peri-implantitis and suggests a logical way to record the degree and prevalence of the condition. The evaluation of bone loss must be made within the concept of natural physiological bony remodelling according to the initial peri-implant hard and soft tissue damage and actual definitive load of the implant. Therefore, the reason for bone loss must be determined as either a result of the individual osseous remodelling process or a response to infection. Methods: The most current Papers and Consensus of Opinion describing peri-implantitis are presented to illustrate the dilemma that periodontologists and implant surgeons are faced with when diagnosing the degree of the disease process and the necessary treatment regime that will be required. Results: The treatment of peri-implantitis should be determined by its severity. A case of advanced peri-implantitis is at risk of extreme implant exposure that results in a loss of soft tissue morphology and keratinized gingival tissue. Conclusions: Loss of bone at the implant surface may lead to loss of bone at any adjacent natural teeth or implants. Thus, if early detection of peri-implantitis has not occurred and the disease process progresses to advanced peri-implantitis, the compromised hard and soft tissues will require extensive, skill-sensitive regenerative procedures, including implantotomy, established periodontal regenerative techniques and alternative osteotomy sites.

Xeroderma pigmentosum group A with mutational hot spot (c.390-1G>C in XPA ) in South Korea

  • Purpose: Xeroderma pigmentosum (XP) is rare autosomal recessive genetic disorder of DNA repair in which the ability to repair damage caused by ultraviolet light is deficient. We reported the first molecularly confirmed Korean patient of XP by targeted exome sequencing. The prevalence of XP included all subtype and carrier frequency of XP-A the using public data were estimated for the first time in South Korea. Materials and Methods: We described a 4-year-old Korean girl with clinical diagnosis of XP. We performed targeted exome sequencing in the patient for genetic confirmation considering disease genetic heterogeneity and for differential diagnosis. We verified a carrier frequency of c.390-1G>C in XPA gene known as mutational hot spot using Korean Reference Genome Data Base. We estimated the period prevalence of all subtypes of XP based on claims data of the Health Insurance Review and Assessment Service in South Korea. Results: We identified homozygous splicing mutation of XPA (c.390-1G>C) in the patient. The carrier frequency of risk for XPA (c.390-1G>C) was relatively high 1.608 e-03 (allele count 2/1244). The prevalence of XP in South Korea was 0.3 per million people. Conclusion: We expect that c.390-1G>C is hot spot for the mutation of XPA and possible founder variant in South Korea. However, the prevalence in South Korea was extremely low compared with Western countries and Japan.

The effect of low-dose intravenous bisphosphonate treatment on osteoporosis in children with quadriplegic cerebral palsy

  • Purpose: Quadriplegic children with cerebral palsy are more susceptible to osteoporosis because of various risk factors that interfere with bone metabolism. Pamidronate is effective for pediatric osteoporosis, but there are no guidelines for optimal dosage or duration of treatment in quadriplegic children with osteoporosis. We aimed to evaluate the efficacy of low-dose pamidronate treatment in these patients. Methods: Ten quadriplegic patients on antiepileptic drugs (6 male, 4 female patients; mean age, $10.9{\pm}5.76years$), with osteoporosis and gross motor function classification system level V, were treated with pamidronate (0.5-1.0 mg/kg/day, 2 consecutive days) every 3-4 months in a single institution. The patients received oral supplements of calcium and vitamin D before and during treatment. The lumbar spine bone mineral density (BMD) z score and biochemical markers of bone metabolism were measured regularly during treatment. Results: The main underlying disorder was perinatal hypoxic brain damage (40%, 4 of 10). The mean cumulative dose of pamidronate was $4.49{\pm}2.22mg/kg/yr$, and the mean treatment period was $10.8{\pm}3.32months$. The BMD z score of the lumbar spine showed a significant increase from $-4.22{\pm}1.24$ before treatment to $-2.61{\pm}1.69$ during treatment (P=0.008). Alkaline phosphatase decreased during treatment (P=0.037). Significant adverse drug reactions and new fractures were not reported. Conclusion: Low-dose pamidronate treatment for quadriplegic children with cerebral palsy increased lumbar BMD and reduced the incidence of fracture.

쓰나미에 의한 계류 선박의 동적 동요 해석에 관한 연구 (A Study on Dynamic Analysis of Moored Ship Motions by Tsunami)

  • 최근 거대 지진에 의한 쓰나미 발생 확률이 대단히 높다고 경고하고 있다 특히, 항만내의 선박 운용이라는 관점에서, 쓰나미에 의한 막대한 재산 및 인명 피해가 염려되기 때문에 쓰나미에 의한 계류 선박의 영향을 고려하는 것은 대단히 중요한 일이다. 쓰나미가 발생하면 항만 부근에서 입출항중의 선박은 표류를 시작하게 되며, 계류중인 선박도 계류색이 절단되어 표류에 이를 가능성이 높다. 또한, 좌초 및 안벽 충돌 등에 의한 엄청난 사고가 발생할 가능성이 존재한파. 한편, 쓰나미는 수분 정도의 성분파를 포함하고 있기 때문에 계류 선박의 장주기 운동과 공진할 가능성이 높으며, 쓰나미의 유속은 항내에서 발생하는 조류에 비해 대단히 크기 때문에 른 항력이 선박에 작용할 가능성이 있다. 본 연구에서는 대규모 쓰나미의 내습으로 인한 선박 운동의 관점에서 수치 시뮬레이션 과정을 검토하고, 선박 운동에의 영향 및 계류 하중을 수치실험으로 평가한다.

고산 윤선도 수정동 정원유적 정비에 관한 연구 (A Study of Planning for Sujeong-dong Garden Heritage Maintenance)

  • 수정동 원림은 조선중기 고산 윤선도에 의해 조영된 곳으로 국문학적으로나 정원사에 있어 중요한 정원유산 이지만 최근 주변 개발로 인한 외부요인에 의한 훼손우려와 오랫동안 방치된 결과 정원 내부의 훼손이 진행되고 있어 대상에 대한 신중한 조사와 분석을 통한 정비계획이 요구된다. 본 연구의 목적은 한국 전통정원 유산인 수정동 원림을 대상으로 진정성 있고 신중한 정비방향을 수립하는 것이다. 연구의 방법으로 지역주민과 전문가들의 인터뷰와 자문, 문헌고찰, 현장조사와 정밀측량, 전문가집단의 참여를 통한 현장 고증 등을 실시하였다. 연구 결과는 다음과 같다. 첫째, 유구에 대한 핵심 권장 검토 발굴 구역을 제시하였다. 둘째, 인위적으로 조영된 환경을 대상으로 고산 당대 조성 혹은 명명된 유구와 조성시기 확인이 요구되는 유구로 구분하여 정비내용을 제시하였다. 셋째, 자연지형 요소에 대해서는 식생정비계획과 활용측면에서 간단한 시설 도입을 제시하였다. 마지막으로 고산이 정원을 즐기고 이용했을 것으로 추정되는 공간들을 중심으로 구체적인 동선과 관련 정비내용을 제시하였다.

GIS와 연계한 확산파 침수해석 모형의 적용에 대한 연구 (Study on Application of Diffusion Wave Inundation Analysis Model Linked with GIS)

  • 본 연구에서는 GIS와 연계한 2차원 확산파 침수해석 모형을 개발하여 2002년 8월 집중호우로 인하여 침수피해가 발생했던 낙동강의 지류인 화포천유역에 대하여 하천제방의 월류 및 붕괴에 따른 침수해석을 실시하였다. 당시의 침수흔적도 및 FLUMEN 모형의 침수해석 결과와 시간별 침수심 및 최대 침수면적의 비교를 통해 모형의 적용성을 평가해 보았다. 침수흔적도와의 비교를 통해 침수면적에 대한 적합도를 분석한 결과 88.61%의 적합도를 갖는 것으로 확인되었으며, FLUMEN 모형과의 비교를 통하여 최대 침수면적 및 침수지역의 공간적 분포가 상당부분 일치하는 것으로 확인되었다. 따라서 2차원 확산파 침수해석 모형의 적용으로 계산된 시간별 침수구역 및 최대 침수면적 등은 홍수에 대비한 위험지역의 파악 및 재난저감 대책을 수립하기 위한 판단자료로 활용될 수 있을 것으로 기대된다.

부산지역 미세먼지에 대한 건강 취약성 평가 (Health Vulnerability Assessment for PM10 in Busan)

  • Objectives: This study seeks to evaluate the vulnerability assessment of the human health sector for $PM_{10}$, which is reflected in the regional characteristics and related disease mortality rates for $PM_{10}$ in Busan over the period of 2006-2010. Methods: According to the vulnerability concept suggested by the Intergovernmental Panel on Climate Change (IPCC), vulnerability to $PM_{10}$ is comprised of the categories of exposure, sensitivity, and adaptive capacity. The indexes of the exposure and sensitivity categories indicate positive effects, while the adaptive capacity index indicates a negative effect on vulnerability to $PM_{10}$. Variables of each category were standardized by the rescaling method, and each regional relative vulnerability was computed through the vulnerability index calculation formula. Results: The regions with a high exposure index are Jung-Gu (transportation region) and Saha-Gu (industrial region). Major factors determining the exposure index are the $PM_{10}$ concentration, days of $PM_{10}{\geq}50$, ${\mu}g/m^3$, and $PM_{10}$ emissions. The regions that show a high sensitivity index are urban and rural regions; these commonly have a high mortality rate for related disease and vulnerable populations. The regions that have a high adaptive capacity index are Jung-Gu, Gangseo-Gu, and Busanjin-Gu, all of which have a high level of economic/welfare/health care factors. The high-vulnerability synthesis of the exposure, sensitivity, and adaptive capacity indexes show that Dong-Gu and Seo-Gu have a risk for $PM_{10}$ potential effects and a low adaptive capacity. Conclusions: This study presents the vulnerability index to $PM_{10}$ through a relative comparison using quantitative evaluation to draw regional priorities. Therefore, it provides basic data to reflect environmental health influences in favor of an adaptive policy limiting damage to human health caused by vulnerability to $PM_{10}$.
