  • Due to the rapid popularization of mobile multimedia devices and the Internet as well as the realization of high-speed data transmission and large-volume data recording media, high quality content distribution and ubiquitous information services are making progress and a new type of information distribution and network sharing service has gradually emerged into the market. It is capable of utilizing terabyte sized home servers also in private homes. Under these circumstances, in distribution of content over shared networks, it is crucial to establish DRM (Digital Rights Management) technologies to protect the content from illegal copying and usage. A truly successful DRM system must be built on open worldwide specifications and provide maximum interoperability and user acceptance. An open interoperability of DRM is able to construct highly expandable PKI based DRM, targeting usage between systems, considering the expansion of recent content distribution services and clients This document gives protocol specifications for the exchange of rights information between the DRM module, description of specifications for rights information and encrypted content formats.

  • There is no substantive enactment in our country to regulate testifier's false statement in the process of investigation under current law. In consideration of such investigation reality, there exist predominant view that the regulations against testifier's untrue statement are necessary to fine actual truth on criminal justice. However, such view is not quite agreeable, for it holds a probability that excessive investigation rights might cause infringement on personal rights. It's because of human rights protection that the criminal justice puts before the finding of actual truth as its biggest principle, and as we see above, any testifiers' untrue statement are already punishable, although restrictive, through interpretation of deceptive scheme under current law such as obstruction of justice, crimes of sheltering or flying a criminal or calumny.

  • Purpose - The purpose of this study is to expand the taxpayer's rights protections, which are covered in the previous studies, and to suggest ways to increase tax inspection efficiency as a way to induce fidelity reporting under the final tax return system and to lower tax compliance costs. Design/methodology/approach - The tax audit is a necessary system for the taxpayer to induce self-reporting in a sincere manner, but it is necessary to harmonize the realization of fair taxation and the rights of taxpayers because it is likely to infringe taxpayer rights in the process. Research implications or Originality - The purpose of this study is as follows. First, the government will seek ways to improve tax investigations to strengthen the protection of taxpayers' rights by increasing the fairness and procedural transparency of the current tax investigation system, as pointed out in the National Tax Administration Reform T / F. Second, we will consider ways to enhance the effectiveness of tax audit as a means of inducing faithful tax in Korea's tax system, which assumes sincere taxpayers.

  • Metabus, currently represented by Second Life on the Internet, is the next-generation 3DCG Internet world in which the 2D Internet world has evolved, and has grown as a new ICT culture of mankind that can replace real society with virtual society. As such, the reason why the world of metabus has rapidly expanded is that the era of 3D Internet has arrived due to the evolution of the Internet, which only used information, and the spread of 5G communication in user-participating WEB. However, there are many situations in which laws do not exist in this virtual world and various illegal acts occur. As the Internet culture developed earlier, illegal activities by users began to appear, and as the legal responsibility of Internet providers was discussed, mankind quickly passed the Millennium Copyright Act or introduced new copyright protection measures such as technical protection, transmission rights, and rights management information. Therefore, this paper reviews and studies how to accept and further grow this new metabus culture, including the viewpoint of intellectual property.

  • The apartment housing in Korea has been rapidly constructed by adapting the most suitable construction methods as like wall structure, wet and united construction. But most of short-lived equipments usually filled in the structure which has longer life, and it causes not only to make difficult coping with the deterioration of equipments but also to let buildings remained deteriorate themselves. The buildings can be remodelled to slow down the terms of deterioration or reconstructed to give a new life of themselves, although the disposal of wastes or the lack of natural resources still be problems and unsolved that can occurred in pulling down and reconstructing the buildings. Furthermore, it is the time to need keeping with worldwide trends and movements as like sustainability or 'green growth' movements based on low carbon emissions. The researches for Long-Life Housing apartments which has durability and variation have been advanced up to now. Long-Life Housing apartments can separate their structures from equipments and interior or exterior materials of buildings. Therefore equipments or materials of buildings can be easily repaired and replaced with new ones, even if they are deteriorated themselves. Also, the construction process of Long-Life Housing apartments can be independent from the matter of proprietary rights, terms of durability, decision rights and so on. 'The law of Possession and Management of Collective Building' and the 'Regulation of Management of Collective Building' established by each local governments are already legislated for declaring the rights of using and ownership, responsibilities of each parts of apartment buildings. These laws and regulations classify the ownership of each parts of apartment buildings, and divide the ownership with public possession and exclusive possession. Therefore, this study will conduct comparative analysis between 'The law of Possession and Management of Collective Building' and 'the Regulation of Management of Collective Building' and find problems which can be occurred in future construction of Long-Life Housing apartments. It will be helpful to revise laws and regulations.

A Study on Human Rights Behavior of Korean Care Workerin Long Term Care Facilities: The Interaction Effect of Human Rights Awareness and Service Orientations (장기요양기관 요양보호사의 노인인권옹호행동 영향요인: 개인의 인권의식과 조직의 서비스 지향성을 중심으로)

  • As the provision of long-term care policy takes root and with a gradual increase in elderly population, the use of elderly care service has become a growing norm. More than ever, there exists an urgent need for a paradigm shift in the building of an institutional basis for the improvement of care service, from the prevalent practice of 'need based service' toward the concept of 'human rights based service'. A great focus is being shed on care-workers, at the 'front line' of advocating human rights, as their human rights advocacy behaviour is seen as a key variable in providing high quality care service for elders. This study aims to examine how care-workers' individual human rights awareness levels, and the influence of their respective organizations, as an environmental factor, affect their human rights advocacy behaviour. The study includes a comprehensive analysis of the interactions between the regulatory effect of environmental factors (service orientation?) on an organizational level, human rights awareness (individual level) and the service environment (organizational). The analysis sample consisted of 782 registered non-profit corporation of long-term care facilities all over the country in 2014. The findings of the thesis suggest that human rights awareness at individual levels has a significant influence on human rights advocacy behavior. The interaction of human resources management in service orientations was also found to influence human rights advocacy on a significant level. Both human rights awareness at individual level and service orientations at organizational level were thus determined as key variables for improving the human rights awareness of care worker in long-term care facilities in Korea.

Usufruct Rights Conflicts during the Exploitation and Management of Forest Parks in China

  • Forest parks are regarded as one of the scientific ways to keep the forest sustainably developed, meanwhile deliver the benefits to the general public. The development of forest parks in China has experienced simply more than 20 years and both the exploitation and management institutions haven't been set up systematically, which, in reality, reflects as inadequate legislative and policy framework. Without the regulatory guidance and collaborating assistance of environment relating governmental sectors at both national and local levels, it's inevitable that the development of forest parks in the country would face constant problems and conflicts. Therefore, it might be helpful to sort out this conflicts and problems and further more to work out how to solve the barriers. The research in this report started with introducing the IUCN Protected Areas Categories, the overall current situations in China and compared the definition of forest parks in the country and that in international experience. It is to aim to find out the real usufruct rights conflicts during the exploitation and management of forest parks and the method used in this report is field visit, previous investigation, collecting secondary materials, interview, analysis and comparison. The research result in this report couldn't cover all the conflict situations during the forest parks' exploitation and management in China but will provide the analysis of this problem from the legal perspective. Practical application and concerning suggestion will be fully discussed in Part 5 in terms of legislative, social and environmental effects.

  • The oral record related to the sexual slavery by Japan's military is considered important evidence as it can grasp the damage situation and actual condition at that time. Therefore, systematic and integrated management of the organization's oral records is necessary. For this purpose, this study proposed metadata elements for the management of oral records. The metadata proposed in this study consists of 16 upper elements and subelements, respectively. The suggested upper elements consist of 6 "essential elements" and 10 "optional elements." The essential elements are "title," "date," "format," "creator," "content," and "rights."

  • Purpose: The purpose of this study is to analyze the method of calculating the usage fee, rent, and lease rights of public goods necessary for the operation and management of the underground shopping mall, and to suggest systematic improvement points for the operation of the underground shopping mall. Data and Methodology: First, ordinances and regulations related to common property were investigated. Second, previous studies were analyzed. A survey was conducted with five questions that conflict with the interests of underground shopping mall merchants among the ordinances and operating systems related to the current underground shopping malls' common property. Results: Underpass merchants wanted monthly payment for the use of common property, and merchant organizations wanted to limit the increase rate with the right to use. They asked for the property value due to donation to be excluded from the loan fee, they wanted to revise the Common Property Act on the transfer of lease rights, and they wanted to revise the loan contract renewal period. Conclusion: There is a need to improve the laws and systems for underground shopping malls, and it will have to be negotiated according to the opinions of the merchants gathered among them, and it will have to be implemented in stages in the long term.

  • As wireless Internet speads widely, circulation of various types of digital contents become active. Therefore, it is necesary to make a mobile-based DRM (Digatal Rights Management) system to protect digital contents from illegal reproduction and to give proper rights to contents users, In this paper, we present a mibile security system, which protects the copyright for digital contents offered throughout the mobile environment. Our security system is focused on presenting mobile-based DRM architecture. Especially, considering mobile device's decrying power, we adopted partial encryption scheme. For this, wecompared and evaluated the performant of each contents encryption scheme (the entire encryption scheme and the partial encription scheme) and proved that a proper DRM system for current wireless devices is the partial encryption system. Our mobile DRM system can be very efficient to protect contents on the wireless Internet environment.
