기업책임경영(RBC)의 국제입법동향과 정책적 시사점 (International Legislative Trends on Responsible Business Conduct (RBC) and its Implications on Policy)

  • As Multi-National Enterprises expanded their investments to foreign countries, numerous controversies and disputes arose from their negative impacts, such as violations of human rights and damage to the environment of the host countries. In response, International Organizations such as the OECD have considered various ways to prevent these negative impacts and search for more efficient dispute resolution methods. It is recognized that the OECD Guideline is one of the tools they created for this purpose. The OECD Guideline is contrastable from Corporate Social Responsibility (CSR) initiatives which are regarded as a corporation's charity activities apart from their core business functions. However, Responsible Business Conduct (RBC) like the OECD Guideline can be understood as a concept moving forward from CSR, due to its requirements that corporations carry out their duties in a responsible manner within the field of their core business, such as tax, global supply chain or consumer protection. RBC which is binding in nature, has even been implemented through legislation in developed countries such as the USA, France, Switzerland, and the UK. The discussion in Korea, however, has not reached that level. Discussions for legislation center singularly on CSR efforts, with a dialogue only recently forming around the topic of legislation concerning RBC. Small and medium sized enterprises (SMEs) who lack certain financial and other resources to adequately develop RBC initiatives may find this more obstacles to implementation through legislated RBC, than if it were presented in Korea through other means. It's necessary to admit that RBC is a critical issue in international business. However, time is required to consider its application directly to SMEs.

  • OECD는 투자위원회를 중심으로 각국 NCP들이 OECD 가이드라인을 효과적으로 이행하기 위한 일환으로 NCP 간 동료평가(Peer Review)를 강조하는 추세이다. 각 NCP로서는 동료평가가 자발적인 성격이라고는 하지만 부정적인 평가를 받게 되는 경우 국제적으로 많은 비난을 받을 소지가 크고 국가 이미지에도 심각한 타격을 입을 가능성이 높다. 더군다나 지난 2017년 3월, 기업책임경영에 관한 작업반(Working Party on Responsible Business Conduct) 회의에서 한국 NCP에 대하여 2019년 동료평가를 시행하기로 결정하였다. 이에 본 논문에서는 NCP 동료학습의 의의와 현황, 최근 시행되었던 덴마크와 벨기에 동료평가 사례들을 검토함으로써 우리 정부가 2019년 동료평가에 어떻게 대비해야 하는지 정책적 제언을 하고 있다.

소비자의 기업평가에 있어서 기업과 소비자의 사회적 책임활동의 상호작용효과 (The Interaction Effect of Social Responsibility Activities of Consumers and Corporations on Corporate Evaluation)

  • Business firms and consumers exist within a society, and their activities influence a society, because they are not separated from a society. Thus, consumers as well as business firms have been asked to conduct socially responsible actions (i.e., environmentally friendly production and socially friendly activities). Previous researchers have investigated on the relationship between corporate social responsibilities and business performances. For example, researchers have analyzed the effects of corporate social responsibility on consumer's corporate evaluations. The corporate social responsibility is commonly classified into the three dimensions (economic, social, and environmental responsibility). In this paper, we demonstrated that the consumer social responsibility can also be classified into the three dimensions. Previous researchers have shown that the three dimensions of corporate social responsibility influence consumer's corporate evaluation. However, they have not considered the interaction effect of the corporate social responsibility and the consumer social responsibility on consumers' corporate evaluation. Different from the past studies, this study investigated on the interaction effect of consumer social responsibility (economic, social, environmental responsibility) and corporate social responsibility (economic, social, environmental responsibility) on consumer's corporate evaluation. For the study, we collected survey data of 200 consumers and analyzed the interaction effect with ANOVAs. The result showed that the three dimensions of social responsibility to both corporate and consumers influence positively the corporate evaluation. They also showed that the interaction effect of consumer responsibility and corporate responsibility on the corporate evaluation was statistically significant. This implies that it is necessary for corporate to conduct corporate social responsibility differently depending on consumer's activity for consumer social responsibility.

Strategic Alliance within the Sugar Industry of Pakistan: A Resource Dependence Perspective

  • Purpose: This paper uses the resource-dependency theory to present the case of the Pakistan sugar industry to highlight how the industry uses a strategic alliance to gain a powerful bargaining position over its critical dependencies. The case of the Pakistan sugar industry is well-known and it is common knowledge that the alliance or the cartel within it is responsible for frequent price hikes and sugar supply shortages in the country. Research design, data and methodology: We use a case study, qualitative document analysis design to trace how the alliance overcomes its various dependencies, and in doing so, how does it harm various stakeholder interests. Results: This paper finds that the sugar industry alliance maintains its bargaining power by manipulating sugar supply through horizontal alliances, political affiliations, underselling and under-reporting sugar stocks, purchasing sugarcane from the black market, and by gaining billions of rupees in export subsidies by hoarding stock and using its political connections. Conclusion: The paper concludes by providing a summary of the measures which the government has taken to curb this anticompetitive conduct; the most important of which is the removal of protectionist measures for sugar trade and allowing market forces to control the demand and supply of sugar in the local market.

러시아 투자 환경 변화에 따른 한국기업의 분쟁 대응 전략에 관한 연구 (A Study on the Dispute Resolution Strategy of Korea Companies on Russia's Investment Environment Changes)

  • Russia has a huge amount of energy resources. It is an attractive factor to countries which spend loads of energy. Republic of Korea is also one of large energy consumption countries. Therefore, It will be needed to raise energy cooperation with Russia. It's companies will increase trade focusing on the energy industry in the long term. Recently, However, Foreign companies should be careful when they enter the rapidly changing Russia market. In other words, companies will need a strategic approach to prepare the early case assessment and how to solve a possible dispute as they analyze cost and profit in business. This study is analyzing several dispute cases related in Russia. It presents some strategies for Korean companies such as dispute resolution method, arbitration institution selection method and so on. In addition, it proposes the introduction of the early case assessment for reducing a waste of time and cost. Furthermore, according as the importance of OECD Guidelines for Multinational Enterprises is highlighted in international community, companies should prepare practical division to establish a system of responsible business conduct. Finally, they will have to get an advice and counseling from the Russia legal experts in the early stages of the contract.

Knowledge and Experiences of Risks among Pupils in Vocational Education

  • Background: Young male and female workers are over-represented in statistics concerning negative outcomes of poor work environment and risky work. Young workers often have low awareness of risk, a lack of safety training, and inadequate introduction to the work. The aim of this study was to identify the knowledge and experiences of pupils of vocational schools concerning potential work environment risks in their future work. Methods: The study design was a dual one, and included a questionnaire and focus group interviews. The study group consisted of 239 pupils from 10 upper secondary schools, who were graduating pupils in four vocational programs: the Industrial Technology Programme, the Restaurant Management and Food Programme, the Transport Programme, and the Handicraft Programme (in which students specialize in wood products). The upper secondary schools were located in the central region of Sweden. Results: The pupils had limited knowledge that employers must, by law, conduct risk analyses and prevent risks. Many felt that they themselves are mainly responsible for performing their tasks safely. Pupils in all programs mentioned acute risk as the greatest risk at work. The theoretical education about safety at work was provided in the $1^{st}$ year of the 3-year vocational programs. Conclusion: A systematic approach to pupils' training in work environment, which is a basis for a safe and healthy workplace, is lacking. The study findings indicate that pupils are offered knowledge far from that intended by laws and by state-of-the-art occupational health risk research.

OECD 다국적기업 가이드라인 한국 국내연락사무소 (NCP)의 분쟁해결 기능과 지배구조 개선방안 (A Proposal for Enhancing Dispute Resolution Functions and the Governance of Korea National Contact Point (NCP) to the OECD Guidelines for Multinational Enterprises)

  • The OECD Guidelines for Multinational Enterprises (The Guidelines) was initially promulgated in 1976 as a form of annex to the OECD Declaration on International Investment and Multinational Enterprises. The Guidelines aims at accomplishing the implementation and dissemination of the Responsible Business Conduct. The latest version of The Guidelines, as revised in 2011, directed 47 adhering countries to The Guidelines to set up their respective National Contact Points (NCPs). NCPs are The Guidelines' dispute resolution mechanism for specific instances arising from breach by multinational enterprises of The Guidelines. Korea to date has its own NCP performing its role to offer good offices and facilitates settlement between the parties to the specific instances regarding The Guidelines. However, there has been strong criticism from NGOs and civil society that Korea NCP has not performed well due to lack of transparency and impartiality, especially in the context of the governance of Korea NCP. Under this circumstance, this paper ⅰ) examines current status and problems of Korea NCP, ⅱ) evaluates the core criteria for function and governance of NCPs through a comparative overseas cases study, and ⅲ) suggests improvement plans for Korea NCP.

기업의 사회적 책임활동이 기업이미지에 미치는 영향 : 대기업과 중소기업의 비교 (The Effect of Corporate Social Responsibility on Corporate Image : Large versus Small and Medium Sized Company)

  • Previous studies have examined the relationship between corporate social responsibility and corporate's business performance (especially, consumers' corporate evaluation). According to them, the corporate social responsibility influences the consumers' corporate evaluation. A small and medium sized company as well as a large company is asked to conduct socially responsible actions, however, it is not easy to find a study that focuses on whether the effect of the corporate social responsibility on the consumers' corporate evaluation is different by the size of company. In this paper, we classified the corporate social responsibility into the four dimensions (economic responsibility, legal responsibility, ethical responsibility, philanthropic responsibility), and investigate the differences between a small and medium sized company and a large company in the effects of the four dimensions on the consumers' corporate evaluation. We showed that the each dimension of the corporate social responsibility had an positive effect on the corporate image regardless of the size of company. In addition, we demonstrated that the effects of the four dimensions on the company image were different by the size of company; The legal responsibility and ethical responsibility are more influential to the corporate image of a large company than to that of a small and medium sized company, however, the effects of economic responsibility and philanthropic responsibility are not different by the size of company.

  • 최근에 지속적 발전(sustainable development)은 환경정책 분석뿐만 아니라 현대 환경, 생태 경제학에 있어서 중요한 개념이 되어왔으며, 이 개념은 어업에 있어서 특히 중요한 국제적 이슈(issue)가 되고 있다. 어업은 갱생자연 자원에 입각한 산업으로서 지속적 발전의 길로 가야만 한다. 이것은 1982년 UN해양법 협약(UNCLOS), 1995년 UN경계왕래성 어족과 고도회유성 어족에 관한 집행협약 (UNIA), FAO의 책임있는 어업(the Code of Conduct fer Responsible Fisheries)을 위 한 국제규범과 일련의 기술지침서에서 구체적으로 표현함으로써 국제적 합의가 이루어 지게 되었다. 지속적 발전의 개념에 대한 심층적인 이해는 어업 관리자가 어업정책의 수립과 평가에 대한 새로운 요소와 기준을 설정함에 있어서 중요한 의미를 부여한다. 이것은 특히, 어업관리자(정부와 단체 그리고 어업자)가 어업관리 목표 어종 및 비관리목표 어종과 어종의 생태, 그리고 환경을 포함한 어업 자원의 직접 사용 가치와 비사용 가치(즉, 내재 가치 )등에 관련된 제문제를 다루는 것을 그 내용으로 한다. 따라서, 이 논문은 국제사회에서 지속적 발전과 관련된 지식의 현 주소와 어업관리에 있어서 갖는 함축적 의미와 주로 관계된다. 이 논문은 지속적 발진에 대한 개념의 기원과 형성과정, 개념 구조를 상세히 고찰함으로써 어업의 지속적 발전을 위한 어업관리정책 수립을 위한 방향설정에 기여하게 될 것이다. 또 이 논문에서는 지속적 발전의 개념하에서 어업의 지속성과 지속적 발전이 어업관리에 어떠한 의미를 갖는지 고찰한다. 그 하나로 이 논문에서는 FAO에서 최근에 제시한 해양어업의 지속적 발전지표를 어떻게 설정하는지에 대한 가이드라인을 분석 고찰 하였다. 이 FAO의 지속적발전지표는 지속적 발전의 평가체계의 구성요소와 어업에 대한 지속적 평가체계[sustainable development reference system(SDRS)]를 수립하는데 있어서 필요한 관련 절차에 관해 특별한 의미를 부여해 줄 것으로 생각한다. 마지막으로 본 논문에서 는 SDRS가 지역어업 협력체계 구축에 있어 서 어떠한 역할을 할 것인가를 강조함으로써 결론을 내리고 있다.

대입준비생들의 치과위생사에 관한 인식도 조사 (Recognition of college-preparatory students for dental hygienist)

  • Objectives : The purpose of this study was to survey the recognition of college-preparatory students who interested and prevented themselves in oral health diseases for dental hygienist in Yeungnam South Korea. Methods : The subjects in this study were 328 students who was seriously worried for career and entrance into a school. The survey period was from August 16th 2011 to November 26th 2011, and the data was collected from the high school students in Yeungnam and the preparatory students who visited S college in Gyeongju. This study was conducted by using the self-reported questionnaire. Results : The result of this study are as follows. 87.2% of the subjects have recognized about the name of dental hygienist, 51.5% have distinguished dental hygienist in the clinic, and 67.4% have recognized about education of dental hygienist that was more than a college graduate. The received services from dental hygienist was scalling(15.6%), assistant of treatment(14.7%), tooth brushing instrument(11.5%), Reception & receipt(11.0%), and etc. The majority of the subjects have recognized that dental hygienist was the professional(4.82 points), the important role in oral health(4.88 points), and the intermediary between patients and dentists(4.60 points). And they were friendly(4.64 points), responsible(4.81 points), and worthwhile job(5.01 points). However their appellation has not been established yet(4.00 points), they was difficult to distinguish from nursing assistants(4.37 points), and their task did not differs from AN(4.53 points). Also they compared to other job was not stressful job(3.58 points). Conclusions : Refer to these results, those will be the basis for professional development and status establish of clinical dental hygienists and for the upright role as a professional medical personnel of dental hygiene students. In addition, those will help to patients in the future, and become an effective instrument to learn knowledge, skill, and service that needed to conduct business.
