  • North Korean market created by reunification of the Korean Peninsula is expected to serve as a new growth engine to the already-developed construction industry of South Korea. Improvement on deteriorated construction facility of North Korea is a project in urgent need at the initial stage of reunification. Prior to market entry of the Korean peninsula under these circumstances, economic feasibility analysis on construction technology application must be preceded by considering reunification period. Therefore, this study conducts an economic feasibility analysis on construction facility improvement project of North Korea considering application period of technology developed by South Korea. Results of this study are expected to be utilized in future reunification process as the basis for establishing relevant guidelines for construction facility improvement project of North Korea.

  • Everybody may be vulnerable to fires depending on the time, place, and circumstances. Fire statistics show that the occurrence of fire death depends not only on the severity of a fire itself, but also largely on the conditions of occupants such as physical functions, the environment around occupants, and the type of facility where are fire occurs. The review of fire safety from the viewpoint of vulnerable populations does not simply mean additional special attention and care only to high risk groups, but instead it means significant review of fire safety design and systems for all people from a more universal standpoint. Therefore, in order to examine the strategies of a fire death-reduction program, safety measures suitable for the relevant high-risk groups considering the type of vulnerable person, the type of fire, and the type of building in residential occupancies. Solutions will require strenuous multilateral effort and flexibility.

  • Most design temperature of environmental test in korea is based on the standard of Department of Defense. There are few studies to establish temperature standard. Besides the representative environmental test guide 'MIL-STD-810F' encourage to tailor to generate the most relevant test data possible and to test to make a match of test environment with operational environment. Under these circumstances, it is irrational to comply with baseless daily cycle. Thus the study about design method of test temperature is essential. So, the daily cycles to be appropriate to the Korean peninsula was presented in this study. And this research shows how to derive two main element, frequency-of-occurrence and daily maximum (minimum) temperature in daily cycles, in case we can not find the daily cycle.

Clinical Practice Guideline of Gastric Cancer in Korea (위암 표준진료권고안)

  • There were no Korean evidence-based multidisciplinary guidelines for gastric cancer. Experts from related societies developed guidelines de novo to meet Korean circumstances and requirements, including 23 recommendation statements for diagnosis (n=9) and treatment (n=14) based on relevant key questions. The quality of the evidence was rated according to the GRADE evidence evaluation framework and the recommendation grades were classified as either strong or weak. The topics of the guidelines cover diagnostic modalities (endoscopy, endoscopic ultrasound, and radiologic diagnosis), treatment modalities (surgery, therapeutic endoscopy, chemotherapy, and radiotherapy), and pathologic evaluation. Major limitation of the present guideline is that there is no enough evidences in Korea. Therefore, clinical studies about gastric cancer for evidence generation should be conducted.

Adverse Inferences as Sanctions in International Arbitration

  • International arbitration is a widely preferred alternative dispute resolution mechanism for many desirable characteristics, such as, party autonomy, procedural flexibility, ability of parties to select their arbitrators, as well as, finality of arbitral awards, among others. However, because arbitral tribunals derive their authority and jurisdiction from the parties' agreement(s) to arbitrate their dispute(s), arbitral tribunals lack coercive powers that national courts have. At times, arbitral tribunals have to deal with circumstances of non-production and/or spoliation of evidence, and due to the lack of coercive authority, it may be challenging to compel such recalcitrant parties to produce the relevant evidence and/or witnesses. Therefore, adverse inferences drawn against the recalcitrant parties may be the most effective sanctions. This article explores the sources of authority for arbitral tribunals to make such adverse inferences and argues for a precise set of rules or standard to be consistently applied by the arbitral tribunals in order to increase predictability in arbitral proceedings. Additionally, some of the critical issues when considering adverse inferences as sanctions are discussed.

Concept Analysis and Development of Suffering -Application of Hybrid Model Method- (고통(Suffering) 개념분석과 개발 -혼종모형(Hybrid Model) 방법 적용-)

  • There is a need to define the concept of suffering more appropriate in the context of Korean culture. This research is an attempt to analyze and develop the concept of suffering by applying the Hybrid Model suggested by Schwartz-Barcott and Kim. The data were collected from March 20, 1995 to September 17,1995. The subjects of the study were eight persons including in-patients and out-patients of a general hospital who were diagnosed as having cancer and those resting in sanatoria for natural treatment of cancer. Qualitative research methods of in-depth interview and participant observation were used for data collection. The contents of the interviews were recorded on tape. Data-analysis progressed according to the 3 phases suggested by the Hybrid Model. For each case, in-depth interview data and participant observation data were included and the attributes of suffering revealed in these data were analyzed. Finally, by summarizing the results from each case, the attributes of suffering, its dimensions, definition, and processes observed in the field were suggested. According to the results of the study, the followlng new definition of suffering is suggested : Suffering is a fundamental and inevitable experience of all human beings. When each individual experiences loss, damage, and pain which threaten one's personal integrity, suffering is perceived differently among each individual depending on their personal inner factors, one's significant others, exterior circumstances and stimuli, and the ultimate meaning of life. Suffering brings severe and unendurable distress which accompany despair, powerlessness, anxiety, bitterness, fear, anguish, guilt, depression, withdrawal and anger. The results of this study suggest that the more responsibility and burden a cancer patient felt, the more suffering she/he experienced and it tended to be more relevant to one's significant others and exterior circumstances and stimuli : the less responsibility and burden a cancer patient had, the less suffering she/he experienced and it tended to be related to one's inner factors. These findings have implications for nursing profession. When caring for patients who experience suffering, nurses need to consider the influence of responsibility, burden, and each dimension of suffering. Moreover, appropriate nursing interventions aimed at relieving pain and satisfying the spiritual need of patients experiencing loss need to be developed and implemented more widely.

A Study on the Construction Process and Design Characteristics of Korean Pavilion in Paris 1900 Exposition Universelle in Korean Modern Architecture (근대 초기 파리만국박람회(1900) "한국관"의 건축과정과 초기설계안의 디자인 특성에 관한 연구)

  • The purpose of this study is to clarify the historical circumstances under which the Korean Pavilion was established at the 1900 Paris Exposition Universelle, and the construction process and design features of the pavilion building. At that time, even though Korea faced difficulty due to lack of experience in the world exposition and funds, Korea attempted to positively participate in the international cultural event by establishing the Korean Pavilion under an official contract with assistance of the French Government. Moreover, the Pavilion shows significant architectural features which had not been shown until then in terms of the structure and design of the pavilion building. In this connection, in this thesis, among others, the historical circumstances under which the "Korean Pavilion" was established at the 1900 Paris Exposition Universelle, and the construction process as well as the process and features of the draft design prepared at an early stage by Baron Delort de Gleon on the part of France among the above parties to the project for construction of the Korean Pavilion, which have never been addressed in the field of architecture or interior due to lack of existing data, will be clearly studied based on relevant literatures. According to analysis of the study, it reveals that the representation method for the Korean tradition of Korean Pavilion designed by Baron Delort de Gleon was based on the Chinoiserie, the style widely seen in Europe. In addition, Delort de Glean's commerce-oriented concept is integrated into the design of the Korean Pavilion as well.

A Study on Grounds for Challenging Arbitral Awards in Korea and China (우리나라와 중국 중재법에서 중재판정의 취소사유에 관한 연구)

  • The obligation on a national court to recognize and enforce arbitral awards as provided in Article III New York Convention, which both Korea and China have ratified, is subject to limited exceptions. Recognition and enforcement will be refused only if the party against whom enforcement is sought can show that one of the exclusive grounds for refusal enumerated in Article V(1) New York Convention has occurred. The court may also refuse enforcement ex officio if the award violates that state's public policy. This article explores the circumstances where arbitral awards may be refused enforcement under the Korean and Chinese arbitration laws. It first analyzes the relevant statutory provisions. In Korea and China, which have adopted the UNCITRAL Model law, the grounds of challenge are exhaustively defined within their respective arbitration laws. According to their arbitration laws, an arbitral award may be set aside if a party making the application proves that (i) a party to the arbitration agreement was under some incapacity or the agreement is not valid under the applicable law, (ii) the party making the application was not given proper notice of the appointment of an arbitrator or of the arbitral proceedings or was otherwise unable to present his case, (iii) the award deals with a dispute not contemplated by or not falling within the terms of the submission to arbitration or contains decisions on matters beyond the scope of the submission to arbitration, or (iv) the composition of the arbitral tribunal or the arbitral procedure was not in accordance with the agreement of the parties. An arbitral award may also be set aside ex officio by the court if the court finds that (i) the subject-matter of the dispute is not capable of settlement by arbitration under the applicable law or (ii) the award is in conflict with the public policy. This article then reviews relevant judicial decisions rendered in Korea and China to see how the courts in these countries have been interpreting the provisions specifying the grounds for challenging arbitral awards. It concludes that the courts in Korea and China rarely accept challenges to arbitral awards, thereby respecting the mandate of the New York Convention.

A Study on the Legal Protection of Fashion Designs and its Possibility under the Korean Design Protection Act - Based on the Review of Cases Related to the Requirements for a Design Definition and Acquisition of Design Rights and the Judgment of Design Identity & Similarity - (패션디자인의 디자인보호법상 보호와 보호 가능성에 관한 고찰 - 디자인 성립 및 등록요건과 동일·유사 판단 기준 관련 판례 검토를 중심으로 -)

  • This paper is aimed at intensively examining the scope of legal protection for fashion designs under the Design Protection Act of Korea. For this purpose, this looked into how the Act defines the concept of design, its requirements, and the prerequisites for acquiring design rights. The study also reviewed statutory interpretations over the judgment of the identity and similarity of designs. For more practical and substantial discussions, this research utilized cases and precedents, which had relevant legal principles. This study also figured out how both the requirements for a design definition - such as merchantability, configuration, visibility, and aesthetics - and the prerequisites for acquiring design rights - like industrial applicability, novelty, and creativity - are interpreted and utilized in actual circumstances. The authors expressed their opinions regarding the criteria of judging the identity and similarity of designs, based on a study of previous cases. Previous rulings show that aesthetics of the exterior design is used as the criteria for determining whether a design is same or similar. So, two designs, which have different specific details, are deemed same or similar, if both designs show similarity in the dominant elements. This is because both designs will produce similar aesthetic qualities. However, if the dominant elements of a design are part of the public domain, and the specific details characterize the design, the latter has to be evaluated in the process. This paper examined scope of legal protection for fashion designs using relevant precedents. The study may serve as academic materials that lead to the establishment of rightful ownership in creative activities.

Problems of Environmental Conservation Planning and its Improvement in Aspects of Spatial Environmental Planning (공간환경계획 측면에서의 환경보전계획의 문제점 및 개선방안)

  • Environmental conservation planning as set forth in the "Framework Act for Environmental Policy" is a representative planning that demands linkages with spatial development planning like urban master plan. However, despite the intentions and efforts of government (including revision of relevant guidelines etc.), controversy still continues regarding the efficacy of environmental conservation planning in respect of its linkages to spatial development planning. Accordingly, this study was devised to examine existing issues and produce proposals for improvement in ensuring the efficacy of environmental conservation planning by local governments. This study focused in particular on the establishment of spatial environmental plans as suggested in the guidelines of the Ministry of Environment for the purposes of strengthening the efficacy of environmental conservation planning. Based of questionnaires for relevant officials of local governments, the study found that although local governments with established current spatial environmental plans are not numerous, the need for establishment of spatial environmental plans were high in terms of the applicability of environmental conservation and spatial plans. Furthermore, this study also confirmed through analysis of questionnaires data, archival research and case study research that there were a number of salient issues including an overly access and program centered planning method based on individual pollution sources and individual post factor measures in the planning aspect, a lack of usable spatial information in the application of spatial environmental information, and inadequate connections with spatial development planning in respect of linkages with other plans. Under these circumstances, various proposals for improvement were presented including the establishment of contents in environmental conservation planning for each urban master planning item from the standpoint of planning, strengthening of basic environmental surveys for spatial planning and preparation of applicable proposals from the perspective of leveraging of spatial environmental information, and systematic improvements that can enable mutual consideration through feedback between environmental conservation planning and urban master planning from the perspective of connections with spatial planning.
