한국과 몽골의 경비업법 비교연구 (Private Security Regulation: A Comparative Study of South Korea and Mongolia)

  • 몽골에서 민간경비와 관련된 법제정은 비교적 최근의 일로, 2000년에 몽골국회가 계약경비서비스에 관한 법을 통과시킴으로써 몽골에서 민간경비가 법적으로 탄생하게 되었다. 그러나 아직까지 몽골의 계약경비서비스에 관한 법은 국제기준에 미치지 못하며 따라서 이를 개정해야 할 필요성이 존재한다. 본 연구에서는 한국의 경비업법과 몽골의 계약경비서비스에 관한 법을 비교 분석하여 몽골 관련법의 문제점을 파악하고, 그에 따른 개선방안을 제시하고자 하였다. 분석결과, 몽골의 계약경비서비스에 관한 법은 법령의 명칭과 용어, 경비업체의 등록과 영업행위에 관한 절차규정, 경비업체의 대표 및 경비원의 자격요건과 책임성 확보, 경비업무의 범위 등에 문제점이 있다는 사실이 파악되었다. 이러한 문제점들을 개선하고 또 앞으로 몽골의 민간경비산업의 발전을 촉진하기 위하여 본 연구에서는 계약경비서비스에 관한 법의 개선방안을 제시하였다.

Asymmetric Regulation of Mobile Access Charges and Consumer Welfare with Price Regulation

  • Asymmetric regulation as applied to mobile termination rates refers to regulatory arrangements in which different mobile operators charge different termination rates, even though the services provided are essentially identical. The asymmetric regulation has been frequently used as a regulatory tool to support new entrants to a mobile market. This paper examines the economic effects of asymmetric regulation of mobile termination rates using a theoretical model and its simulation. The result shows that when there is no noticeable difference in brand loyalty between mobile operators with the high degree of substitutability between services provided by mobile operators, and the costs of new entrants are low, a reduction in the asymmetry of mobile access prices results in an enhancement of consumer welfare. These findings provide positive evidence for the argument that in certain situations asymmetric pricing of mobile access services may be counterproductive for consumer welfare.

Consumers' Responses to Smart Home Services: The Role of Self-Regulation Systems

  • In the new era of IoT, a deeper and richer understanding of consumer characteristics is required to accelerate the acceptance and popularization of different types of smart home services (e.g., hedonic or utilitarian smart home services). In the current research, self-regulation systems are considered one of the consumer characteristics. Therefore, this research examines the role of consumers' regulatory focus (promotion focus vs. prevention focus) in their responses to smart home services, particularly when they are not familiar with the services. Specifically, this research examines whether consumers' attitudes toward utilitarian/hedonic smart home services differ according to their regulatory focus, particularly when they are not familiar with the services. The results indicate that consumers who are not familiar with smart home services have more favorable attitudes toward hedonic smart home services when they are promotion-focused (vs. prevention-focused). In contrast, there is no significant difference in their attitudes toward utilitarian smart home services between promotion- and prevention-focused consumers. Our findings imply that regulatory focus may be an effective marketing and segmentation tool in promoting new smart home services and facilitating low-familiarity consumers' receptiveness to the services.

전자상거래상의 인터넷 에스크로 서비스의 규제에 관한 연구 (A Study of Regulating Internet Escrow Services in Electronic Commerce)

  • As with the fast spread of internet uses in recent years, electronic commerce has evolved. The proliferation of electronic commerce has increased diverse forms of fraud cases since internet helps intended criminals remain anonymous. In absence of effective tools to warrant the reliability of parties offering products or services through electronic commerce, consumers have to absorb damages unfairly. Internet escrow service has been considered to be an option to establish reliability between buyers and sellers and to protect consumers from possible fraud cases. However, like other industries, fraudulent escrow services have appeared in internet. This study has been intended to analyze fraudulent internet escrow services and to propose an effective regulatory system of internet escrow services. To do that, this study benchmarked the regulation of the State of California, primarily focusing on the formation of escrow company, regulation of escrow business, and remedies for wrongdoing, so Korea can consider the adoption of similar systems.

  • 현재 세계 여러 나라는 GATS의 통신에 관한 예외규정에 입각하여 기간통신서비스의 국경간 공급을 반경쟁행위 통제, 국내 소비자 보호, 조세부과, 국가안보 등을 이유로 규제하고 있다. 우리나라의 경우 통신서비스의 국경간 공급을 WTO 및 국내법의 규정을 통하여 부분적으로 규제를 시행하고 있으나, WTO 및 FTA 협상시 국경간 공급에 대한 규제완화를 요구받고 있다. 그러므로 규제에 대하여 실효성 파악하고 이에 대한 대응이 절실히 요구되고 있다. 따라서 본고에서는 주요국의 통신서비스의 국경간 공급 정책을 살펴보았다. 또한 주요국의 실제 규제 사례를 살펴봄으로써 우리나라의 국경간 공급 규제정책에 대한 시사점을 모색해 보았다.

개인정보 보호 분야 공동규제의 성공요인과 발전방향에 관한 연구 (A Study on the Success Factors and Development Directions of Co-regulation in the Personal Information Protection Area)

  • The Personal Information Protection Commission has been promoting the adoption of co-regulation to replace/improve the existing self-regulation programs since 2022. While the Commission's co-regulation framework has received positive feedback for its contribution to address the regulatory issues, it has also faced criticism for being seen as "co-regulation in appearance only without any real differentiation from existing self-regulation." This study aims to examine the case of industry-specific co-regulation proposed by the Personal Information Protection Commission, with the objectives of 1) determining whether their approach can be categorized as a type of co-regulation with differentiation from the existing self-regulation programs, and 2) proposing improvements for successful regulation. The 'co-regulation' of the Commission can be classified as a form of co-regulation that differs with traditional self-regulation, as it involves government and private organizations collaborating to establish self regulatory codes reflecting industry-specific characteristics as well as provides interest groups with incentives to comply with the codes. The co-regulation framework is evaluated to some extent as successful, but there is still room for improvement in three major aspects. (1) When selecting the areas for co-regulation, a focus should be placed on areas where technological changes are rapid, and government regulations should be applied in areas where they are not. (2) It is necessary to enhance the expertise of regulatory agencies, and (3) ensuring the democratic nature of regulation, such as encouraging the participation of civil organizations, is necessary.

국내 스테이블코인 규제 방향 제안: 테라-루나 사태를 중심으로 (A Proposal for the Direction of Stablecoin Regulation in Korea: Focusing on the Terra-Luna Crash)

  • Luna Coin, which ranked eighth in the global market capitalization and established itself as a super-large stablecoin, plunged overnight, shocking the market. Therefore, this study proposed the direction of Korea's stablecoin regulation, focusing on the Terra-Luna situation, starting with the question of whether the stable coin's value, 'stability', can be trusted. The whole story of the Terra-Luna incident was examined in depth and the problems were pointed out, and the direction of domestic stable coin regulation was described based on overseas cases. In the absence of any legal guidelines for stablecoin at the moment, we hope that this study will provide a minimum stabilizer in the virtual asset market and help protect investors.

Development of the Control System for Fast-Responding Frequency Regulation in Power Systems using Large-Scale Energy Storage Systems

  • Energy storage systems (ESS) can be used to provide frequency regulation services in a power system to replace traditional frequency regulation power plants. Battery ESS, in particular, can provide "fast-responding frequency regulation," wherein the facility can respond immediately and accurately to the frequency regulation signal sent by the system operator. This paper presents the development and the trial run results of a frequency regulation control system that uses large-scale ESS for use in a large power system. The control system was developed initially for the 4 MW ESS demonstration facility in Jocheon Jeju Island, and was further developed for use in the 28 MW ESS facility at the Seo-Anseong substation and the 24 MW ESS facility at the Shin-Yongin substation to provide frequency regulation services within mainland Korea. The ESS facility in Seo-Anseong substation responds to a sudden drop in frequency via governor-free control, while the ESS facility in Shin-Yongin responds via automatic generator control (AGC).

수질오염총량을 이용한 생태계 수질조절 서비스 가치 평가 (Valuation of Ecosystem Water Quality Regulation Service Using TMDL)

  • 본 연구에서는 생태계서비스 중 수질조절 서비스 가치 평가를 수행하기 위해 생태계서비스 수질조절 서비스의 물리량을 정량적으로 평가하였고 이를 이용하여 경제적 가치를 평가하는 방안을 마련하였다. 과거에 비해 수질이 개선되고, 어류 등 수생생물의 종과 수가 늘었더라도, 그 요인은 생태계의 수질조절 서비스와 수질개선를 위한 환경기초시설의 확충, 수질환경규제 등 복합적인 요인에 기인된다. 그 중 생태계 조절서비스 가치에 대해 정량적으로 산정할 수 있는 방법을 모색하는 것을 연구의 목적으로 설정하였다. 본 연구에서 생태계의 수질조절 서비스를 정량적 가치를 규명하기 위해 수질오염총량을 활용하는 방법에 대해 제안하였다. 이와 함께 생태계의 수질조절 서비스의 산정된 물리적 수질조절량에 처리단가를 곱함으로써 경제적 가치 평가 방안을 제시하였다. 마지막으로 개발된 평가기법을 이용하여 낙동강 수계에 BOD, T-P 항목에 대해서 생태계 수질가치를 평가하였다.
