  • Geographical indications are place names (in some countries also words associated with a place) used to identify the origin and quality, reputation or other characteristics of products. Protection required under the TRIPS Agreement is defined in two articles. The purpose of this study is to select the representative geographical indication item of Korea, discuss of the new intellectual property rights, and promote the trade of that product. It is also discussed of a geographical indication registration system and the recognition with international point of view. The international geographical indication protection is strengthening in recent. There are many multilateral and bilateral discussions and talks for geographical indication system. In order to protect excellent Korean products locally and internationally, the 'Quality Management of Agricultural Products Act' has been introduced form July 1, 1999. The geographical indication registration of Korea currently is 31 cases. The geographical indication is limited the regional promotion in Korea. Therefore, it is studied the registered items on the list and analyzed the result of the registration. Consequently, this paper suggests that more effective ways have to be prepared for the systematic management of geographical indications, campaigns for the recognition as a property.

The Efficient Methods of Population-based Cancer Registration in Daegu City (대구지역 암등록사업의 효율적 수행방안)

  • Objective: This study was conducted to automatically improve the completeness and validity of the Daegu Cancer Registry, using cross record linkage of many data sources, and to develop a computerized patient enrollment system for efficient communication among cancer researchers via the internet. Method: We analyzed 10,229 cancer patients who were reported in the National Cancer Registry, and from pathological reports, health insurance cancer claims lists, cancer patient records at hospital information centers and death certificates from the Korea National Statistical Office. Result: We confirmed 4,624 cancer patients and found 897 of new cases from a review of medical chart. The new cases were detected efficiently using cross record linkage. We developed a computerized patient enrollment system, based on a client-sewer model, for the input of cancer patients, and then developed a web-based reporting homepage and patient enrollment system for the internet. Conclusion: This system could manage cancer databases systematically, and could be given to other researchers as a basic database.

A Study on the Improvement of Personal Identity Proofing Service Using an Alternative Method for Resident Registration Number Based on Electronic Signature (전자서명 기반의 주민등록번호 대체수단을 사용한 본인확인서비스 개선 방안에 대한 연구)

  • As the status of public certificates expired due to the recent revision of the Electronic Signature Act, electronic signature-based public certificates were also lost in the means of replacing resident registration numbers(RRN). As a result, public certification institutions have recently been designated by the Korea Communications Commission as identity verification service providers through a review of the designation of personal identity proofing agency based on alternative means of RRN. However, unlike existing RRN replacements such as i-PIN, mobile phones, and credit cards, the personal identity proofing process for applicants for certificates is different from existing alternatives. The proposed method shows that it is possible to protect users' personal information and provide universal, reasonable, and safe identification services by applying improvements to electronic signature-based personal identity proofing services.

The Law and Case Study on the Domain Name Protection (도메인네임의 보호(保護)에 관한 법리(法理) 및 사례연구(事例硏究))

  • As a domain name can be registered simply by filing an application for registration, disputes over the domain name between the holder of domain name and the holder of trademark increased. Since the holder of trademark who was late for registering domain name is willing to pay for the return of domain name, cybersquatters increased. Cybersqatters are not genuine users of the Internet. This article is to compare the construction of law by American Courts and by Korean Courts and to assert the creation of the law similar to the law of US as to anti-cybersqatting. American Courts applied the Trademark Act and the Anti-Dilution Act to resolve the disputes over domain name. To apply the Trademark Act, the Court required the plaintiffs to prove that the goods or the services expressed by the domain name should be identical or similar to the goods or the services represented by the trademark. However, there were many cases where the holder of domain name used it for the goods or the services irrelevant to those of the holder of trademark. Also, the Anti-Dilution Act could not successfully protect the holder of trademark from cybersquatters because it required that the trademark should be famous or distinctive. As a result, the US promulgated a new law which is designed to prohibit cybersquatters from being free of sanction by the existing laws. Korea Courts applied the Trademark Act and the Unfair Competition Prohibition Act to the cases disputing domain name. Likewise in the US, Korean Courts must cope with the issue of identity of the goods or the services, and the famousness or distinctiveness of trademark. The Courts hesitate to give a winning judgement to the holder of trademark simply because the domain name of alleged violator confused the trademark. Some scholars advocate the broadening of construction of the Unfair Competition Prohibition Act to illegalize cybersquatting but it is beyond the meaning of the law. Accordingly, it is a time to make a law similar to the Anti-Cybersquatting Act of the US. The law must be a fair and reasonable compromise to resolve the collision between system of registration of domain name and the system of registration of trademark. Some commentators advocate that the registration of domain name should be examined just as the one of trademark and to facilitate it, the Patent and Trademark Office should have jurisdiction of registration of domain name. But it abandons the distinction of domain name and trademark and results in obstructing e-commerce. By adopting the Anti-Cybersqatting Act, we can prohibit it. In other cases, we get a reasonable adjustment between the holder of domain name and the holder of trademark through the Trademark Act and the Unfair Competition Prohibition Act.

Theoretical Review on the Vertical Geometric Design Standards for High-speed Roadway (초고속 주행환경에서의 종단경사 설계기준에 관한 기초연구)

  • PURPOSES: The purpose of this study theoretically reviews vertical grade deriving process in super high speed environment and compares overseas design criteria with Domestic Standardization also draws suitable vertical grade design criteria of high standard for Domestic Circumstances in Korea. METHODS : By researching domestic vehicle registration status, calculating typical vehicle, using Vissim which is traffic simulation program, Speed-distance curve of the vehicle is derived under each design speed condition. Through Speed-distance curve, estimating critical length of grade and considering critical length of grade, maximum longitudinal incline is proposed. RESULTS : The result of domestic vehicle registration status, the typical vehicle for deriving vertical grade is calculated based on gravity horsepower ratio 200 lb/hp. For calculating critical length of grade, according to change speed of uphill entry, speed-distance curve is derived by using Vissim. Critical length of grade is calculated based on design speed 20 km/h criteria which is point of retardation. Estimated critical length of grade is 808 m and based on this result, maximum longitudinal incline was confirmed in the design speed between 130km/h to 140km/h. CONCLUSIONS: The case of the typical vehicle(truck) which is gravity horsepower ratio 200 lb/hp, maximum longitudinal incline 2% is desirable at the super high speed environment in the design speed between 130km/h to 140km/h.

Value of a statistical life estimation of carcinogenic chemicals for socioeconomic analysis in Korea

  • Objectives To protect public health from risk, the Minister of Environment in Korea legislated an act concerning the registration and evaluation of chemical substances. In this study, we estimated the value of a statistical life (VSL) of carcinogenic chemicals to evaluate the socioeconomic analysis in Korea. Methods The estimation of the health benefit can be calculated through an individual's VSL and willingness to pay (WTP). To estimate the VSL and WTP, we used a contingent valuation method through a web-based survey. Results The survey is conducted with 1434 people living in Seoul and six large cities. An analysis of the survey is essential to review the distribution of the characteristics of the target population. The statistically significant variables affecting the WTP are location, age, household income, quality of life. Through the review of data, we secured statistical validity. The WTP was estimated as 41205 Korean won (KRW)/person, and the estimated VSL appeared as 796 million KRW/person. Conclusions There is a case in which the amount of statistical life value is estimated in connection with domestic environmental policy, fine dust, etc. However, there are no cases of evaluation for chemical. The utilization of this result is possible for conducting other study with chemicals.

Canadian Domain Name Arbitration (캐나다의 도메인이름중재제도)

  • On June 27, 2002 Canadian Internet Registration Authority (CIRA) launched dot-ca domain name dispute resolution service through BCICAC and Resolution Canada, Inc. The Domain name Dispute Resolution Policy (CDRP) of CIRA is basically modelled after Uniform Domain Name Dispute Resolution Policy(UDRP), while the substance of CDRP is slightly modified to meet the need of Canadian domain name regime and its legal system. Firstly, this article examined CIRA's domain name dispute resolution policy in general. It is obvious that the domain name dispute resolution proceeding is non-binding arbitration to which arbitration law does not apply. However it still belongs to the arbitration and far from the usual mediation process. Domain name arbitrators render decision rather than assist disputing parties themselves reach to agreement. In this respect the domain name arbitration is similar to arbitration or litigation rather than mediation. Secondly it explored how the panels applied the substantive standards in domain name arbitration. There is some criticism that panelists interprets the test of "confusingly similar" in conflicting manner. As a result critics assert that courts' judicial review is necessary to reduce the conflicting interpretation on the test of substantive standards stipulated in paragraph 3 of CDRP. Finally, it analysed the court's position on domain name arbitral award. Canadian courts do not seem to establish a explicit standard for judicial review over it yet. However, in Black v. Molson case Ontario Superior Court applied the UDRP rules in examining the WIPO panel's decision, while US courts often apply domestic patent law and ACPA(Anticyber -squatting Consumer's Protection Act) to review domain name arbitration decision rather than UDRP rules. In conclusion this article suggests that courts should restrict their judicial review on domain name administrative panel's decision at best. This will lead to facilitating the use of ADR in domain name dispute resolution and reducing the burden of courts' dockets.

Effectiveness of Acupuncture, Mind and Body Practices, and Natural Products for Insomnia: an overview of systematic reviews

  • Objectives: This overview summarizes the evidence for the effectiveness and safety of complementary therapies for insomnia through systematic reviews (SRs) and meta-analyses (MAs). Methods: A comprehensive literature search on SRs and MAs for complementary therapies for insomnia was conducted using six databases. Results: This overview included 30 SRs/MAs. The Pittsburgh Sleep Quality Index (PSQI) analysis of insomnia included 383 randomized controlled trials and 31,748 participants. Twenty-four SRs/MAs (80%) out of 30 SRs/MAs reported a positive result, and six SRs/MAs reported a partially positive result. The most frequently used form of acupuncture reported a positive effect in 89.5% (17/19) of SRs/MAs and a superior effect to western medicine, sham/placebo, and no treatment. The lack of protocol registration and the excluded studies list resulted in generally poor methodological and reporting quality in SRs/MAs with AMSTAR 2. Conclusion: This overview confirmed that complementary therapies positively affected the PSQI scores in patients with insomnia. However, better-designed primary studies are needed to strengthen the relevant evidence in the future. A more stringent assessment of multiple systematic reviews 2 must be followed when performing SR and MA.

  • KISTI(Korea Institute of Science and Technology Information) has developed the ${\ulcorner}$KITTI­ACOMS (KISTI-Article COntribution Management System)${\lrcorner}$ as part of the national project for automating the process of processing academic information by societies, in order to convert journals published by academic societies in Korea into an electronic form and make them accessible on the Internet. This system has been developed in the year 2001 and has since been distributed to societies free of charge. The number of societies requesting the service has risen recently, which prompted us to take more recommendations of the societies that adopt this system into account in expanding and standardizing the area of service being provided by the system. This paper will investigate the functions of KISTI-ACOMS constructed for use in the Korean Society of Crop Science and list the functions and requirements for the next system to enhance the on-line paper management system.
