A study on legal improvement on Online P2P financial loan

  • Along with the recent growth of Fintech industry and low interest rate basis, one of the alternative investment technique for expecting higher investment profit, P2P loan using P2P financial system is greatly increasing. P2P loan can be referred to as a type of Crowdfunding that the law of Crowdfunding (adopted to revised Capital Market Act) enacted on January 25th 2016 only allows investment type Crowdfunding so that it can be used as a tool of raising fund for startup and venture companies. Also, it is true that Korean government could not make any legislative foundation related to P2P loan. At this moment, those online platform companies mediating P2P loan are not included as financial companies, expected to cause various legal arguments. Financial Services Commission has released a guideline in February of this year saying that limit of P2P loan is 10 million Korean Won per arbitrating company and 5 million Korean Won per borrower. However, what is more important is to make a law supporting this institutional system. If legislation on P2P loan is implemented without care, it may disturb growth of the field but it may result in the damage of investors if not clearly defined by law. As this is the case, first, "revision of execution regulations for loan business" should take place as soon as possible to intensify inspection of loan companies by registering them to Financial Services Commission. Second, saving customer fund separately in the their organization. Third, making law on protecting investors such as regulating exaggerative advertisement. Fourth, to have transparent and fair public announcement system, standardized agreement and guideline describing clear understanding on autonomous public information publication of P2P loan online platform business and information on the borrower.

  • The editorials of the leading newspapers may reflect as well as help formulate the public opinions to a significant degree. Bearing this in mind, this study was carried out to provide information useful in formulating such public health policies that could practically meet the social interests and demands in health appearing in the editorials of the newspapers. This analysis covered the editorials of 5 leading newspapers such as Donga Ilbo, Chungang Ilbo, Hankook Ilto, Chosun Ilbo and Seoul Shinmoon for about 10 years from Jan. 1st, 1970 through Oct. 31th, 1979. The major findings are as follows: 1. The total number of health-concerned editorials in the five daily papers for the period was 1,768 or occupied 6.4% of the total editorials of the same sources. The increasing trend of frequnecy of the health-concerned editorials since 1976 indicates the increment of social interests and demands in health. Analysing the contents, environmental pollution received the greatest attention in those editorials, which was followed by medical affairs, environmental sanitation, and disease control in order in terms of frequency of appearance. However, there was a tendency that the interests in the environmental pollution, medical affairs and social welfare tended to increase year by year, whereas those in environmental hygiene and disease control comparatively decreased. 2. Motives of dealing with the health-concerned editorials were provided by announcement of the governmental policies and implementation for 25.6% and by out-breaks of the relevant events for 23.9%. This tendency coincides with the general characteristics of the editorials that reflect the timely issues. Closely analysing, however, the fact that the motives engendered by the out-breaks of the relevant events or by the season concerned comparatively tended to decrease as years pass by, indicates that the editorials tend more to seek the future-oriented demands in health rather than the current issue-oriented. 3. The editorials appeared to be more concerned with the governmental policies. 95.7% of all the editorials analysed were addressed to the government. This signifies the role of government in the field of public health and medical affairs. Their attitudes toward health-related policies of the government were much more negative than the other editorials that were addressed to the government in other fields. This suggests that the governmental interests in health were neither sufficient nor fair. 4. What the editorials most stressed were; (1) increment of governmental interests in health, (2) improvement of the governmental health administration, (3) enriching the basic statistics, and (4) development of various technologies pertinent to health affairs and disease control, and so forth. However, must of their suggestions were not concrete but rather abstract and conceptual. 5. The editorials also expressed strong interests in research area. The areas of the needed research most suggested by items are; (1) development of effective health care delivery system, (2) establishment of more practical system of calculating medical cost, (3) implementation of effective policies to control degenerative diseases, (4) division of medical care services and pharmaceutical services systems, (5) effective ways to prevent Co poisoning accidents, (6) changing status of environmental pollution and its effects upon health, and (7) status of occupational diseases, and so forth. 6. There were some editorials -not small in quantity -that have risk to mislead the public opinions as well as the health policies due to lack of professional knowledge of the writers. It is desirable to establish some kind of mechanism that screens the erroneous contents of the editorials to help prevent misleading opinions.

한국 대학도서관 학생 관외대출제도에 관한 조사연구 (A Survey Research on the Circulation System for Students of College and University Libraries in Korea)

  • This is a survey of the circulation system for students in college & university libraries in Korea. The survey used a questionnaire with 14 questions on 6 items concerning the various aspects of the circulation system in 82 libraries responded among 85 college & university libraries as of 1981. The survey results discovered many problems needing improvement. The following list describes the measures needed to better the problems found in the survey results of 82 libraries. 1. 67.1% of the libraries shows the restricted volumes loaning less than 2 volumes, and 81.7% of the libraries shows the loan periods less than a week, but it is desirable to extend them, when comparing with the size of holdings and the higher educational system at present. 2. It is desirable that the number of a staff in charge of circulation works places one person per average 75-85 books borrowed a day, when calculating an adequate number of the staff on the basis of the correlation between books borrowed a day and number of the staff. 3. 59.8% of the libraries does not have reserved book system, but it is desirable to take it for increasing reliability about the circulation services. 4. More than half of the libraries takes a method of a public announcement on a notice-board for claims of overdue books, but it is desirable to send a claim notice to the individual in viewpoint of keeping their privacies. 5. More than half of the libraries to take the open access system uses a call slip, but it is desirable not to use it in viewpoint of simplicity and economical efficiency of the charging system, because of demanding the unnecessary records. 6. Most of libraries shows many problems of the charging system, especially in factors of the records and filing system, but it is desirable to improve it on the basis of 4 basic factors of the charging system, that is, simplicity, economical efficiency, promptitude and accuracy.

지방의료원의 경영활동 운영자금 조달방법과 경영성과에 미치는 영향 (Operation Financing Method for Management Activities and Effect on Management Performance in Regional Public Hospitals)

  • 본 연구는 의료기관 회계정보 공시시스템에 등록된 29개 지방의료원의 재무정보를 이용하여 지방의료원들이 경영활동 운영자금 조달방법별 조달비율과 이들이 당기순이익에 어떠한 영향을 미치는지를 분석하였다. 연구결과, 지방의료원들의 경영활동 운영자금 조달비율은 의료수익 83.50%, 의료부대수익9.53%, 기부금수익 4.54%, 기타 의료외 수익 4.42%, 감가상각비 1.21%, 고유목적사업준비금 전입액 0.73%이었다. 지방의료원들의 경영활동 운영자금 조달방법들이 당기순이익에 미치는 영향을 살펴본 결과 의료수익, 의료부대수익, 기부금수익, 기타 의료외수익에 의한 운영자금 조달비율이 당기순이익에 긍정적인 영향을 미쳤으며, 고유목적사업준비금 전입액에 의한 조달비율이 당기순이익에 부정적인 영향을 미치는 것으로 확인되었다. 따라서 지방의료원들이 바람직한 경영활동을 위해서는 비용관리에 있어서 자체발생수익, 내부에 유보할 수 있는 자금 등을 고려할 필요성이 제기된다.

Corruption, Terrorism and the Stock Market: The Evidence from Iraq

  • The current study explains how corruption, terrorism, political stability and oil price has an effect on on the Iraq stock exchange utilizing corruption perception index as a proxy of corruption, global terrorism index as proxy for terrorism, political stability and oil price with ISX60 index as proxy of stock market for the period (2005-2019) using Ordinary Least Square method. The results show that the level of corruption, terrorism activities and political stability coefficient is significantly positive with Iraq stock exchange. In contrast, the oil price coefficient is significantly negative with Iraq stock exchange, which means that lower levels of corruption, less terrorism activities and more stability in political system have strong influence on stock market development in Iraq. The study concludes that the explanatory variables are important for Iraq stock exchange. Hence, the study suggests the policy makers to develop stock market by implementing policies and strategies to overcome high level of corruption, terrorism activities especially after ISIS/ISIL announcement has been made public. There is a need for transparency and creating stable political environment through good governance practices in order to attract more foreign investment and promote economic development. Factors like terrorism and corruption make economic and political systems unstable and has an adverse effect on on Iraq's stock exchange performance.

  • 최근까지 한국은 3년 연속 UN 발표 전자정부 세계 1위를 차지했다. 이에 버금하여, 한국의 정책수립과 비전에 따라 예산 집행규모는 꾸준히 성장해, 정보화사업의 대형 정보화 프로젝트 증가로 이어졌다. 특히 불특정 대다수 사용자들에게 영향을 미칠 수 있는 Mission Critical한 공공 인프라의 경우 다양하고 복잡해진 사용자들의 요구를 충족시킬 수 있는 새로운 기술이 적용된 고품질의 정보시스템 구축 필요성이 대두되고 있다. 이와 같은 대표적인 영역의 하나인 국방 정보체계에서는 첨단 기술을 적용하여 선진 군사역량을 구축하고, 효율적인 국방경영을 구현하는 핵심 역할을 수행하기 위해 네트워크 중심 국방 지식정보화를 국방정보화의 비전으로 제시하고 이에 따라 국방정보화 추진체계의 선진화 및 국방정보시스템의 고도화를 추진하고 있다. 본 연구에서는 Mission Critical한 공공 인프라의 대표격인 국방 분야 정보화사업의 시험평가와 관련된 새로운 품질지표를 고찰하였다. 먼저 관련 국제표준 및 가이드를 고찰하였고, 실제 시험평가 사례를 분석하였으며, 이를 확장하여 전자정부법(법률 제12346호, 2014. 1.28. 공표, 2014. 7.29. 시행)의 근거에 따라 현재 사용되고 있는 감리 점검 항목에 적용하였다. 제안하는 모델을 공공부문 중 국방 분야 정보화사업의 시험평가에 적용하였을 경우, 국방정보화 사업의 생산성에 미치는 영향을 분석한 결과, 국방정보화 사업의 신뢰성, 전문성, 안전성의 요소로 시험평가 생산성이 향상 될 수 있다는 가능성을 확인하였다.

THE INVESTIGATION OF PROPERTY MANAGEMENT AND DEVELOPMENT OF "BUILDING ADMINISTRATION SYSTEM"

  • Because each building is built in different time, there exists different equipment to meet the need for each age. Before the announcement of "Community Management Regulation", the old communities usually suffer the problem of lower requirement and living quality. This may bring some security problem that we should face. In this research, we construct "Building Administration System" to provide users a tool to perform a standard operation procedure in community management. This powerful tool will also help manager to effectively handle important tasks in property administrating by reducing unnecessary documentation. In the current regulation, all community committee members shall be voted each year. This will seriously affect the cumulative of management knowledge and cause a worse efficiency. In this research, we use Object Oriented concept and Visual Modeling techniques to combine with Interbase, ER/Studio, and Delphi to develop this management system for Building Property. Through the help of current computing technology, we can solve the problem that can not be inherited and the storing of the huge amount of data. In this system, we develop the modules such as Basic Data Module, Administrative Expense Calculation, Receipt Print, and Inquiring for Inheritance. In this system, we have integrated all houses, parking lots, and public equipments in it. Manager will only need to handle some basic accounting data; the system will automatically handle the rest. Through the help of this system, the community management staff can be easily accomplished and put more manpower on some needed aspect to improve the living quality.

일본의 지방기록관리 연구 기록관리 조례 제정과 아카이브 정비 사례를 중심으로 (A Study on Local Records Management in Japan : Focusing on the Enactment of Records Management Ordinance and the Improvement of Archives)

  • 이 논문은 2009년 제정된 일본의 "공문서등의 관리에 관한 법률"의 영향으로 새롭게 변화하고 있는 지방 기록관리의 모습을 도도부현과 정령지정도시의 사례 연구 방식을 통해서 구체적으로 포착하고자 하였다. 일본 지방자치체에서의 기록관리는 지금까지 기록관리에 관한 기본법이 존재하지 않았던 상황에서 행정기관 내부의 '문서관리규정'에 근거하여 이루어졌다. 법 제정을 계기로 지방에서도 '법률의 취지'를 반영한 '적정한 기록관리'를 실현하기 위한 기록관리 법령 정비와 아카이브 정비가 추진되었다. 지방마다 처한 조건으로 인해 그 내용과 수준에서 차이를 보이지만, 기록관리 조례의 제정을 통해서 법에서 규정한 '현용과 비현용을 아우르는 일원적인 기록관리체계'를 도입하고 있으며, 이 과정에서 지방아카이브의 기록관리에 관한 권한과 기능의 강화 확대를 꾀하였다. 또한 기록물처리일정표와 기록목록의 공표, 제3자적 관점 확보 위한 공문서관리위원회의 운영 등을 통해 조례에서 정한 기록관리 내용의 법적 준수를 철저하게 지킨다. 이러한 일본의 지방자치체의 변화는 행정기관의 기록이 주민공유의 지적재산이라는 점과 이를 적정하게 관리하여 주민에 대한 설명책임을 달성하려는 공문서관리법의 취지를 충실하게 반영한 것이다.

상관관계분석을 이용한 시공능력평가 제도의 실증적 고찰 (Empirical Study for the Appraisal System of Execution Capacity using Correlation Analysis)

  • 기업의 시공능력을 평가하기 위한 노력은 지난 1958년 공사청부제한제도로 시작되어 1961년 공사도급제한제도를 거쳐 1996년 시공능력 평가 및 공시로 변경된 채 현재에 이르고 있다. 시공능력 평가 및 공시 제도는 그동안 많은 문제점 및 그에 따른 제도개선에도 불구하고 건설업체의 공사수행 역량을 평가하기 위한 확고하고 유일한 수단으로 활용되어 있다. 그러나 그동안 수행되었던 시공능력 평가 및 공시 제도의 개선을 위한 다수의 연구에도 불구하고 본 제도를 실증적 관점에서 분석하고자 하는 노력은 부족했다. 이에 본 연구에서는 지난 2007년부터 2016년까지의 10년간의 시공능력 평가 결과, 건설공사실적, 건설업 경영관리 지표, 거시경제 지표에 대한 상관관계분석을 통해 시공능력 평가 및 공시 제도의 현황을 분석하고 그에 따른 시사점을 도출하였다. 분석결과, 시공능력 평가액은 토목과 조경 분야에서 건설공사실적에 비해 지나치게 부풀려져 있으며, 토목, 산업설비, 조경 분야에서 시공능력 평가액과 건설공사실적 간에 상관관계가 높지 않음을 알 수 있었다. 또한, 토목과 조경 분야의 기술능력평가액이 지나치게 부풀려져 있으며, 토건과 산업설비 그리고 규모가 큰 기업은 시공능력 평가액과 세부 평가액들 간의 상관관계가 높았으나, 토목, 건축과 조경 분야와 규모가 작은 기업은 그 상관관계가 높지 않았다. 마지막으로 시공능력 평가액의 집중이 점점 심화되고 있으며, 시공능력 평가액 집중도와 건설업 경영관리 지표와 및 거시지표와의 상관관계 분석 결과, 시공능력 평가액의 집중은 건설업 경영관리 지표와 거시지표를 악화시키고 있음을 알 수 있었다. 본 연구에서 도출된 시공능력 평가 및 공시 제도에 대한 시사점을 바탕으로 대안을 수립하여 본 제도에 대한 개선을 수행한다면, 건설업체의 공사수행 역량을 평가하기 위한 확고하고 유일한 수단으로서의 지위를 향후에도 지속적으로 유지할 수 있을 것이다.

ACMS 모형을 적용한 전력정책의 변동 분석 : 한국전력공사의 발전자회사를 중심으로 (An Analysis on Electric Power Policy through ACMS Model : Focused on the Power Generation Subsidiary Company of the Korea Electric Power Corporation)

  • The purpose of this study is to dimensionally examine the factors of policy changes by applying the ACMS model to KEPCO's structural reorganization privatization policies and study its implications. As a result of the analysis, among the external variables that affect as a financial source or restriction to advocates, all areas except for the difference in opinion of the people as well as policy decision and effects of other subordinate systems were shown to be in an advantageous condition acting as a financial source to advocates of structural reorganization privatization. On the other hand, advocates affected by the external variables share a certain belief system in which the advocates of privatization share the justification of profitability while the advocates of collectivization share the justification of publicness. In these flows, the announcement of the privatization plan of public enterprises of the committee of planning and budgeting acts as a matter of contact which opens the windows for policy changes, and this window goes through ignition, explosion, and fixation which causes fierce interactions among advocates of both sides. Eventually, in accordance with the contents of excluding electricity(KEPCO) from the list for privatization the window for policy changes has closed and things have changed to a transitional KEPCO privatization policy. Based on this, the first implication is that non-official participants such as the people, social organizations, labor unions, etc. influence policy changes more than they did before. Secondly, in the process of policy changes, there is an order of boundary even in the fierce interactions between each advocate. Thirdly, specific variables can play various roles in complex policy phenomenon. Fourthly, a logical analysis using the ACMS model is possible in Korea as well. Fifthly, as a result of analyzing the change process of the KEPCO structural reorganization privatization policy through the ACMS model, not all matched with the main research results implied by the ACMS model.
