본 연구는 기술수명을 직관적이 아닌 정량적이고 객관적인 방법으로 추정하기 위한 것으로 미국특허에서 인용된 특허의 수명을 분석하고자 하였다. 인용 특허의 수명을 추정하기 위해 기술예측 방법론 중의 하나인 탐색적 기법을 근간으로 하였으며, KISTI의 미국특허 데이터베이스(USPA)를 대상으로 계량정보학적 방법을 이용하여 인용특허의 수명을 추정하고 이를 통계적으로 나타냄으로써, 해당 기술군에서 인용된 특허들의 수명 분포를 알 수 있었다. 이러한 결과는 기술의 속성 분석을 고려함에 따라 기술수명주기 분석 및 기술가치평가시 기술의 경제적 수명추정에 활용이 가능할 것이다.

This study analyzes patent trends regarding farming-related technologies such as breeding or nursery technology, production systems, and new cultivation methods in order to provide objective patent information about the trends of R&D on marine products' proliferation or farming. Presently, in Korea, we try to secure marine living resources through the formation of artificial resources instead of environmental improvement policy or resource management policy. However, this is not about eliminating the causes of marine environment destruction but just the policy for improvement, so it is needed to revise the related policy with more ultimate measures. And it is necessary to develop technology that can secure the rights by integrating patent application strategies from the stage of R&D for medicine that can be utilized in chief farming countries and provide intensive support for the research centering around strategic varieties for farming in each region as well as strategic national farming varieties afterwards. Also, the analysis shows that it is urgent to make applications overseas based on domestic applications in order to develop technology that can be commercialized in not just Korean but overseas market as well.

지식정보경제에서 무형자산은 부와 성장을 결정하는 중요한 역할을 한다. 특히 기업이 보유한 무형자산 중 대표적인 특허에 대한 평가가 많은 주목을 받고 있다. 중소벤처기업의 활동이 경제의 큰 부분을 차지하면서 이들이 보유한 특허의 가치를 어떻게 평가할 것인가에 대한 문제가 실무 및 학계에서 큰 관심의 대상이 되고 있다. 중소벤처 기업에 대한 인수 합병, 투 융자 등에서 가장 중요하게 고려되는 것이 특허가치에 대한 평가이기 때문이다. 이러한 필요성에 의해 본 연구에서는 특허가치평가를 위해 평가대상기업 재무제표를 이용하여 매출총이익으로부터 영업이익을 계산한 후 법인세, 자본비용을 고려하고 감가상각비는 증감함으로써 초과이익을 계산하고 현가계수를 곱하여 현재가치를 구하게 되며, 여기에 기여도를 곱함으로써 궁극적인 무형자산 가치를 구하게 되는 DCF모형과 사례분석을 제안하였다.

SGML(Standard Generalized Markup Language)의 디스크립션은 WIPO(World Intellectual Property Organization) Standard ST.32의 디스크립션과 더불어 자세히 기술되고있다. SGML의 이용에 대한 이점이 강조되고 있으며, 그것은 시스템 독립적이며 특허출판 및 전문 데이터베이스구축에 타당성이 있다는 것이다. WIPO Standard ST.32를 적용한 특허문헌의 내용구조는 ST.32에 따라 작성한 DTD로 표현하고 텍스트 자체는 DTD에 따른 범용 마크업을 사용하여 기술한다. 본고에서는 전체문헌, 특정 서브문서, 문단 등의 계층구조와 표, 도면, 화학구조식 등의 비계층구조로 되어 있는 문서구조를 어떻게 표현하는가에 대하여 예를들어 설명하였다. 그리고 특허 문헌처리에서 SGML의 효과에 대하여 논의하였다.

The recent patent wars in the information technology (IT) industry demonstrate the strategic importance of IT patents in the industry. In this paper, we adopt the lens of real options to study the value of IT patents for IT firms. Specifically, we examine the relationship between IT patents and firms' market performance. We also consider the moderating effect of the innovation orientation of firms' patent portfolios (exploitative vs. explorative). Based on a large panel dataset consisting of 697 firms in US IT industries, our results suggest that the impact of IT patents on firm value (as measured by Tobin's q) is positive and significant. Further, we find that this impact varies, depending on the innovation orientation of firms' patent portfolios. IT patent portfolios with higher levels of an exploitative orientation are associated with higher firm value, compared to those with a lower exploitative orientation. This study highlights the value of employing real options theory as the underlying mechanism in understanding the impact of patents on firm valuation. Future researchers can adopt the real options lens to identify and empirically examine the role of other factors that may affect the value of patents and other investments exhibiting real option characteristics. While our paper answers some questions about the value of patents in the IT industry, it also raises a number of additional new questions. As such, we hope that it will generate more research on this important topic.

As the importance of technology forecasting while countries and companies manage the R&D project is growing bigger, the methodology of technology forecasting has been diversified. One of the forecasting method is patent analysis. This research proposes quick forecasting process of emerging technology based on keyword approach using text mining. The forecasting process is following: First, the term-document matrix is extracted from patent documents by using text mining. Second, emerging technology keyword are extracted by analyzing the importance of word from utilizing mean values and standard deviation values of the term and the emerging trend of word discovered from time series information of the term. Next, association between terms is measured by using cosine similarity. finally, the keyword of emerging technology is selected in consequence of the synthesized result and we forecast the emerging technology according to the results. The technology forecasting process described in this paper can be applied to developing computerized technology forecasting system integrated with various results of other patent analysis for decision maker of company and country.

There have been studies to evaluate valuation of firms by using patents in various ways. Also, the theory that value of patents helps enterprise's growth is valid in economics. However, when evaluating the value of the company, through the patent evaluation has not been used. Because of previous studies researched relation between patents and firms only at certain points. To solve this problem, this study intends to analyze lag between patent and profitability of the firms. In this study, we classified top 100 software firms in the United States through PBR, PER and value of intangible assets by using cluster analysis. And we applied Almon's distributed lag model to each cluster to find out lag between patent and profitability of the firms. As a result, in the cluster of more valuable companies, patents have an effect on profitability of the firms at regular lags. This study indicates that the patents are an important indicator to assess companies.

본 논문에서는 "Co-word" 특허분석방법과 "기술로드맵(technique road-map)" 그리고 특허활성화 라이프 사이클그래프 및 추세분석을 활용하여 ITS(Intelligent Transportation System)의 미래녹색기술에 대해 예측한다. 분석 결과 미래의 ITS 녹색 기술 분야의 발달로 탄소배출 절감 효과가 발생하기 때문에 환경 보호에 도움을 줄 것으로 예측 되었으며, 미래의 ITS 녹색 기술은 fuel saving 분야에 대한 성장이 클 것으로 예상되었다. 또한 fuel saving 분야는 미래의 IT 기술과의 융합으로 인해 더욱 실용적인 기술 분야로 발전할 수 있을 것으로 예측 되었다.

최근 특허권을 포함한 지식재산권에 대하여 다양한 목적으로 가치평가가 이뤄지고 있으며, 특히 특허가치평가를 통한 대출, 보증, 담보용의 평가가 기술금융의 활성화와 더불어 관심이 제고되고 있다. 비록 특허가치평가에 관한 다양한 연구가 진행되어 왔으나, 특허가치평가의 적정성에 관련한 연구는 거의 이뤄지지 않고 있다. 본 연구에서는 기술가치평가의 방법 중 실무에서 가장 많이 사용되는 수익접근법(DCF모형)을 적용하여 산출된 추정가치와 평가이후 수집된 재무제표를 바탕으로 산출한 실제가치를 비교 분석함으로써 특허가치평가의 적정성에 대한 문제를 분석한다. 실증분석 결과, 특허가치 평가액에 대한 추정가치와 실제가치의 차이는 통계적으로 유의미하게 차이가 있다는 것을 확인하였고, 평가업무별로 추정가치와 실제가치가 차이가 있다는 것을 발견하였다. 또한 기술성 평가자에 따른 차이 분석에서는 교수, 변리사, 연구원에 있어서는 차이가 발생하지 않고 있는데 반해 변리사와 기타 평가자간에는 유의한 차이가 있는 것으로 확인되었고, 평가대상 업종별 분석에서도 유의한 차이가 발견되었다.

본 논문에서는 특허풀 내에서 공평한 로열티 분배를 위한 특허가치평가 방안에 대하여 살펴보고자 한다. 지식기반경제에서는 지적재산, 즉 축적된 기술과 노하우가 기업의 경쟁력과 국가의 경제성장의 가장 중요한 원천으로 인식되고 있다. 특허제도는 특허권자에게 독점적인 권리를 부여함으로써 기술혁신, 즉 새로운 기술의 발명과 상업화를 촉진시켜 궁극적으로 삶의 수준을 향상시키는 것을 목표로 하고 있다. 하지만 특허권의 숫자가 증가하고 특허권의 소유가 분산되면서 나타나는 특허제도의 문제점들이 기술혁신 의욕을 저하시키고 있다. 이에 대한 유망한 해결책으로 특허풀이 제시되고 있으며, 1차 세계대전 당시 미국정부가 특허풀을 결성하여 항공기 관련특허를 모든 생산업체들에게 라이선스함으로써 항공기 산업을 활성화시킨 사례가 있다. 특허풀의 원활한 운영을 위해서는 특허풀에 참여하는 특허들의 기술적 기여도를 평가하여 특허권자들에게 공평하게 로열티 수입을 분배할 필요가 있다. 이러한 특허가치평가에는 Rating/Ranking 방법이 적절한 것으로 보인다. 본 논문에서는 여러 특허가치평가 기관들의 평가모형들을 살펴보고 Rating/Ranking 방법에 활용될 수 있는 주요한 평가항목들을 추출하였다.
