Conflicts between Protected Franchise Territory and Unrestricted Delivery Trading Area

  • Propose: The expansion of the delivery market in franchise business is a positive means of advertising and promotion for franchisees and contributes to substantial sales growth for stores. However, unrestricted and uncontrolled delivery sales and business activity of franchisee directly lead to encroachment of business territory between franchisees, resulting in increased operating costs of franchisees and conflicts between franchisees over rights and interests on franchise business. Moreover, in relation to the restrictions on the opening of competitors, it is incapacitating the law intent of prohibiting unfair encroachment of business territory, in the issue of the Fair Franchise Act in regard to guarantee of exclusive sales and business activity rights of franchisee. This study aims to point out major problems arising out of franchisee's infinite competition on delivery sales and business activity that are not restricted or controlled and then suggest legal supplements, policy tasks, and practical implications for improvement on the issues. Literature Review: In franchising business transactions, vertical restraints are associated with the exclusive territory establishment, control of transaction area, restriction of intangible sales and business activity of franchisee. Therefore, in the franchise business, it is necessary to take positive interpretation and application on e-commerce, the area of e-commerce, and delivery trading area and find proper and practical ways, by virtue of constructive attitude of each actor, to reduce the encroachment of business territory and various conflicts caused by unrestricted delivery trading area. Conclusion and suggestion: The finding shows that unrestricted or uncontrolled delivery sales and business activity of franchisees cause encroachment of business territory and many conflicts among franchisees. And this matters also weaken the legislation of the law on the protection of the business territory and can be negative factors that disrupt the protection of identity and sound development of the franchise industry in the long run. Therefore, in the franchise business, it is necessary to take positive interpretation and application on e-commerce, the area of e-commerce, and delivery trading area and find proper and practical ways, by virtue of constructive attitude of each actor, to reduce the encroachment of business territory and various conflicts caused by unrestricted delivery trading area.

효율적인 국방M&S 인정업무 수행을 위한 평가시스템 발전방안 연구 (A Study on Improving Plan of the Evaluating System for Efficient Defense M&S Accreditation Work)

  • 최근 4차산업혁명을 통해 융합 기술이 발달하면서, 국방 분야에서도 이러한 흐름을 바탕으로 무기체계의 첨단화, 고도화 등을 모색하고 있다. 하지만 첨단 기술을 바탕으로 개발되는 무기체계의 성능시험은 여러 변수들이 존재하며, 실제 운용환경에서 시험을 수행하기에 많은 어려움이 따른다. 이러한 문제점을 극복하기 위한 방안으로 M&S 자원을 적극 활용하여 그 성능을 입증하고 있으나, 사용 중인 M&S 자원의 신뢰성을 보증할 수 있는 수단을 추가로 요구하고 있다. 이에 따라 위한 VV&A 업무 수행을 통해 M&S 자원의 신뢰성을 확보하고 있다. VV&A 업무의 지속적인 요구와 수행으로 인해 관련 제도 등은 많은 발전이 이루어졌지만, 업무 수행을 위한 도구나 기법 등은 제도에 맞추어 발전하지 못하여 업무 수행에 있어 비효율적인 부분이 존재하며, 체계적인 시스템의 부재로 인하여 보안 등 여러 안전사고가 발생할 수 있는 위험성을 다수 내포하고 있다. 본 논문에서는 수행중인 국방M&S VV&A 업무의 문제점 분석을 통해 보다 효율적이고 안전한 방법을 모색하고, 이를 기반으로 업무의 발전방향을 제시하고자 한다.

  • 절도, 폭행, 성범죄 등과 같은 각종 범죄들이 증가에 대응하기 위하여, 각 지자체에서 CCTV를 설치하고, 비상대응을 위해 24시간 관제센터를 운영하고 관리하고 있다. CCTV 관제센터에서 현장의 위험 상황을 감지하면, 경찰이나 119와 연계하여 대응하고 즉각 처리하고 있다. 하지만, 사람이 관리하는 것이다 보니 대응 속도가 변칙적이고 사후 처리에 중점적으로 활용되고 있는 것이 현실이다. 따라서, 인공지능 LED 안내판을 통해 현장에서 긴급상황을 알리고, 행인의 도움을 받거나 사고가 발생하기 전경고의 기능을 하도록 한다. 본 논문에서는 인공지능 algorithm을 반영하여 LED 안내판의 조명 색을 바꾸거나 소리를 내는 등 경고시스템을 설계하고 연구한다. 본 연구를 통해 치안 및 사회 안전에 기여하려고 한다.

선형 예측 분석 기반의 딱총 새우 잡음 검출 기법 (Linear prediction analysis-based method for detecting snapping shrimp noise)

  • 본 논문에서는 선형 예측 분석을 기반으로 한 딱총새우 잡음 검출을 위한 특징을 제안한다. 딱총새우는 천해에 서식하는 종으로, 높은 진폭의 신호를 생성하고 빈번하게 발생하기 때문에 수중 잡음의 주된 원인 중 하나이다. 제안된 특징은 딱총새우 잡음이 갑작스럽게 발생하고 빠르게 소멸하는 특징을 활용하기 위해 선형 예측 분석을 이용하여 정확한 잡음 구간을 검출하고 딱총새우 잡음의 영향을 줄인다. 선형 예측 분석으로 예측한 값과 실제 측정값 사이의 오차가 크기 때문에 이를 통해 효과적으로 딱총새우 구간 검출이 가능해진다. 추가적으로 제안된 특징에 일정 오경보 확률 탐지기를 결합하여 잡음 구간 검출 성능을 추가적으로 개선한다. 제안한 방법을 딱총새우 잡음 구간 검출 최신 방법으로 알려진 다층 웨이블릿 패킷 분해와 비교한 결과, 제안한 방법이 수신자 조작 특성 곡선과 곡선 아래의 면적 측면에서 성능이 평균적으로 0.12만큼 우수하였고 계산량 측면에서도 계산 복잡도가 더 낮았다.

미국(美國) 내셔널브랜드 C사(社)의 마케팅전략(戰略)을 통한 브랜드리뉴얼 성공사례(成功事例) 연구(硏究) (A Study on the Successful Case of Brand Renewal through American National Brand 'C' Company's Marketing Strategy)

  • It's not easy to renew old brand of over 50 years history to the tastes of new consumer of our time. Most of national brands that has a history of some 20 years in Korea have strove for continuation and growth of brand to no avails, which can be taken as a good example of current situation. For instance, C company, one of the National brand of US which has a history of 51 years, has made its position secure as a fashion group and based itself on a sound foundation by establishing new marketing strategy and completing successful brand renewal in the process of strategic M&A with Italian company. Those successful marketing strategies are as follows. 1) they regarded both market and consumer oriented marketing activity as company's highest priority strategy and put great emphasis upon concentration on target market and reestablishment of brand image of business casual wear. 2) Setting up and operating planning team composed of merchandizer alone in Milano, they set the direction of plan on the basis of concentrated research on potential item in market according to thorough market research done by buying office in Korea, branch office in Hong Kong and buyer in US prior to blueprint planning for season. 3) Great emphasis was placed on business which focused on intensive presentation of basic key item for apparel career women who are main consumer group in the midium-low prices market in US and on supplementation of size and color. they named this line 'collectibles' and helped their customer develop their own clothes plan without worrying about the change of color and fabric by supporting same fabric and color throughout the year and enabled them to add variation easily by supplementing new trend item. 4) Company set black as a main color that lots of apparel career women find easy to care and to express their own image and presented them with pebble which belongs to navy and beige and added fashion color such as wine and brown etc as season goes by. They constructed basic line in order for their customers to coordinate purchased item with new one or to add them to present collection, and to achieve efficient sale by setting up strategy which allows this cross coordination and changing pattern occasionally. 5) Though basic jacket for 99$, short slim skirt for 49$ are products within midium-low prices range, in the material planning stage aiming at production of item that has both resonable function appealing to consumer and is fashionable, synthetic material had to be used as a main source due to price competitiveness. Despite this situation, considering comfortable sense of fit and refined drape of silhouette that has no sign of cheap material, whole collectible line was divided into two items, which contributed to reduction of cost. In case of material that is composed of triacetate and polyester in 70 to 30 ratio, was used up to 4 million yard, which allowed drastic curtailment of cost accompanied by concentration. In case of 'collectibles' line, using Korean material mainly, C company chose to have their product sewed in Southeast Asian countries where transportation is well developed and both productivity and quality verified by operating global production system which aiming at cutdown of cost through outsourcing production from the country where labor cost is low and getting finished product. Polarization between present consumers telling us that consumers with the mind of middle classes in the past no longer exists between consumers who seek after only fine article of highest quality and wise consumers who are sensible enough to judge bubble on correlation between price and quality. To cope with this change in new consumer mind, apparel makes changing their policy so as to produce item that has reasonable quality and falls within affordable price range anywhere in the world. and they're striving to get out of difficult situation by operating global marketing strategy which stresses separation of planning, production and sale and sensibility of fashion shared worldwide. The marketing strategy of C company can be exemplified as a successful one.

기업간 거래에서 정보기술을 활용한 전자적 협력의 범위와 선행요인에 관한 연구 (A Study on the Scope and Determinants of Electronic Collaboration based on IT in Interorganizational Relationships)

  • This study suggests strategies which can enable to creation of new opportunities of competitive advantages while operating a long lasting and consistent business with major trading partners, based on interorganizational information systems (IOISs) specially established and installed for interorganizational transactions. Nowadays, IOISs based mechanism having been widely expanded as a conventional business infrastructure for the interorganizational transactions and/or exchanges, it is customary difficult to obtain any strongly sound advantage over the competitors who have adopted even the simplest deployment of the IOIS mechanisms. In this connection, this study intends to investigate the interorganizational collaborative activities conducted by under the auspicious of IOISs, focused on the prospect of the exploitation of IOISs rather than the implementation of the IOISs. In this study, we, firstly, suggest the concept of Electronic Collaboration which can be defined by the collaborative activities conducted by IOISs, compared to the ones conducted on off-line. In addition, we suggest the Electronic Collaboration as a multi-dimensional concept, constituted by three sub-constructs, the Electronic Information Sharing (EIS), the Electronic Joint Activity (EJA), and the construction of the Electronic Relational Knowledge Store (ERKS). Secondly, we empirically verify the effects of relational and environmental determinants on the Electronic Collaboration. In this study, the relational determinants relate to the variables created in interorganizational relationship like Trust, Influence, Relational Specific Asset-asset invested for the transaction-, and Continuity of the relationship. On the other hand, the environmental determinants relate to the variables surrounding the relationship which are difficult to control. We consider Product Complexity, Technological Uncertainty, and Market Variability as the domain of the environmental determinants. To test our hypotheses, we conducted both paper-based survey and online-based survey. After refining the data with missing responses, a total of 150 data was used for analysis. The results were as follows : Firstly, it is statistically significant that the Electronic Collaboration is composed of EIS, EJA, and ERKS. In particular, the results imply that the firms are able to accumulate relational knowledge base as well as to exchange information or knowledge, and to conduct joint activities through effort to further expand the Electronic Collaboration. Secondly, we have verified the individual effects of the relational and the environmental determinants on the Electronic Collaboration. Product Complexity has been revealed as the most influential variable affecting the Electronic Collaboration. Next, Interorganizational Trust and Technological Uncertainty, in that order, have been seen to have significant effects on the Electronic Collaboration. In other words, when products or services seem to be difficult to standardize, and the core technologies seem to rapidly change, the need for the Electronic Collaboration increase. In addition, the observation dictates that the interorganizational trust turns out to be a critical variable in building a relationship and in seeking further collaboration. The results, further, illustrate that the environmental determinants are relatively more effective than the relational determinants, which is not consistent with a few prior researches relational determinants emphasized. It is because this study doesn't consider the size of the firm. A few researchers have given an emphasis on the relational determinants like trust and influence, especially from the perspective of small firms in interorganizational relationship. However, in our study, where all the sizes of the firms are contained, electronic collaboration is considerably affected by the environmental determinants.

유통업체의 부실예측모형 개선에 관한 연구 (Performance Evaluation and Forecasting Model for Retail Institutions)

  • Purpose - The National Agricultural Cooperative Federation of Korea and National Fisheries Cooperative Federation of Korea have prosecuted both financial and retail businesses. As cooperatives are public institutions and receive government support, their sound management is required by the Financial Supervisory Service in Korea. This is mainly managed by CAEL, which is changed by CAMEL. However, NFFC's business section, managing the finance and retail businesses, is unified and evaluated; the CAEL model has an insufficient classification to evaluate the retail industry. First, there is discrimination power as regards CAEL. Although the retail business sector union can receive a higher rating on a CAEL model, defaults have often been reported. Therefore, a default prediction model is needed to support a CAEL model. As we have the default prediction model using a subdivision of indexes and statistical methods, it can be useful to have a prevention function through the estimation of the retail sector's default probability. Second, separating the difference between the finance and retail business sectors is necessary. Their businesses have different characteristics. Based on various management indexes that have been systematically managed by the National Fisheries Cooperative Federation of Korea, our model predicts retail default, and is better than the CAEL model in its failure prediction because it has various discriminative financial ratios reflecting the retail industry situation. Research design, data, and methodology - The model to predict retail default was presented using logistic analysis. To develop the predictive model, we use the retail financial statements of the NFCF. We consider 93 unions each year from 2006 to 2012 to select confident management indexes. We also adapted the statistical power analysis that is a t-test, logit analysis, AR (accuracy ratio), and AUROC (Area Under Receiver Operating Characteristic) analysis. Finally, through the multivariate logistic model, we show that it is excellent in its discrimination power and higher in its hit ratio for default prediction. We also evaluate its usefulness. Results - The statistical power analysis using the AR (AUROC) method on the short term model shows that the logistic model has excellent discrimination power, with 84.6%. Further, it is higher in its hit ratio for failure (prediction) of total model, at 94%, indicating that it is temporally stable and useful for evaluating the management status of retail institutions. Conclusions - This model is useful for evaluating the management status of retail union institutions. First, subdividing CAEL evaluation is required. The existing CAEL evaluation is underdeveloped, and discrimination power falls. Second, efforts to develop a varied and rational management index are continuously required. An index reflecting retail industry characteristics needs to be developed. However, extending this study will need the following. First, it will require a complementary default model reflecting size differences. Second, in the case of small and medium retail, it will need non-financial information. Therefore, it will be a hybrid default model reflecting financial and non-financial information.

디지털 증거 선별 조사의 효율성을 위한 Digital Evidence Container 설계 및 구현 (A New Design and Implementation of Digital Evidence Container for Triage and Effective Investigation)

  • 최근 국내외 수사 기관은 초동 수사 시 현장에 컴퓨터가 있을 경우, 사이버 범죄 수사가 아닌 경우에도 시스템을 압수 또는 확보하는 것이 필수적인 단계로 자리 잡고 있다. 이렇게 확보한 시스템으로부터 용의자의 범죄 사실 입증을 위한 정황 증거를 확보하여 수사에 활용되고 있다. 하지만 사이버 범죄가 아닌 일반 범죄 사건에서 확보한 시스템에서 디스크 이미지를 확보한 후, 면밀히 조사하는 것은 시간이 많이 소요되며 신속한 사건 대응이 필요한 납치, 살인사건과 같은 범죄 유형에는 더욱 어려움이 따른다. 또한 기업 수사에서도 대용량 데이터베이스나 파일 서버 조사에서 나아가 클라우드 환경에서는 디스크 단위의 복제는 불가능하므로 선별 수집한 디지털 증거를 분석에 이용해야 한다. 하지만 다양한 종류의 디지털 증거를 선별 수집하더라도 이를 저장 및 보관하기 위한 표준화된 데이터 포맷이 존재하지 않아 법정에서 증거력을 증명하기 어려운 것이 현실이다. 따라서 본 논문에서는 선별 수집된 다양한 디지털 증거를 보관하기 위한 새로운 증거 보관 포맷을 제시한다. 본문에서 제시하는 디지털 증거 포맷은 다양한 디지털 증거 자료에 활용할 수 있도록 범용성과 확장성에 중심을 두었으며, 일반적인 XML 기술과 압축 파일 포맷을 이용하여 기존 시스템에 적용하기 쉽도록 설계하여 기존 연구들보다 활용하기 쉬운 장점이 있다.

$OakDSPCore^{\circledR}$를 이용한 적응형 다중 비트 (AMR) 음성 부호화기의 실시간 구현 (Real-time Implementation of the AMR Speech Coder Using $OakDSPCore^{\circledR}$)

  • 적응형 다중 비트 (AMR: adaptive multi-rate)은 ETSI (European Telecommunications Standards Institute)에서 채택한 광대역 코드분할 다중화(W-CDMA: wideband cadedivision multiple access)용 음성 부호화표준방식으로서 채널 상태의 변화에 따라 가변적인 전송률을 가진다. 본 논문에서는 적응형 다중 비트 음성 부호화 알고리즘을 분석하고 C프로그램 최적화 과정을 거친 후OakDSPCore/sup R/를 기반으로 설계된 C&S Technology사의 CSD17C00A칩을 이용하여 전과정을 어셈블리어로 실시간 구현하였다. 구현된 코덱은 최대의 계산량을 요구하는6.7 kbps 모드일때 인코더부분이 최대 20.6MIPS이며 디코더부분은 약2.7MIPS의 복잡도를 나타낸다. 사용된 메모리는 약 21.33 kwords, 데이터 RAM메모리는 약 4.25 kwords를 가지며 데이터 ROM메모리는 약 15.1kwords 이다. 구현된 코덱은 최대 약 23.29MIPS의 복잡도를 가지고 있으므로 40MIPS의 성능을 가지는 CSD17C00A를 이용한 보드상에서 실시간 동작이 가능함을 확인하였다. 구현된 프로그램은 ETSI에서 제공하는 21개의 테스트 (test) 벡터를 통하여 bit-exact함을 확인하였다. 그리고 마이크와 스피커를 이용한 실시간 음성 입출력이 음질의 왜곡이나 지연없이 실시간으로 동작함을 확인하였다.

PCITS에 의해 소손된 1Φ 2 W MCCB의 탄화 패턴 및 작동 특성 (Carbonization Patten and Operation Characteristics of a 1Φ 2 W MCCB Damaged by PCITS)

  • 본 연구에서는 대전류공급장치시스템(PCITS)을 이용하여 열동전자식 배선용차단기(MCCB)에 과전류를 인가하였을 때 소손된 패턴을 해석하는 데 있다. MCCB의 트립바가 소손된 상태에서 PCITS로 과전류 150 A를 5 s 동안 흘렀을 때 우측에 위치한 온도 조절 장치의 표면이 심하게 탄화되었다. 동일한 조건에서 300 A의 과전류를 5 s 동안 흘렸을 때 온도 조절 장치의 전체가 열화(劣化)되어 납작하게 밀착되었다. 과전류 450 A를 5 s 동안 흘렸을 때 온도 조절 장치의 코일은 융융 및 단선이 발생하였다. 또한 접점, 외함 및 상부 덮개 등에서 탄화 흔적 및 변형이 확인되었다. 과전류600 A를 공급하고 3 s 정도가 경과되었을 때 MCCB의 내부에서 흰색 연기가 발생하였고, 불꽃이 외부로 방사되었다. 그리고 탁(딱)하는 소리와 동시에 과전류의 공급이 중단되었다. 동일한 MCCB를 일반 화염으로 소손시켰을 때 작동 손잡이, 단자, 소호 장치 및 온도 조절 장치 등의 표면에 탄화가 고르게 형성된 것을 알 수 있다. 또한 작동 기구부의 트립바는 녹아 흘러 내렸으며, 작동 금속핀은 트립 상태로 이동된 것이 확인된다.
