In the era of the Nagoya Protocol, the way researchers have perceived genetic resources needs to change - genetic resources are no longer a common heritage of mankind. Many countries have recently amended their legal systems and are ready to adopt new legal procedures for access and benefit-sharing (ABS) of genetic resources to implement the Nagoya Protocol, claiming their sovereign rights over these resources for research use. Although both Korean government and academics have been striving to respond to the Nagoya Protocol, the understanding of ABS among researchers and the governmental guidelines for the use of genetic resources are not satisfactory yet. Researchers may perceive the implementation of the Nagoya Protocol as another burden for their research. However, it is evident that resource-rich countries are more likely to protect their genetic resources than other countries, and this tendency is expected to last long. Therefore, Korean researchers need to be prepared to minimize any damage that might be caused by ABS. This paper aims to raise awareness of ABS among Korean researchers by reviewing the key contents and overall structure of the Nagoya Protocol. It also identifies ABS procedures and presents specific measures for researchers to respond to the resulting changes in their research environments. Accordingly, this paper will serve as a guide for researchers to conduct research and development in accordance with the Nagoya Protocol.

"Plant genetic resources for food and agriculture" means any genetic material of plant origin of actual or potential value for food and agriculture. "Genetic material" means any material of plant origin, including reproductive and vegetative propagating material, containing functional units of heredity. (Internal Treaty on Plant Genetic Resources for Food and Agriculture, ITPGRFA). The "Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization (ABS) to the Convention on Biological Diversity (shortly Nagoya Protocol)" is a supplementary agreement to the Convention on Biological Diversity. It provides a transparent legal framework for the effective implementation of one of the three objectives of the CBD: the fair and equitable sharing of benefits arising out of the utilization of genetic resources. The Nagoya Protocol on ABS was adopted on 29 October 2010 in Nagoya, Japan and entered into force on 12 October 2014, 90 days after the deposit of the fiftieth instrument of ratification. Its objective is the fair and equitable sharing of benefits arising from the utilization of genetic resources, thereby contributing to the conservation and sustainable use of biodiversity. The Nagoya Protocol will create greater legal certainty and transparency for both providers and users of genetic resources by; (a) Establishing more predictable conditions for access to genetic resources and (b) Helping to ensure benefit-sharing when genetic resources leave the country providing the genetic resources. By helping to ensure benefit-sharing, the Nagoya Protocol creates incentives to conserve and sustainably use genetic resources, and therefore enhances the contribution of biodiversity to development and human well-being. The Nagoya Protocol's success will require effective implementation at the domestic level. A range of tools and mechanisms provided by the Nagoya Protocol will assist contracting Parties including; (a) Establishing national focal points (NFPs) and competent national authorities (CNAs) to serve as contact points for information, grant access or cooperate on issues of compliance, (b) An Access and Benefit-sharing Clearing-House to share information, such as domestic regulatory ABS requirements or information on NFPs and CNAs, (c) Capacity-building to support key aspects of implementation. Based on a country's self-assessment of national needs and priorities, this can include capacity to develop domestic ABS legislation to implement the Nagoya Protocol, to negotiate MAT and to develop in-country research capability and institutions, (d) Awareness-raising, (e) Technology Transfer, (f) Targeted financial support for capacity-building and development initiatives through the Nagoya Protocol's financial mechanism, the Global Environment Facility (GEF) (Nagoya Protocol). The Rural Development Administration (RDA) leading to conduct management agricultural genetic resources following the 'ACT ON THE PRESERVATION, MANAGEMENT AND USE OF AGRO-FISHERY BIO-RESOURCES' established on 2007. According to $2^{nd}$ clause of Article 14 (Designation, Operation, etc. of Agencies Responsible for Agro-Fishery Bioresources) of the act, the duties endowed are, (a) Matters concerning securing, preservation, management, and use of agro-fishery bioresources; (b) Establishment of an integrated information system for agro-fishery bioresources; (c) Matters concerning medium and long-term preservation of, and research on, agro-fishery bioresources; (d) Matters concerning international cooperation for agro-fishery bioresources and other relevant matters. As the result the RDA manage about 246,000 accessions of plant genetic resources under the national management system at the end of 2016.
Objectives : The 10th Conference of the Parties to the Convention on Biological Diversity (COP 10) was held in Nagoya, Japan in October 2010, during which an international convention on access to genetic resources and conventional knowledge and sharing of benefits thereof was adopted. The Oriental Medicine field uses medicinal herbs based on genetic resources, as well as traditional knowledge about genetic resources. As such, if Korea, China and Japan compete over the ownership of such traditional knowledge, it will almost certainly trigger disputes over the payment of royalties among other problems. Notably, since the traditional medicine industry is closely related with China, it is highly likely this will adversely affect Korea's production of medicines using natural materials, including Korean herbal doctors' prescription, formulation and preparation of medicinal herbs. Methods : This study also analyzed the recent situation in Japan, which is the chair nation of the Nagoya Protocol and a member nation like Korea. It analyzed the Japanese people's awareness of the Nagoya Protocol and its strategies in the two years since its adoption, as well as the Guidelines for Genetic Resources, which were newly revised in 2012. Conclusions : The Nagoya Protocol requires the preparation of legislative and administrative measures and policies in order to pave the way for sharing the benefits deriving from the use of genetic resources and the relevant traditional knowledge with the providers of such resources. Thus, corresponding domestic legal measures need to be taken. Such measures include the refining of the procedure of accessing genetic resources, the designation of liaison offices, a competent agency and a supervisory agency, and the building of a system designed to issue internationally acknowledged certificates. It is also important to operate related professional consulting offices, as is the case in Japan. In addition, in the case of genetic resources, there is a need to seek multinational and bilateral cooperation including free trade agreements. Regarding traditional knowledge about genetic resources, measures need to be prepared to enable the three East Asian countries, namely, Korea, China and Japan, to commonly use ancient literature on Oriental medicine and to claim exclusive rights to such intellectual properties. Notably, with China now moving to expand the scope of traditional knowledge through the WIPO, Korea needs to prepare response measures.
최근 생명공학 R&D의 필수 재료인 유전자원에 대한 취득과 그 이용을 규제하는 국제 규범, 즉 나고야의정서가 등장하면서 관련 분야 연구자에게 상당한 불편과 부담이 우려되고 있다. 나고야의정서가 발효함에 따라 그 동안 인류공동유산으로서 마치 공공재처럼 모든 국가가 자유롭게 사용해왔던 유전자원에 대하여 자원 보유국의 배타적 소유권이 인정되면서 자원의 취득과 이용에 대한 각국의 법적 규제가 도입되고 있다. 특히 유전자원의 해외의존도가 높은 우리나라는 보다 체계적인 대응을 해야 할 필요성이 있다. 본 논문은 연구자를 포함한 국내외 유전자원 이용자의 나고야의정서에 대한 인식 제고를 위하여, 먼저 의정서의 주요 핵심내용을 분석하고 해외 유전자원 이용을 위한 접근, 취득 및 이익공유의 전체적인 구조와 흐름을 제시함으로써 향후 적절한 대응에 도움이 될 수 있도록 구성·기술하였다. 나고야의정서에 적절하게 대처하기 위해서는 연구자 본인의 노력과 국가적인 차원에서의 지원이 동시에 필요하다. 우선 연구자는 나고야의정서 체제에서의 연구활동 진행에 관한 전체적인 틀과 각 단계별 구체적인 대응에 관한 이해를 반드시 해야 한다. 이를 토대로 유전자원 접근단계부터 이로 인해 발생한 이익의 공유단계까지 제공국의 ABS 절차에 적절하게 대응해야 한다. 이렇게 볼 때 나고야의정서로 인해 과거 대비 연구활동에 일정부분 제한이 가해지고 연구 외적인 부담이 가중되었다고 할 수 있다. 하지만 전 세계적으로 유전자원에 대한 국가의 주권을 인정하는 현 상황을 일시적인 것으로 보기는 어렵다. 나고야의정서 체제를 중심으로 자국의 유전자원에 대한 주권적 권리를 지키고자 하는 자원부국의 기조가 더 강해질 것이기 때문이다. 따라서 우리나라 환경생태분야 연구자도 본 논문의 내용을 참고하여 불필요한 피해를 입지 않기 위한 대비를 확실히 해야 할 것이다.
나고야의정서 또는 ABS의 목적은 생물유전자원의 이용에 따르는 대가를 실현시킴으로써 생물다양성을 유지하는데 있으나 아직까지 구체적으로 실현된 사례가 드물다. 이는 이익공유 방식을 둘러싼 논란과 생물유전자원 보유국과 이용국 또는 이용기업간의 정보 비대칭이 존재하기 때문이다. 본고에서는 주인-대리인 모형을 이용하여 정보 불확실성 하에서의 이익공유 방식을 분석하였다. 고정지출계약과 매출액 기준 로열티 방식 중 후자의 방식이 생물유전자원의 가치증대와 자원보전 측면에 우수한 인센티브 계약인 것으로 나타났다. 이는 향후 나고야의 정서 하에서 로열티 중심으로 상호협정조건 가이드라인이 마련될 필요가 있음을 시사한다.
유전자원의 접근 및 이익의 공평하고 균등한 공유에 관한 나고야의정서(이하 '의정서'로 지칭함)의 발효에 따라 향후 우리나라의 바이오기업들이 해외 유전자원에 접근하고 이용과정에서 나타날 수 있는 추가적인 경제적 부담을 분석하였다. 의정서 가입에 따라 발생할 수 있는 우리나라 바이오기업들의 추가적인 부담 금액은 우리나라의 바이오산업 규모, 해외 유전자원 의존비율, 로열티 기준 ABS 적용비율을 이용하여 분석하였다. 의정서가 2009년에 발효했다면, 우리나라의 바이오기업들은 2009년 기준으로 국내 이용하는 해외 유전자원에 대한 ABS 비용으로 13억~60억 원을 추가로 지불해야 했다. 그리고 이 금액은 점차 증가하여 2015년에는 136억~639억 원(우리나라 바이오산업시장의 0.01% 이하)을 추가로 지불해야 할 것으로 예측하였다. 이 금액을 볼 때, 우리나라의 의정서 가입은 국내 바이오기업의 매출액 감소폭에 미미한 수준으로 작용할 것으로 보고 있다. 의정서가 발효하면, 의정서의 가입여부와 관계없이 외국의 유전자원을 이용하는 당사자(국)는 PIC 비용과 당사자(유전자원 제공자와 이용자)들 간의 MAT에 의한 ABS 비용을 지불해야 한다. 이 ABS 비용은 우리나라의 당사자와 상대국의 당사자 간의 사적 자치에 의해 결정될 것이다. 반면에 우리나라는 의정서 가입에 따른 유전자원 제공국으로서의 이점을 얻을 수 있다. 외국 기업의 우리 유전자원 이용에 따른 전통지식을 포함한 로열티 이익과 국내 유전자원을 이용한 라이센싱 수익 발생 등이다. 그 외 의정서의 발효 이후, 유전자원의 접근 및 이익 공유에 관한 소송 또는 특허 취소 소송과 규제 등을 포함하는 다양한 사회 경제적 편익을 고려할 때, 의정서 가입과 미가입에 따라 우리나라 바이오산업에 미치는 경제적인 영향 차이는 크지 않을 것으로 보인다.
As the competition for securing cross-border biological sovereignty becomes intensified due to the adoption of the Nagoya Protocol, this study analyzed patent trends only for freshwater plants in order to secure national biological sovereignty. As a result, freshwater plants include a total of 68 genera and 128 species, and a total of 60 genera and 3,256 patents were surveyed. Among them, iris was the most industrialized, 14.71% followed by angelica(8.48%) and Mentha(6.94%). However, unconfirmed eight genera (Aneilema, Artemisia Cabomba, Nymphoides, Pistia stratiotes L., Pseudoraphis Griff., Ruppia) are not patented freshwater plants and it is expected that patent entry is high and barrier is low in the future. Based on patent results, Cooperative Patent Classification analysis was carried out and as a result, a total of 15 industry sectors were derived. And biopharmaceutical(30.24%) was found to be the most industrialized industry sector followed by agricultural chemistry (28.89%), biochemical industry (16.25%). In the biomedical industry, angelica(17.74%) was the most used and Iris (9.55%), Sium(20.56%) and angelica (20.48%) were found to be the most used in agricultural chemistry, biochemical industry and bio food industry, respectively. The analysis of detailed industry fields for 15 industry sectors showed that medicines of unknown structure containing substances from plants (37.77%), raw materials (46.57%) such as insect repellants, attracting agents and preparation of peptides(16.82%) with more than 21 amino acids were most frequently used in biopharmaceutical, agricultural chemistry and biochemical industry, respectively. This study is of significance as a basic data to know which freshwater plants are used in which field in order to secure biological sovereignty and patent analysis is considered necessary to continuously secure the biological sovereignty for freshwater plants.
Objectives : In recent years, the Chinese Government has been providing full support aimed at promoting the excellence of Chinese culture, including Traditional Chinese Medicine (TCM), to the world after recognizing Chinese culture and medicine as elements that can generate national wealth. Methods : In investigating China's awareness of the issues surrounding the intellectual property rights of TCM, as well as its implementation of protective measures, this study analyzed the law and platform policies of the Chinese Government, as well as the designation status of China's intangible cultural heritages and the recent research trend in the TCM field. Results : First, China is taking various protective measures based on laws and institutional devices, including the Patent Act. Second, China is protecting the intellectual property rights of traditional Chinese medicines by registering them as Chinese intangible cultural heritages or UNESCO world heritages. Third, China is seeking to promote TCM throughout the wider world through various research and academic conferences, and by strengthening ties between nations. Conclusions : With the adoption of the international regimes of the WIPO and CBD, and particularly the Nagoya Protocol in 2010, China is seeking to implement measures aimed at maximizing the national interest based on the intellectual property rights of TCM. China began to implement a system of protection of medicinal resources and the related traditional knowledge after recognizing the potential crisis that could occur if Chinese medicine-related patents were taken over by foreign countries. As such, the system now takes various forms.
나고야의정서의 발효로 유전자원을 이용하려는 기업들은 유전자원 이용 이익 공유방안을 제공국과 협상을 통해 결정해야 할뿐만 아니라 유전자원 이용 사업 자체에 대한 투자 의사를 결정해야 한다. 본 연구에서는 유전자원의 이용으로 인한 이익의 공유방안을 샤플리 밸류와 매출액 기준 일정 비율에 의한 방법을 통해 기업의 수익구조에 반영한 후 실물옵션기법을 이용해 유전자원 이용 프로젝트에 대한 경제성을 분석하였다. 그 결과 이익공유 비율과 할인율, 그리고 유전자원의 상품화 시기가 상기 두 분석 방법에 따른 투자임계가격의 순위에 영향을 미치는 것으로 나타났다. 협상을 통해 이익공유 방안에 대해 상호합의된 조건을 도출해야 하는 기업에게는 이와 같은 다양한 방법에 의한 접근과 분석이 협상 시 유용한 참고자료가 될 것이다.
본 논문은 한국 기업들이 나고야 협정을 준수하게 하고 생물다양성을 고려한 경영을 하도록 유도하고자 생물다양성 표시제품에 대한 가상가치법을 사용하여 생물다양성에 대한 소비자 가치를 추정하였다. 본 논문의 연구 가설은 생물다양성 표시제의 사용가치와 존재가치가 소비자 가치의 감정 가치, 조건 가치, 그리고 지식 가치를 통해 소비자의 지불의사액에 긍정적인 영향을 미친다는 것이다. 분석대상 제품은 우유(실용재)와 화장품(선호재)이다. 분석 결과, 생물다양성표시가 있을 경우, 우유는 35.7% 화장품은 6.3%의 추가금액을 지불할 의사가 있는 것으로 분석되었다. 특히, 생물다양성 표시제를 실시한 기업에 대한 영향도를 높게 평가한 사람일수록, 생물다양성 표시에 대한 이해도가 높을수록 추가 지불의사액이 높아짐을 알 수 있었다. 이는 기업이 생물다양성을 고려한 공유가치전략을 실시할 경우, 소비자는 기업의 상품에 더 큰 지불을 할 의향이 있으며 이는 기업이 나고야 협정을 준수하게 하는 유인이 될 수 있음을 암시한다. 또한 생물다양성을 고려한 기업경영이 자리 잡기 위해서는 국가차원에서의 제도에 대한 지속적인 교육과 홍보도 필요함을 시사한다.

회원은 전자우편주소 추출기 등을 이용하여 전자우편주소를 수집 또는 제3자에게 제공할 수 없습니다.
제 6 장 손해배상 및 기타사항
제 18 조 (손해배상)
당 사이트는 무료로 제공되는 서비스와 관련하여 회원에게 어떠한 손해가 발생하더라도 당 사이트가 고의 또는 과실로 인한 손해발생을 제외하고는 이에 대하여 책임을 부담하지 아니합니다.
제 19 조 (관할 법원)
서비스 이용으로 발생한 분쟁에 대해 소송이 제기되는 경우 민사 소송법상의 관할 법원에 제기합니다.
[부 칙]
1. (시행일) 이 약관은 2016년 9월 5일부터 적용되며, 종전 약관은 본 약관으로 대체되며, 개정된 약관의 적용일 이전 가입자도 개정된 약관의 적용을 받습니다.
