광주·전남의 구급대 활동분석 및 발전방안

  • This study is to suggest some developmental policies by analyzing the activities of first aid party in Kwangju and Chonnam regions for two years from Jan. 1, 1991 to the end of December, 1995. First, the residents in Kwangju and Chonnam regions have the sufficient benefits of emergency medical center, but it will be desirable that general hospital should be established and managed in Kohung peninsula which forms the wide island area far away from big cities. Second, the classification of the degree of severe case in the field by rescue members should be strengthened as the means which can reduce the number of patients transferred to the emergency room and the legal method which rescue members can select the medical agency. Third, children less than 10 are most frequent emergent patients and it is due to parent's indifference and children's in sensibility to safety. So the safely education in the course of infant and elementary education should be strengthened and the method which can keep the self safety through the legal system. Fourth, to increase the rate of emergency measure by rescue members, the reasons of fail of emergency treatment are suggested, the treatment results of each rescue member are analyzed every year and it is desirable that the system which can evaluate the personal ability should be introduced. Fifth, the medical accidents occurred in the case of medical act, by rescue members must lake the legal responsibility, but such a problem can he solved with the compensation of insurance system by government. Sixth, to reduce the time required for transfer, traveling service system for the fixed period in beach should be complemented and extended more and service system at ordinary times should be examined at mountains, the area of traffic jams and large special industrial park. Seventh, since service system with one team of two members of 119 rescue party in expressway cannot be mobilized when multiple accidents occur at the same time, it is considered that service system of two teams of four members should be extended. Eighth, first-aid service in expressway is conducted with rescue and emergency treatment by the rescue party at the same time, but the professional rescue lacks and it may result in the injury of patients. Therefore the creation of rescue party in expressway is the urgent problem.

무면허 의료행위 처벌에 관한 고찰 -의료인과 비의료인의 협업관계를 중심으로- (A Study on the Punishment of Unlicensed Medical Practice -Focusing on Collaboration between Medical and Non-medical Personnel-)

  • 오늘날 의료체계는 질병의 치료만을 위한 체계가 아니라 종합적인 건강관리체계(health care system)로 변화하고 있다. 그러나 현행 의료법은 그런 '협업'도 무면허 의료행위라는 일탈행위로 낙인찍고, 의사의 위험관리영역에서 행위한 비의료인은 물론 그와 협업한 의료인까지도 무면허의료행위죄로 처벌하고 있다. 무면허 의료행위를 규제하는 법제도와 의료현실 사이의 간극을 좁히기 위해서는 무면허 의료행위를 이원적이고 국가주의적이며 신분중심적으로 규율하는 구조적 한계를 극복해야 한다. 무면허의료행위죄의 보호법익은 '사람의 생명, 신체'라는 개인적 법익뿐만 아니라 '국가의 의료인면허제도의 유지·보호'라는 국가적 법익으로 이중적 성격을 가지는데, 여기서 유념해야할 것은 형벌을 가하는 본죄들의 규정이 보호하는 법익의 판단기준은 본래 '인격적 법익론'에서 찾아야 한다는 점이다. 그리고 어떤 행위가 의료행위인지 그리고 그 위험성을 판단할 때 행위의 주체(신분)에 편중하지 않고 행위와 수단의 차원을 함께 빠짐없이 형평성 있게 고려해야 한다. 즉 그 행위로 인해 초래될 수 있는 부작용의 위험이 합리적으로 관리되고 있는지에 따라 무면허의료행위에 해당되는지 여부가 좌우되어야 할 것이다. 의료의 본질이 치료자와 환자 간의 상호신뢰와 상호이해가 되어야 함을 일깨우는 치료적 대화의 지평을 고려할 때, 의료법 정책은 다원적 의료인격들 사이에서 일어나는 협업의 가능성을 원천적으로 차단하지 않는 방향으로 나아가야 바람직하다고 할 것이다.

한방의료에 대한 인식 및 만족도 조사 (The Research about Recognition and Satisfaction on Korean Medicine)

  • Object: Recently, demend for Korean Medicine have been rapidly increasing in Korea. However, there are still a few studies for recognition, satisfaction and satisfaction factors of Korean Medicine to increase competitiveness of Korean-Medical service. Thus, the purpose of this study is to grope ways to strengthen the competitiveness of Korean-Medical service by investigating recognition and satisfaction factors on Korean medicine. Method: People who have been experienced Korean Medicine were targets of investigation. Questionnaire was consisted of questions about awareness for the Korean Medicine, awareness of Korean-Medical treatment, satisfaction level for Korean Medicine, satisfaction and dissatisfaction factors. This questionnaires were conducted through personal interviews. Result: Total 315 members responded to the survey and the results of the analysis were as follows. 1. Korean Medicine treatment was recognized as the scientific medical act to protect human body wellness. 2. Korean-Medical service can be represented by acupuncture and moxibustion therapy, physical therapy, Korean medicine. And care for diseases such as pain disorders, chronic fatigue, anti-aging, and geriatric disease were wanted. 3. The factors that influence on satisfaction of the Medical Services was the perception that Korean Medicine is scientific and safe. Conclusion: To strengthen the competitiveness of Korean-Medical service, first, efforts to enhance the effectiveness of the basic treatment such as acupuncture and moxibustion, herbal medicine are required. Second, scientific development of Korean Medicine is necessary. Finally, the effort to offer various services of Korean Medicine are needed.

보건의료관련 법률의 진료거부금지에 관한 규정이 의료계약에서 계약의 자유를 제한하는지에 관하여 (The Prohibition Against Medical Refusal and the Principle of Private Autonomy in Medical Contracts)

  • 본 논문에서는 민법전에 의료계약에 관한 규정을 신설하기 위한 논의의 과정에서 의료관련 법률의 진료거부금지 규정과 의료계약에서 계약자유의 원칙의 관계를 검토하였다. 그 내용은 다음과 같다. 의료법의 진료거부금지 규정이 의료계약 체약의 자유를 제한하는 것은 아니다. 환자의 요청에 따른 진료개시와 진료개시 후 의학적 판단에 기초한 의료내용의 결정과 진료비에 대한 협의 하에 체결되는 의료계약의 성립은 구별된다. 반면 진료거부금지 규정으로 의료계약 해지의 자유는 제한된다. 의료계약은 전문가인 의료인과 자신의 생명·신체에 대한 처분을 전문가에게 맡긴 환자의 신뢰에 기초한 것이기 때문에 신뢰가 깨지면 계약을 해지할 수 있을 것이다. 그러나 계약의 해지로 환자의 생명·신체에 불이익을 주어서는 안 되기 때문에, 의료계약의 해지에는 일정한 제한을 두어야 할 것이다. 의료계약의 체약을 강제하고 정당한 사유가 있는 때에만 계약을 해지할 수 있도록 하는 것이 현재 의료법의 태도이다. 민법전의 의료계약에 관한 규정에서는 의료계약 해지의 자유를 인정하되, 일정한 경우에 계약의 해지를 제한하는 방향을 제시하였다. 계약의 해지를 위한 정당한 사유가 인정되고, 환자가 다른 의료인으로부터 진료를 받을 수 없는 등 불리한 시기가 아닌 경우에 계약의 해지를 인정한다. 의료법의 진료거부금지의무 위반에 대한 처벌규정을 삭제하고, 계약법의 문제로 옮겨와야 할 것이다. 진료를 거부한 행위 자체에 대해서는 국민건강보험법의 요양급여거절의무에 따른 행정제재로 규율하여야 할 것이다.

노인복지 관련법제의 발전방향 (A Study on Improvement of Laws regarding Welfare for the Aged)

  • 평균수명의 증가 및 출산율의 저하와 함께 수반되는 급격한 인구고령화는 단기간에 우리나라의 경제 사회 문화 전 분야에 걸쳐 중대한 변화를 야기하고 있다. 단순히 노인의 비율이 늘어나는 것뿐만 아니라 평균수명이 계속해서 증가하여 많은 국민들이 장기간의 노후생활을 영위해야 하는 상황이다. 이와 같은 배경에서 노인들이 인간으로서의 존엄과 가치를 유지하면서 품위 있게 인생을 마무리할 수 있도록 노인복지 관련법제의 역할과 기능이 특별히 강조될 수밖에 없으며, 사회보험 및 공공부조와 기능적 연계성을 토대로 사회복지서비스를 목적으로 하는 노인복지법의 역할도 점차 중요해지고 있다. 노인복지법은 노인을 위한 사회복지서비스의 내용을 제시하고 있는데, 그중에서도 소득보장, 보건의료서비스, 요양 및 주거복지를 중심으로 하는 복지조치 그리고 일자리 등 사회참여지원 등을 핵심요소로 하며, 그와 같은 복지서비스의 유기적 결합을 통하여 노인이 살아가는데 적합한 생활조건을 실현할 수 있게 된다. 이를 위하여 노인복지법은 기초노령연금법과 노인장기요양보험법 등 관련법제와 밀접한 규범적 네트워크를 형성하면서 효율적인 노인복지시스템을 구축하게 된다. 그러나 우리 현행 노인복지법 및 관련법제는 21세기의 고령사회, 장수사회를 대비하는데 여전히 미흡하다고 하지 않을 수 없다. 노후소득보장과 다양하고 수준 높은 노인의 사회참여의 결합, 보건 의료와 요양의 효율적 연계 및 국가 또는 지방자치단체의 비용부담수준, 복지조치의 효과성 제고를 통한 품위 있고 존중받는 노인복지의 실현을 위해 더 많은 노인들을 포괄할 수 있는 다양하고 구체적인 개선방안이 마련되어야 할 것이다.

병원 의사결정지원시스템의 서비스 품질이 경영성과에 미치는 영향 : K대병원 사례 중심으로 (A Study on the Effects of the Service Quality of Hospital's Decision Support System on Management Performance : the Case of K-University Hospital)

  • Recently, due to external environment like the changes in health policy and various healthcare accreditations, along with hospital's internal efforts to improve the quality of medical services, demands for the development of medical information systems are increasing. Some examples are clinical information like DUR (Drug Utilization Review), CVR (Critical Value Report), and automatic benefit processing by treatment purposes, or hospital DSS (Decision Support System) on overall medical practice. Such systems act as a guide in making clinic judgments during practice or in other medical practice, and their effects on the medical treatment improvements are being proven by previous studies. In the reality of increasing attention in the effects of medical treatment improvement, studies related to hospital DDS were mostly focused on clinical, technical, and engineering points of view, and studies focusing on the user viewpoint are very limited. In order to verify the effects of DSS on practice improvements and hospital's management performance, this study used a research model constructed to verify how SERVQUAL of hospital DSS affects hospital management performance in BSC (Balanced Score Card) point of view. To empirically verify the research model, a questionnaire was conducted on the basis of "K-University Hospital's DSS" on clinicians and hospital employees related to system development, and the relationships between the factors were analyzed through path analysis. As a result of path analysis, excluding reactivity, tangibility, confidence, reliability, empathy among service qualities, had partially significant effects on management performance factors (learning and growth, internal process, financial affairs). This study is to prepare the theoretical ground on the management performance analysis of hospital DSS, and suggest the service quality of the system that should be considered in the planning and development stages for improved system.

의료분쟁조정법안(약칭)의 민사법적 고찰 (A Study on the Medical Dispute Arbitration Law in Terms of Civil Law)

  • Medical Dispute Arbitration Law had been debated on its legislation several times since Korean Medical Association's submission of the bill to the National Assembly in 1988, eventually in December, 2009, passed the National Assembly Standing Committee and was laid before the Legislation and Judiciary Committee, and thus its legislation is now near at hand. During the long process, it has provided a hot issue with our society. And yet, Medical Dispute Arbitration Law has differed considerably in legislative content depending on the main body of proceeding the enactment, which subsequently was given the mixed comments of 'Act on Malpractice-related Damage Relief' or 'Medical Indemnity Act', and this legislative bill also cannot be free from this debate. It is desirable that medical disputes between doctors and patients be resolved through conciliation between the parties concerned. But, because reaching a compromise is difficult owing to deep emotional conflicts between the parties, difficulties in investigating a cause and requiring a high amount of settlement money, etc., it is inevitable to seek a resolution by third party intervention. By the way, such an arbitration by third party is based on the compromise of the interested parties and thus has a limitation of not being able to satisfy both parties completely. Therefore, the legislative bill made for arbitration of medical disputes between the parties will have to prepare an institutional system for the parties to easily understand and accept. Also, problems occurred in the legislative bill will have to be corrected through an in-depth discussion in order for the legislative bill to work as an effective system.

간호사의 법적 책임에 관한 연구 (A Study on the Legal Responsibility of Nurse)

  • As the number of medical disputes regarding nurses has increased after medical disputes have increase, there is a need for a study on it. However, the legal relationship between nurses and patients has not yet been analyzed. Recently, the role and function of nurses are expanded according to the development of the science of nursing; moreover their activity and limitation of responsibility are also expanded. For this reason, the medical disputes regarding nurses have been increasing. However, the majority of these kind of dispute are just passed over because their practice is usually considered to be a mere action to assist doctor's role. In addition, nurse practice is not a secondary action of doctor's role, but forms part of a medical treatment. Of course, nurses handle many secondary tasks after doctors finish their medical treatment. But this is only part of the whole tasks of nurses. Furthermore, the general details of their medical treatment are not different from those of doctors because they also belong to the medical service personnel. Considering these features of nurse and the medical condition in South Korea, their task is becoming increasingly developed and specialized and they are also establishing their own field. With this stream of times, there is a growing interest in enacting a Nursing Practice Act, in other words, the independent law on nurse for the sake of patient safety and national health promotion. Then, their responsibility will distinctly be expanded as much more. That is, the time that nurses practice their medical care by following doctors' order and also pass over their responsibility to doctors is closed. Thus, this study examines the features and responsibilities of nursing practice, and discusses an institutional framework to efficiently cope with the legal disputes between nurses and patients. It aims to throw light on the decision making on nurse-patient disputes in future.

방사선사법 제정의 필요성 (The Necessity of Redefining the Radiological Technologist Independent Law)

  • According to the changes of the medical environment of the times, it is necessary to discuss the issues of the doctor's medical guidance and to conduct continuous research so that alternatives can be prepared systematically. Furthermore, in order to enhance the professionalism of radiological technologists and to develop the medical technician system, the new Radiological Technologist Independent Act has been established, which contains the overall contents of the scope of work, professional qualifications, and specialized education of radiological technologists, and provides quality medical services to patients through professional procedures and treatment. In order to increase the level of medical care, the purpose, definition, mission, role, and scope of work specified in the Medical Act, Medical Service Technologists, etc. Act, the Enforcement Decree, and the Enforcement Rules were variously analyzed and new directions were presented. First, the definition of a medical technician should use a generic term so that the factors of conflict and prejudice could be resolved. Second, change the doctor's guide to doctor's prescription; and then legislate the authority to sign and write medical records after examination by radiological technologists, thereby prohibiting unlicensed technicians that seriously endanger patient safety. Third, an accurate definition of radiological technologists' roles should be established; not only selection and management of radiological technologists' work but also procedures and treatment for each radiology field should be specified to suit the current medical system. Fourth, a professional radiological technologists' qualification system and a specialized education system should be established in order to secure human resources that could provide patients trust in procedures and treatment based on professional knowledge and experience in the field of radiology. Fifth, the Education and Evaluation Institute should be operated in Korea education system to educate the professional knowledge and competency for students. In addition, it is necessary to in-depth analysis of foreign cases could be applied to the medical system and education system in Korea; it could strive to nurture systematic human resources.

구급대원의 임파워링 리더십과 성장욕구 및 이직의도와의 상관관계에 관한 연구 (A study on correlation between empowering leadership, growth needs and turnover intentions in 119 emergency medical technicians)

  • Purpose: The purpose of this study is to investigate how empowering leadership effects on growth needs and turnover intentions to emergency medical technicians. Methods: The study was based on seventy six paramedics and seventy EMTs-basic who were working at the fire stations. A survey questionnaire was used to prove connection between empowering leadership, growth needs, and turnover intentions. Results: There was a positive correlation between empowering leadership and growth needs, and negative correlation between empowering leadership and turnover intentions. There was a positive correlation between emergency medical technicians growth needs and turnover intentions. Conclusion: This analysis is empirically applied to study the empowering leadership focused on the empowerment act of leader to a leading role to empowerment in fire service organization.
