A Study on the Settlement of Dispute through ODR Dispute Mediation System (ODR 분쟁조정시스템 활용을 통한 분쟁해결에 관한 연구)

  • As the Internet settles down as a general means, every year the domestic e-commerce transaction using the internet rapidly increases in its scale, and the conflicts occurred from the e-commerce largely grow as well. However, it is true that the clear settlement means to work out such conflicts is not established yet. Considering the feature of e-commerce, it would be better to resolve them by ADR rather than by lawsuits in the court, and in addition to it, the ODR system having sweetness as its advantage will be the optimized model. But to make the ODR settled down, there are many assignments to be improved in many aspects afterwards. In case of our country also, since the ODR system is still its early developing step, it is not activized yet due to its weak technical, lawful environments. Thus, currently, it is unavoidable to operate the dispute mediation system, carrying out a system by the existing Off-line together, and thereby, as we replace the parts worked out by the Off-line with by the On-line, we must try to develop it into a quick, cheap, and reliable dispute settlement system.

Muslim Consumer's Identification with and Loyalty to Halal Brand

  • Purpose - This research aimed at exploring the mediation role of Muslim's identification with halal brand in the effects of the congruity between Islamic self and halal brand and Islamism commitment on the loyalty to the brand. Research design, data, and methodology - A single factor design was employed. A total of 199 undergraduate, graduate students or office workers in Bangladesh participated in main survey to finish the questionnaire. Structural equation model analysis was used to verify hypotheses. Results - The results of verifying hypotheses were as followings. First, the Muslim's identification with halal brand positively affected on the loyalty to the halal brand. Second, Both Muslim's commitment to Islamism and the congruity between Islamic self and halal brand positively affected on the identification with the halal brand. Third, mediation analysis showed the partial mediation role of Muslim's identification with halal brand in the effects of the Islamism commitment on the loyalty to the halal brand, and there was the full mediation role of the Muslim's identification in the effect of the congruity on the loyalty. Conclusions - Marketers should build the congruity between Islamic self and their halal brand and promote Islamism commitment to induce the loyalty to the halal brand from Muslim.

  • On February 4, 2020, the Personal Information Protection Act ("Privacy Act") was amended to facilitate the convergence and utilization of data, a key resource of the Fourth Industrial Revolution, and to support the development of the data industry. As the scope of the law applies to telecommunications operators, financial operators, and personal information processing providers, the scope of related dispute settlement is expected to increase. Therefore, this paper first introduces the role and function of the Personal Information Dispute Committee and the institutional standards for personal information dispute mediation, and researches the roles and issues that the Personal Information Dispute Mediation Committee should play in accordance with the revision of the Data 3 Law. In this study, For efficient operation of personal information dispute mediation, expert deliberation by field, new adjustment criteria for new industrial technologies, way to secure business continuity between the Personal Information Dispute Committee and the Personal Information Committee, Secure the link between the mediation decision and courts, and Suggested the strengthening of the operational standards for collective dispute mediation.

The Differential Effects of Giving and Receiving Social Support on Self-esteem in the Elderly: The Focus on the Mediation effects of Meaning in Life (노년기 사회적 지지제공과 지지받기가 자기존중감에 미치는 차별적 영향: 삶의 의미 매개효과를 중심으로)

  • The current study examined the differential effects of giving and receiving social support in the elderly when relationships(family, friend/neighbor) are important. For this purpose, the mediation effects of meaning in life on the relationship between giving and receiving social support and self-esteem were analyzed. Self-reporting data of 310 adults aged over 60 living in Busan and Gyeongnam in South Korea were collected regarding giving and receiving social support, meaning of life and self-esteem. The mediation analysis showed that giving social support had a positive effect on self-esteem with the partial mediation effect of meaning in life. Receiving social support, however, showed no significant mediation effect of meaning in life. This pattern was similar regardless of both family and non-family relations. The result that giving social support enhances self-worth in the elderly through meaning in life suggests the importance of social interaction with intimate others as a source of happiness in the elderly.

Effect of Organizational Culture Perception on Job Performance of Welfare Centers Workers for the Disabled: Testing of Mediation Effect of Intellectual Capital (장애인복지관 종사자의 조직문화 인식이 직무성과에 미치는 영향: 지적자본의 매개효과 검증)

  • The purpose of this study is to investigate whether organizational culture perception affect the intellectual capital and job performance. And the empirical analysis on the mediation effect of intellectual capital between organizational culture and job performance is done. Result of the analysis is as follows. First of all, development culture has a negative relationship with job performance. Secondly, group culture has a positive relationship with intellectual capital. Thirdly, as for the mediation relationship of intellectual capital between organizational culture and job performance, there is a partial mediation effect in the relationship between development culture and job performance, and a complete mediation effect between group culture and job performance. Those analysis results suggests that welfare centers workers for the disabled in organizational culture perception should be taken considerations on various measures utilizing intellectual capital to improve job performance.

How Does the Presentation Mode of Product Information Affect Product Evaluation? : The Mediation of Construal Level and the Moderation of Response Time

  • The purpose of this study was to examine how the presentation mode (sequential- vs. simultaneous-mode) of information influences its evaluation. Three experiments revealed the interaction effect between the presentation mode and the valence of the product information. When respondents read about the positive aspects of the product, the evaluation was higher in the simultaneous presentation mode than in the sequential presentation mode. For negative product information, respondents' evaluation was higher in the sequential presentation mode than in the simultaneous presentation mode. The simultaneous presentation mode intensified the impact of the information valence on evaluation. This study proposed that the sequential and the simultaneous presentation modes prime high and low construal levels, respectively. The mediation analysis provides support for such a prediction. Finally, the mediating effect of construal levels in evaluation was shown to disappear when respondents focused on the product information for a longer duration, while the mediation effect remained when the response time was short.

The Influence of Organizational Justice on Employees' Motivation to Participate in Training: A Quality System Perspective on Human Resource Practices

  • This study sought to examine the effect of three (distributive, procedural, and interactional) justice perceptions in predicting employees' motivation to participate in training activities. On the basis of theoretical linkages between the constructs, full mediation and partial mediation models by perceived benefits of training were developed. The models were tested using SEM (Structural Equation Modeling) on responses from 302 employees of three wireless operators in the Republic of Korea. The results showed the partial-mediation model is a dominant model. It also confirmed that interactional justice directly influence motivation to participate in training, whereas procedural justice influence the variable through perceived benefits of training. Furthermore, limitations and implications of the current study and directions for future work are discussed.

The Problems and Reform Measures of Conflict Resolutions related to Constructions through ADR (ADR 에 의한 건설분쟁해결의 문제점과 개선방안)

  • There are two methods to resolve conflicts related to constructions which are through lawsuits and ADR (Alternative Dispute Resolution) just like any other conflicts. Along with the special characteristics pertaining to the conflicts related to constructions, the advantages that ADR is in possession of such as its cost, duration and professionalism, resolving conflicts through ADR has been considered to be more logical than any other options recently. In Korea's case at present, the resolution of conflicts regarding constructions through ADR is mostly dependent on administrative mediation or through arbitration. However, in the case of the administrative mediation, its usage rate is very low due to problems caused by problems in its running and effectiveness. In the case of arbitration, the services of the Korean Commercial Arbitration Board is comparatively used more but because of the fact that arbitration relies on a single trial system and the fact that its executive powers while having the same effectiveness as the final ruling does not get acknowledged leads to the phenomena of avoiding its usage. In addition, in relation to the selective arbitration clause, the problem of effectiveness of the arbitrative agreement is becoming a hindrance to the activation and promotion of the arbitration process. Furthermore, in the case where the ordering body is the government, the public servant involved in the case avoiding the arbitration process because of concerns of being penalized by the internal and external audit within the institution is becoming a problem as well. These problems are not only limited to conflicts regarding constructions and there needs to be actions taken to promote the activation of ADR by enacting a basic law. The more important issue at hand however is offering a resolution measure that would be the most appropriate for users and this could probably be done only through actions such as implementing the American partnering system or the dispute adjudication board system so that they can supervise the resolution of conflicts through mediation, arbitration, and assistance as well as offering consultations regarding conflicts related to constructions.

Technology Innovation Activity and Default Risk of Firms : Focusing on a Mediation Effect of Profitability (기술혁신활동이 부도위험에 미치는 영향 : 수익성 매개효과를 중심으로)

  • This study explores the effects of technology innovation activity on a profitability and the default risk of firms. Sample for this study consists of manufacturing firms listed on the Korea Stock Exchange from 1st January 2000 to 31st December 2007. We use of R&D ratio as a proxy of technology innovation activity. The default probability proxied for the default risk of firms is measured by the Merton's (1974) model where accounts for a market value of firms and a volatility of it. This study provides evidence that technology innovation activity has a positive effect on a profitability, but a negative effect on the default risk of firms. Our study also finds the significant mediation effect of profitability that the enhancement in profitability resulting from technology innovation activity lowers the default risk of firms.

How Brand Equity Factors Shapes Smartphone Purchase Intentions Among Millennials in Nepal

  • Purpose: This study explores the factors affecting purchase intention of smartphones among millennials. The study incorporates factors of brand equity, specifically brand awareness, brand loyalty, perceived quality and their mediation effect in purchase intention. Research design, data, and methodology: This study evaluates the role of brand equity factors in influencing purchase intentions by using structural equation modeling to analyze 197 respondents. Results: The findings indicate that brand loyalty, followed by brand awareness, and perceived quality are significant factors in determining customer purchase intention. Further, brand loyalty mediates the relationship between perceived quality and purchase intention, as well as between brand awareness and purchase intention significantly. Additionally, perceived quality mediates the relationship between brand awareness and purchase intention significantly. Finally, the serial mediation of perceived quality and brand loyalty significantly affects the relationship between brand awareness and purchase intention. Conclusions: This research has provided valuable insights into the relationship between brand equity and purchase intention among millennials supporting the Aaker's Model. Useful theoretical and managerial implications also have been provided.
