  • 중국의 새로운 해양정책법(Maritime Policy Law: MPL)은 중국해안경비대 등의 중국 해양경찰 기관들의 임무를 규제하고, 중국의 주권, 안보, 권리, 이해관계를 보호한다고 주장한다. [하지만] 중국이 본토 주위 및 남중국해에서 넓은 해역에 대한 권리를 주장하고 있다는 점에서, MPL은 훨씬 광범위하게 적용될 수 있다. 중국이 제기하는 대부분의 해양 주장이 국제법에 부합하지 않는다는 점을 고려하면, 이렇게 해양법 집행 관할권을 광범위하게 적용하는 것은 문제의 소지가 많다. MPL이 분쟁해역 또는 공해에서 외국선적 선박에 대한 관할권을 주장한다면, 이는 국제법 위반이다. 무력 사용에 관한 MPL의 많은 규정 역시, 해양법 집행 관할권의 사용에 관한 국제 규칙 및 기준을 위반한 것이며, 모든 국가의 영토 온전성이나 정치적 독립성에 반하는 위협이나 무력사용을 금하는 유엔헌장에도 위배된다. 중국은 MPL을 남중국해와 동중국해에서 불법적인 영토 및 해양 주장을 제기하기 위한 구실로 사용할 수 있으며, 다른 연안국의 배타적경제수역 내 자원 권리 행사를 방해하기 위한 구실로도 사용할 수 있다.

A Study on Chinese Special Regulations Concerning the Maritime Claims

  • Under Chinese law system, the maritime law is a special branch of the civil law. For this reason, the maritime litigation shall be governed correspondently by the civil prodecure law. However, since the maritime litigation has its own special prodecure which is different from that of general procedure, there must be some special regulations to be a supplement to the civil procedure law. In this paper, a study is made on such regulations which are "The Regulations Relating to the arrest of Ships Before Litigation" and "The Regulations Concerning the Auction of Ships Which Have Been Arrested by Maritime Court for Clearing off the Debts" The aim of this paper is to describe the basic principles established in the regulations mentioned above in order to make the people who are unfamiliar with Chinese maritime legislation to be understood about Chinese special procedure adopted in maritime litigation.maritime litigation.

중국 해상법집행기관조직 개편과 한·중 해양협력 (China's Reorganization of Maritime Law Enforcement Administrations and ROK-China Maritime Cooperation)

  • China National People's Congress has passed the bill to combine the Marine Law Enforcement into "State Oceanic Administration People's Republic of China". This bill was intended to resolve the overlapping jurisdiction and disputes caused in ocean territory in nearby countries. The purpose of reorganizing the administration was to combine the dispersed organization into one group. This new big administration was basically organized to increase the power of China marine state on the long-term. The reorganization plan is to group General Administration of Customs, China Marine Surveillance, Fisheries Law Enforcement Command, and Border Control Department into one State Oceanic Administration. The new state Oceanic Administration carries the authority to protect rights and enforce the marine law supported by Public Security Bureau. Korea Coast Guard has been cooperating with China Marine Surveillance since 1998 when the first pact was made. The next step expanded to General Administration of Customs. Currently working with Regional Maritime Law Enforcement organizations dealing mostly with illegal Chinese fishing boats and IEODO conflict. In order to solve the problems we face today is to observe the process of the New China Coast Guard administration, analysing the effects that could be caused by the change and to keep close cooperation between the new administrations.

  • 해상노동법이란 선원의 노동에 관한 일체의 관계를 규율하는 법제도의 전체를 말한다. 해상노동이 육상노동과 구별되는 특수성으로는 위험성, 고립성, 책임의 중대성, 이사회성 등을 들 수 있다. 이러한 해상노동만이 가지는 특수성을 충분히 고려한 해사노동기준이 마련되어야, 선원의 지위 향상과 권익 보호를 실질적으로 달성할 수 있다. 선박 자체가 국제성이 강하므로, 그곳에서 이루어지는 해상노동 역시 매우 국제성이 강하다 그러므로 어느 나라에서 해상노동에 관한 입법을 할 때에는 국제적 관계를 충분히 고려하여야 한다. 따라서 이 논문은 해상노동법의 판단에 관한 사적 연구를 통하여 그 입법 정신을 밝히고, 이에 관한 국내법 제정지침을 제시하고자 한다.

The Ship in the New Saudi Commercial Maritime Law

  • The new commercial maritime law in the Kingdom came comprehensive and detailed for all topics related to commercial maritime navigation, thus responding to most of the problems that arise in the field, specifically regarding the ship as the focus of the rules of maritime law. This system defines the ship in law, regulates its civil status, determines how to name it, determine its domicile, and the conditions for acquiring Saudi nationality. It also contained a regulation of the rights granted to ships by ownership, as well as their lease and mortgage, the mechanism of attachment to them to settle debts and the rights in kind dependent on them and controlling the rights of third parties on ships and the procedures for forcibly selling them from precautionary seizure and executive seizure and then forced sale in public auction. Until this research was an effort to present a clear picture about the legal system of the ship in the new Saudi commercial maritime system and confirming the extent of the success of the Saudi legislator with the ship system in highlighting the legal frameworks for this facility prepared for maritime navigation.

중국의 해상교통안전법 (The Maritime Traffic Safety Law of P.R. China)

  • The Maritime Traffic Safety Law of P. R. China has not the legal nature of navigation rule which regulates the vessel traffic directly but has the legal nature of management to ensure the safety and good order of the whale marine traffic. For that reason, the legal status of this Law is a general basic norm for the marine safety regulations rather than a definite enforcement regulation. This Law does not have any clear statements on adaptation of the steering and sailing rules of the International Regulations for Preventing Collisions at Sea, but it can be presumed the Convention would be applied on the viewpoint of the international practice. The subject matter of this Law is easily understandable, because the IMO and shipping countries have already made similar legislation. Since the maritime traffic condition of the P. R. China also has a direct effect upon the Korean coastal waters, it is essential to observe closely the process of enforcement and development of the P. R. China's Maritime Traffic Safety Law.

독도(獨島)의 실효적(實效的) 지배(支配)와 해양(海洋) 전략자산(戰略資産)으로서의 국제법(國際法) (The Legal Definition of Effective Control and Dokdo Issue: International Law as Critical Asset of National Maritime Strategy)

  • Dokdo issue reaches beyond economic and security interest to Koreans, as it is regarded as symbol of her independence. Albeit the fact that Japan has merely no legitimate title over Dokdo, Japan has been tenaciously insisting their jurisdiction over Dokdo since the independence of Korea. Under such circumstances, public outrage towards Japan is most certainly understandable. Yet, mere outrage itself, lacking in logic and factual grounds, can contribute little if not any, to the desirable solution of the problem. Precedents reveal that dealing maritime issues amid lack of profound understanding in international law has often led to undesirable results, such as the inclusion of Dokdo in the Joint Management Fisheries Zone in 1999 Korea-Japan Fisheries Agreement. In a sense, adroit use of international law is a critical element in preserving Korea's sovereign rights against persistent Japanese plans to rob Dokdo once again. The Dokdo issue is inextricably bound to international law; the legal status of Dokdo as island, the equitable solution of maritime boundary delimitation and effective control, existence of dispute. Yet, the public policies and arguments made by pundits are generally in lack of understanding in international law. It is now the time for Korea to commence on long-term cross-academia / department plans to establish Dokdo strategy as part of the nationwide maritime strategy effectively using international law as its stronghold.

일본의 해양기본법 제정과 우리의 대응방안 연구 -한중일 해양행정체계 비교를 중심으로- (A Study on the Analysis of Japan's Basic Ocean Law and Policy of Korea -The Case of Korea, Japan and China on the Administrative System for Ocean-)

  • Japan's new Basic Ocean Law took effect in 20 July 2007. This law contains that 1) calls for the consolidation of eight government offices that previously worked separately on maritime issues; 2) establishes a basic plan for maritime matters, and; 3) creates a comprehensive maritime policy headquarters, run by the Prime Minister. The result is a structure for the integrated promotion of maritime policy. The Minister of Land, Infrastructure and Transport has been appointed to the newly established position of maritime minister. Japan has been in conflict with Korea and China over EEZ and territory, which has caused the country to turn to ocean. If Japan puts more emphasis on sea, it will be on a collision course with neighboring countries such as Korea, China, Russia, and Taiwan. Japan has been at odds with these countries; with Korea over Dokdo islets, with China over the Senkaku Islands and the East China Sea, where gas fields lie, with Taiwan over fishery rights in the East China Sea, with Russia over the Kuril Islands. Korea's position about the establishment of Japan's new Basic Ocean Law is followed: 1) expression of Korea's position in maritime resourcces of east china sea, 2) understand of strategy for maritime resources development and maritime delimitation in China and Japan, 3) a caution for extention of EEZ and maritime activities, 4)effective and comprehensive policy establishment, and strength in R&D, 5) construction of active and responsive system for maritime issues in neighbor country.

자율운항선박의 해양사고 발생에 따른 해상법적 고찰 (A Study on the Maritime Law According to the Occurrence of Marine Accidents of MASS(Maritime Autonomous Surface Ship))

  • 정보통신기술(ICT) 및 인공지능(AI) 기술 산업의 급격한 발전에 따라 먼 미래로만 생각했던 자율운항선박의 등장이 최근들어 현실로 다가오고 있다. 이러한 급격한 기술의 발전과 더불어 해양법 분야에서의 해사안전, 해양환경보호, 해양질서유지 등의 공법(公法)분야분만 아니라 책임, 손해배상, 해상보험 등 사법(私法)분야에서의 변화 또한 필수불가결하게 되었다. 특히 선원이 승선하지 않는 자율운항선박이라는 새로운 형태의 선박의 등장으로 해양사고 발생 시 책임, 손해배상, 보험계약 등의 그 유형과 종류 또한 달라질 것이다. 이 논문에서는 먼저 자율운항선박의 개념, 분류, 효과 및 미래에 대한 일반적 이론 및 자율운항선박 논의를 위한 해상법의 개념과 해상법상 각종 의무와 책임에 대한 일반적 이론을 살펴본다. 다음으로 자율운항선박의 해양사고 발생 시 선박으로서 지위, 용선 계약상의 법률관계, 감항능력주의의무, 책임의 주체 및 손해배상책임과 면책에 대한 쟁점 사항을 해상법적 관점에서 검토한다. 아울러 향후 자율운항선박 4단계에서 해양사고 발생 시 책임의 귀속 주체와 기준을 명확히 하기 위한 추가적인 연구의 필요성과 더불어 이를 위한 기술개발·법령정비·자금지원 등 제도적 개선의 필요성을 제시한다.
