발달장애인 권리보장 및 지원에 관한 법률과 지방자치단체 유사조례 간의 연계성과 자치성에 관한 연구 (A Study on the Correspondence and the Autonomy between the Act on the Guarantee of Rights of and Support for Persons with Developmental Disabilities and the Similar Ordinances of the Local Governments)

  • 본 연구는 발달장애인 권리보장 및 지원에 관한 법률과 이를 모법으로 하는 지방자치단체의 유사 조례간 연계성(일치성) 및 자치성(차별성)을 분석하였다. 2017년 10월 기준으로 조회된 전국 63개의 지자체 조례와 발달장애인법을 분석 대상으로 하여 모법의 조항별 내용을 기준으로 조례와의 일치성을 분석하였고 자치성은 조례의 내용적 측면에서 모법과 다른 사례가 있는지 행정적 측면에서 이행 의지를 보다 강조한 사례가 있는지 내용분석으로 시행하였다. 분석 결과 첫째, 모법의 조례 반영률은 조항별로 다르게 나타났는데, 복지지원을 강조하는 측면에서 일치율이 높았고 발달장애인의 권리 보장은 조례상 반영률이 낮았다. 이는 발달장애인을 보호적 관점에서 보는 법적 제도적 특징을 보이는 증거로 볼 수 있다. 향후에는 발달장애인 당사자의 의사결정에 대한 존중이나 권리보장에 관한 내용이 조례에 적극적으로 포함될 수 있도록 하는 정책방안이 필요하다. 둘째, 조례 반영률이 0%인 조항도 있었는데, 해당 지역에서 타법에 의해 보장될 수도 있기에 지역 내 관련 제도의 부재를 의미하지는 않으나 제도적 사각지대의 가능성이 있다. 향후에는 발달장애인 관련 지역 내 여타 법제도와의 상보성에 관한 검토가 이루어져 제도적 사각지대에 발달장애인이 놓이지 않도록 해야 할 것이다. 셋째, 지역의 자치성이 내용적 측면 및 실질적 이행을 돕는 행정적 측면에서 검토되었다. 단체장의 책무를 강조하거나 실태조사를 강조하거나 복지위원회 운영을 명시하거나 모법상에 없는 내용을 추가적으로 조례에서 담아내고 있기도 했다. 향후 조례제정을 고려하는 지자체는 이와 같은 사례를 참고하여 지방자치의 특성을 살린 지역 밀착적인 실현가능한 조례를 제정할 필요가 있다.

지방자치시대의 농촌지도업무의 변화와 방향 (Trends and Directions of Agricultural Extension Services under the Local Autonomy Period in Korea)

  • The purposes of the study were to identify the present status of the agricultural extension services in Korea and its surrounding environment, and to search the desirable ways of improvement under the serious restructuring period occurred by the nation-wide localization, globalization and development of information technology. Agricultural extension services have made great accomplishment in the education for rural people and agricultural technology diffusion, but agricultural extension service system no longer well fits in the changed environment. Agricultural extension services in Korea should restructure the system, function and methods in order to cope with the changing technology and rural society. The objectives of the extension services should be clear and simplified so that the extension workers can understand their role and duty more clearly. The local governments should encourage the extension workers to carry out their services diligently and with the pride. Also, the extension workers should change their mind to fit in the changing world and should improve their capability for their services.

에너지전환과 지방정부의 역할: 문재인 정부의 재생에너지 정책을 중심으로 (Energy Transition and Roles of Local Governments: Renewable Energy Policy under the Moon Jae-in Administration)

  • In December 2017, the Moon Jae-in administration announced a major policy shift away from nuclear and coal, committing itself to the vision of creating a society where renewable sources account for 20% of its electricity generation by 2030. This energy transition involves not just a technical transition from conventional energy sources to renewable energy but also active participation of multiple stakeholders in the energy governance. While energy policy making has long been dominated by the central government in Korea with the aim of managing the supply for rapid industrialization and economic growth, the Moon administration aims to diffuse the central government's authority across various actors in society. Among those actors, this study focuses on the roles that local governments play in energy transition. Despite deepening local autonomy since 1995, Korean local governments have remained policy targets or recipients in the energy policy domain. This article discusses how such a traditional role has evolved under the new administration's energy transition policy and examines what challenges and limitations local governments face in creating a more decentralized energy governance system.

항만공사제도의 효율적 운영방안 - 인천항만공사를 중심으로 - (Strategies for the Efficient Management of the Port Authority System in Korea: Focused on Incheon Port Authority)

  • In order to improve inefficient and unproductive factors and in response to criticisms of the failure in harbor privatization introduced in 1997, the Korean government introduced the Port Authority system, which is commonly adopted in advanced harbors in the world. This research examined the theoretical background of harbor management system and various cases of harbor management in foreign countries. The desirable introduction of Port Authority system must be preceded by the settlement of problems in harbor structure and operation. In addition, the Port Authority Act, which restricts the autonomy of harbor corporations, should be improved for user-centered Port Authority system. Strategies for the successful introduction of Incheon Port Authority are as follows. Firstly it is required to establish consumer-centered harbor operation system. The second requirement is to activate the harbor logistics industry through the development of nearby logistic complexes led by Port Authority and, by doing so, to promote the development of local economy. Thirdly it is essential to lay the foundation of mutual prosperity through developing profitable businesses by linking localities and harbors, and to suggest a crisis control network for Port Authority and local self-governing bodies to cope jointly with crises in logistics and natural disasters.

  • 본 연구는 정부간 협력관계의 필요성에 대한 문제제기와 함께, 보다 바람직한 협력관계를 유도할 수 있는 방안을 모색하였다. 따라서 정부간의 협력관계 정립을 위한 정책적 수단으로서 인적협력능력의 지표를 개발하여 건전한 지방자치제의 육성과 발전을 위해 바람직한 지방정부간의 협력체제를 유도할 수 있는 방안을 모색해 보고자 하는 데 연구의 목적을 두었다. 연구결과 지방정부간의 협력과정에서 나타나는 자치단체장의 행태적 요인의 특성은 정도상의 차이는 있지만 나름대로 행태적 특성과 관련하여 자치단체장의 가치관과 행태가 지방정부간의 협력에 있어서 필수적인 요인 중의 하나라는 것을 알 수 있었다. 이에 기초한 본 연구는 향후 자치단체장의 행태적 특성에 대한 경험적 연구를 위한 기반으로 삼을 수 있을 것으로 기대한다.

한국소방발전을 위한 정책과제 연구 - 소방청 신설에 대응하는 제도·조직개선 구상 - (A Study on the Policy Tasks for the Development of National Fire Service - Redesigning Institutional and Organizational Improvement for the Establishment of the National Fire Service Agency -)

  • Today, the basic problem of functional safe management of Korean Disaster Control system was separately administrated 33 acts that are relating to safe management in 13 ministries. Because of the facts that the fire service is not provided practically, the control system and risk management for safe administration are not operated, the information can not be shared with each other, and the various laws have the lacks of linkage, the National Safe System was appeared unsteady. The roles and functions of fire service have started with restriction to operate structurally and institutionally, which operational structure of fire service is becoming weak. As a result, the federal and local fire organizations have not reached yet to the institutionalization and the local fire service agencies have bias with the task regarding the fire service because of the relation between organizational structure and the local fire agency. With the enforcement of the federal and local fire system, professionality and autonomy for making policy, and dealing with changes of fire service positively, the national fire service on the policy performance can be established. Promotion of research and development and education training to strengthen innovation in technology and competition in fire industry will contribute to the firmly establishment of control system to prevent from fire, flood, terror and national disaster. This article proposed that (a) the established law and administration, agency are required efforts to effectively operate fire service system; (b) the national fire service agency, national college of fire, national institute of science fire, and national fire service hospital should be early established to make firmly policy to operate effectively and practically. These kinds of innovational acts are known the best ways of operating solid policy of national fire service system.

지역적 정보 공유를 활용하는 멀티 에이전트 시스템 기반의 공급사슬 관리 아키텍쳐 (A Multi-agent Architecture for Coordination of Supply Chains with Local Information Sharing)

  • Multi-agent technology is being regarded as one of the promising technologies for today's supply chain management because of its desirable features such as autonomy, intelligence, and collaboration. This paper suggests a multi-agent system architecture with which companies can improve the efficiency of their supply chains by collaborative operation. Reflecting the practical difficulties of collaboration in complex supply chains, the architecture allows agent systems to share information with only neighboring companies for the coordinated operation. The suggested architecture is elaborated with a collaboration model based on Petri-net, conversation models for communication, and internal behavior models of each agent. A simulation experiment was performed for the evaluation of the suggested architecture. The result implies that when the estimation of market demand is higher than a certain level, the suggested architecture can be beneficial.

Study on the Korean application of cultural accessibility and cultural arts education: focusing on French cultural policy

  • This study examines the main elements, concepts, and directions of 'cultural accessibility' in the field of cultural arts education through the French case. Above all, 'cultural accessibility' is viewed from the perspective of the problems of 'social exclusion' and the corresponding 'participation'. We discuss strategies for applying 'cultural accessibility' through French policy discussions. France is implementing this consistent policy structure through the development of its local self-government system. We first look at the current status of French cultural policy and cultural accessibility, and the participation. Next, we will discuss separately into the cultural arts education of the central government and those of local governments. For application to Korea, we propose the application of education to apply 'culture of public values', the establishment of autonomy in cultural arts education, and the application of a dual strategy for public advocacy.

개인정보보호를 위한 ELIS의 자치법규서식 개선방안 (Improvement Method of ELIS Local Laws and Regulations Format for Personal Information Protection)

  • 본 논문에서는 강원도 기초자치단체 18기관 가운데 4개 주요시에 대하여 자치법규의 개인정보 요구 실태를 파악하였다. 자치법규정보시스템(ELIS)을 활용하여 지자체의 자치법규에서 별지서식을 대상으로 전수조사를 실시하였다. 분석결과 슈퍼키인 주민등록번호를 포함하여 거부감이 있는 스마트폰 번호, 자택 전화번호 등의 개인정보 요구가 심각한 상태로 조사되었다. 개선방안으로 PIMS 준수와 개인정보 자동검색엔진의 시급한 개발을 제안하였다.

임진왜란이후 밀양도호부 읍성의 공간구조 변화 (Change of Miryang-Dohobu Eupseong(Town-castle)'s Spatial Structure Since Japanese Invasion of Korea in 1592)

  • Compared to Early Chosun Dynasty, the spatial structure of most local Eupseongs of Korea had a standardized change with the expansion and spread of the Rye-hak(禮學:a study of confucius Rite). Meanwhile in the process of rebuilding Eupseongs there was a tendency of relocation of the local government offices(官衙) and its attached facilities in terms of functions and use. Although it was PyeongSanseong Miryang Eupseong had an unreasonable spatial structure locating Gaeksa(客舍; accommodation house for visitors) in the middle of the local government office complex, and Dongheon(東軒;main office building) in the east of it before the Japanese Invasion of Korea in 1592. However with the reorganization of spatial Structure of local Eupseongs after the Japanese invasion Gaeksa was moved to the foot of Adongsan where commanded a fine view of river. Dongheon was moved to the center of Eupseong for the effective management of its auxiliary organizations. It was because road system and administrative efficiency had a serious effect on deciding the location of the local government office and its attached facilities. After the Japanese invasion Hyangchoeng(鄕廳), having been out of Eupseong, also was moved to the independent location within Eupseong separate from Dongheon and Gaeksa. It seemed to take into account the autonomy of Hyangchoeng. Dongheon, Gaeksa, and Hyangchoeng which are the crucial facilities of Milyang Eupseong were arranged at each angular point of big triangle. In order to enhance the administative efficiency, the attached administrative facilities were arranged surrounding Dongheon and Hyangchoeng. The spatial structure of Milyang Eupseong in the late Choseon dynasty was of great difference from that of uniformly organized system of early Choseon Period. It was because the development of administrative function, the pursuit of efficiency, and commercial progress had a great impact on the change of urban space.
