국회도서관 납본 활성화 방안에 관한 연구 - 디지털 학위논문을 중심으로 - (A Study on the Activation Plan for Legal Deposit in National Assembly Library of South Korea: Focusing on Thesis and Dissertation)

  • 본 연구는 학위논문의 납본과 관련한 대학도서관의 인식 및 실태를 실증적으로 분석하고 학위논문 납본의 저해요인 확인을 통해 국회도서관의 학위논문 납본 활성화 방안을 모색하였다. 분석 결과, 대부분의 대학에서는 학위논문의 납본을 수행하고 있으나, 학위논문을 담당하는 전담부서나 전담인력 배치는 저조한 것으로 나타났다. 사서들은 여러 기관으로의 납본 등 납본업무의 중복으로 인한 어려움에 직면하고 있으며, 납본이 이루어지지 않는 경우 대학도서관의 정책, 납본 절차의 중복 및 번거로움, 저작권 동의서 확보의 한계 등이 주된 이유로 나타났다. 이러한 학위논문 납본에서의 문제를 해결하고 학위논문이 지닌 사회적, 정보적 가치를 극대화하기 위한 방안으로 독립적인 납본법의 제정을 통한 디지털 학위논문 납본 제도의 강화, 디지털 학위논문의 효율적 보존 방안 마련, 통합된 학위논문 납본 시스템 개발, 석박사학위논문 전문 컬렉션 개발을 통한 국회도서관의 위상 강화 등을 제안하였다.

법률정보허브로서 법원도서관의 지식정보공유 기능과 역할 강화에 관한 연구 (A Study on Legal Information Landmark, Court Library, Knowledge Information Sharing, Function and Role Expansion, Legal Information Hub)

  • 본 연구에서는 법원도서관이 법률정보허브로서 어떻게 지식정보공유의 기능과 역할을 강화할 수 있는지에 대해 다각도로 조명하고자 하며, 이를 위해 문헌조사, 사례조사, 관계자 면담, 그리고 이용자를 대상으로 한 설문을 기반으로 현황을 총체적으로 파악하고, 이를 기반으로 법원도서관이 법률 지식의 보급과 공유에 있어서 중추적인 역할을 할 수 있는 방안을 모색하여 제시하고자 하였다. 연구결과, 법원도서관의 역할 및 기능으로, 4가지의 사법부 지식정보 공유 복합센터로서의 역할, 다섯 가지의 사법부 지식정보 공유 복합센터로서의 기능, 그리고 9가지의 법률 문화 확산을 위한 접근성 확대 방안을 제안하였다. 이렇게 법원도서관이 법률 지식 문화 대중화라는 목표를 가지고 차세대 공유 복합 센터로서의 기능을 수행한다면, 법률과 문화에 관심이 많은 국민과 법률 관련 기관 및 교육 기관 종사자, 센터의 근접지역에 거주하고 있는 국민을 상대로 법률 지식 접근성을 확대할 수 있을 것이다.

법정 스마트도시서비스 지원기관의 발전방향 (Development Direction of Smart City Service Supporting Institutions)

  • 본 연구는 스마트시티의 발전과 고도화를 위해 스마트도시서비스 지원기관이 나아가야 할 발전방향에 대해 제시하는 것을 목적으로 한다. 이를 위해 첫째, 스마트도시서비스 지원기관의 필요성과 법적근거, 주요기능 등에 대해 이론적으로 검토하였다. 둘째, 스마트도시서비스 지원기관의 기능영역별 현황을 검토하고 기능영역별 상대적 중요도 도출 및 의견수렴을 위한 전문가 심층인터뷰를 수행하였다. 셋째, 이론적 검토와 기능별 현황파악, 우선순위 도출, 전문가 의견 수렴 등을 종합한 스마트도시서비스 지원기관의 발전방향을 제시하였다. 본 연구결과는 향후 국내 스마트시티 사업에서 핵심적인 역할을 수행할 것으로 예상되는 스마트도시서비스 지원기관의 역할과 기능, 그리고 향후 발전방향을 제시하였다는 점에서 그 의의가 있다.

비영리법인 의료기관의 과세 제도를 정비해야 할 시점: 미국 수준의 면세혜택 제공을 검토해야 (For Non-for-Profit medical institutions, tax exemption benefits such as the United States should be basically provided.)

  • Purposes: The purpose of this study is to argue that the taxation system for non-for-profit medical institution in Korea should be revised and that the basic direction should be to expand tax exemption like the US. Methods: We analyzed the US context of taxation policy for non-for-profit medical institutions and compared the US and Korean situation. Findings: In the United States, for-profit or non-for-profit medical institutions eternities are the most important criteria for hospital classification. Basically, full tax-exemption has been applied for non-for-profit medical institutions. The reason why many hospitals maintain their status as non-for-profit are following. First, the American society places great importance on the social responsibility and role of non-for-profit hospitals. Second, maintaining the status of non-for profit medical institutions is financially beneficial while maintaining good social reputation. The most powerful financial incentives are tax deductions and tax deductions for donations. Practical Implications: How will the taxation system for medical institutions in Korea be reformed in the future? First, if Korean government do not allow for-profit medical institutions, Korean government should consider implementing a full tax exemption system suitable for non-profit medical institutions like the US. Second, there are many variation in taxation for non-for-profit medical institution according to their legal positions. Therefore, current taxation system should be revised. Third, the reorganization of such taxation system should be in a direction that can finally encourage community benefit activities of medical institutions of nonprofit hospitals.

보건의료정보의 법적 보호와 열람.교부 (A Study on Legal Protection, Inspection and Delivery of the Copies of Health & Medical Data)

  • In a broad term, health and medical data means all patient information that has been generated or circulated in government health and medical policies, such as medical research and public health, and all sorts of health and medical fields as well as patients' personal data, referred as medical data (filled out as medical record forms) by medical institutions. The kinds of health and medical data in medical records are prescribed by Articles on required medical data and the terms of recordkeeping in the Enforcement Decree of the Medical Service Act. As EMR, OCS, LIS, telemedicine and u-health emerges, sharing and protecting digital health and medical data is at issue in these days. At medical institutions, health and medical data, such as medical records, is classified as "sensitive information" and thus is protected strictly. However, due to the circulative property of information, health and medical data can be public as well as being private. The legal grounds of health and medical data as such are based on the right to informational self-determination, which is one of the fundamental rights derived from the Constitution. In there, patients' rights to refuse the collection of information, to control recordkeeping (to demand access, correction or deletion) and to control using and sharing of information are rooted. In any processing of health and medical data, such as generating, recording, storing, using or disposing, privacy can be violated in many ways, including the leakage, forgery, falsification or abuse of information. That is why laws, such as the Medical Service Act and the Personal Data Protection Law, and the Guideline for Protection of Personal Data at Medical Institutions (by the Ministry of Health and Welfare) provide for technical, physical, administrative and legal safeguards on those who handle personal data (health and medical information-processing personnel and medical institutions). The Personal Data Protection Law provides for the collection, use and sharing of personal data, and the regulation thereon, the disposal of information, the means of receiving consent, and the regulation of processing of personal data. On the contrary, health and medical data can be inspected or delivered of the copies, based on the principle of restriction on fundamental rights prescribed by the Constitution. For instance, Article 21(Access to Record) of the Medical Service Act, and the Personal Data Protection Law prescribe self-disclosure, the release of information by family members or by laws, the exchange of medical data due to patient transfer, the secondary use of medical data, such as medical research, and the release of information and the release of information required by the Personal Data Protection Law.

영재교육진흥법에 대한 교육법적 쟁점 (Legal Issues in the Act on the Promotion of Education for the Gifted and Talented Law)

  • 본 연구는 영재교육과 관련된 법체계의 구조와 교육법적으로 쟁점이 되는 사항을 살펴봄으로써 영재교육과 관련된 법적 논의의 대상을 모색하는데 목적을 두고 있다. 이를 위해 '영재교육진흥법'과 동법 시행령의 법률상 위치를 고찰하였다. 다음으로 입법과정과 주요내용, 법제에 대한 공과를 논의하였다. 마지막으로 법 체계와 목적, 영재교육 대상자, 교육과정, 영재교육 교사에 대한 법 규정에 대한 논의를 하였다. 그 결과 영재교육에 대한 법 제정의 역사가 10년도 채 되지 않는 상황이어서 법체계와 상위법의 근거 조항 및 목적 등의 미비점이 발견되었다. 또한 영재교육 대상자의 권리를 확보하기 위한 법적 조치가 필요하고, 교육과정 역시 부분 수정이 필요하며, 국가나 지자체의 책무성이 보다 강화되어야 했다. 그리고 교원 자격은 보다 엄격하게 규정되어야 할 필요가 있었다. 그리고 향후 특정 주제별로 구체적인 분석을 위해 고려되어야 할 사항을 영재교육 입법, 교육재판, 교육정책 등으로 제시하였다. 그러나 본 연구는 개괄적 수준에서 법의 기본 체제나 내용을 제시하였으므로 전체적인 법적 구조까지 검토하고 제시하지 못한 한계가 있다.

영리법인병의원에 대한 고찰을 통한 국내 의료법인제도의 재구성 방안 (Suggestion for Reform of Korean Medical-Juridical-Person System: through review on for-profit ownership of Korean medical institutions)

  • The rate of conversion to Medical-juridical-persons' ownership of medical institutions has increased rapidly since its start in 1970s in Korea. The most sensitive issue to introduce for-profit medical institutions, ignited particularly by the WTO/DDA negotiations, has sparked considerable debate, stemming largely from conflicting views on the theoretical effects of ownership status on organizational behavior. This study surveyed health-related experts' opinions on allowing for for-profit-firms-owned medical institutions. Some fear that the obligation to maximize the share-holders' return on their investment will cause the medical institutions to eliminate necessary but less lucrative services. They may easily fall under more pressure to generate income, and respond more aggressively than not-for-profit medical institutions to financial pressures. Advocates of for-profit ownership of medical institutions argue that greater responsiveness to the demands of the marketplace will lead to larger investment, higher quality and lower costs to consumers. Referring to both foreign countries' experience and domestic experts' opinions, this study suggests for reform of the current Korean Medical-Juridical-Person(MJP) System. Introduction of so-called “Capital-investment” MJPs is recommended where the properties left in case of their dissolution can be distributed to original investors according to the procedures stipulated in their statutes. However, their annual profits are not allowed to be allocated to investors, but should be reinvested for their medical institutions, as is the case in current MJPs. Their legal aspects are also reviewed in this study.

환자의 의무기록 관련 의료인의 법적 지위 (Legal Status of Medical Personnel on Medical Records)

  • This study is a paper reviewed legal status of medical personnel and issues of law on recently discovered medical records. As the increase of medical personnel who have gone through the administrative disposal in regards to the medical records, it is needed to examine the legal issue or dispute on the medical records under the current law. Medical records are the statement on patient's medical conditions made by the medical personnel. This records are used as important source for patient's further treatment. This becomes the communication route between the patients and the other medical personnel, and it provides the patients a right to find out their medical information. According to the Medical Service Act (Article 21), a medical personnel shall prepare respectively a record book of medical examination and treatment. And medical personnel shall make a signature. Furthermore, the medical personnel or the opener of the medical institutions must preserve the record book (including an electronic medical record). Meanwhile, the issues of a ban on false entry, additional record, revision or manipulation on the medical record have been recently on the rise. This paper briefly examined the major issues in regards to the medical records. It especially clarified the legal duty on medical records and its major-contentious-issues. At the same time, it pointed out the problems of the unreasonable over interpretation of the law. Furthermore, this suggested the guidelines for the further discussion and review.

T-Commerce 활성화를 위한 소비자 효용 속성 분석 (Consumer's Utility Attributes Analysis for T-Commerce Activation)

  • Recently, T-Commerce is emerging to provide new services, with the proliferation of digital broadcasting services. However, T-Commerce market and TV home shopping market are being classified as a legal policy on other markets, such as regulated in the service of live broadcasts. The factor that has inhibited activation T-Commerce related to the lack of appropriate institutions and legal systems in the market, despite the environment with the digital broadcasting service is being spread. We were performed conjoint analysis. For this analysis, we select attributes as a quality attractive factors that significantly affects the satisfaction of TV based shopping customers through previous studies. The results showed that the TV-based shopping customers are important to think 'Responsive', 'Playfulness', 'Live broadcast', 'Convenience' and 'Bidirectional' in the order. The 'Responsive' and 'Live broadcast' of such attributes are served as possible only in TV home shopping, because these attributes don't service due to legal and institutional regulations in T-commerce market. The cluster analysis result also showed that TV shopping consumers are more important to think 'Responsive', 'Playfulness', 'Live broadcast' than 'Convenience' and 'Bidirectional', except one of the classification clusters. If real-time broadcast service is impossible because of the legal and institutional regulations, it seems to require the expansion of the services linked the terrestrial broadcasting to the activating T-Commerce market.

Determinants of Operational Self-Sustainability of Microfinance Institutions in Vietnam

  • The purpose of this paper is to investigate the determinants of the Operational Self-Sustainability (OSS) of Vietnamese microfinance institutions (MFIs). This research uses both qualitative and quantitative research methods: (i) qualitative research was via in-depth interviews with ten microfinance practitioners, policymakers and researchers; (ii) quantitative research was conducted by using panel data of 34 MFIs in the period 2011-2015 with binary logistics and OLS regressions. Results are as follows: (i) MFIs' OSS in Vietnam are mainly determined by five key factors: portfolio at risk (PAR>30), capital structure, gross loan portfolio, scope of activities and legal form; (ii) OSS are most affected by legal status (social organizations have better OSS than formal MFIs or programs/projects), location (MFIs focus in one province have higher OSS than working nationwide or just in one district), capital structure (MFIs with more equity proportion have higher OSS); (iii) surprisingly, average loan size per borrower and age of MFIs do not have statistically significant correlation with OSS. The key recommendations are: (i) MFIs should focus on its professionality and increase its equity; (ii) related stakeholders such as State Bank of Vietnam should promote the enabling ecosystem for microfinance development to enhance poverty reduction and economic development.
