무역조정지원(貿易調整支援) 사례(事例)에 관한 연구(硏究) (Analysis on the Trade Adjustment Assistance Program and the Case Study)

  • This paper is to provide for an analysis on the trade adjustment assistance program and the Case study affected by international trade and FTA. The paper offers a legal study on analysis about Korea's Trade Adjustment Assistance Law for the Manufacturing Industries, USA's TAA. and Japan's law for Industry revival. In general, USA's TAA measures are defined as assistance actions for business enterprises, farmers and manufacturing industries workers. We exclude farmers and fishermen under Korea's Trade Adjustment Assistance Law for the Manufacturing Industries's business enterprises and workers, but we give them the systemic supports under korea's special assistance law for the farmers and fishermen and so on after FTA. Especially this focuses on the trade adjustment assistance case about both Korea's agriculture-farmer assistance from FTA and USA's TAA from workers in layoffs of trade-impacted communities. Korea has provided TAA to the sphere of agriculture after special legislation in Korea-Chile helping closed orchard, modernizing high quality producing facility for agriculture competition, producing superior fruit saplings, and constructing the distribution center in the producing district. But for US-Korea FTA and rapid increase of import by FTA expansion, we must prepare such indemnity systems for loss as cash benefit and wider aids for closed farm. The USA's TAA program targets manufacturing workers affected by international trade, who may have fewer transferable skills and face greater challenges to reemployment than other dislocated workers. A large majority sought some assistance from their one-stop center. Relatively small numbers chose to enroll in training, but those who did it often used this opportunity to chart a new career path. Finally, we learned the importance of education and discipline from USA cases. The fast and accurate information providing can raise efficiencies. The infrastructure can maximize the effect of TAA. The effective application would help us get over difficulties of TAA at hand.

시설포도 농가의 가온시기 변화에 미치는 요인 분석 (Analysis of Factors for Heating Period Changes among Greenhouse Grape Farms)

  • 본 연구에서는 한 칠 FTA 이후 시설포도 재배농가들이 가온시기를 늦추는 요인을 알아보기 위해 2004년부터 2016년까지 작형 변화 패널 데이터를 이용하여 분석하였다. 패널로지스틱모형에 대한 분석결과 시설포도 재배면적에 대한 추정계수는 0.0002로 10% 유의수준에서 통계적으로 유의한 것으로 나타났고, 포도 수입량에 대한 추정계수는 1.4258로 1% 유의수준에서 통계적으로 유의한 것으로 나타났으며, 지역더미에 대한 추정계수는 0.808로 5% 유의수준에서 통계적으로 유의한 것으로 나타났다. 이것은 재배면적이 많은 농가일수록, 포도 수입량이 증가할수록, 상대적으로 추운 중북부지역일수록 가온시기를 뒤로 미루게 될 확률이 증가하는 것으로 나타났다. 정부에서는 포도의 수입량 증가로 인한 시설포도농가의 피해를 줄이기 위해 FTA 피해보전직접지불 폐업지원을 하고 있어 시설포도농가의 피해를 다소나마 줄일 수 있지만, 이것은 궁극적인 대책이 되지는 않을 것이다. 포도 소비변화에 적절하게 대응하기 위해서는 품종 갱신, 가온비용 절감을 위한 농자재 지원, 비닐하우스 시설현대화를 통한 에너지 효율 증대 및 비용 절감 등의 다양한 지원책이 필요할 것이다.

지역주의와 다자주의간의 관계 - 한국 컴퓨터 산업을 중심으로 - (The Relationship between Regionalism and Multilatevalism: A Case Study of the Korean Computer Industry)

  • 한국은 최근 체결된 칠레와의 자유무역협정을 제외하고는 어떤 공식적인 지역주의에도 가입하지 않고 있는 예외적인 국가중의 하나이다. 동북아시아에서의 지역주의의 결여는 경제성장의 엔진으로서 세계수출시장을 선호한 전후의 국가정책을 반영한다. 한국의 50개 기업에 대한 설문조사를 바탕으로 본 연구는 컴퓨터산업의 관점에서 지역주의와 다자주의간의 관계를 고찰한다. 연구결과는 지속적인 수출증가를 위해 한국 컴퓨터 산업은 지역주의보다는 다자주의를 선호함을 보여준다. 연구결과에 따르면 세계무역기구를 통한 가속적인 무역자유화 조치가 지역주의에 대한 수요와 지역주의로부터의 부정적 영향을 감소시키는 것으로 나타난다. 전반적으로 연구결과는 한국 컴퓨터산업은 무차별원칙에 기초한 강력한 다자간 구속력이 있는 무역체제를 선호한다는 것을 시사한다.

ICSID의 투자분쟁 해결구조에 관한 고찰 (A Study on Settlement of Investment Disputes under ICSID Mechanism)

  • Settlement of investment disputes is quite different from that of commercial disputes arising from ordinary commercial transactions in view of disputing parties, applicable laws and rules, etc.. Therefore, it is very important to consider the Convention on the Settlement of Investment Disputes between States and Nationals of Other States(Washington Convention) of 1965. The creation of the International Centre for Settlement of Investment Disputes(ICSID), which was established under the Washington Convention, was the belief that an institution specially designed to facilitate the settlement of investment disputes between governments and foreign investors could help to promote increased flows of international investment. Pursuant to the Washington Convention, ICSID provides facilities for the conciliation and arbitration of disputes between member countries and investors who qualify as nationals of other member countries. Recourse to ICSID conciliation and arbitration is entirely voluntary. However, once the parties have consented to arbitration under the Washington Convention, neither can unilaterally withdraw its consent. Moreover, all Contracting States of the Washington Convention are required by the Convention to recognize and enforce ICSID arbitral awards. Provisions on ICSID arbitration are commonly found in investment contracts between governments of member countries and investors from other member countries. Advance consents by governments to submit investment disputes to ICSID arbitration can also be found in many bilateral investment treaties including the Korea-China Agreement on the Encouragement and Reciprocal Protection of Investments(1992), the Korea-Japan Agreement for the Liberalization, Promotion and Protection of Investment(2003) and the Korea-Chile FTA, the latter was signed as of February 15, 2003 and is still pending in the National Assembly for its ratification. Arbitration under the auspices of ICSID is similarly one of the main mechanism for the settlement of investment disputes under the bilateral treaties on investment. Therefore, it is a problem of vital importance that Korean parties interested in investment to foreign countries should understand and cope with the settlement mechanism of investment disputes under the Washington Convention and bilateral investment treaties.
