Among many open libraries under the rule of the Japanese imperialism, only the railroad library as the character of special library under the control of the Japanese Government General is remarkable for having opened its facilities to outsiders as well as the interior users. This study tries a) To look into what were the colonial background, aim and motive of the establishment of the railroad library under the Japanese rule, b) To analyze its activities and the change of its organization, c) And to find out its vestiges an the effects which it has on our country's library circles. The following are the result: A. The railroad library under the rule of the Japanese imperialism functioned as a public library by the outside book's circulation rather than the interior using. B. The outsiders were qualified to use it only when they got the joint guarantee for the city resident, which means that the o n.0, pportunity of the circulation was not free for the Koreans rather than the Japanese. C. From the aspect of collections, technical books such as natural science, and reference ones tended to be collected, and their whole composition was focused on the materials for the Japan-Korea identification scheme and development of the national spirit as the Japanese empire's subjects. D. In the respect of its organization, all the clerical employees, as well as the chief librarian were composed of the Japanese. Although the Koreans were in principle prohibited from working there, a few of them were employed as guard or servant as the China-Japan War was close to the end. E. The area of the outside book's, circulation service was expanded throughout the whole region along the railroad connecting Pusan with Manchuria. Such a service activity which contained several meanings, was tried by means of culture's books, circuit's books, train's books, hotel's books, mind's development books and reader's reading books etc. F. Such matters as the limitation on book circulating and the quantity of circulation book, the paid circulation and the partial restriction on free circulation mean the wartime system under the rule of the Japanese imperialism and also a n.0, ppeared as a factor of hampering the Koreans from getting accustomed to using library, which has affected them until now. G. The noticeable thing in the service activity is shown in attempting the diversified and positive way of service like free circulation in order to solidify the attitude of the Koreans toward war by organizing mind's development books as well as culture's books with the China-Japan War. H. On the other hand, it can not be passed over that the diversified service activity of the railroad library played a role of bridge in turning of today's library circles of ours to the modernization.
This study is to analyse the reimbursement prices of drugs in Japan. Japan has the world's second-largest pharmaceutical market, and the world's largest price-controlled pharmaceutical market. The reimbursement prices of new drugs in Japan are determined by confidential negotiations between the manufacturer and the Japanese Ministry of Health, Labor, and Welfare. Pharmaceuticals account for a larger share of total healthcare expenditures in Japan than in most other major pharmaceutical markets such as France, Germany, United Kingdom and United States. Prescription drugs' share of total healthcare spending has slightly increased in recent years, from 20.2% in 2000 to 21.5% in 2004, the most recent year for which data are currently available. This trend is attributable to the effect of the Japanese rapidly aging population that stimulates demand for healthcare services. There are several method of price setting for drugs as below. First, on the initial pricing of branded drugs, is the similar-efficacy pricing method and cost calculation method. Second is postmarketing price changes which are biennial price revisions under the rule of National Health Insurance. Third is the rule of the generics price. Recently, the generics market is expanded because there are increasing numbers of hospitals by DPCs(Diagnosis-procedure Combinations).
The aim of this research is to analyze and periodize the relationship between railroad and river transportation as one aspect of the transformation of the land transportation system in Korea. As a result, three phases can be observed: a first phase of equality and interdependence (1910s); a second phase, subordinating rivers to feeder lines under railroad's dominance; and a third phase when trucks and buses became a major means for local transportation in place of traditional shipping routes. River ports were among the main planned destinations during the first and second phases, but such plans were changed or withdrawn after the third phase. This relationship between river and rail illustrates one geopolitical factor relating to the development of Korea's rail transportation network.
This study addresses how the main group of community ritual changed as the regional community changed during the period of Japan's colonial rule of Korea with emphasis on Gwanseongmyo in Jangchung-dong, Seoul. First, almost every regional community was changed because of city planning which was carried out by Japan in Korea for colonial exploitation and for the use of military bases. Mapo-dong and Seobinggo-dong were the appropriate examples. The city planning projects by the Japanese colonial government selected Jangchung-dong as the place of settlement of many Japanese people. The stream, Cheonggyecheon, made a border between the Korean and Japanese settlements and the traditional system of regional community in Jangchung-dong was changed and reorganized considerably. Second, the Japanese government used the rituals of regional community purposefully to combine them with the ceremony in the Japanese shrine. Those who supported Japan performed the regional rituals and tried to follow the policy of 'Rule of Culture' required by the Japanese colonial government. However, most regional rituals continued as they were before Japan's colonial rule of Korea without any change. Under this new trend the ritual of Gwanseongmyo was changed from the ritual for worshipping Guan Yu to that of the regional community. Last, the main groups that led the rituals of regional community were diversified during the period of Japan's colonial rule of Korea. In other words, the rituals of community used to be led by the families that lived in the region for generations before Japan's colonial rule of Korea. However, they were later led by various groups that emerged as a result of the colonial rule, urbanization, commercial development, regional differentiation, and so on. As an example,Yeongsinsa of Gwanseongmyo,which was the main group to lead the ritual of Gwanseongmyo, shows that the regional community rituals were extended to worshipping Guan Yu. The members of the main group to lead the ritual were pro-Japanese senior officials who were formerly military officers. This shows that the main groups leading the regional community rituals were further diversified.

Unlike other mountains in Korea, Seoul Namsan(南山), which is one of the landmarks that represent the country's capital city, is perceived as a city park. This article aims to study the process that Namsan became a park and the transformation of its place in Korean Emperor and Japanese colonial period. The serial changes in Namsan, in early modern era, mean that is associated with the colonial urbanization and the rule of space by Japan. The stages of Waeseongdae Park(倭城臺公園), Gyeongseong Park(京城公園) and Hanyang Park(漢陽公園) under the leadership of Japan, due to the extension of Japan's power, Namsan has became the park. Here, the park has become a strategic tool of other's occupying Hanseongbu(漢城府), a capital city. The process that Namsan became a park dose not mean making the space for recreation and rest, but is an excuse for using the land. Since then, Namsan's parks barely fulfilled its original function as park as it was transformed into a shrine, Gyeongseong Jinjya(京城神社), for Japanese warriors or was incurred upon by Joseon Singung(朝鮮神宮), which was established as a facility to govern Korea, sometimes is gradually and sometimes is mercilessly. The fact, transplantation of Japanese culture and replacement as ruler space, is another aspect of occupying and govern place. In other words, while the process that Namsan became a park is the way of establishing Japanese force, the transformation of its place show a colonial rule as an aspect of space. Meanwhile, in spite of transformation to shrine, Namsan became accepted as a park for a long time, because of the forest of Namsan. Japan managed forest as a sacred place. It is also a result of the Japanese rule of space.
This study looks at the origin of a wild-ginseng, Korean ginseng, and traces the origin of associated wild-ginseng digging customs back to the Annals of the Joseon Dynasty. These historical customs helped Korea gain control over its wild ginseng resources following Japanese colonization acts, Korea's present-day forest laws, and Korean Civil Law. Prior to Japanese colonial rule in Korea (1910-1945), ginseng digging was a common custom, but Imperial Japan distorted Korea's own legal principles of the public rights of wild-ginseng digging during this colonial period. Distorted legal principles concerning digging customs continued after Korea's liberation from Japanese rule and were maintained until the enforcement of the Korean Civil Law in 1960, when legal principles of the right of common were changed to special servitude. The origin of the right of common can be found in the Sichojang of the Joseon Dynasty. The Sichojang, a place where local residents jointly collected firewood and fed livestock, was the minimum right to life and interest at the time. Since the right of common was the right to life, Imperial Japan attempted to abolish it, but it was never successful. In addition, distorted legal principles have been maintained in present-day forestry-related laws and regulations. Over 75 years since the liberation from Japanese rule in 1945, it is imperative to break away from the distorted legal principles and acknowledge that digging custom rights have changed from common customs to a special servitude under Korean Civil Law. Hence, an organization of wild-ginseng diggers is an unincorporated association, and their wild-ginseng digging customs can be constituted as a special servitude. Hence, their practices should be considered valid under customary law. Through this, it will be possible to clarify the legal nature and grounds for ginseng-related wild-ginseng digging activities, as well as the civil responsibility for the activities of wild-ginseng diggers.
There are several ways to implement charter parties in the operation of the vessel. Under the time charter party, the charterer borrows the vessel from the shipowner and uses the vessel to benefit his business. The time charter party's legal relationship can be divided into internal and external relationships. This article deals with an internal relationship. The legal matters between the shipowner and charterer are regulated by the agreement. The NYPE is the most widely circulated type of time charter party. According to the NYPE, navigational matters fall upon the shipowner while business matter falls upon the time charterer. There are vague parts in interpreting NYPE articles. NYPE Art. 8, called the employment clause, is one of them. The Master employed by the shipowner should follow the order of the charterer. Whether the charterer has the right to order the Master of the vessel to follow the navigating route recommended by him was addressed in the Hill Harmony case by the UK Supreme Court. The court was affirmative. Under the Ocean Victory case, whether the time charterer has an obligation to order the Master to go out to escape heavy weather from the berth at the port was at issue. The Japanese lower court decided negatively. There is a tendency that many countries insert default rule in the maritime law to apply it to the case at issue in a case where there is no agreement. It serves the enhancement of legal stability; China, Japan, and Germany are such countries. The author thinks that Korea should follow the above three countries' revision of their maritime law.
This study is to re-read Yun, Baek-nam(1888-1954)'s editorial "Theatre and Society" from the perspective of postcolonial criticism. He was a man of the theatre who pursued practical interests in compliance with the colonial reality under the rule of the Japanese imperialism. His advocacy of theatre development work was based on the Japan-directional reformism and on Japan-friendly in following after Japan's improvement policy. His general discussion on Western theatre history had considerable errors as a result of focus on the social role and utility of the theatre. But his vindication of theatre-actor opened an era of interaction between theatre and intelligence in Korea. In addition, his enlightening view of a theatre became such as one of the cornerstones for the Shinkug Movement during Japanese colonial period in Korea.
During the ancient times, there was no separative judicial system and administrative , legislative and judiciary functions were ultimately concentrated in the all-powerful monarch. And the three states developed state organization , adopting hieratical structures and placing at the pinnacle . State Codes were promulgated to initiate a legal system to rule the people, these codes instituted under influence of China codes. The people tradition sees crime control as the preservation of the authority of hereditary rulers. In the period of the Koryeo dynasty, government accepted a serious of detailed penal code from Tang dynasty . Legal response to crime stressed preservation of the dynasty rather than making citizen behave according to certain rules. In the period of Early Joseon , the compilation of Grand Code for state administration was initiated, the Kyeongkuk Taejeon ,became comer stone of the dynastic administration and provided the monarchial system with a sort of constitutional law in written form. This national code was in portant means of criminal policy at that time, Late Joseon , the impact of Western culture entering through China gave further impetus to pragmatic studies which called for socio-economic reforms and readjustment. Approach to criminal justice policy emphasized more equitable operation of the criminal justice system ,rehabilitation and crime control. Korea-Japanese Treaty concluded on 22 August ,1910 and proclaim a week later ,Japan gave the coup de grace to the Korea Empire and changed the office of the Resident - General into the Government - General . Thus korean criminal policy were lost during a dark ages ,which lasted for 36 years after fall of Joseon Dynasty (the colnial period,1910${\sim}$1945). After 1945 Korea's liberation from Japanese colonial rule, the occupation of devided Korea by the United States and Soviet Union frustrated the efforts of Koreans to establish an independent government, and the transplantation of two conflicting political ideologies to south and the north of the 38th parallel further intensified the national split. U.S. military government office occupied the south of the 38 the parallel and placed emphasis on democracy of criminal policy. ln 1948, the U.S. military government handed over to the ROK government its administrative authority.
This article aims to inquire into the decision making system and the sources of the original documents made by means of it in Imperial Japan, the colonial Chosun, GHQ, and the occupied Japan in terms of the post-war treatments of compensation on the Japanese colonial rules. It deals with them from 1910 to 1952 in the perspective of history and archivistics. This article attempts to establish the foundation on which the perception of the documents made in the Imperial Japan, its colony, and the occupied territory would be widened by placing the colonial rules and the compensation on them into a continuous line. The records of Japan's forced occupation of Korea during 1910-1945, and the original records documenting the decision making process of post-war compensation under GHQ, 1945-1952, have been dispersed in Korea, Japan and the United States. This dispersed preservation was mainly due to the complicated decision-making process among Governor-General of Chosun, the Japanese Imperial government, and the GHQ. It was the top-down styled, dual decision making system, in which the critical policies, personnel, and budget had been decided in Imperial homeland, while their implementations were made in the colonies. As a result, the records documenting the whole process of domination have been preserved dispersedly in Japan and its colonies. In particular, the accounts of not yet paid Korean workers that was forced to mobilize in Japan's colonial periods, which is emerging as the diplomatic conflict between Korea and Japan, had been dealt in the decrees of the Japanese government and policy-making of GHQ. It has already been changed to the problem as 'economic cooperation' from the 'debt'. Also, the critical records for post-war compensation were preserved dispersedly in the United States and Japan under the top-down decision making process of GHQ-Japan. Therefore, the dispersed records of 1910-1952 about the colonial rules by the Imperial Japan and the post-war compensation on them must be re-investigated for the adequate documentation in the context of time and space.
