Purpose - This paper studies whether CISG can be a suitable governing law for pure service contracts. When CISG was first drafted, there was little disagreement on the fact that contracts for the sale of goods and those for the provision of services were two different types of contract. Based on this understanding, CISG explicitly provides that the Convention will apply to contracts where the preponderant part of the contractual obligation is on the sale of goods, not services. However, as more sales transactions have come to include more elements of services, mainly due to the advancement of the IoT industry, the distinction between goods and services became more blurred. Based on the observation of recent changes, some scholars even argue that such a change supports the applicability and suitability of CISG to even pure service contracts. The purpose of this paper is to critically analyze and evaluate their argument. Design/methodology - This paper focuses on two separate but related issues: CISG's 'applicability' and 'suitability' to service contracts. For the first issue, this paper will examine the rules of interpretation of international treaties under the Vienna Convention on the Law of Treaties of 1969, and will apply its rules to find the proper answer. For the second issue, this paper will perform logical and empirical analyses on the reasoning employed by scholars claiming the suitability of CISG to service contracts. Findings - This paper concludes that CISG does not, and should not, apply to pure service contracts. The argument that CISG applies to pure service contracts directly contravenes Article 3(2) of the Convention, which expressly states that it does not apply to a contract wherein the preponderant part of its obligation is about services rather than sales. Similarly, CISG is not a suitable governing law for pure service contracts because it aims provide rules specifically tailored to the needs of transactions of sales of goods, not services. Servitization of sales of goods transaction does not change this conclusion. Originality/value - This paper presents different views from those offered by some eminent scholars on the issue of applicability and suitability of CISG to service contracts. By doing so, it is hoped that the confusion caused in discussions so far are clarified. Hopefully, this paper can also provide practical guidance to practitioners engaged in the fields of international sales, services, and IoT industries.

This study is centered on the combined use of LiDAR(Light Detection and Ranging) and AR(Augmented Reality) technologies during vertical and horizontal frame measurements in construction projects. The intention is to enhance the quality control procedure, elevate accuracy, and curtail manual labor along with time expenditure. Present methods for accuracy inspection in frame construction often grapple with reliability concerns due to subjective interpretation and the scope for human error. This research recommends the application of LiDAR and AR technologies to counter these issues and augment the efficiency of the inspection process, along with facilitating the dissemination of results. The suggested technique involves the collection of 3D point cloud data of the frame utilizing LiDAR and leveraging this data for checks on construction accuracy. Furthermore, the inspection outcomes are fed into a BIM (Building Information Modeling) model, and the results are visualized via AR. Upon juxtaposing this methodology with the current approach, it is evident that it offers benefits in terms of objective inspection, speed, precise result sharing, and potential enhancements to the overall quality and productivity of construction projects.

Purpose : This study aimed to identify ways to improve the quality of physical therapy research and ultimately review the current situation to improve evidence-based decision-making in physical therapy. Methods : For better evidence-based decision-making in physical therapy, researchers should review the quality assessment of articles in more detail and report their findings for valid and appropriate level of evidence and strength of recommendations. The level of evidence affects how well the findings are derived from well-designed literature. The evaluation of the evidence focuses primarily on the study design and the degree of bias that may compromise the validity of the findings. The final recommendation is based on a combination of the study design and literature quality. To uncover gems of information in each paper, a risk of bias assessment should be performed after the literature has been initially selected. Results : Researchers should consider the complexity of the intervention, appropriate grouping, and calculation of effect sizes for the intervention. Researchers conducting systematic reviews should provide a detailed description of the quality assessment performed and present a detailed analysis of their interpretation of the results. The results of systematic reviews and meta-analyses should be interpreted with caution and include a risk of bias assessment. Guidelines for the level of evidence and strength of recommendations should be developed and utilized more broadly to improve reporting practices in physical therapy. Conclusion : Researchers should be knowledgeable about the strengths and limitations of each study design and methodology. In the future, researchers will also need to improve their ability to critically evaluate their findings, given the potential for their results to influence clinical practice.
Purpose - This paper examines the admissibility of restitution as the legal consequence where a contract is frustrated under the Law of Reform (Frustrated Contracts) Act 1943 in comparison with Korean Civil Code (KCC). In order to provide practical guidelines and advice regarding choice of and application of law for contracting parties in international trade, the paper comparatively evaluates requirements and the scope of restitution under the Act 1943 and KCC. Design/methodology - This paper executes a comparative study to analyze whether the parties may claim restitution of money paid or non-money benefit obtained before or after the time of discharge under English law and KCC. To achieve the purpose, it focuses on the identifying characteristics of each statute, thereby providing guidelines to overcome difficulties in legal application and interpretation as to restitution as the consequence of frustration. Findings - Under English law, the benefit may be restituted according to Art 1943 or the common law rule, mistake of fact or law. Under the KCC, restitution is considered based on the principle of the obligation to recover the original obtained regardless of the time when the benefit is conferred. Whilst Act 1943 does not require careful analysis of the grounds of restitution, requirements to justify restitution according to the principle of unjust enrichment, mistake of fact or law, and the KCC should be met. Meanwhile, the KCC may provide more opportunities to award restitution because it does not require the burden of proof related to the defendant's good faith, unlike the principle of unjust enrichment. Originality/value - Where the contract is frustrated by the effect of COVID-19, one legal issue is a consequence of frustration. Therefore, this paper analyzes requirements and the scope of restitution under English law as compared with the KCC in a timely manner. It provides contracting parties with practical guidelines and advice to reduce unpredictability when they choose the governing law in a contract.

In addition, policy needs such as the development plan of the imperial cultural festival, re-establishment, application, reuse, re-establishment, and reproduction according to environmental changes, and technical support and monitoring systems for investigating and preserving imperial cultural assets are needed. Until now, Academic disciplines were categorized according to the standards of the National Research Foundation of Korea, and this categorization has contributed to the development of each disciplines. However, as time goes by, there is a need for a transition to the new trends, convergence. Therefore, to suggest the resolution for pre-existing phenomenon and problems, this study explored the concept and traits of narrative science as a convergence discipline and discussed its implications and tasks. Narrative Science is a human science, based on narrative epistemology, and it focuses on human's interpretation, communication, and inter-subjectivity. Narrative Science has many inner structures per trait, and it provides pre-existing disciplines with narrativistic inter-relation. It also pays attention to human's inner areas. For the development of Narrative Science in the future, it should be free from a misunderstanding as a narratology discipline or a methodology of qualitative research. Under this change, Narrative Science discipline areas should be fused in the perspective of human science, based on narrative philosophy and psychology.
As part of a feasibility study for introducing carbon labeling of fruit products in Korea, we explore the use of carbon footprints for Korean kiwifruit from Gyeongnam region as a case study. In Korea, the Korean Environmental Industry and Technology Institute (KEITI) is responsible for the carbon footprint labeling certification, and has two types of certification programs: one program focuses on climate change response (carbon footprint labeling analysis) and the other on low-carbon products (reduction of carbon footprints analysis). Currently agricultural products have not yet been included in the program. Carbon labeling could soon be a prerequisite for the international trading of agricultural products. In general the carbon footprints of various agricultural products from New Zealand followed the methodology described in the ISO standards and conformed to the PAS 2050. The carbon footprint assessment focuses on a supply chain, and considers the foreground and the background systems. The basic scheme consists of four phases, which are the 'goal', 'scope', 'inventory analysis', and 'interpretation' phases. In the case of the carbon footprint of New Zealand kiwifruit the study tried to understand each phase's contribution to total GHG emissions. According to the results, shipping, orchard, and coolstore operation are the main life cycle stages that contribute to the carbon footprint of the kiwifruit supply chain stretching from the orchard in New Zealand to the consumer in the UK. The carbon emission of long-distance transportation such as shipping can be a hot-spot of GHG emissions, but can be balanced out by minimizing the carbon footprint of other life cycle phases. For this reason it is important that orchard and coolstore operations reduce the GHG-intensive inputs such as fuel or electricity to minimize GHG emissions and consequently facilitate the industry to compete in international markets. The carbon footprint labeling guided by international standards should be introduced for fruit products in Korea as soon as possible. The already established LCA methodology of NZ kiwifruit can be applied for fruit products as a case study.
In Korea, modern geomorphology has developed as one of main subjects in geography, such as in Europe. Geomorphology is one of the most advanced specialties in the geography dicipline, since foundation of Korean Geographical Society in 1945. Untill 1960's study, first generation of the Korean geomorphologists trained the younger ones, together with energetic research activities. Their great works in education and research established the base of ulterier development of the geomorphology in Korea. Since 1970s, research manpower and quality has incresed rapidly, partly due to the various international activities and cooperations of Korean geomorphologists. Owing to above development, Korean geomorphologist was able to found "The Geomorphological Association of Korea" in 1990 and publish "Journal of GAK", since 1994. Furthermore, geomorphologists are playing important roles in interdisciplinary academic societies, such as "The Korean Quaternary Assocition". Still 1960s, our research had focused on the identification and interpretation of erosional surfaces in Korea Peninsular. Of course, W.M. Davis's "Geographical Cycle Theory" and L.C. King's "Pedimentation Theory" had a great influence on the Koerans' works. After 1970s, the study of erosional surface played the important role in setting up the morphoclimatic viewpoint and methodology. Research scope tend to be notably broad and various than it was untill 1960's. Disposotion of the scientific methods and techniques become more and more apparent. These trends of research has settled precise descreption and interpretation of actual landforms, based on the careful field works, scientific measuring, and analisis, rather than methodology focused on the particular master theories. Recent geomorphological researches show the scope from climatic geomorphology and Quaternary geomorphology to granite and limestone weathering, pedo-geomorphogenic environment and periglacial landforms, focused on the small-to-medium scales. And then there have been new trying to interprete erosional surfaces such as hillslopes and terraces. Also, studies of coastal and plain landforms have been successfully developed. Recent new trends show the quantitative and analytic modelling using field measurement and laboratory work, and study on the human impacts on the natural landforms.y on the human impacts on the natural landforms.
Grain-Size Trend Analysis is the methodology to identify net sediment transport pathways, based on the assumption that the movement of sediment from the source to deposit leaves the identifiable spatial pattern of mean, sorting, and skewness of grain size. It can easily be implemented with low cost, so it has great potentials to contribute to geomorphological research, whereas it can also be used inadequately without recognition of its limitations. This research aims to compare three established methods of grain-size trend analysis to search for the adequate way of application, and also suggest the research tasks needed in improving this methodology 1D pathway method can corporate the field experience into analyzing the pathway, provide the useful information of depositional environments through X-distribution, and identify the long-term trend effectively. However, it has disadvantage of the dependence on subjective interpretation, and a relatively coarse temporal scale. Gao-Collins's 2D transport vector method has the objective procedure, has the capability to visualize the transport pattern in 2D format, and to identify the pattern at a finer temporal scale, whereas characteristic distance and semiquantitative filtering are controversial. Le Roux's alternative 2D transport vector method has two improvement of Gao-Collins's in that it expands the empirical rules, considers the gradient of each parameters as well as the order, and has the ability to identify the pattern at a finer temporal scale, while the basic concepts are arbitrary and complicated. The application of grain sire trend analysis requires the selection of adequate method and the design of proper sampling scheme, based on the field knowledge of researcher, the temporal scale of sediment transport pattern targeted, and information needed. Besides, the relationship between the depth of sample and representative temporal scale should be systematically investigated in improving this methodology.
Robert Rauschenberg's artistic career has often been regarded as having reached its culmination when the artist won the first prize at the 1964 Venice Biennale. With this victory, Rauschenberg triumphantly entered the pantheon of all-American artists and firmly secured his position in the history of American art. On the other hand, despite the artist's ongoing new experiments in his art, the seemingly precocious ripeness in his career has led the critical discourses on Rauschenberg's art to the artist's early works, most of which were done in the mid-1950s and the 1960s. The crux of Rauschenberg criticism lies not only in focusing on the artist's 50's and 60's works, but also in its large dismissal of the significance of the imagery that the artist employed in his works. As art historians Roger Cranshaw and Adrian Lewis point out, the critical discourse of Rauschenberg either focuses on the formalist concerns on the picture plane, or relies on the "culturalist" interpretation of Rauschenberg's imagery which emphasizes the artist's "Americanness." Recently, a group of art historians centered around October has applied Charles Sanders Peirce's semiotics as art historical methodology and illuminated the indexical aspects of Rauschenberg's work. The semantic inquiry into Rauschenberg's imagery has also been launched by some art historians who seek the clues in the artist's personal context. The first half of this essay will examine the previous criticism on Rauschenberg's art and the other half will discuss the artist's 1955 work Rebus, which I think intersects various critical concerns of Rauschenberg's work, and yet defies the closure of discourses in one direction. The categories of signs in the semiotics of Charles Sanders Peirce and the discourse of Jean-Francois Lyotard will be used in discussing the meanings of Rebus, not to search for the semantic readings of the work, hut to make an analogy in terms of the paradoxical structures of both the work and the theory. The definitions of rebus is as follows: Rebus 1. a representation or words or syllables by pictures of object or by symbols whose names resemble the intended words or syllables in sound; also: a riddle made up wholly or in part of such pictures or symbols. 2. a badge that suggests the name of the person to whom it belongs. Since its creation in 1955, Robert Rauschenberg's Rebus has been one of the most intriguing works in the artist's oeuvre. This monumental 'combine' painting($6feet{\times}10feet$ 10.5 inches) consists of three panels covered with fabric, paper, newspaper, and printed reproductions. Despite the title's allusion to the legitimate purpose of the painting as a decoding of the imagery into sound, Rebus, I argue, actually hinders a reading of it. By reading through Peirce to Rauschenberg, I will delve into the subtle anxiety between words and images in their works. And on this basis, I suggest Rauschenberg's strategy in playing Rebus is to hide the meaning of the imagery rather than to disclose it.
