The purpose of this paper is to introduce the limitation of liabilities of multimodal transport operators(MTO) in Korea. Also, this paper reviews the revised draft of Korean Commercial Code in 2015. This paper analyzes Korean multimodal transport systemand the limitation of liabilities of MTO by analyzing articles, regulations and practices of Korean Commercial Code and it's the draft in 2015. The paper, also, studies multimodal transport rules by comparing specifically international treaty, rules, or practices. In Korea, Article 816 of Commercial Code treats multimodal transportation adopting the network liability regime. The Article describes only the case of the multimodal transportation where the maritime carriage is engaged. Korea proposed the draft of multimodal transport regulation of Commercial Code in 2015 because present law could not apply for the multimodal transportation involved in the air or land carriage. This paper support the draft of Korean Commercial Code in 2015 because it is necessary to make a predictable legal system of multimodal transport and the limitation of liability reflecting practices or customs.

The Rotterdam Rules, which was adopted in December 2008 by UNCITRAL, has underlying intention that it will provide uniform law for the international carriage of goods by sea and modernize transport law reflecting modern transport custom. However, it is also true that there are various conflicting views on the Rotterdam Rules. This article tried to analyze main controversial issues such as scope of application, basis of liability of the shipper and the carrier, exception th the volume contract, legal position of the freight forwarder, delivery of the goods from the both sides of view. The Rotterdam Rules exposes some problems in applying and interpreting the Rules as many people indicated. These problems, I think, mainly due to the extended scope of application and broader range of issues. However, I do not think that the Rotterdam Rules will serious affect to the international transport industry. Furthermore, it is unreasonable to expect perfect Rules satisfying every interests.

The Incheon International Airport Express(I'Rex) is the railroad that connects Incheon International Airport, Gimpo Airport and Seoul Station. I'Rex is now under construction, and it will be connected to Gimpo Airport by 2007, to Seoul Station by 2010. However, there has been no discussion on how th connect different routes of railway Systems. Therefore it seems likely that rail passenger demand will be lower than that of limousine bus. Therefor, this paper proposes 4 effective connecting methods for I'Rex - (1) Shuttle transport, (2) Short-distance connecting transport (Inside I'Rex, Seoul Subway Line 9, 'Han-River line') (3) Mid-distance connecting transport (Jung-ang, Tae-baek, Young-dong line) (4) Long-distance connecting transport (Korean Train Express (Korean high speed railroad)) These methods can increase the connectivity of I'Rex with existing railroads and the competition power of I'Rex against a highway.

More than two years have passed since the latest UCP, Uniform Customs and Practice for Documentary Credits, 2007 Revision, ICC Publication No.600 became valid on July 1, 2007. There has been a lot of confusions in connection with the interpretation of the new UCP since July 1, 2007. Especially the transport document articles of the new UCP are the most confusing ones. Therefore, this work intends to study some points for practical attention of transport documents in the UCP 600. Transport documents can be divided into two kinds of documents such as marine transport documents and other transport documents. But most sellers and buyers distinguish two kinds of transport documents : the document of title and the document of non-title. Most traders consider the document of title importantly and ignore the document of non-title.

This paper investigates changing business transaction under the e-commerce environment and their implications on freight transport industry with some case studies. It shows that an efficient and reliable delivery system is essential for e-commerce as business industries are faced with the stricter and more diversified demands of customer. In addition, many aspects of business practices such as small batch, customized production and just-in-time distribution in the e-commerce environment, in turn, bring about a number of changes in the volume and service patterns of freight transport. E-commerce requires longer transport distances and often higher delivery frequencies. It also entails to a certain extent a modal shift towards truck and air freight transport modes. On the one hand, the logistical requirements of e-commerce goods may stimulate greater complexity in existing supply chain management, causing higher costs. However it is true that the increased visibility of goods through more efficient information flow allows more efficient and effective transport management in the logistics system.

The change of the development of transport and logistics systems occurs with the active change of technology and the advent of the era of Industry 4.0. It requires modernization of approaches to the development of transport and logistics systems at the macro and micro levels. The present study aims to identify perspective directions of development and evolution, find out the existing obstacles in the integration of technological solutions of transport and logistics systems at the macro and micro levels. This study is based on a quantitative and qualitative methodology for assessing the level of integration of technologies into transport and logistics systems to study the prospects for their development at the micro level. Macroeconomic indicators of transport and logistics in the context of different regions of the world were used to quantify the development prospects. For a qualitative assessment of the development of the transport and logistics system, the case study method was used. The object of the study was selected logistics company Sensco Logistics Inc., Austin TX. At the macro level, countries with more innovative logistics sectors have stronger mechanisms for coordinating private sector activities. Simplification of administrative procedures of control and regulation by the public sector in order to facilitate trade between countries is a promising direction for the development of transport and logistics systems. Such reforms are more effective in developing a "rigid" transport infrastructure. The integration of Industry 4.0 technology solutions into the international logistics sector is defined by political and legal barriers, especially in developing countries. In low-income countries, hard and soft infrastructure reforms are hindering the development of logistics companies that provide transport services. This determines the national level of development of transport and logistics systems, and in general the global level of development of transport and logistics. In developed countries, the legal barriers to the development of new technological logistics are environmental requirements for the integration of technologies into the transport system. These trends are slowing down the development of International Logistics, which, compared to other industries, is slower to integrate Industry 4.0 technologies. This study combines macroeconomic factors that determine the prospects for the development of transport and logistics systems at the micro level.

C.I.F. and F.O.B. contracts are the chief terms used in international trade contracts. But, in recently, the multimodal transport which is based on the containerization and the improvement of air transport has been grown gradually, Regardless of theese change in international trade environment, most of the contract of sale is made by C.I.F. and F.O.B. contracts which are based on the traditional port to port transport. In other words, there are some limitation in terms of legal base in which traditional C.I.F. and F.O.B. contract is applied to the changed environment. Especially, problems arised in marine insurance which export by F.O.B. trade terms. Therefore, when the parties of the contracts of sale make an sale contracts by using the container ship and Multimodal Transport, they should use the F.C.A. and C.I.P. contracts Instead of F.O.B. and C.I.F. contracts for the transport of goods. And parties of the contracts of sale need to gain a better understanding of the characteristic of F.C.A. and C.I.P. terms and the problem of the F.C.A. and C.I.P. contracts used in the performance on international multimodal transport.

Mongolia as a land-locked country, has tried to diversify its foreign trade with European and Asian countries. Recently continual price rise of mineral resources also helps Mongolia have chances to gain her trading partners. Nevertheless, regulations and barriers to exports of Mongolian mineral resources in China and Russia, which are transit countries, are complex and complicated in border crossing and transshipment procedures for transit transport. This paper discusses problems and barriers to economic and efficient logistics systems and transit transport of Mongolian mineral resources, and addresses a proposal of international intermodal transport corridors for improving transit transport, and suggests international cooperation, by applying transit rights of land-locked country. Specifically, it is necessary for Mongolia to search for other international intermodal corridors besides the corridor through the port of Tianjin. It is needed to build an international organization for discussion of affirmation of logistics equipments and improvement of transit procedure in border crossing, and to raise financial feasibility in building a new intermodal corridor.
