  • The purpose of this comparative study is to compare and evaluate international arbitration and forum selection agreements. Recent decades have seen an unparalleled expansion of global trade and investment. Business enterprises of every description ann find themselves entangled in legal proceedings with foreign companies or government entities. Thus, the costs of these proceedings and the consequences of losing are often substantial. Almost, every international commercial controversy poses a critical preliminary question - 'where, and by whom, will this dispute be decided?' the answer to this question often decisively affects a dispute's eventual outcome. It can mean the difference between winning and losing. between de minimis damages and a multimillion dollar award. The same dispute can have materially different outcomes in different forums. Because of the importance of forum selection, parties to international contracts often include contractual dispute resolution provisions in their agreements. These provisions significantly reduce the uncertainties inherent in international commercial disputes, and can offer a substantial measure of partisan advantage. as a consequence, it is almost always advisable to include a contractual dispute resolution provision in any international contract. These provisions typically take the form of : (1) forum selection clauses, or (2) arbitration agreements.

A Study of Developing the Evaluation Tools of International Airport′s Service Quality in Korea (국제공항 서비스품질 측정도구 개발에 관한 연구(인천 및 김포국제공항을 대상으로))

  • It has been regarded as important in both academic and practical issues how to evaluate service quality. In addition international traveling will be growing due to increasing income and globalization. Thus, it is very important to measure the international airport's service quality properly. This study was conducted to identify the service quality factors which are utilized to measure international airport's service quality. According to the statistical analyses' results of this study, seven service quality factors and thirty two measurement items were found to evaluate international airport's service quality. They are some different from those which PZB(1988b) identified to measure service quality. This result implies that it is necessary to find the service quality factors reflecting the unique characters of the service organization when measuring service quality of a service organization.

Perspectives on the new National Ecological Institute in South Korea

  • The Ministry of Environment of South Korea has launched its plan to establish the National Ecological Institute. An International Symposium and Workshop was held at Ewha Womans University in Seoul on Thursday, 30 September 2010, to strengthen international cooperation, networking and partnerships for the conservation of biodiversity. This symposium was attended by experts of many major institutions for biodiversity conservation from South Korea and overseas. At the symposium and workshop preceded by a keynote speech by the renowned primatologist and conservation biologist Jane Goodall the participants discussed a wide range of topics including "biodiversity conservation: in situ and ex situ approaches", "conservation of species diversity and ecosystem management", and "international cooperation for biodiversity conservation and research". As a basis for future discussions, this article summarizes how the National Ecological Institute might contribute most effectively to public life and environmental management in South Korea and worldwide. It addresses the following issues: governance and funding, synergies within Korea, participation in international networks, external advice, a broad view of ecological issues, research agenda, building on identity, public outreach, and training the next generation of scientists.

  • The International Maritime Organization (IMO) issued 2017 Guidelines on maritime cyber risk management. In accordance with IMO's maritime cyber risk management guidelines, each flag State is required to comply with the Safety Management System (SMS) of the International Safety Management Code (ISM) that the cyber risks should be integrated and managed before the first annual audit following January 1, 2021. In this paper, to identify cyber security management targets and risk factors in the maritime sector and to conduct vulnerability analysis, we catagorized the cyber security sector in management, technical and physical sector in maritime sector based on the industry guidelines and international standards proposed by IMO. In addition, the Risk Matrix was used to conduct a qualitative risk assessment according to risk factors by cyber security sector.

The Management Performances originated from the Competitive Advantages of Korean Tourism Firms (한국 관광기업의 경쟁우위 요인이 경영성과에 미치는 영향)

  • This study is for analyzing the management performances of Korean tourism firms, operating as preparing strategically against FTA which is one of the most importantly external environment in international management since in the middle of 1990s. The main purpose is to test empirically some relations between the management performances and the levels of ownership-specifics advantages of Korean tourism ones. To be exact, the dependent variables of management performances are classified with sales, profits and management satisfaction, while the independent ones of the competitive advantages are sorted with the 5 following factors like marketing, product development, service supply, finance and organization culture. The survey of Korean tourism enterprises engaging in management activities in Korea is implemented by collecting questionnaires. And for testing the hypothesis, the analyzing tools are being used for correlation, reliability, validity, multi regression and the path analysis of structural equation modeling. As a result, Marketing is certified as only common factor to influence three dependent variables of sales, profit and management satisfaction positively.

  • Major accidents such as typhoon, tsunami, and chemical accidents have been continuously occurred. In this environment, Technical Commitment (TC) related to disaster management part in the International Organization for Standardization (ISO) concentrates their efforts to enact the business continuous management in emergency situation for international standard. As a result of TC223, four international standards are enacted in 2011, 2012. In the Korean industrial standard, two international standard (ISO22300, ISO22301) out of four standards were enacted in 2012. This study analyzes a recent trend and proposes a method activating of international societal security standard for chemical accidents. Disaster certificate system for developing disaster safety industry is suggested. We hope each related organization could develop our disaster safety management policy and research based on this study.

The Effect of international management activity and e-business on knowledge management (국제경영활동과 e-비즈니스가 지식경영에 미치는 영향)

  • Recently, knowledge management and E-business are very important issues in academic and business fields. Research questions related with these issues are which factors stimulate knowledge management. Another question is whether knowledge management is related to E-business. To answer these questions a research model was proposed. The data were collected from 90 manufacturing firms in Korea. Appropriate research methodologies were employed for analysis. Results found that the degree of firm's internalization, diversity of domestic management activities and learning orientation affect knowledge aquisition and transfer. Knowledge aquisition and transfer facilitate knowledge application, resulting in new product development, cost reduction and technology differentiation. Knowledge management is a kind of process. This result, therefore, confirms what previous literature predicted.

  • A nuclear power plant construction is a complex form of construction which comprises various stakeholders and contractors. Therefore, contract disputes will occur due to conflicting interests of contracting parties and unpredictable factors which arise during construction work. Even if the contract is well prepared, it cannot fully prepare for future situations in actuality. Claims management is very important in carrying out construction management. This study intends to define claim, and delve into development of claims management processes from the viewpoint of owners and contractor through consideration on international contract terms on claims management and the details of the claims management of the Construction Extension to the PMBOK. In addition, it is needed to accumulate and manage data on claims that have occurred so that they can be referenced in the future. As information should be accumulated so that type classification can be carried out and that lessons can be learned on claims that have occurred in each business site, study on establishing data-based systems relating to claims processes will be needed in the future.

  • Air pollution problem has been one of the most urgent global environmental problems since UN Framework Convention on Climate Change accepted in Rio Conference, 1992.
