A Study on Improvement of the Calculation Methodology of Employee Invention Compensation (직무발명 보상액 산정 방법론의 개선 방안 연구)

  • According to the Statistics Korea in 2016, 56.9% of companies do not fairly pay compensation for employee invention, despite the increasing proportion of the inventions in corporations. One reason is that the objective calculation method for employee and patent's contribution and the clear standard of fair compensation have not been established. Therefore, this study proposes a new calculation method using DCF (Discounted cash flow) and AHP (Analytical hiearchy process) methodology to calculate the fair amount of employee invention compensation, and verified it through real case examples. As a result, 2.3 times higher amount of compensation was calculated than the previous approach. This study is meaningful that it provided objective compensation criteria that could more protect the inventor in the situation which the clear criteria for the calculation of fair compensation are not established. This methodology is expected to be applicable for SMEs as employee invention compensation.

  • Financial instruments are economic and intangible assets that bring financial company tremendous economic returns when it is a success. Also, It is necessary to protect this because it is a product of effort made by a lot of human resources and materials. However, legal and institutional devices for financial instruments are insufficient currently and 'copying practices' are rampant throughout the industry in korea. This ultimately inhibits the utility and welfare of consumers, but also adversely affects the competitiveness of the financial industry. In order to finance innovation that new financial products and services have appeared, it is necessary to grant the appropriate rights, such as intellectual property rights of financial instruments. And, there is a need for measures to protect it. Thus, this study proposed new way protecting the financial instruments through Intellectual property right. It is the introduction of similar protection system to financial instruments, such as mechanisms that protect database producers in copyright law.

  • Unlike other lawsuits, patent infringement litigation is a very difficult case to grasp without expert knowledge of the patented technology. The Patent Agent Act seems to recognize the legal representation of patent agent in Article 8, but the Constitutional Court and the Court have refused to recognize patent agent's legal representation right in the patent infringement suit. In this regard, constant controversy is taking place among patent agents and lawyers. This study examines the measures to enhance the effectiveness and professionalism of patent litigation in patent infringement litigation. This study analyzes the role of patent attorneys in patent infringement lawsuits in major countries and derive rational alternatives. As a result, it is inappropriate to restrict the attorneys' automatic acquisition of patent attorneys' qualifications or revise the patent attorneys' law in relation to the patent attorney's right of proxy. In the case of litigation parties, it is a desirable alternative to introduce a revised patent attorney system for the fundamental problem solving and to allow the litigants to reasonably choose the litigation agent.

  • The development of digital technology and the Internet has brought about a great change in the content industry. In order to keep pace with these changes, the copyright law has undergone several revisions, and the concept of "digital sound transmission" was introduced in the 2006 revision. However, in the current law, digital audio transmission is problematic in that the criteria for distinguishing between broadcasting and transmission is abstract and unclear. This ambiguity makes it difficult to judge the legal status of new music webcasting service such as "Free Litsen". Although these services are positioned as digital audion transmission, they have created a new concept of pseudo transmission because of its similarity to the audio transmission in its convenience and utility. These problems stem from the imbalance of between the development of technology and the legal system, so the change of the legal system is inevitable. Thus, this study discusses US copyright law and related cases, and then suggests solutions for pseudo transmission problems. This study suggests legislative criteria for pseudo transmission problems and legislative measures that can reduce the actual damage to the music market.

Personal Characteristics and Information Privacy Concerns (개인적 특성과 정보 프라이버시 염려)

  • There has been active discussions on informational view among various privacy perspectives because of Internet usage. Social science research has largely discussed determinants of information privacy concerns (IPC) and its behavioral outcomes. However, the focus of studies was limited to company's practices and existing studies have not reported consistent results. In addition, the relationship between demographic characteristics of user and IPC has not been discussed enough. In this study, we re-investigate the relationship between users' demographic characteristics and IPC with data from a large sample provided by the Korea Information Society Development Institute (KISDI). The results showed that educational background and income level have effects on IPC in line with existing studies. But the effects of gender and age had different impact on IPC compared to previous studies. This study has implications in enabling generalization of empirical findings and confirming the results of previous studies.

  • Digital Humanities System is a method to effectively share and spread Humanities information and knowledge to users by using information technology. It Also comes into the spotlight as a new research methodology for researches of Humanities researchers. Digital Humanities System distinguishes itself from other existing information systems. Therefore, when the system is developed, it needs to supply with manpower related to development process which is specialized for Digital Humanities System, not for the several established construction methodology. Digital Humanities System studies recently is mostly constructed using the usual methodology of information system construction. Because of its falling efficiency and usability after constructing the system, however, examples of failure of operating system occur. In this paper, accordingly, effective and creative Digital Humanities System development methodology will be studied from the point of view of information technology through collaboration with various field of expertise. In detail, based on information system methodologies in software engineering perspective, we propose a methodology to build a specialized system in the digital humanities.

  • As a form of convergence studies, many studies on electronic cultural atlas have been performed. In this paper, our objective is to design an electronic cultural atlas for utilizing photo contents based on display and sharing effect. This is one of the ways to effectively use various photo contents. Through electronic cultural atlas, photo contents are recognized as an object that contains a lot of information. To do this, we design an electronic cultural atlas for utilizing photo contents, and investigate the utilization differences through comparison with existing systems. In detail, we examine the limits of the traditional photo exhibition method, and research on usability of users when an electronic cultural atlas was used to exhibit and share the photos contents efficiently.

A Study on Electronic Cultural Atlas using Thematic Overlay Function Focused on Israel·Palestine (주제별 중첩 기능을 활용한 전자문화지도에 관한 연구 - 이스라엘·팔레스타인을 중심으로)

  • Electronic cultural atlases based on a variety of topics have been studied because of recently increased interest about them. Existing cultural atlases are difficult to analyze the correlation between the subjects and to make utilization based on the various points of view since they are implemented mostly by a single theme. To solve these problems, we propose a method that express a variety of themes by using layer functions of electronic cultural atlases. Using thematic overlay functions, also, application plans are suggested to analyze the relationship between subjects and to derive new knowledge through the association of various themes.

  • Geographical Identification (GI) regulation is not common in Korea. Although studies on the regulation recently have been conducted, there is a lack of academic discussion about its domestic introduction and activation plan. GI regulation has advantages in terms of activation of local industry, consumer protection, and economic efficiency. Moreover, the quality of agricultural and marine products in Korea is not lower than that in Europe to apply GI regulation. Therefore, it is necessary to establish the regulation in Korea through the review of the reference cases. This study examines the status of GI regulation and policies in Korea and foreign countries for the protection of domestic liquor industry. This study also provides suggestions to achieve the growth of domestic Makgeolli through GI regulation as if the liquors representing a country such as French wine, Japanese sake, and German beer are being loved around the world.

Improvement of PCR Preprocessing Efficiency through PEO-controlled Synthesis of Silica Nanofibers (PCR 전처리 효율 향상을 위한 PEO 제어 실리카 나노섬유 제작)

  • In this study, we demonstrated a silica nanofibrous membrane based on the electrospinning process and evaluated its DNA isolation and purification performance in PCR pretreatment. Generally, silica membranes made of non-woven fabric are used for PCR pretreatment, but this study aimed to improve the efficiency of the pretreatment process by developing a nanofiber-type silica membrane with high specific surface area and porosity. In order to manufacture a nanofiber-shaped silica film while maintaining the original physical properties of silica, nanofiber membranes produced by adding various concentrations of PEO (5 wt%, 8 wt%, and 10 wt%) to silica prepared by the sol-gel method were compared. In terms of nanofiber membrane production, the higher the PEO concentration, the more effective it was in producing nanofiber membranes. The produced silica nanofiber membrane was inserted to a pretreatment device used in commercial PCR equipment, and the pretreatment performance was compared and verified using Salmonella bacteria. When Salmonella was used, samples containing 5 wt% PEO showed superior PCR efficiency compared to samples containing 8 wt% and 10 wt% PEO. These results show that adding 5 wt% of PEO can effectively improve DNA purification and separation by producing a nanofiber-shaped silica film while maintaining the physical properties of silica. We expect that this study will contribute to the development of effective PCR pretreatment technology essential for various molecular biology applications.
