이 글은 공연예술아카이브의 기록물 수집과 서비스 과정에서 필요한 초상권 문제를 검토하고, 실무적 대응방안 마련을 위한 것이다. 이를 위하여 초상권의 개괄적인 내용을 검토하고, 공연예술사진과 영상의 수집과 서비스 과정에서 발생하는 초상권 문제를 분석하였다. 이러한 분석을 바탕으로 공연예술아카이브의 운영에 참고할 수 있는 점검사항을 제안하였다. 연구의 결과로, 초상권은 인간의 외면적 모습을 보호대상으로 하며, 공공의 알 권리와 충돌할 경우에 그 이익을 비교 형량하여 보호의 여부가 결정됨을 밝혔다. 아울러 공연은 사회적 표현행위의 하나로 출연자는 공연의 일부를 구성하는 특정한 역할을 수행하는 것이기 때문에 이를 사생활로 보기는 어려움을 밝혔다. 공연예술아카이브는 기록물의 내용과 공개의 파급효과를 종합적으로 고려해서 서비스의 범위와 수준을 결정할 필요가 있다.

본 논문에서는 구성요소와 그들 간의 유연한 연결을 가진 인체 모델로 인체를 추적하기 위한 구성요소 기반 확률 전파를 제안한다. 인체는 사람의 동작을 추적하는데 필요한 6개의 인체 부위로 나뉘는데, 머리, 몸통, 왼팔, 오른팔, 왼발, 오른발 등이다. 제안하는 추적 방법은 인체 전체의 실루엣을 추적하지 않는 것이 아니라 구성요소로 이루어진 인체모델을 이용하여 인체의 각 부위를 개별적으로 추적하게 된다. 제안된 인체 추적 시스템은 유아의 동작 교육에 적용되는데, 균형잡기, 앙감질, 뛰기, 걷기, 회전하기, 구부리기, 뻗기와 같은 동작을 추적하는데 이용된다. 제안하는 시스템은 인체 모델의 각 부위를 개별적으로 탐지하고 움직임을 추적하여 평균 97%의 추적율을 획득하였다.

Information and Communication Technologies(ICTs) have substantially enlarged both the opportunities to realize one's human rights but have also resulted in the emergence of new challenges. ICTs are so deeply embedded and cental to almost all aspects of human activity. And ICTs are assuming an increasingly central role in all aspects of human and societal development across the world. But this is especially true of the right to privacy, which faces challenges such as profiling and data mining for public(including national security) and private purposes. ICTs access is a fundamental right for all humans in the information age. So we have need for regulation based on human rights in the digital age. And governments have a responsibility to protect individuals against violations of human rights and data protection by public authorities, but also by private entities. In addition, internet governance and multi-stakeholder principle have to be stressed on all of the internet issues because internet governance is included in the principle of democracy which have bottom-up communication and equality. So it is very importance that Internet Governance Forum is the space for a meaningful discussion on public policy issues relating to the internet.

이 글은 현행 헌법의 규정과 헌법재판소 결정 그리고 개헌안의 건강권 신설 규정 등을 비판적으로 검토함으로써 건강권의 헌법적 의미를 특히 '인간다운 생활을 할 권리'와의 관련성 속에서 고찰하는 것을 목적으로 한다. 건강은 개인의 일반적인 행위 및 가치실현의 전제가 되는 기본적인 자유로서의 성격을 갖게 되었으며, 국가는 개인의 건강을 보호하여 가장 기본적인 '인간다움'의 조건을 보장하고 자유 실현의 기초를 마련해야 한다. 헌법 제36조 제3항에서 규정하는 보건 보호라는 국가 과제는 인간다운 생활을 할 권리에 관한 헌법 제34조의 구체적 내용으로 이해되어야 한다. 그리고 인간다운 생활을 할 권리를 '사회보장권'으로 이해할 경우, 헌법상 건강권은 '건강에 관한 사회보장권' 내지 '건강보장권'을 의미한다고 할 수 있다. 한편, 헌법재판소는 인간다운 생활을 할 권리에 대한 사법심사에서 소위 '최소한의 물질적인 생활 기준'을 채택함으로써 동 권리의 내용을 협소하게 파악하고 있다. 그러나 인간다운 생활을 할 권리는 '인간의 존엄성에 맞는 건강하고 문화적인 생활을 향유할 수 있는 권리'를 의미하고, 다만 그 보호의 수준이 어느 지점인지에 대한 판단이 일차적으로 입법재량에 맡겨져 있을 뿐이다. 그렇다면 인간다운 생활을 할 권리에 관한 사법심사는 입법재량의 통제 문제로 귀결된다.

This study was conducted to observe the condition of the ramification of the bronchus and pulmonary blood vascular system by injection of vinylite into the bronchial tree and pulmonary blood vessels in normal adult swines. The results obtained were summarized as follows. 1. Lungs of swine were composed of the same pulmonary territories as in lungs of human and dog. 2. Bronchial tree of swine also were axial divergency in the patterns. 3. Ramification of the left and right apical lobes are especially complex patterns but cardiac and diaphragmatic lobes are a little monotonous. 4. Intermediate lobe corresponding to mediobasalis branch of human lungs formed only one lobe in swine lung. 5. Pulmonary artery of right apical lobe was mono branch form in all case by authors observation. 6. $B._2$ streched into the seg. dorsalis of the right apical lobe was especially developed compare to $B._1$, $B._3$ of the seg, apicalis and seg, ventralis.

KORAIL continuously drives practical reforms of change and originality both internally and externally for the purpose of adapting to rapidly changing circumstance and promote productivity of the organization. Various management strategies are needed to increase its productivity, yet the fist thing to be considered is to select talented human resources. A selection of the human resource should be conducted based on 3R(Right People, Right Place, Right Time). This study empirically analyzes through actual study how the method of new employment introduced on January 1, 2005 positively affects capability and productivity of each member of KORAIL. The area of this study is defined centering on the standard of new employment, capability of personnel, and productivity of the organization. Also, the improvement of new employment standard of KORAIL is suggested as significance of the standard was verified through survey of the standard, the capability and the productivity conducted to KORAIL working personnel.

오늘날 연예 스포츠 및 광고산업이 급격하게 발달하면서 유명인의 성명 초상 등을 광고에 이용하는 경우가 증가하고 있으며, 유명인의 성명 초상 등을 이용한 상품의 선전이나 광고는 높은 상품선전력, 고객흡인력 및 상품구매력을 가지게 되었다. 이처럼 개인의 성명 초상 등에는 인간의 존엄과 가치의 징표인 인격적 가치뿐만 아니라 이를 이용하여 경제적 이익을 얻을 수 있는 재산적 가치가 혼재되어 있다. 그러나 광고업자 등이 유명인들의 성명 초상 등을 허락 없이 또는 그 계약범위를 넘어 이용함으로써 당사자는 정신적인 고통을 받음과 동시에 경제적인 손해를 보게 되어 법적 분쟁이 발생하고 있다. 우리나라도 한류열풍으로 인한 저작권산업의 시장이 커져 가고는 있지만, 한류스타들의 법적 보호장치 없이 앞으로도 계속해서 그들의 성명, 사진들이 도용되는 것을 방치한다면 한류는 지속될 수 없다. 한류의 끝임 없는 공급을 위한다면 연예인, 스포츠 스타들이 성명, 초상 등을 상업적으로 이용할 수 있는 권리인 퍼블리시티권의 법제화에 대하여 본격적으로 논의할 필요성이 있다. 이와 관련하여 본 논문에서는 퍼블리시티권의 양도성과 상속성에 관하여 살펴보고자 한다.

We could summerize the concept of the right and left mentioned in Nai-Gyung and some literature of oriental medicine as follow At first the right and left is a directional right and left which implys left-liver-right-lung(左肝右肺), left-yang-right-eum(左陽右陰), secondly it is also the road of eumyang which implys man-left-woman-right(男左女右), left-blood-right-ki(左血右氣), left-sinsu-right-myungmon(左腎水右命門), and left-right of pulse. left-liver-right-lung(左肝右肺), left-yang-right-eum(左陽右陰) and man-left-woman-right(男左女右) are expressions of the movement of yang which is a core of chang, at the same time, left-blood-right-ki(左血右氣), left-sinsu-right-myungmon(左腎水右命門), and left-right of pulse are expressions of the eum in response to the movement of yang. (go up and down of water and fire) Finally, both a directional right and left and a road of eumyang mean a road of going up and down of eumyang so, this is very important index in circulation and keeping ballance of eumyang (ki-Hyul:氣血) in the human body therefore, we can treat a disease with acupuncture in the use of this charater, for example when a disease occurs in the left side, we can treat it with acupuncture in the right side, the same applys to right.

The "Child Care and Education Policy(CCEP)" is important because it is responsible for providing 'care and education service' to young children in their 'most sensitive period' of human development. In reality, however, children's rights can only be sanctioned by adults and their rights are recognized at the level of abstraction. This study analyzes the 'Child Edu-care Act(CEA)' first enacted in 1991 from the 'perspective of children's rights', especially in terms of the rights of infants and preschoolers. In order to assess the CEA's "children's rights guarantee level", this study developed a number of standards based on the "UN Convention on the Rights of the Child(CRC)" and other documents. The results revealed that "children's rights guarantee level" was assessed against 4 categories ('Right to Survival and Development', 'Right to Welfare', 'Right to Education', and 'Right to Proper Care'), and the CEA(1991) was found to have a high guarantee level although it was enacted before Korea's ratification of the CRC. The results of this study can serve as a useful reference point for detailing children's rights and suggesting regulation standards for the CCEP.

동성애로 인하여 인간면역결핍 바이러스에 감염된 54세 남자가 발열, 우측흉통을 주소로 응급실로 내원하였다. 흉부단순촬영상 우측 흉막삼출액이 관찰되어 폐쇄식 흉관삽입술을 시행하였으며 흉막액 세균배양검사에서 살모넬라와 대장균이 동정되었고 항생제 투여에도 불구하고 증상 호전이 없어 늑막전폐절제술을 시행하였다. 수술 후에 환자상태는 호전되는 양상이었으나 수술 후 10일째 부분발작을 보여 뇌 단층촬영을 시행하였으며 우측 전두엽과 좌측 전측두엽에 여러 개의 종괴가 관찰되었고 수술 후 12일째 의식이 저하되면서 급성 호흡부전으로 수술 후 14일째 사망하였다.
