Nuclear Weapons Deployment and Diplomatic Bargaining Leverage: The Case of the January 2018 Hawaiian Ballistic Missile Attack False Alarm

  • North Korea's development and deployment of nuclear weapons increases Pyongyang's diplomatic bargaining leverage. It is a strategic response to counteract the great expansion in US leverage with the collapse of the USSR. Post-Cold War American influence and hegemony is justified partly by claiming victory in successfully containing an allegedly imperialist Soviet Union. The US created and led formal and informal international institutions as part of its decades-long containment grand strategy against the USSR. The US now exploits these institutions to expedite US unilateral global preeminence. Third World regimes perceived as remnants of the Cold War era that resist accommodating to American demands are stereotyped as rogue states. Rogue regimes are criminal offenders who should be brought to justice, i.e. regime change is required. The initiation of summit diplomacy between US President Trump and North Korean leader Kim Jong-un occurred following the January 2018 Hawaiian ballistic missile false alarm. This event and its political consequences illustrate the efficacy of nuclear weapons as bargaining leverage for so-called rogue actors. North Korea is highly unlikely to surrender those weapons that were the instigation for the subsequent summit diplomacy that occurred. A broader, critical trend-focused strategic analysis is necessary to adopt a longer-term view of the on-going Korean nuclear crisis. The aim would be to conceptualize long-term policies that increase the probability that nuclear weapons capability becomes a largely irrelevant issue in interaction between Pyongyang, Seoul, Beijing and Washington.

  • This study has been started by the trendy analysis of parody in post-modern dance. Creative parody is not an imitative work but provides new originality of a work of art and serves as the criticism. Since the 1960s the trend and characteristics of using parody in post-modern dance can be classified into five concepts which are the cultural diversity, the autonomous thinking ability, the aesthetic perception, the use of the mass media and the cultural relations of the critical process. In conclusion, the parody elements in post-modern dance are due to the cultural diversity, and the experimental values which are divided into the beauty of content and mode has been acted as the important factors to achieve the parody elements to new dimension.

Legal review on essential business of hospital business (병원사업에 있어서 "필수유지업무"에 관한 법리적 검토)

  • This paper is to discuss essential business of hospital business. While the labor world and ILO made continuous recommendation for improvements towards the compulsory arbitration system along with the controversy over unconstitutionality of the system, the Constitutional Court ruled that the system is constitutional on December 23, 1996(90hunba19) and on May 15, 2003 (2001hunga31). Despite this decision from the Constitutional Court, there has been much controversy over whether the compulsory arbitration system infringes the rights of collective action against the principle of trade union & labor relations adjustment which allows Commissioner of the Labor Relations Commission to decide on submission of arbitration by virtue of his/her authority in case where industrial disputes take place in the essential public-service businesses. The revision on the above provision was closely examined from the year 2003 and an agreement was made on the abolition of the compulsory arbitration system and the introduction of essential business with a grand compromise among labor unions, employers and the government on September 11, 2006 followed by revision(Essential business system enacted on January 1, 2008) of the Trade Union & Labor Relations Adjustment Act on December 30 in the same year. Accordingly, in order to perform the essential business, parties to labor relations must have an agreement or obtain a decision by the Labor Relations Commission before taking industrial actions. This paper firstly examined the concept of essential public-service businesses and essential business, legal meaning of essential business, procedures for making agreement and decision and legal effects. Secondly it intensively explored a theory against the principle of the legality which was raised from some part of society. In other words, it is claimed that a theory against the principle of the legality is not consistent with the rule of legislation and some abstract wording is against void for vagueness doctrine because part of crime constitution requirements is delegated to the Presidential Decree or to consultation among parties to labor relations. But analysis on the rule of legislation and void for vagueness doctrine reflected in the decision by the Constitutional Court led that argument for a theory against the principle of the legality is not reasonable. Close examination was done on a formal act of essential business agreement and necessity of prior agreement before submission of decision to the Labor Relations Commission which might have difficulties in performing work. A Study on History of Criminal Policy in Korea (한국(韓國)의 형사정책(刑事政策)에 관한 역사적(歷事的) 고찰(考察))

  • During the ancient times, there was no separative judicial system and administrative , legislative and judiciary functions were ultimately concentrated in the all-powerful monarch. And the three states developed state organization , adopting hieratical structures and placing at the pinnacle . State Codes were promulgated to initiate a legal system to rule the people, these codes instituted under influence of China codes. The people tradition sees crime control as the preservation of the authority of hereditary rulers. In the period of the Koryeo dynasty, government accepted a serious of detailed penal code from Tang dynasty . Legal response to crime stressed preservation of the dynasty rather than making citizen behave according to certain rules. In the period of Early Joseon , the compilation of Grand Code for state administration was initiated, the Kyeongkuk Taejeon ,became comer stone of the dynastic administration and provided the monarchial system with a sort of constitutional law in written form. This national code was in portant means of criminal policy at that time, Late Joseon , the impact of Western culture entering through China gave further impetus to pragmatic studies which called for socio-economic reforms and readjustment. Approach to criminal justice policy emphasized more equitable operation of the criminal justice system ,rehabilitation and crime control. Korea-Japanese Treaty concluded on 22 August ,1910 and proclaim a week later ,Japan gave the coup de grace to the Korea Empire and changed the office of the Resident - General into the Government - General . Thus korean criminal policy were lost during a dark ages ,which lasted for 36 years after fall of Joseon Dynasty (the colnial period,1910${\sim}$1945). After 1945 Korea's liberation from Japanese colonial rule, the occupation of devided Korea by the United States and Soviet Union frustrated the efforts of Koreans to establish an independent government, and the transplantation of two conflicting political ideologies to south and the north of the 38th parallel further intensified the national split. U.S. military government office occupied the south of the 38 the parallel and placed emphasis on democracy of criminal policy. ln 1948, the U.S. military government handed over to the ROK government its administrative authority.

  • In recent years, the relationships and inter-dependencies between the countries in East Asia have deepened, and the vision for regional cohesion such as the East Asian Community have been gradually elaborated. A Grand Design for Northeast Asia is one of these comprehensive visions that aim to improve and develop international infrastructure through cooperation in the field of transportation, energy, environment, and information technology. This study paid attention to the possibility for a system for regional cohesion and cooperation in spatial development in East Asia, and analyzed the roles of the ESDP according to the requirements of the East Asian situation. As a result, it was understood that while the development of infrastructure is a main stream in the case of the regional cohesion in East Asia, the cooperative visions for the conservation of natural and cultural heritage, which are being positioned as an important policy in the EU, have not been seen. It is a very important subject to promote the policy cohesion/cooperation on the conservation and management of natural/cultural heritage and the development of tourism infrastructure for the sustainable development of East Asia, considering the trends in the growth of the interchange population and tourism market in East Asia. It was discussed that the role of research networks like the International Landscape Architectural Symposium of Korea, China and Japan is becoming important in supporting this policy cohesion and in grasping the present conditions and trends of the spatial development of these counties.

The Question of 'State and Art' with regard to Soviet Socialist Realism (소련 사회주의 리얼리즘에 관하여: '국민과 예술'의 문제)

  • The artworks of Socialist Realism of the former Soviet Union, with the beginning of the 21st century, are gaining a new attention from art collectors. One reason for this might consist in the fact that relevant art pieces exemplify the ways in which they visualize ideas on the basis of their high-profile art tradition and also in which they integrate their utopian ideals with mysticism. These aspects of the Soviet art goes far beyond the wide-spread assumption that their art, as a means of propaganda, principally represents a political allegiance to the system. With Stalin coming into power in the 1930s, the artistic trend of Socialist Realism obtained a nationwide sympathy and support from people, giving birth to a new art which essentially corresponded to the demands of the political power. An official art current of the USSR over the period from the 1930s to 1950s, Socialist Realism was in tandem with the Communist commitment to the party and popularity, symbolizing a loyalty to the cause. It was thus characterized by plainness and lucidity so that ordinary people could gain easy access to art. Its salient feature, over an entire range of art, was an optimistic pursuit of a utopian dream. Therefore, it tallied with the popular sentiment for a Communist paradise, giving form to their beliefs in human agency working at the materialist world and also to such abstract concepts as force, fitness, and beauty by adding even mythical ideals. Its main subject matter includes harvest feasts of collective farms, imaginary socialist cities, grand marches of heroic laborers and in this way it served as a propaganda for a sacred utopia of socialist totalitarianism. On the other end of the spectrum, however, rose the second camp of art, which put an emphasis on bona-fide artistic activities of plastic art and on an artist's personal expression and freedom, as opposed to the surface optimism of Socialist Realism. Central to the Russian Avant Garde art, which prized the above-mentioned values, were Malevich's Geometric Abstraction and A. Rodchenko's Constructivism. Furthermore, in the transitional era of the late 20th century and the 21st century it was recognized that film art or electronic media art, rather than traditional genre of paintings, would function as a more efficient way of propaganda. These new genres were made possible by ridiculing the stereotypes of the Russian lifestyle and also by ignoring ethical or professional dimensions of artworks. That is, they reinvented themselves into a sort of field art, seemingly degrading the quality of artworks and transforming them into artifacts or simulacres in the very sense of post-modernism. The advent of the new era brought about the formation and occupation of pop culture of the younger generations, calling into question the idea of art as the class-determined. It also increased the attention to field art, which extensively found way to modern art centers, galleries, and exhibition projects. It can be stated that this was a natural outcome of human nature.
