싱가포르 국제중재제도에 관한 연구 (A Study on the International Arbitration System of Singapore)

  • These days, in line with the increase of opportunities in our country's firms to do transaction, large-scale M&A and investment with foreign firms incorporating arbitration clauses in the contracts have become general practice. Recently, Singapore has come to the fore as a place of arbitration and, particularly, Singapore International Arbitration Center (SIAC) was assessed as the favored international arbitration institution uniquely in Asia at the 2010 International Arbitration Survey: Choices in International Arbitration, along with the ICC, LCIA, and AAA/ICDR. Therefore, the country's firms need to understand properly the international arbitration procedure of Singapore. This study examines the international arbitration system of Singapore, focusing on the arbitration procedure of the SIAC. The Center revised arbitration rules twice in 2010 and 2013, and established the Court of Arbitration of SIAC in April 2013 for the first time in Asia in pursuit of stricter neutrality and promptness. It further seeks to run the arbitration procedure fairly by selecting a third country's people as an arbitrator, while its arbitration expenses are cheaper than those of the ICC. The study believes that for the country's international arbitration institutions such as the KCAB to jump forward as a world-class international arbitration institution, the Korean government should render positive support to them, learning from Singapore which does not spare any political and financial assistance to cultivate international arbitration institutions. On the other hand, KCAB should also try hard to improve in the aspects of neutrality, fairness, and promptness and to be selected as a trustworthy international arbitration institution by firms in Asian countries.

한국노동쟁의에 있어서 직권중재제도의 개선에 관한 연구 (A Study on the Improvement of Compulsory Arbitration System in Labor Dispute of Korea)

  • This article deals with the Improvement of Compulsory Arbitration System on Trade Union and Labor Relations Adjustment Act in Korea. If a labor dispute occcur, the settlement of labor dispute must be reached for the parties' own accord. The autonomy of the parties concerned is the fundamental principle in the settlement of labor dispute. If the Rights Which are guaranteed by art. 33 Constitutional Law belong to civil liberties, we should consider Trade Union Act as the restriction of basic rights. Arbitration is a procedure which permits the most positive intervention by the arbitrator. It is carried out by an arbitration committe which is composed of three arbitrators appointed by the chairman of the Labor Relations Commission. Compulsory arbitration system of the labor for parties should be improved. In case of necessary public enterprises, more strict requirements on assembly for labor disputes should be prepared and the government should support institutions to prevent labor-management disputes by educating experts on labor-management relations and improving the quality of arbitration.

중국 광저우(廣州)중재위원회의 온라인중재 운용에 관한 연구 (A Study on the Practices of Online Arbitration System of Guangzhou Arbitration Commission in China)

  • There are more than two hundred arbitral institutions in China. Some of them are active in the development of online arbitration system, such as CIETAC and Guangzhou Arbitration Commission(GAC). GAC, founded in 1995, is the second largest arbitral institution in China which accepts more than 4,000 cases a year. With extensive experiences in arbitration, GAC has conducted online arbitration procedures since 2007. Moreover it opened the whole process of online hearing to the public through the Internet. With this background, this article aims to support the development of online arbitration through the analysis of GAC practices. To meet the purpose, status quo, rules and procedure of online arbitration of GAC are outlined, followed by introducing nine cases conducted by GAC. The scope of GAC online arbitration is comparatively narrow and the institution is still under the government supervision. But the practices of GAC proved that online arbitration is fully admissible and effective under the current legal framework.

Structural joint modeling and identification: numerical and experimental investigation

  • In the present work, structural joints have been modeled as a pair of translational and rotational springs and frequency equation of the overall system has been developed using sub-structure synthesis. It is shown that using first few natural frequencies of the system, one can obtain a set of over-determined system of equations involving the unknown stiffness parameters. Method of multi-linear regression is then applied to obtain the best estimate of the unknown stiffness parameters. The estimation procedure has been developed first for a two parameter joint model and then for a three parameter model, in which cross coupling terms are also included. Two cases of structural connections have been considered, first with a cantilever beam with support flexibility and then a pair of beams connected through lap joint. The validity of the proposed method is demonstrated through numerical simulation and by experimentation.

  • The successful operation of a product In service depends upon the effective provision of logistic support in order to achieve and maintain the required levels of performance and customer satisfaction. Logistic support encompasses the activities and facilities required to maintain a product (hardware and software) in service. Logistic support covers maintenance, manpower and personnel, training, spares, technical documentation and packaging handling, storage and transportation and support facilities.The cost of logistic support is often a major contributor to the Life Cycle Cost (LCC) of a product and increasingly customers are making purchase decisions based on lifecycle cost rather than initial purchase price alone. Logistic support considerations can therefore have a major impact on product sales by ensuring that the product can be easily maintained at a reasonable cost and that all the necessary facilities have been provided to fully support the product in the field so that it meets the required availability. Quantification of support costs allows the manufacturer to estimate the support cost elements and evaluate possible warranty costs. This reduces risk and allows support costs to be set at competitive rates.Integrated Logistic Support (ILS) is a management method by which all the logistic support services required by a customer can be brought together in a structured way and In harmony with a product. In essence the application of ILS:- causes logistic support considerations to be integrated into product design;- develops logistic support arrangements that are consistently related to the design and to each other;- provides the necessary logistic support at the beginning and during customer use at optimum cost.The method by which ILS achieves much of the above is through the application of Logistic Support Analysis (LSA). This is a series of support analysis tasks that are performed throughout the design process in order to ensure that the product can be supported efficiently In accordance with the requirements of the customer.The successful application of ILS will result in a number of customer and supplier benefits. These should include some or all of the following:- greater product uptime;- fewer product modifications due to supportability deficiencies and hence less supplier rework;- better adherence to production schedules in process plants through reduced maintenance, better support;- lower supplier product costs;- Bower customer support costs;- better visibility of support costs;- reduced product LCC;- a better and more saleable product;- Improved safety;- increased overall customer satisfaction;- increased product purchases;- potential for purchase or upgrade of the product sooner through customer savings on support of current product.ILS should be an integral part of the total management process with an on-going improvement activity using monitoring of achieved performance to tailor existing support and influence future design activities. For many years, ILS was predominantly applied to military procurement, primarily using standards generated by the US Government Department of Defense (DoD). The military standards refer to specialized government infrastructures and are too complex for commercial application. The methods and benefits of ILS, however, have potential for much wider application in commercial and civilian use. The concept of ILS is simple and depends on a structured procedure that assures that logistic aspects are fully considered throughout the design and development phases of a product, in close cooperation with the designers. The ability to effectively support the product is given equal weight to performance and is fully considered in relation to its cost.The application of ILS provides improvements in availability, maintenance support and longterm 3ogistic cost savings. Logistic costs are significant through the life of a system and can often amount to many times the initial purchase cost of the system.This study provides guidance on the minimum activities necessary to Implement effective ILS for a wide range of commercial suppliers. The guide supplements IEC60106-4, Guide on maintainability of equipment Part 4: Section Eight maintenance and maintenance support planning, which emphasizes the maintenance aspects of the support requirements and refers to other existing standards where appropriate. The use of Reliability and Maintainability studies is also mentioned in this study, as R&M is an important interface area to ILS.

토지주택분야 정보 현황과 빅데이터 연계활용 방안 (Utilizing Spatial Big Data for Land and Housing Sector)

  • 본 논문은 우리나라의 빅데이터 정책과 활용사례 조사, 공간 빅데이터의 토지주택 활용분야를 제시함으로써 토지주택분야의 미래 사업을 발굴하고, 정부정책에 선제적으로 대응하기 위한 공간 빅데이터 기반 활용분야를 제안하였다. 연구결과, 첫째, 우리나라의 빅데이터 관련 정책과 사례를 살펴보았다. 우리나라는 정부3.0 추진위원회를 중심으로 정부부처의 각 정보를 빅데이터 기반 체계로 구축하고 있으며, 국토교통부에서는 국가공간정보 플랫폼을 통한 빅데이터의 적극적 활용, 일자리 창출을 지원하기 위하여 2013년부터 공간 빅데이터 체계 구축을 추진 중이다. 둘째, LH에서 구축 및 운영하고 있는 정보시스템을 중심으로 국토정보의 현황과 토지주택분야에서의 활용방안을 살펴보았다. 먼저, 정보시스템은 크게 공사업무지원, 통계조회, 부동산정보조회, 온라인민원, 국가정책지원 분야로 구분되며, 주요 활용분야 도출의 기본방향으로는 국토정보(DB), 활용수요(업무영역), 수익창출(사업모델) 측면을 고려하였다. 이러한 기본방향 설정 후 접근방법으로서 업무분야와 업무절차 측면에서 살펴본 결과, 지역개발사업 후보지 선정, 임대주택 운영 및 관리, 토지비축 우선순위 설정, 도시재생 우선순위 설정 등 4개의 활용분야를 도출하였다. 셋째, 도출한 4개의 활용분야에서 공간 빅데이터 활용체계를 구현하기 위하여 필요한 데이터와 적용방법, 각 활용분야별 분석절차를 제시하였으며, 공간 빅데이터 활용방안을 구현하기 위하여 LH에 요구되는 개선사항과 향후 검토방향을 제시하였다.

여성발전기금의 평가도구 개발 및 지원단체의 사업수행능력 평가에 대한 연구 - 서울특별시 여성발전기금 지원사업 평가를 중심으로 - (A Study on the Development of Criteria to Assess the Business Performance of the Development Fund for Women and the Organizations it Supports - focusing on the Assessment of the Seoul Metropolitan Government's Development Fund for Women -)

  • This study aims to create assessment tools for the development fund for women, and to assess the business performance of the organizations using this development fund for women on the basis of such tools. A total of 57 projects by 58 organizations were assessed for a period of eight months. The assessment was carried out by using five tools: 1) examining the weight of the assessment tools, 2) visiting and inspecting project sites, 3) visiting and inspecting the offices of the participating organizations, 4) cooperating with the Seoul Metropolitan Government for municipal administration, and 5) assessing the final project report. Each tool was comprised of three elements: ability of relevant organizations, operational procedure, and projects results. The assessment results are summarized below: 1. According to the examination of the general trends in assessing the organizations that received the Development Fund for Women, it was found that the assessment emphasized performance more than the process involved in the project. Thus, the result suggested that the projects should be carried out more aggressively. 2. Regression analysis was conducted to identify the capability of the organizations in performing the projects with the development fund for women and the capability of the subjects as an independent variable. It was observed that such capabilities were affected by the degree of role sharing and the utilization of internal organizations. It suggested the importance of human resources. 3. To motivate the subjects involved in executing the projects with the use of the Development Fund for Women, the requirements and the satisfaction factors suggested strengthening the scope of financial support and activating the project environment. In conclusion, it is considered that the findings would provide practical ways to improve the system in using the Development Fund for Women, and in setting relevant policies in the future.

장애인보조기구 수리서비스 현황 및 만족도에 관한 연구 (The Research of the Satisfaction and Current State with Repair Service of Assistive Technology Devices for the Disabled)

  • 본 연구는 국내 장애인보조기구 수리서비스에 대한 현황 및 만족도를 파악하여 수리서비스에 대한 문제점을 알아보고 이를 바탕으로 하여, 효과적인 발전방안을 알아보고자 하는데 그 목적이 있다. 설문조사는 2015년 7월부터 2015년 10월까지 전국에 있는 장애인 750명을 대상으로 시행하였고, 최종 회수된 280부를 분석하였다. 수리의뢰가 많았던 품목은 대부분 이동보조기구였으며 수리 의뢰는 대부분 구입업체와 장애인 보조기구 전문 수리기관에서 시행되었다. 만족도 조사에서 일부 불만족의 사유로는 수리기간이 길고 수리 접수 및 절차의 복잡성으로 나타났다. 장애인보조기구 수리서비스 활성화를 위한 중앙정부의 역할로는 수리지원사업에 대한 홍보 확대, 수리지원 대상품목 및 지원금액 기준마련, 장애인보조기구 수리를 위한 법적 체계 마련이 매우 필요하다는 의견이 많았다. 보다 효과적이고 체계적인 장애인보조기구 수리서비스를 제공하기 위해서는 수리서비스 절차의 체계 확립, 시장가격을 반영한 부품별 수리단가 제시 등이 마련되어야 할 것이다.

중고령 실직자 재취업 과정에 대한 현상학적 연구 (Phenomenological Study for re-employment process for middle or old-age people the Unemployed)

  • The purpose of this study is to understand the meaning and essence of concrete and practical experience on a series of debates to reveal factors that could be exposed when middle or old-aged people are in the process of re-employment process when they were unemployed by exploring the phenomenon of experience on the courses for the unemployed focusing on middle or old-aged people for employment support program. Depth consultation interviews were conducted and the structure of this phenomenon was revealed and described by applying Giorgi's phenomenology technical as a procedure for analyzing participants' statements by concentrating on the essence of the experience in this study. The meaning of the experience of the unemployed re-employment process structure as a result of analysis on the nature of re-employment experience on the basis of research participants and the information stated through this study showed respectively such as , , , , , and "Reemployment Success Factors>. It is a significant meaning that middle and old-aged people were able to confirm that they experienced Dynamic pursuit of hopes and dreams and got the chance to participate in society Toward a new life By strengthening employ ability skills by undertaking vocational training, obtaining licenses, and regaining confidence and employment determination, and a lot of desire using the card for learning tomorrow, government support system.

복지관 이용 노인의 사회적 지지가 회피적 대처방식의 매개효과를 통하여 자살생각에 미치는 영향 (The Effect of Social Support of the Elderly Using Elderly Welfare Center on Suicidal Ideation through the Mediating Effect of Avoidance Coping Style)

  • 본 연구는 복지관 이용 노인의 사회적지지가 회피적 대처방식의 매개효과를 통하여 자살생각에 미치는 영향을 파악하기 위한 목적으로 시도되었다. 연구방법은 G시에 소재한 4곳의 노인복지관을 이용하는 노인 392명을 대상으로 한 서술적 조사연구로, 2019년 10월 21일부터 11월 8일까지 자료를 수집하였다. 연구 통계방법은 IBM SPSS/win 26.0 프로그램으로 t-test, ANOVA, Scheff's test, 피어슨 상관관계를 분석하였고, 매개효과는 Baron과 Kenny의 3단계분석 절차에 따른 다중회귀분석으로 분석하였다. 그 결과, 대상자의 사회적지지의 평균점수는 5.73±1.23점으로 높은 것으로 나타났으며, 회피적 대처방식은 12.53±3.47점, 자살생각은 6.21±2.06점으로 회피적 대처방식과 자살생각의 점수 모두 매우 낮은 것으로 나타났다. 각 변수들 간의 상관관계에서 자살생각은 사회적지지(r=-.151, p=.004)와 음의 상관관계 있었으며, 회피적 대처방식과(r=.315, p<.001)는 통계적으로 유의한 양의 상관관계가 있는 것으로 나타났다. 노인복지관 이용 노인의 회피적 대처방식은 사회적지지와 자살생각의 관계를 부분매개하는 것으로 나타났다(Z=-2.97, p<.001). 따라서 지역사회 노인들의 자살생각과 같은 부정적인 정서를 사전에 예방하고 방지하기 위해 지역 및 정부차원의 다양한 정책과 지원이 지속적으로 이루어져야 할 것이다.
