Studies on compensation structures of international technology licensing show that the level of intellectual property protection in the host market and the favorableness of the host country's economic environment are positively related to the use of running royalty-based compensation structure. Lump-sum fee or fixed royalty compensation is more likely to be used in the introduction and decline stages of the technology life cycle, and running royalty compensation in the growth stage. The international experience and the size of the licensor company are positively related to the use of running royalty. In this theoretical context, this paper analyzes the choice of compensation structures in Korean technology imports. The paper uses the officially reported data to analyze the compensation structures. It analyzes the characteristics of the compensation structures in terms of fixed royalty and running royalty by licensor country, group of licensor countries and size of licensee companies.

Industrial Technology Development Program enables the recipient to set up technology infrastructure and to facilitate technology diffusion. In return, government charges royalty from the program recipient. However, the current royalty system is not in the effective form. This study analyzes the various aspects of royalty collection methods applied to the Industrial Technology Development Program and recommend the following: (1) employ the combination of fixed amount royalty and running royalty with predetermined portion of revenue generated, (2) adjust the royalty collection duration by applying product life cycle, and (3) devise new program to link extra-gain from royalty collection with commercialization and other means to increase the effectiveness of research and development activities.

본 연구에서는 시장접근법 기반의 기술가치평가를 위한 원리적인 개념 모형을 제안한다. 하나의 기술이 기술성과 사업성을 기초로 기술가치를 부여받고, 다시 그 기술가치가 시장가치로 전이되는 개념모형을 제시하고 그 논리적인 타당성을 논의한다. 기술대가 지불방식의 두 가지 형태인 정액기술료 및 경상기술료 방식 각각에 대해, 기술-기술가치-시장가치 전이모형을 구성하는 구체적인 요인들을 식별하고 측정방식을 분석함으로써 구체화된 시장접근법 기반 기술가치평가 개념 모형을 개발한다. 더불어 본 연구에서 제안하는 개념 모형을 이용하여 기술가치평가의 세 가지 접근법인 비용-소득-시장접근법간의 관계를 설명할 수 있음을 보인다.

본 연구에서는 국가가 산업기술경쟁력 제고를 위해 전략적으로 수행하는 산업기술지원 연구개발사업의 연구개발성과물인 기술의 실시를 위해 납부하는 기술료 관리의 제반 문제점을 분석하고 그 개선 방안을 제시하였다. 본 연구의 결과를 바탕으로 제안하는 개선책은 다음과 같다. 우선 산업기술지원 연구개발사업의 기술료 징수와 관련하여 첫째, 개발기술의 유형에 맞는 고정기술료와 경상기술료의 기술료 징수체계를 마련 둘째, 제품수명주기(Product Life Cycle)를 고려하여 산업분류별로 징수기간을 설정하는 방안을 마련할 필요가 있으며 셋째, 무형적 발생품의 소유권에 대한 재검토가 필요하다. 한편으로는 기술료의 수명주기 전 과정에 대한 효율적인 통합관리를 위해 평가관리 전담기관 내에 기술가치평가업무, 기술이전업무, 기술사업화 지원업무, 기술료 징수 및 관리업무, 성과확산 및 보고업무를 전담하는 조직을 조속히 신설하여야 한다는 것이다.

This paper analyzes how franchise contract conditions are influenced by business structures as well as how contract conditions affect producer surplus by utilizing Korean franchise Information Disclosure Documents for the years 2014-2016. We find that franchise fees tend to increase in line with increases in the numbers of direct stores or the business period. Accordingly, it would be reasonable to check whether the franchise fee is excessive compared to the amount of reputation capital rather than to criticize the absolute level of the franchise fee. Regarding royalty contracts, the larger the discount in the raw materials purchase is, the higher the initial royalty is. Although this appears to be a royalty discount, it can be a means of inducing a raw materials purchase contract by initially setting a high royalty rate and then lowering it after the purchase contract is signed. Concerning the effect on producer surplus, the results show that an increase in franchise fees and royalties negatively affects the franchisee's operating profits but positively affects those of the franchisor's, leading to conflicts over the distribution of economic value added. Based on the findings here, we propose various policy recommendations, specifically reinforcing the contents in the Information Disclosure Document, further activating fixed-rate royalties, and strengthening the qualifications of franchisors when recruiting franchisees.

현재 MPEG에서 무료(royalty-free) 비디오 코덱으로 표준화 중인 IVC(Internet Video Coding)에서는 저지연(low-delay) 모드 부호화 구조에서 비참조 P 프레임 부호화 기법을 사용하여 부호화 성능 이득을 얻고 있다. IVC 시험모델 ITM(IVC Test Model) 4.0에 채택되어 있던 기존의 비참조 P 프레임 기법은 움직임 벡터(MV)의 크기를 이용하여 적응적으로 고정된 부호화 구조의 비참조 P 프레임을 적용하였으나 시퀀스에 따라서 오히려 부호화 성능이 크게 떨어지는 단점이 있었다. 본 논문에서는 이러한 기존의 적응적 비참조 P 프레임 부호화 성능을 개선하기 위하여 기존의 고정된 비참조 P 프레임의 구조를 변경하는 기법과 MV와 함께 참조 프레임 대비 비참조 프레임의 발생 비트량 비를 함께 사용하는 적응적 기법을 제시한다. 실험결과 제안된 기법은 시퀀스에 따른 큰 성능 저하 없이 ITM 7.0 대비 6.6% 정도의 비트율 감소를 얻음을 확인하였다.

The object of International License Contract is technology. Technology is means to produce visible goods, which are human's intellectual creations such as Intellectual Property Right - patent, design, trademark- and Know-how. Unlike visible goods which decrease as being used, these technologies are possible to be produced expansively and develop additionally. Therefore, the way to make a contract of goods is a sales contract which transfers ownership while technology follows license contract which gives approval of use for a certain period. International license contract means that licensor has right to possess, allows licensee to use licensed technology for a fixed period and takes royalty. So there are various matters such as selection of the duration of a contract, confirmation of technology range, competition limitation, technique guidance and support, calculation of royalty, withholding tax between parties. This study examines licensor's grant of license and competition limitation. Intellectual property rights fundamentally give exclusive rights to the creator so the licensor use or dispose of his or her intellectual property rights at will. Technology transfer is possible through license contract because of this right. But licensor must exercise his or her intellectual property rights within a reasonable limit. It means, when licensor makes an unreasonable demand abusing his or her position, it is regarded as competition limitation clause and the deal itself may become null. Therefore, restraint on competition needs to be examined in detail as it influences on contract validity. Each country has their own competition laws for establishing a fair market order and inspection guide and guideline for judging whether there is any unfair act related to intellectual property rights. Judgment on intellectual property rights is subject the technology-introduced country's domestic laws and thus, contracting parties each need to precede opposite nation's domestic laws system.

나고야의정서 또는 ABS의 목적은 생물유전자원의 이용에 따르는 대가를 실현시킴으로써 생물다양성을 유지하는데 있으나 아직까지 구체적으로 실현된 사례가 드물다. 이는 이익공유 방식을 둘러싼 논란과 생물유전자원 보유국과 이용국 또는 이용기업간의 정보 비대칭이 존재하기 때문이다. 본고에서는 주인-대리인 모형을 이용하여 정보 불확실성 하에서의 이익공유 방식을 분석하였다. 고정지출계약과 매출액 기준 로열티 방식 중 후자의 방식이 생물유전자원의 가치증대와 자원보전 측면에 우수한 인센티브 계약인 것으로 나타났다. 이는 향후 나고야의 정서 하에서 로열티 중심으로 상호협정조건 가이드라인이 마련될 필요가 있음을 시사한다.
