This study discussed the international reorganization of fisheries in the East China Sea and the Yellow Sea, for the cases of Korea, China and Japan, through the fishery competition and the division of sea areas and resources. In these sea areas, each country has done mutual operation, which causes the fishery competition and controls fishery development. Besides, Exclusive Economic Zon(EEZ) established in 1996 resulted in the prominent changes of fishery development as well as fishery relationship among each country, demands reorganization of fisheries. New fishery order in these sea areas is controlled by BEZ system. The fishery reorganization according to EEZ is a common issue of each country and it also includes the importance of mutual fishery agreement. Resources of fisheries could be used continuously under reasonable management. Each country should consider the stability and existence of fisheries in the international viewpoint. At this point of time, those should be considered such as adjustment of interests according to the division of sea areas, establishment of resource management system and insurance of fishery management, for the subject of fishery reorganization.
This study aims to investigate the development of the stow-net fishery operated in East China Sea and Yellow Sea and its role in the off-shore demersal fishery In Korea after 1980's. This paper also reorganization problems of this fishery under 200 mile exclusive economic zen system. Stow-net fishery which has an important role in offshore demersal fishery in terms of the fish production and supplies had attained an rapid growth since 1960's throughout advancement of the fishing technique, government support and enlargement of fish market. However, the production had come to a stagnant stage since 1980, and even reduced in 1990's by reason of competition from Chinese vessels which have been developing reapidly as well as other more productive demersal fishery such as trawl of Korea. Nevertheless, high fish price has maintained the business of this fishery. This fishery faces some difficulties such as limited resources, the plunge of fish price due to fish import freedom, and 200 mile EEZ settlement in those Seas among the related countries ratifying the United Nations Convention of the Law of the Sea in 1996. This paper discusses the reorganization problems of the stow-net fishery under the new situation. : (1)to lighten a damage to the fishery to keep the fishing ground and to restrict the entry of competitive fisheries, (2)to reduce the fishing effort by the governmental support, (3)to introduce new fishing methods, (4)to employ foreigner as a cheep labour, (5)to rise fish price throughout more freshness of fishes.
This study intends to review the development of Large Purse Seine Fisheries in Korea and Japan, and subsequent changes in the fisheries regime as well as management conditions and to examine reorganization directions. In the Northeast Asian Fishing Area, each country has done mutual operation, which causes the fishery competition and controls fishery development. Besides, Exclusive Economic Zon(EEZ) established in 1996 resulted in the prominent changes of fishery development as well as fishery relationship among each country, demands reorganization of fisheries. In the Large Purse Seine fisheries, Korea and Japan are not decreasing, they are stable. In other words, the increase in one country does not necessarily make the decrease in the other country. This is a difference from the case of the bottom fishery. Japan is the highest in the cost, the management is getting worse due to decreasing fish price and shortage of labor. In the case of Korea, the stagnant productivity has been compensated by the rising fish price, but the fishery of low productivity to cut down the size. In addition, during the 1990s the environment of fishery is getting worse because of the free import fishery, shortage of labor, etc. Following the new fisheries paradigm, each country should reorganize its fisheries structure. The principle for reorganization of fisheries structure in each country should be focused on the establishment of sustainable fisheries. The reorganization of fisheries structure for each country by EEZ establishment does not mean only dividing fishing ground and fisheries resources by countries, but means that countries should cooperate together in fisheries management for long-run benefits from fisheries.
This study aimed to review the reorganization of fisheries and the future tasks in accordance with the establishment of new fishery order in the Northeast Asian Seas. As the United Nations Convention on the Law of the Sea, which recognized the sovereign rights of Coastal States in a 200-nautical mile exclusive economic zone (EEZ), entered into force in 1994, the three countries of Korea, China and Japan ratified the United Nations Convention on the Law of the Sea in 1996 and started negotiations to establish a new fishery order consistent with the EEZ system. However, a conflict of interest occurred because of differences in fisheries between countries, negotiations many times have proceeded, resulting in the signing of fishery agreement between China and Japan in 1997, Korea and Japan in 1998, and Korea and China in 2000. Each fishery arrangement consists of a dual system of EEZ and provisional waters (middle waters, provisional waters). The two countries are engaged in mutual fishing based on coastal states in EEZ, and in the fishing operation under the principle of flag state in provisional waters. There are overlapping or ambiguous jurisdictions in the intermediate waters and provisional waters that are jointly available to both fisheries. The presence of these seas is a challenge to the establishment of a reasonable international fisheries management system for the entire Northeast Asian Seas. In this context, the challenges of the reorganization of the new fisheries order are as follows: 1) conversion to a fishery order for coexistence of fisheries, 2) expansion to an international fishery management system, and 3) establishment of a multilateral fishery cooperation system. Although the jurisdiction of their own waters has been expanded through the establishment of EEZ according to new fishery order, the need for mutual cooperation grows when considering the movement and migration of fishery resources, fishery management, fish consumption and trade. In addition to the fisheries cooperation between the governments, it is also necessary to revitalize the civil cooperation focused on fishermen who exploit fishing grounds together.
This study discusses the development structure of China's Marine Fisheries in the East China Sea. China's marine fisheries have developed since the 1980s along with it's economic expansion. The total catch in the East China Sea has increased especially during the 1990s. The Chinese fishery has developed remarkably through individual management, expansion of their fishing grounds from inshore to off-shore, and increase of the catch in both pelagic and bottom species. In other words, the trawl fishery in China has led to higher production. We can say that the progress in Chinese fisheries is the result of their expansion policy. Their boats have been coming closer and closer to the Japanese and Korea fishing grounds during the 1990s. Chinese fisheries is exploiting the low cost and thus strengthening its quantity. Based on rising fish price, expanding domestic fish markets as well as expels, China is enjoying the high income. However, in trawl fishery, productivity is stagnant and profit is going down due to the rising cost. In accordance with the new 200 mile EEZ system in the East China Sea, China's fisheries will be restricted mostly by the new regulation which requires the reduction of fishing efforts and the application of resource management.
Nowadays, Under the current system of fisheries laws, fishery division and marine division are unified into one marine-fishery related law system indiscriminately. So they are not divided by nature. Moreover, terminology of fishery Law has been used by now in inappropriate conditions from Japanese 1951 fishery law systemct. Because fisheries administrative reorganization is also in parallel with the same logic as above, the reorganization of the legal system should be made. Finally, when the above mentioned problems is clearly defined and improvement is actually performed, more efficient management will be achieved through the beneficiary of more simple legal services. And so fisheries managers will be able to contribute to the development of the industries through more efficient management. While the existing framework of laws and regulations currently being enacted or established should be kept as much as possible, in order to ensure better control of fisheries resources and ensure sustainable development of related industries. Under various existing laws including the Fisheries Act, the Enforcement Regulations/enforcement rules, notice, instruction, established rule, the recognition of problems and improvements on the overall delegate legislative framework will be needed.
The fishing vessel buyback program, that is, the project of fishing vessel reduction is a complex challenge that needs to take into consideration for both fishing resource protection and industrial restructuring. By the way, the fishing vessel buyback program in Korea is still poorly fruitful and there are few applications for the project in the country. For example, the buyback program of this nation has some problems like uncertainly set goals, conflicts among targets, no flexibility in the program implementation, low participation in the project and lack in follow-up actions. To solve these problems, this study offers the following alternatives. First, it is setting up detailed targets for fishing vessel buyback. Those targets should be what can be actually driven under policy support, such as reduction in illegal fishing, decrease in an exact number of fishing vessels and decline in fishing capacity rather than what seem to be comprehensive such as protection of coastal or offshore fishery and industrial restructuring. Second, it is taking measures for the livelihood of those who would face disadvantages due to fishing vessel reduction. Those measures providing or supporting the re-education and re-employment of fishery workers and building up systems that help the workers transfer fishing to another job. Third, it is adopting the governance system that overcomes lacks in communications between the fishing vessel buyback program and improves the performance effectiveness of that program. Here, governance means that businesses and authorities concerned in the program interact and cooperate with one another in making and implementing policies related to the project of fishing vessel reduction and assessing the results of that project. Fourth, it is taking actions for fishery reorganization after the fishing vessel buyback program. Factors that can be considered as those actions include supporting fishery workers' cost of fishing vessel reduction, decreasing and modernizing fishing fleets and improving the quality of fishing equipment. In conclusion, the fishing vessel buyback program should be prepared with comprehensive actions or measures that can cope well with a variety of problems that may be arisen from it while keeping itself on the track of its original goals.
This study is attempted to serve the fundamental theory for ‘The reorganization of Korean coastal and adjacent water fishery.’ On the Korean coastal and adjacent water fishery where one species stock is catched by multiple fisheries, traditional analysis is not suitable, as analyzing through adjusting the heterogeneous fishing effort among the fisheries to an unit having same fishing strength. Therefore, this study presents the ‘Multi-Variable Model’, adopting fishing effort from each fishery as independent variable, respectively, in order to analyze the quantitative fluctuation of fishery resource not with fishing strength but with amount of fishing effort, measured by the unit of each fishery. For the sake of simplication, this study assumes that one species is catched by two fishery, premise two assumption. 1) Every fishery has not the selectivity in fishing 2) The promotion of fishing efficiency is accomplished in the same speed. Cold storage warehouse industry in Japan has been extended in its scale in terms of both the number of storages and cold storage capacity in order to meet the extended reproduction of the marine products industry. However, increasing total amount of the stored goods since mid 80s led to relative decrease of marine products while the number of storages was remained the same or decreased, though cold storage capacity was gradually increased and is maintained the increase of the average cold storage capacity. As structural change in the cold storage warehouse industry emerges, cold storage warehouses require new approach to individual storage management with 1)diversity of the stored goods; 2) more competition due to increase of the cold storage capacity; and 3) sizing of the average cold storage capacity. Therefore, this study analyzed how cold storage warehouse management activity with individual storage sizing changes; and significance of sizing and functional change in cold storage warehouses experiencing sizing, by observing leading cold storage warehouse industry of the metropolitan area in Japan. In conclusion, reorganization of cold storage warehouse industry in the metropolitan area in Japan can be summarized as follows: First, competition among cold storage warehouses in the metropolitan area in Japan is not simply limited to storage industry but extended to establishment and securing physical distribution function. Second, since cold storage warehouse industry is in Scrap & Build phase, decision of management executives on whether taking direction to maintain/continue enhancement of physical distribution function may cause drastic reorganization in the cold storage warehouse industry, Third, since profit of physical distribution management based on cold storage warehouses is insignificant, it is not easy to accomplish expected management outcome, Fourth, today's cold storage warehouse industry mainly characterized by diversity of the stored goods needs facility reorganization with comprehensive and functional integration covering from F class cold storage capacity to F&C class.
This study intends to review the development of Squid Angling Fisheries of Korea and Japan and subsequent changes in the fisheries regime as well as management conditions and to examine reorganization directions. Although catches and productivity are all increasing in Korea and Japan as the squid resource in the East Sea is improving, the number of fishing vessels and the conditions of fisheries management are showing a symmetrical relationship. The former is increasing in Korea and decreasing in Japan while the latter is aggravating in Korea and rather stable in Japan. And while the competition between the two countries for more fishing grounds and catches are not that serious since the resource is relatively increasing, the catch and price competition with other domestic fisheries is a more significant problem. Furthermore, even though light restriction is implemented in both countries in order to suppress over-competition, it is adopted as a means to curtail management costs and block over-investment rather than to adjust international or inter-fisheries circumstances. Japan has been implementing the TAC system on squid resources since 1998. However, it has a different meaning than as a resource management method in its original sense because it is based on the highest catch level of the past and takes into consideration the fishermen's management conditions. In case of Korea, it is necessary to establish a plan to strengthen its fisheries management competence to address its shrinking catch in the Japanese waters. The developments mentioned so far have appeared amidst the increase of squid resources, and if such conditions disappear, problems such as international allocation of catches and fishing seasons, access to fishing grounds, and domestic conflicts among different fisheries will emerge.
