일반적으로 행정법 위반행위에 대하여는 고의나 과실을 요하지 않는다고 하지만, 공정거래법 위반행위에 대하여는 그 자체가 곧바로 형벌의 구성요건을 이루고 있다는 점에 비추어 특히 법위반 사실에 대한 고의요건을 배제하기는 어렵지 않을까 생각된다. 부당지원행위에 한정하여 본다면, 하나 하나의 행위만으로는 부당성이 인정되기 어렵다 하더라도 수 개의 행위를 포괄하여 부당성을 인정할 여지가 있다면 수 개의 행위를 포괄하여 하나의 법위반 행위를 구성한다고 이론구성을 할 수 있다고도 생각해 볼 수 있지 않을까 생각된다. 대법원 2004. 4.9. 선고 2001두6197 판결이 자금지원행위는 자금을 지원할 의도로 자산이나 용역 등의 거래로 인한 대가인 자금을 변제기 이후에도 회수하지 아니하여 지원객체로 하여금 그 자금을 운용토록 함으로써 그이자 상당의 수익을 얻게 하는 것과 같은 부작위행위도 포함한다고 해석함이 상당하다고 한 취지는 이러한 관점을 전제로 한 것이 아닌가 생각된다. 이 점에 관한 논의의 활성화가 기대된다.

공정거래위원회는 각종 개별법령에 근거하여 운영되어 온 55개 카르텔제도를 검토한 결과 동 카르텔제도 중 32개 제도의 운영에 대하여 폐지하거나 보완하는 방안을 마련하고, 이와 관련하여 이해관계자 등 각계의 의견을 수렴하기 위해 지난 7월 23일(목) 대한상공회의소 2층 중회의실에서 KDI와 공동으로 공청회를 개최하였다. 동 공청회에서는 KDI 신광식 연구위원의 주제발표에 이어 학계와 관련단체 등 각계 참석자들의 토론이 있었다. 공정위는 동 공청회 및 입법예고 과정 등에서 제시된 의견을 종합적으로 검토하여 카르텔정비방안을 확정한 후 23개 법률개정대상은 $\lceil$카르텔 일괄정비법$\rfloor$ 제정안에 포함하여 금년 정기국회에 상정하고, 시행령 등 하위법규개정대상 및 규제개혁대상 9개는 관계부처와 협조하여 금년 중에 관계규정을 개정할 계획으로 있다.

일본의 공정취인위원회는 지난 1977년부터 일본 경제에서 큰 비중을 차지하고 있는 6대 대규모기업집단에 대한 기업집단 내의 소유지배관계, 자본$\cdot$인적 및 상품에 대한 내부거래 현황, 그리고 대규모사업추진에 따른 상호 협력관계 등 멤버기업간의 결합 실태를 조사하여 왔다. 이 글은 공정취인위원회가 지난 1996년 1월부터 1997년 6월 30일간에 결산기가 도래된 기업을 대상으로 한 제6차 경영행태 조사의 결과를 요약$\cdot$분석하여 일본 공정취인협회가 발간한 $\lceil$공정취인$\rfloor$(1998년 12월호)지에 게재한 것은 전문 번역 게재한 것이다. 우리나라에서도 대규모기업집단의 선단식 경영에 대한 폐해(물론 장점도 있지만)와 공정거래 위원회의 부당한 내부거래의 제재에 대한 논란이 이루어지고 있기 때문에 양국의 재벌급 기업집단의 경영 형태를 비교$\cdot$검토함으로써 정책 운용에 참고가 될 수 있도록 하였다.

본 논문에서는 계층적 공정 경쟁 유전자 알고리즘을 통한 비선형시스템의 정보입자 기반 퍼지집합 퍼지집합 모델의 최적화 방법을 제안한다. 퍼지집합 모델은 주로 전문가의 경험에 기반을 두어 얻어지기 때문에 동정과 최적화 과정이 필요하며 GAs를 이용하여 퍼지모델을 최적화한 연구가 많이 있다. GAs는 전역 해를 찾을 수 있는 최적화 알고리즘으로 잘 알려져 있지만 조기 수렴 문제를 포함하고 있다. 병렬유전자 알고리즘(PGA)은 조기수렴를 더디게 하고 전역 해를 찾기 위한 진화알고리즘이다. 적응형 계층적 공정 경쟁기반 유전자 알고리즘(AHFCGA)을 이용하여 퍼지모델의 입력변수, 멤버쉽함수의 수, 멤버쉽함수의 정점 등의 전반부 구조와 파라미터를 동정하였고, LSE를 사용하여 후반부 파라미터를 동정하였으며 실험적 예제를 통하여 제안된 방법의 성능을 평가한다.

The purposes of this study are to propose exhibition planning and management skills of trade fair organizers and to provide suggestions on the direction of government policies related to fair items. This study analyzes exhibitor objectives of exhibition participation and exhibition choice attributes using revised importance-performance analysis. This research uses visitor level, organizer services and market attraction of hosting country, as explanatory variables affecting companies' trade show choices. It also utilizes sales and non-sales purposes of participants as variables of exhibitors' objectives. As a result of the empirical analysis and examination of prior research, this study presents some recommendations for exhibition organizers and governments of hosting countries. First, the exhibition organizer should consider the importance of the number of visitors. Thus, the organizer should focus on prior marketing activities to attract visitors. Second, the organizer should make a trade fair plan in compliance with participants' needs. Third, policy authorities should provide environment of free competition among players.

본 논문은 회전형 역 진자 시스템(Rotary Inverted Pendulum System : RIPS)의 제어를 위한 Fuzzy cascade 제어구조를 제안하고 병렬유전자 알고리즘의 하나인 계층적 공정 경쟁 기반 유전자 알고리즘(Hierarchical Fair Competition-based Genetic Algorithms : HFCGA)을 이용한 최적화 방법을 제시한다. 회전형 역 진자 시스템은 Rotating arm의 회전을 통해 Pendulum의 각도를 제어하는 시스템으로써 제어 목적은 Rotating arm을 원하는 위치에 오게 하고 진자를 수직 위치의 불안정 평형 점에 위치하도록 하는 것이다. 본 논문에서는 회전형 역 진자 시스템의 제어를 위해 두개의 Fuzzy 제어기로 구성된 Fuzzy cascade 제어 구조를 설계하고, HFCGA를 이용하여 설계된 제어기의 파라미터를 최적화한다. 시뮬레이션 및 실험에서 SGA와 HFCGA의 성능비교를 통해 HFCGA의 우수성을 보이고, LQR 및 PD cascade 제어기와 제안된 Fuzzy cascade 제어기의 성능 비교를 통하여 제안된 방법의 우수성을 보인다.

In this paper I examined economies and implications of "Net Neutrality" and Internet Freedom. It is argued that mandating Net Neutrality would be likely to reduce economic welfare. Instead, the government should focus on creating competition in the broadband market by liberalizing more spectrum and reducing entry barriers created by certain local regulations. In cases where a broadband provider can exercise market power the government should use its antitrust enforcement authority to police anti-competition behavior. To assure Net Neutrality, it is needed to make sure of fair competition and to facilitate flexible prices. Especially it is needed to invest consistently to the sector of Network.

본 논문은 21세기 전 지구촌의 국제경쟁질서와 공정사회의 달성을 위한 새로이 제기되고 있는 이론, 정책, 제도와 법체제의 대안을 고찰하였다. 특히, 우리는 세계화에서 새로운 자유무역질서와 공정사회로서의 시장촉진과 공정거래를 위한 국제수준의 경쟁질서와 경쟁법체제의 기준을 연구하지 않으면 안 된다. 본 논문에서는 첫째, 세계무역기구(WTO)에서 새로운 자유무역의 공정거래를 위한 경쟁질서와 공정사회의 역사성과 기본적인 규범을 연구하였으며 둘째로, 새로운 세계화정책에서 비경쟁행위의 규제체계와 시장경쟁촉진을 위한 상거래유형과 법체계의 윤곽을 연구하였다. 더욱이, 우리는 WTO에서 경쟁질서와 공정사회를 저해하는 요인을 현실적 카테고리에서 연구하였다. 셋째로, 미국-EU와 한국-일본의 경쟁질서와 경쟁법의 적용범주 및 적용사례를 연구하였다. 끝으로, 본 논문은 21세기 최적의 국제경쟁질서와 공정사회의 달성관점에서 다양한 새로운 이론, 정책, 제도와 경쟁법의 연구를 토대로 새로운 대안과 시사점을 제시하였다.

Networks, services and industries have been converging with the advent of digital convergence by technology advancements of digitalization, broadband and interactivity in the areas of information-communication and broadcasting technologies. Especially, this convergence of technology and market has been blurring the boundary of telecommunication and broadcasting sectors, and the severe competition seems to be inevitable due to the lack of the differentiation in broadcasting media and contents. In this study, we regard the competition phenomenon in the digital convergence between telecommunication and broadcasting as the platform competition in two-sided markets which have been actively studied since 2000, and analyzed it using modified Hotelling's location model. According to the analysis of platform competition on the effects of the differentiation of platform (t) , killer component $(\mu)$ and component compatibility $(\theta)$ , it is shown that two differentiated platforms are simultaneously used in case of the decrease of substitution effects, and the profit of platform with killer contents is increased, but the profit of platforms with higher compatibility is decreased. The policy implication is that it is especially necessary to modify the policy and regulation on media contents considering the growing competition in media. On the other hand, differentiated and reasonable policy is required to make fair competition and active market environment.
