우리나라 조선업의 선박평형수 처리장치 수출경쟁력 분석 (The Analysis on Export Competence of Ballast Water Management System in Korean Shipbuilding)

  • The climate change has become one of the most important global issues that require global responses. As one of the leading contributions to climate change, greenhouse gas emissions and Ballast Water Management have attracted growing attention from the international community. The International Maritime Organization (IMO) received its mandate to regulate International Convention for the Control and Management of Ships' Ballast Water and Sediments in 2004. The convention requires that every vessel must be equipped Ballast Water Management System (BWMS) in 2017. Based on this situation, this study aims to analyze the present state and data from the exports of BWMS(HS842121). The results show that as the most leading country in the field, Germany has the largest market share (14.33%), Revealed Comparative Advantage (RCA) index 1.76, and Trade Specialization Index (TSI) 0.636 in the world. The two other leading countries such as Denmark and Netherlands follows the ability of Germany. The Korean market share of HS842121 shows market share (5.98%) which is a bit bellow high compared to other countries. However the RCA index (1.85) presents the state of comparative advantage. In addition, Korea's TSI index (0.453) indicates that it is in the state of export specialization. The Korean BWMS and Shipbuilding industry maintain the state of export specialization. They are also in the state of import specialty. For Korea to raise its export competitiveness and to ensure shipbuilding competitiveness, it is necessary to intensify supporting systems and related policies.

  • Cross-border supply chains undergone complexity in the global trade process, unpredictability and continually evolving regulations and information requirements. Under these circumstances, longer lead time inhibiting quick response to market demands, unanticipated supply chain costs eroding product cost savings, compliance and documentation errors causing delays and fines are challenging global trade companies when they execute global business. These problems are mainly caused by unautomated, unintegrated process which lead to longer and more unpredictable lead times, slower cash flow, cost overruns, and ultimately lower profits and less satisfied customers. Complex and unpredictable global trade environment requires global trade companies of global trade management functions to automate and control this complex environment for driving out cost, time and risk from their business. Global trade management allows cost savings, supply chain efficiencies and improved compliance through improving global supply chain visibility, facilitating cash flow by supply chain financing, enhancing supply chain security and risk management.

OEM 수출기업의 ODM 전환 성과와 성공요인에 관한 실증연구 (An Empirical Study on the Performance and Success factors of Transformation from OEM Exporting companies to ODM)

  • The purpose of this study is to detect the factors which have an effect on transformation level and performance and to provide the ways of successful transformation and vitalization from OEM to ODM. This study was proceeded by an empirical analysis. A model and hypotheses were set up and they were verified through the empirical analysis. Those factors were divided into four, inner company factors, strategic factors, core competence factors and purchase determining factors. In the result of the model suitability analysis on the study model of relationship among 'influencing factors of ODM transformation - ODM transformation level-export performance', every factors, $X^2=912.067$, DF=261, p value=0.000, GFI=0.737, AGFI=0.620, NFI=0.786, IFI=0.837, CFI=0.834, Q value=3.495 were rather insufficient to be a good model, but they were good enough for the general analysis. Taking these accounts into consideration, this study suggests the following implications. First, making a plan and setting up strategies in advance are required. Second, financial plan has to be prepared. Third, trends in global markets have to be analyzed. Fourth, companies have to focus on developing new materials and products through R&D. Fifth, quality competitiveness and quality control systems are required.

韓國加入亞太空間合作組織的可能性 : 基于法律与政策的分析 (The possibility of South Korea to become a member state of APSCO: an analysis from Legal and political perspectives)

  • Asia-Pacific Space Cooperation Organization (APSCO) is the only intergovernmental space cooperation organization in Asia. Since its establishment to date, eight countries have signed the convention and become member states. South Korea participated actively in the preparatory phase of creating the organization, and one conference organized by AP-MCSTA which is the predecessor of APSCO was held in South Korea. However, after the APSCO Convention was opened for signature in 2005 to date, South Korea does not ratify the Convention and become a member. The rapid development of space commercialization and privatization, as well as the fastest growing commercial space market in Asia, provides opportunities for Asian countries to cooperate with each other in relevant space fields. And to participate in the existing cooperation framework (e.g., the APSCO) by the Asian space countries (e.g., South Korea) could be a proper choice. Even if the essential cooperation in particular space fields is challenging, joint space programs among different Asian countries for dealing with the common events can be initiated at the first steps. Since APSCO has learned the successful legal arrangements from ESA, the legal measures established by its Convention are believed to be qualified to ensure the achievement of benefits of different member states. For example, the regulation of the "fair return" principle confirms that the return of interests from the relevant programs is in proportion to the member's investment in the programs. Moreover, the distinguish of basic and optional activities intends to authorize the freedom of the members to choose programs to participate. And for the voting procedure, the acceptance of the "consensus" by the Council is in favor of protecting the member's interest when making decisions. However, political factors that are potential to block the participation of South Korea in APSCO are difficult to be ignored. A recent event is an announcement of deploying THAAD by South Korea, which causes tension between South Korea and China. The cooperation between these two states in space activities will be influenced. A long-standing barrier is that China acts as a non-member of the main international export control mechanism, i.e., the MTCR. The U.S takes this fact as the main reason to prevent South Korea to cooperate with China in developing space programs. Although the political factors that will block the participation of South Korea in APSCO are not easy to removed shortly, legal measures can be taken to reduce the political influence. More specifically, APSCO is recommended to ensure the achievement of commercial interests of different cooperation programs by regulating precisely the implementation of the "fair return" principle. Furthermore, APSCO is also suggested to contribute to managing the common regional events by sharing satellite data. And it is anticipated that these measures can effectively response the requirements of the rapid development of space commercialization and the increasing common needs of Asia, thereby to provide a platform for the further cooperation. In addition, in order to directly reduce the political influence, two legal measures are necessary to be taken: Firstly, to clarify the rights and responsibilities of the host state (i.e., China) as providing assistance, coordination and services to the management of the Organization to release the worries of the other member states that the host state will control the Organization's activities. And secondly, to illustrate that the cooperation in APSCO is for the non-military purpose (a narrow sense of "peaceful purpose") to reduce the political concerns. Regional cooperation in Asia regarding space affairs is considered to be a general trend in the future, so if the participation of South Korea in APSCO can be finally proved to be feasible, there will be an opportunity to discuss the creation of a comprehensive institutionalized framework for space cooperation in Asia.

한국중재의 영역확대 방안에 관한연구 (A Study on the Expansion of Arbitration's Area of Coverage in Korea)

  • From the review of Korean arbitration systems with the comparison of those of other countries, we can summarize some issues to be tackled as follows: First, Korean arbitration system started with the purpose of export promotion. This may be the main reason that various domestic disputes have not been resolved by arbitration. Second, the Korean Arbitration Law applies to private disputes. The Law's arbitration scope is wider than that of China and France, but narrower than that of the U.S.A. that encompasses a variety of disputes in the filed of consumer, labor, medical services, patents, etc. Third, active judges or public officials in Korea can not be arbitrator and there is no arbitration court. However, if chief judge allows the necessity, court's judges in the UK can be arbitrator with the mutual agreement of the parties and also arbitration system is operated in the court. Fourth, the Korean Commercial Arbitration Board(KCAB), the only representative institution for arbitration in Korea, is under the Ministry of Knowledge Economy(MKE). This makes it difficult for the KCAB to handle other disputes related to the Ministry of Health and Welfare, the Ministry of Strategy and Finance, the Ministry for Food, Agriculture, Forestry and Fisheries, the Ministry of Employment and Labor, etc. Fifth, as mentioned, the KCAB is the unique institution for arbitration by the Law in Korea, while other countries allow have a diversity of arbitration agencies such as maritime arbitration organization, consumer arbitration institution, arbitration court, etc. Therefore, we suggest some ideas to expand the arbitration's area of coverage in Korea as follows: First, there should be more active policies that promote various domestic disputes to be settled by the arbitration system. Second, it is quite needed to expand the scope of arbitration to cover many disputes in the fields of consumer, labor, medical service, advertising, fair trade, etc. Third, there should be discussions to allow court judges as arbitrator and to introduce the arbitration court. Fourth, the KCAB should strengthen its status and roles as general arbitration organization to overcome the limited scope of commercial disputes. For this, there should be the strong support and coordination among the MKE and other government agencies. Fifth, to reduce the burden of the court's complicated and expensive procedures, more efficient disputes resolution systems should be established on the basis of the parties' free will. Each central government agency should streamline the legal barriers to allow industrial organizations under its control to establish their own or joint arbitration system with the KCAB.

  • 우주 산업은 21세기 가장 경쟁력 있는 산업으로 부각되는 미래의 핵심 산업이다. 하지만 우주 산업은 인프라 구축에 초기 투자비용이 막대하여 단기에 투자비용을 회수하기 어려운 면이 있어 민간 기업이 독자적으로 우주 사업을 수행하는 것은 한계가 있다. 따라서 미국, 일본 등 우주 산업 선진국들은 초기에 정부의 정책지원으로 일정수준까지 우주 기술발전을 도모하여 왔다. 우리나라는 2005년 우주개발진흥법의 제정과 국가우주개발중장기기본계획의 수정 등 제도적인 보완 노력을 하고 있다. 하지만 우리나라가 세계 8대 경제 대국으로 성장할 동안 위성을 독자 개발하여 국내 수요를 충족하고 수출할 정도의 능력을 가진 대기업이 없는 실정이다. 따라서 본 논문에서는 우리나라 우주개발 임무를 효율적으로 추진하고 국제 경쟁력을 강화하기 위한 위성산업 활성화 방안을 제시하였다.

FTA is a choice, not an essential trade agreement requirements. If the exporter contracts to provide a certificate of origin in trade agreements, it shall issue a certificate of origin of goods originating management is performed. When considering the future trend of spreading wide FTA, it should be extended to one year to take advantage of the FTA Certificate of Origin environments utilizing a comprehensive environment for regional countries that require proof of origin between certain countries, such as current. FTA utilization of the future is to utilize the GVC(Global Value Chain) efficiently. In other words, the expansion of the consumer market and take advantage of an efficient production base across borders. These environmental changes are needed development of the FTA utilization promotion and FTA experts. The experts studying how to procure raw materials or intermediate goods exports in a variety of regional foreign countries, to meet the rules of origin is required for a successful FTA utilization. One of the objectives of Origin managers are qualified experts in the country of origin can take advantage of the FTA plan. Therefore, managers of origin shall collect their ability to expand the understanding and information about the industry as an international business perspective beyond the Certificate of Origin. In addition, it should be in their best learning expertise for the introduction and development of country of origin control system in an effort to effectively perform its international FTA utilization. Once the FTA is more widespread in the future and build a common origin information it must not be disconnected until the export enterprises from terminal manufacturers systematically. Therefore origin management is preferred by expanding the knowledge base of teaching and learning in the common sense to the universal subject of specialization from professional schools to promote the relevant departments so that they can be opened in a college or university. An FTA hub linking East and West, also need the confidence that in order to become a center of Glabal Supply Chain Using an FTA Certificate of Origin and stable environment for importers to import products from the country offers. Certificate of Origin and all of them thoroughly exporters and companies related to the administration of origin and should create an atmosphere that can effectively respond to the origin verification. Korea shall endeavor to elicit a geopolitical value (FTA Hub), as well as securing a competitive advantage in the global industry leverage, trading at a reasonable price competitive products thereby enhancing production and economic growth through the FTA.

국내 상업용 민간 무인항공기 운용을 위한 법제화 고찰 (A Study on the Legislation for the Commercial and Civil Unmanned Aircraft System Operation)

  • 현재 주요 항공기술 선진국들은 군용기에서 거둔 무인항공기의 성공을 그 성장성과 효용성에 주목하고 민간 부문으로 확대하려는 노력을 경주하고 있으며 그 결과 민간 무인항공기 시장은 2020년 경에는 그 시장규모를 약 88억불에 달할 것으로 보면서 앞으로 가장 유망한 시장의 하나가 될 것으로 예상하고 있다. 그 용도도 원격탐사, 통신중계, 환경감시, 기상관측, 국경감시, 산불감시, 위험지역 정찰, 치안, 교통, 재난구호 지원활동 등 다양한 분야에 걸쳐 있다. 그러나 현재의 항공교통체계는 유인항공기 위주로 운용되고 있는 실정이어서 조종사가가 탑승하지 않는 무인항공기의 등장으로 무인항공기 운용을 고려한 조정이 필요하게 되었으며 그 조정에 필수적으로 수반하는 것이 법제화 작업이다. 현재 무인항공기 운용에 관한 법제화 작업은 전 세계적으로 ICAO가 중심이 되어 표준화 작업을 진행 중에 있으며 미국, 영국, 호주 등 국가는 개별적으로 법 규정을 마련하여 운용 중에 있다. 본 논문에서는 ICAO산하의 무인항공기시스템연구그룹(UASSG)의 활동과 무인항공기 법제화에 앞서가고 있는 미국, 영국, 호주의 법제화를 소개 하였다. 이중 미국의 경우는 2012년 2월14일에 오바마 대통령이 미국의 국가공역에서의 무인항공기를 운용하도록 하는 제반 법령 및 규정을 2015년 9월30일 시한으로 제정하도록 하는 법안에 서명함으로서 가장 적극적이다. 우리나라의 경우는 현재 국내 항공법상의 정의 규정과 비행허가에 관한 일부 사항을 제외하고는 운용에 관한 규정은 거의 전무한 상태라고 할 수 있다. 그러나 현실에 있어서는 군사용 및 민간 무인항공기가 실제 개발 운용되고 있는 실정이며 국토교통부에서는 상업용 민간무인항공기 개발을 우리나라의 항공기 제작 및 수출부문에 있어 가장 국제경쟁력 있는 분야로 보아 적극적으로 추진할 계획이어서 국내적으로도 무인항공기 운용을 위한 제반 사항에 대한 법제화가 필요하게 되었다. 무인항공기 운용을 위한 법제화 작업 중 가장 중요하다고 생각되는 부분은 (1)공역사용, (2)항공종사자 자격인증, (3)무인항공기 감항인증 및 기술기준인증 등 이지만 이외에도 (4)무인항공기 등 관련 사항에 대한 정의 규정, (5)무인항공기의 분류체계, (6)탑재장비 및 탑재서류, (7)통신, (8)비행규칙, (9)무인항공기 항공종사자 교육훈련, (10)보안, (11)보험, (12)기타 법제화가 필요한 사항으로 나누어 법제화 작업이 이루어져야 한다고 본다. 이와 함께 우리나라도 2012년 12월에 UASSG에 참가하였으므로 국제기준의 수립에 능동적이고도 주도적으로 참여하여 국제 사회에 기여함은 물론 무인항공기와 관련된 국제 관련 법령의 동향과 선진국의 사례를 파악하여 무인항공기 운용을 위한 국내 관련 법령을 선진형으로 제정 정비하는 법제화 작업을 병행하여야 할 것으로 본다.

어린이놀이시설 안전관리법규의 개선방향 (A Study on the Improvement of Laws Related to the Safety Management of Children's Play Facilities)

  • 본 연구에서는 어린이놀이시설의 안전관리를 합리적으로 하기 위해 현재 적용되고 있는 어린이놀이시설 안전관리 관련법규를 조사 분석하여 문제점을 밝히고 개선방안을 제안하는데 목적이 있다. 연구를 위해 어린이놀이시설 안전관리의 기본법인 "어린이놀이시설 안전관리법" 및 "품질경영 및 공산품안전관리법"과 "도시공원 및 녹지 등에 관한 법률", "주택법", "아동복지법", "영유아보육법", "건설기술관리법" 등을 분석대상으로 하여 첫째, 어린이놀이시설 안전관리와 관련된 법률의 조항을 도출하여 분석하고, 둘째, 조경산업의 활동영역과 일치하게 어린이놀이시설의 제품개발, 설계, 시공, 유지관리의 전체적인 흐름에 기초하여 단계별로 법규의 적용 특성과 불합리한 문제점을 밝혀냈다. 마지막으로 바람직한 어린이놀이시설 안전관리체계를 운영하기 위한 개선방안을 제시하였으며, 연구의 결과는 다음과 같다. 1. 분석 결과 "어린이놀이시설 안전관리법"을 제정하고 안전검사기준 및 안전인증기준을 준비하면서 전문성이 있는 조경분야의 참여가 부족하였고, 소량 다품종의 특성을 갖는 어린이놀이시설의 특성과 어린이놀이행태에 대한 고려가 미흡하였다. 또한, 안전인증의 정기검사기간이 짧고, 사소한 변화에도 재인증을 받아야 하는 불합리한 점이 나타났으며, 제품검사와 공장심사의 중복과 수출입 놀이시설의 안전인증 중복, 설치검사의 "건설기술관리법"에 의한 품질관리 및 감리규정과 중복, 기 설치된 놀이시설의 설치검사 소급적용, 안전검사기관의 부족이라는 문제점이 도출되었다. 2. 바람직한 어린이놀이시설 안전관리를 위해 "어린이놀이시설 안전관리법"을 유지 발전시키고 관련법규와 상호조정을 통하여 종합적인 어린이놀이시설 안전관리체계의 구성이 필요하다. 또한, 안전인증 검사 기준을 우리나라의 실정에 맞도록 정비하는 동시에 국제적인 수준에 부합되도록 해야 하며, 안전인증 검사의 절차 방법을 합리화하여 안전인증 및 검사절차가 중복되거나 과다한 비용이 소모되지 않도록 하고 안전검사기관의 전문성 향상 및 안전검사기관의 확대가 필요하다. 향후 종합적인 어린이놀이시설 안전관리체계를 발전시키기 위해서는 현장에서 발생하는 문제점을 분석하여 관련법규의 재정비 및 법조항의 개정에 관한 심층적인 연구가 필요하다.

미국의 상업적 우주활동에 대한 규제개혁 정책 (U.S. Commercial Space Regulatory Reform Policy)

  • 미 트럼프 행정부는 2018년 5월 24일 상업적 우주활동을 촉진하기 위한 규제개혁방향을 담은 우주정책명령 SPD-2(Space Policy Directive-2)를 발표하고, 뒤이어 6월 18일 우주상황 관리 정책에 관한 행정명령 SPD-3를 발표했다. 이 행정명령은 주요 우주 분야에 대한 개혁조치를 담고 있는데, 이 정책은 2017년 6월 재구성된 국가우주위원회(National Space Council: NSC)가 성안한 개혁 권고안을 대통령이 승인한 것으로 연방정부의 강력한 개혁추진을 위한 가이던스를 제공한다. 상업우주활동개혁정책은 앞서 2017년 12월 18일 발표된 국가안보전략(National Security Strategy)의 큰 틀에서 경제적 번영과 국가안보를 동시에 달성하기 위한 노력으로 이해할 수 있다. 상업적 우주활동을 촉진함으로써 미국의 국익을 달성하고자 하는 미국의 정책과 입법은 우주활동을 규율하는 우주조약을 위반한다는 우려와 논란을 불러일으킬 수 있다. 이에 국제사회는 미국의 상업우주개혁정책에서 노정되는 법적 쟁점에 대한 국제적 논의를 통해 우주기술의 발전과 상업화 진전에 맞는 보편적 국제 규범을 형성하기 위한 노력을 가속화해야 한다.
