윤리적 소비 가치관이 환경친화적 태도와 행동의도(재활용, 재사용, 감량화)에 미치는 영향 (The Impact of Ethical Values on Eco-friendly Attitudes and Behavioral Intentions (Recycling, Reusing, Reducing))

  • It is important to understand consumer attitudes associated with their eco-friendly behavior on account of not only environmental reasons, but also corporate aspects. In this study, we examine the relations between variables influencing eco-friendly attitudes and eco-friendly behavioral intentions, namely, recycling, reusing, and reducing (3R). We first, performed a theoretical consideration through reviews of literature on ethical identity, ethical obligation, altruism, and eco-friendly attitudes, and behavioral intentions. Based on the literature review, we designed a study model and drew hypotheses. Further, we collected data using a survey and processed them statistically in order to verify the hypotheses. A total of 265 samples were collected and the data were analyzed using a structural equation model (-LISREL 8.70). The results suggest that ethical identity and altruism significantly influence environmental attitudes. However, the effects of ethical obligations on eco-friendly attitudes are insignificant. The environmental attitudes have a significant effects on the consumer behavioral intention for recycling, reusing, and reducing. Although this study has some limitations, it is expected that it will positively trigger follow-up research.

인공임신중절과 관련된 윤리학적 논쟁과 문제 분석 (Ethical Argumants and Problems Analysis Related to Induced Abortion)

  • Over one million cases of the induced abortion have been conducted annually in Korea. Among those cases, most of all were illegally done, but this has not been addressed in the literature. While Korean Nurse Association Code of Ethics presents the respect for life as one of the basic ideology, it was not dealt enough in nursing education. The purposes of the study were to activate the debate on the issues related to an induced abortion ; to introduce the related ethical theories ; and to seek the solution of the ethical problems, which will eventually result in establishing the morality of nursing practice. The ethical theories of an induced abortion have traditionally addressed two extreme perspectives ; the conservatives who emphasize the sanctity of human life and the right of life that will never ethically allow the killing fetus ; and the liberalists who insist the right to choice for women to control their body. Since these extreme theories has not been helpful to solve the ethical problems, the recent trend is leading to the modified theories both from conservative and liberal perspectives. The examples of the theories are the potentiality of fetus(Singer, 1993), the obligation of women to serve their body to fetus(Held, 1987), the Replacement theory (Callahan, 1987), and the Principle of Caring (Gilligan, 1982). The study conducted the indepth interviews with 17 women who experienced the induced abortion and the 6 cases were selected to be analyzed. The cases were analyzed and interpreted by using an integrated case method which was combined of the New Casuisty(Jonsen & Toulmin, 1988 ; Jonsen, 1991) and the Specified Principlism (Richardson, 1990 ; Degrazia, 1992). The result of analysis revealed three types of ethical problems ; (1) the responsibility of taking care of the baby to be born (2) the fear for the condition of the fetus, and (3) the choice of induced abortion as the method of birth control. The findings also revealed the related ethical principles for various situations ; the principle of caring was used for choosing an induced abortion by the subjects ; the principles of the potentiality of fetus and the obligation of women to serve their body were for the consideration for the life of fetus ; and the principle of replacement was utilized for the right to choice for women. The ethical principles related to an induced abortion introduced in the study provided the way to solve the moral problems by applying to the clinical situations for nurses. The study also revealed the possibility of modifying the current ethical theories from the method of applying the principles to the various situation in the study. The modified theories would be more useful to guide the clinical practice with similar ethical problems.

  • 최근 인터넷의 사용이 일반화되면서 온라인상의 저작물을 무분별하게 다운받거나 재사용하는 사례가 증가하면서 온라인 저작물 침해에 대한 보호정책이 시급해졌다. 본 논문에서는 온라인 저작권 침해에 대한 보호책으로 강화되고 있는 법적규제 및 처벌과 저작물 침해에 대한 윤리의식 고취가 온라인 사용자의 행동과 의도에 어떠한 영향을 미치는지 실증연구를 통해 분석한다. 본 논문의 목적은 온라인 침해에 대한 합리적인 해결책을 제시하고, 온라인 침해와 올바른 사용에 대한 도덕적, 윤리적인 학습과 제도의 중요성을 부각시키고자 한다. 이 연구의 결과는 처벌과 윤리의식 모두 사용자의 저작권 침해행위에 영향을 미치며, 특히 사용자의 윤리의식이 저작물 침해행위에 더 큰 영향을 미치는 것으로 나타났다.

  • Purpose: The study was done to analyze the concept of accountability. Method: This study adopts a methode of Walker and Avant(1995) for analysis. Result: The defining attributes of accountability are obligation(competency, implementation) of justification, explanation, reporting and disclosure one's action to whom, acception of the evaluation and sanction against results of one's action. The antecedents of accountability are competency, knowledge, skills, values, duty, obligation, authority, empowerment, responsibility, autonomy. The consequences are public safety, improvement of professionalism & healthcare quality, partnership and stress & strain. Conclusions: It is required to develop the ethical concept and theory construction for accountability.

  • Respect for human life and respect for human dignity are two basic values to which organized nursing has urged its members to adhere in their service to mankind. Thus it is the nurses’ duty to provide health care in support of sustenance of life and to pay respect for the patient’s right to dignity. In practice, however, nurses may experience dilemmas between these duties much due to the de velopment of modern advanced techniques. These dilemmas have become more complex and difficult to resolve. Nurses are often faced with situations in which the terminally ill refuse professional care, posing serious conflicts between respect for human life and respect for human rights to self-determination. In such cases, resolution of the problem is not a simple matter, thus requires intensive study into the ethical questions related to the situation. The purpose of this study was to identify ethical problems that nurses experience in caring for terminally ill patients and explore the ways to the resolution of problems within the context of the situations. The methodology used for the study was a case study method which ‘New Casuistry’ proposed by Jonsen & Toulmin(1988) and the ‘Specified Principlism’ proposed by Degrazia(1992) as an alternative to old deductive and intuitive method. Cases were developed through semistructured indepth interviews according to the casutistry method. A total of seven nurses were interviewd who were caring for therminally ill patients. Four cases out of a total 14 cases were related to the topic. Through the case analysis it became evident that nurses appreciated other values more often than respect for the patient’s right to self-determination. These other values were convenience and efficiency in nursing practice in case 1, preservation of life above all other values in case 2, provision of nursing care to fulfill the nurse’s professional obligation at most in case 3, and respect for the family’s demand against the patient’s wish in case 4. This study showed that the most important ethical problems were conflict between respect for the patient’s right to self-determination and sustenance of life for the fulfillment of professional obligation. For this problem, benefit /burden analysis from the perspective of the patient and family for the promotion of patient’s wellbeing may be a way to resolve the conflict. Further, through these analysis it was shown that physicians’ and families’ opinions dominated in the decision - making and the opinions of nurses’ and patients’ tended not to be reflected. Thus the patient's right to his or her care was not readily respected. To solve this problem. nurses should make efforts to communicate reciprocally with their patients, family members and physicians in an effort to respect for their patient’s rights to life and diginity from the point of view and values of the patient. It is also important that nurses provide good basic nursing care up to the time of death regardless of decisions about providing or not aggressive treat-ment for chronically and terminally ill patients.

도서관 업무와 전문사서간의 윤리적 관계에 관한 이론적 고찰 (A study on the professional ethical relationship between librarian and library work)

  • The purpose of this study is to investigate typical ethical problems found in the technical and public services areas. The followings are the summary of the study. There are three distinct elements that govern ethical problems. One element is legal laws. The copyright law and the privacy act are exact examples. The copyright law has strong influence on the inter library loan service where the majority requests from the users are reproduction of copies. The privacy act also creates difficulties for librarians. Most requests for circulation records infringe on the privacy of library user. And advance online access systems also violates the privacy of library users. The second element is the code or rules that private organization has created. American Library Association created many statements that regulate the conduct of librarians. The bill of right, the professional code of ethics and policy on the confidentiality of library records have strong implications in the obligation of librarian. In the case of censorship at the selection of library materials, the code is a defensive tool against intellectual freedom. Yet self-censoring are prevailing practice among librarians. The thirds element is the competence of librarians. The analyzed table 3 showed that beside two elements, the rest of matters are competence required by librarians. The one aspect of it is humaneness and the other one is technical aspects. Technical aspect of competence are:(l) managerial and operational ability (2) communication skill (3) leadership (4) structure of knowledge and (5) self developing professionalism. Humanity aspect of competence are:(l) trust(fiduciary relationship) gained by diligence, objective judgement, ability, belief, rationality, integrity, kindness) (2) objectiveness (free from bias) (3) user-oriented consideration (need, interest, equal treatment, information gap) (4) caution in providing information (5) pride and (6) ability to distinguish advice and guidance specially in medical and law library.

국제중재에서 변호사의 비윤리적 행위 규제에 대한 연구 (Regulation of Attorney Ethics in International Arbitration)

  • For many years commentators have requested more active regulation of attorney ethics in international arbitration. Gradual deterioration of ethical standards in international arbitration will bring disrepute and, once its reputation is lost, it could take decades to rebuild confidence. The first reason for increasing unethical behavior is that there is no ethical code generally applied to all lawyers participating in international arbitration. A second reason might be that nobody is actively regulating attorneys in international arbitration. The first step to solve this problem is that major arbitration institutions should cooperate to enact a uniform code of conduct to be generally applied to all attorneys representing parties in international arbitration. Recently, IBA and LCIA prepared guidelines on party representation in international arbitration, and the guidelines will help attorneys follow uniform standardsof ethics. However, this will not be sufficient. There should be a regulating body to monitor attorney ethics and take sanctions against unethical attorneys accordingly. Arbitrators, who can see unethical behavior by attorneys from the closest distance, are the most appropriate regulating force rather than courts of arbitration seat or an attorney's licensing country. Of course, arbitrators don't have powers to withdraw or suspend an attorney's license, but they have powers to control attorneys'behavior within arbitration proceedings such as an allocation of fees and costs, barring the assertion of claims or defenses, drawing adverse inferences, or precluding the submission of evidence or testimony. Furthermore, arbitrators should be provided with such obligation as active control of attorney ethics. Even arbitration institutions should participate by imposing on an attorney who is a repeat offender a suspension from appearing in future arbitrations. Unethical behavior will decrease through concerted actions among arbitrational institutions to introduce a uniform code of conduct and to empower arbitrators for more efficient regulation of attorney ethics.

한나 아렌트의 비선택적 공거와 주디스 버틀러의 프레카리티 정치학: 몸의 정치학과 윤리적 의무 (Unchosen Cohabitation of Hannah Arendt and Precarity Politics of Judith Butler: Based on Body Politic and Ethical Obligation)

  • 이 논문은 미국의 젠더 이론가이자 퀴어 학자로 알려진 주디스 버틀러의 후기의 정치윤리 사상, 그중에서도 '프레카리티' 정치윤리 사상을 한나 아렌트의 '비선택적 공거'와 연결해서 최신저서 "집회의 수행성 이론 소고"(2015)를 중심으로 고찰하려 한다. 점점 제한된 사회적 정치적 불안정에 놓이게 되는 지구상 모든 인구의 평화로운 공존을 모색하려는 버틀러의 프레카리티 정치 사상은 레비나스의 타자 윤리학과 아렌트의 정치철학의 영향을 받아 윤리와 정치를 결합하고자 한다. 우선 인간은 인간의 조건인 이 지구상에서 자신이 누구와 살지를 결정할 수 없다. 이런 '비선택적 공거'는 한나 아렌트가 "인간의 조건"에서 주장하는 '행위'의 근본적 조건인 '다원성'과 관련된다. 인간의 모든 측면이 정치에 어느 정도 관련되지만 다원성은 특히 정치적 삶의 필요조건일 뿐 아니라 가능조건이라는 면에서 절대 조건이다. 두 번째로 버틀러에게 유대적 선민사상을 부정하는 비선택적 공거는 내가 모르는 다른 여러 타인들과 함께 사는 삶의 가능성, 모두가 근본적으로 취약하기 때문에 상호의존속에 살아가는 보편적 프레카리티의 정치로 연결될 수 있다. 다원적 인간이 지구상에 공존한다는 사실은 인간의 몸이 가지는 근본적 취약성과 상호 의존성에 근간한 '몸의 정치학'을 가능케한다. 불안정성과 구분되는 '프레카리티'는 지구상에 디아스포라처럼 확산되는 다양한 인간의 불확실한 삶에서 평등과 자유를 확장할 수 있기에 윤리적이다. 프레카리티에 입각한 윤리적 의무 개념은 버틀러가 "불확실한 삶" 이후 "갈림길"뿐 아니라 "전쟁의 틀"에서도 강조한 개념이다. 누구든 사회세계의 프레카리티를 피할 수 없으며 그럼 점에서 프레카리티의 보편적 차원이 우리 모두의 비토대적 연결점이 된다. 버틀러가 주장하는 상호의존성은 평등의 관점에서 지속가능한 상호의존성을 양성하기 위한 사회적이고 정치적인 형식의 투쟁이며, 평등을 향한 윤리적 요구는 근거리와 원거리의 가역성에 달려있다. 다시 말해 상호의존성이 비선택적 공거의 특징이라면 원근의 가역성은 프레카리티 시대의 윤리적 의무다. 윤리적 요구는 비선택적 공거, 비의도적 근접성이라는 조건 때문에 모르는 사람의 삶도 존중해야하고, 이런 의무는 정치적 삶의 사회적 조건속에 있으며, 이는 아렌트의 평등 및 레비나스의 노출과 맞닿는다. '비선택적 공거'와 '비의도적 근접성'에 입각한 버틀러의 프레카리티 정치는 정치와 윤리의 접합이자 보편 주체의 비토대적 연결점이다.

지구적 정의론으로서 지구시민권구상의 윤리학적 기초에 대한 연구 - Rawls의 자유주의적 국제주의와 코즈모폴리턴 공화주의를 중심으로- (A Study on the Ethical Basis of Global Citizenship Idea as a Theory on Global Justice - Focusing on Rawls' Liberal Internationalism and Cosmopolitan Republicanism)

  • 이 연구는 유력한 지구시민권구상인 Rawls의 자유주의적 접근과 코즈모폴리턴 공화주의구상에 대해 지구적 정의론으로서의 윤리학적 기초를 연구하는 것이 목적이다. 의무론측면에서 자유주의적 국제주의에 경도된 Rawls의 견해는 국제관계의 불평등이 구조화된 경제의 세계화시대의 호혜성의 의무와 시민적 권리에 관한 의무를 반영하지 못하는 한계가 있지만, 코즈모폴리턴 공화주의는 지구적 차원의 반지배원칙의 구현을 주창해 의무론적 정당화의 기반을 갖추고 있다. 공리주의 면에서 Rawls는 자유주의적 국제주의에 입각해 개별국가들 간의 재분배를 거부하는 논리에 대해 정당화를 시도하고 있지만, 코즈모폴리턴 공화주의는 개도국시민들의 구조적 희생을 극복해 지구적 차원의 해악을 줄이고 효용수준을 획기적으로 개선할 가능성이 있다.

치료중단행위에 대한 의료형법적 고찰 -의학적 충고에 반한 퇴원 사례를 중심으로- (A Study on Medical-criminal Problem of Withdrawing Life-Sustaining Treatment)

  • As a withdrawing care's study, the purpose of this study is searching about withdrawing care's acceptance and circumstances through Bora-mae hospital case(chapter 1). Withdrawing life-sustaining treatment has various forms. Though the meaning of euthanasia, death with dignity, natural death, physician assisted suicide are duplicated, the meaning of those are different slightly. Firstly, this study looks about the difference of the those meaning and acceptance range(condition) by withdrawing care's forms(chapter 2). Bora-mae hospital case sentenced guilty about physician who discharged incompetent patient who was after surgery by patient's wife determination. This Bora-mae case that sentenced guilty about discharge against medical advise(DAMA) that is regarded to custom has brought intensive confliction of legal, social, medical aspect, Bora-mae hospital case has many legal problems. First, as to criminal law rule 250(murder), the problem is whether discharge and withdrawing life-sustaining treatment is commission or omission. this study concluded omission(district court: omission, appeal, supreme court: commission). Because legal denounce point of discharge and medical treatment withdrawing is omission that physician who is obligatory on patient to cure. If physician's act is regarded omission, it is necessary to determine whether he has guardian status and obligation. Without guardian status and obligation, omission crime can't exist. This study decided that physician had guardian status and obligation and foundation of guardian status was pre-action or acceptance of emergency patient. Physician's medical treatment duty finished when patient(or patient's guardian) demands discharge. But when patient death is foreseen and other possible treatment does not exist, his duty of life prolonging treatment does not finish. This originate from physician's social responsibility and public status that limits patient's private liberty. This study regarded physician's action as accomplice about whether physician's discharging action is accomplice or the principal offender(district court: the principal offender, appeal, supreme court: accomplice). Though the principal offender needs criminal determination and action, there is no this common determination and functional action control of physician in Bora-mae case(chapter 3). Bora-mae hospital case partly originated from deficiency of legal, institutive system including medical security system shortage, the instruction is 1. medical security system strengthening, 2. hospital ethical committee's activity strengthening, 3. institutionalization of withdrawing life-sustaining treatment, 4. acceptance of pre-decision making system, 5. sufficient persuasion of physician for patient and faithful writing of medical paper, 6. respect for patients' self-determination and rights, 7. consciousness's changing for withdrawing life-sustaining treatment and persistent education about medical ethics(chapter 4). Considering Bora-mae case, medical sector is not the dead ground of a criminal punishment. Intervention of criminal law in medical sector give rise to ill effect, that is, excess medical examination and treatment, safeguard treatment, delay of discharge from a hospital. Because sufficient guarantee of life becomes mere empty slogan under situation that impose a burden of heavy cost to family or hospital, public and systematic solution should be given(chapter 5).
