A Study on Comparison of Commercial Arbitration System in Korea and U.S.A. (한국과 미국의 상사중재제도에 관한 비교연구)

  • Every year, many million of business transactions take place. Ocassionally, disagreements develop over these business transactions. Many of these disputes are resolved by mediation, arbitration and out-of-court settlement options. The American Arbitration Association(AAA) helps resolve a wide range of disputes through mediation, arbitration, elections and other out-of-court settlement procedures. The AAA offers a broad range of dispute resolution services to business executives, attorneys, individuals, trade associations, unions, management, consumers, families, communities, and all level of governments. The 198,491 cases composed of the 194,303 arbitration cases and the 4,188 mediation cases, were filed with the AAA in 2000. These case filings represent a full range of matters, including commercial finance, construction, labor and employment, environmental, health care, insurance, real state, securities, and technology disputes. The Korean Commercial Arbitration Board (KCAB) does more than render arbitration services. It helps facilitate settlements and guarantee implementation thereof between trading partners at home and abroad involving disputes related to such areas as the sale of commodities, construction, joint venture agreements, technical assistance, agency agreements, and maritime transport. The 643 cases composed of the the 197 arbitration cases and the 446 mediation cases, were filed with the KCAB in 2001. There are some differences between the AAA and the KCAB regarding the number and the area of mediation and arbitration case filings, the breath of service offerings, the scope of alternative dispute resolution, and the education and training. In order to apply to the proceedings of the commercial mediation and arbitration, the AAA has the Commercial Mediation Rules, the Commercial Arbitration Rules, the Expedited Procedures, the Optional Procedures for Large, Complex Commerical Dispute, and the Optional Rules for Emergency Measures of Protection as amended and effective on September 1, 2000. In order to apply to the proceedings of commercial arbitration, the KCAB has the Arbitration Rules as amended by the Supreme Court on April 27, 2000, which have been changed to incorporate the revisions of the Arbitration Act that went into effect on December 31, 1999. There are some differences between the AAA's commercial Arbitration Rules and the KCAB's Arbitration Rules regarding the clauses of jurisdiction and administrative conference, number of arbitrators, communication with arbitrator, vacancies, preliminary hearing, exchange of information, oaths, evidence by affidavit and posthearing filing of documents or others, interim measures, serving of notice, form of award, scope of award, delivery of award to parties, modification of award, release of liability, administrative fees, neutral arbitrator's compensation, and expedited procedures. In conclusion, for the vitalization of KCAB and its ADR system, the following measures should be taken : the effective case management, the development of on0-line ADR, the establishment of ADR system of electronic commerce disputes, and the variety of dispute resolution rules in each expert field.

  • This thesis is a study to develop the tentative objectives and present the professional and courses for the nursing college. The conclusions conducted by the purpose of this study are as follows. First, on the basis of the concepts of the nursing and the view-points of nursing education, the tentative goals for the nursing education are set up as follows. 1. To understand human being's life, dignity and their physical, mental, and social aspects. 2. To understand the basic concepts and the principles of human sciences, social sciences, natural sciences, and medical sciences. To apply their knowledges to nursing practices. 3. To diagnose and assess the problems of individual, family and community in terms of nursing practice. To develop the ability of planning, negotiation, management, and evaluation for the nursing education. 4. To develop appropriate knowlege, attitudes, and skills to promote the clients' health and treat their illness. 5. To accomplish all tasks effectively as a trained and qualified professional nurse through the endless studies. Second, the nursing areas and courses for the nursing college in terms of validity, Importance, continuity, relationship, utility and appropriateness are listed as follows. 1. To correct, supplement or eliminate the stated objectives by a professional or professional groups in that area.

u-EMS : An Emergency Medical Service based on Ubiquitous Sensor Network using Bio-Sensors (u-EMS : 바이오 센서 네트워크 기반의 응급 구조 시스템)

  • The bio-Sensors, which are sensing the vital signs of human bodies, are largely used by the medical equipment. Recently, the sensor network technology, which composes of the sensor interface for small-seize hardware, processor, the wireless communication module and battery in small sized hardware, has been extended to the area of bio-senor network systems due to the advances of the MEMS technology. In this paper we have suggested a design and implementation of a health care information system(called u-EMS) using a bio-sensor network technology that is a combination of the bio-sensor and the sensor network technology. In proposed system, we have used the following vital body sensors such as EKG sensor, the blood pressure sensor, the heart rate sensor, the pulse oximeter sensor and the glucose sensor. We have collected various vital sign data through the sensor network module and processed the data to implement a health care measurement system. Such measured data can be displayed by the wireless terminal(PDA, Cell phone) and the digital-frame display device. Finally, we have conducted a series of tests which considered both patient's vital sign and context-awared information in order to improve the effectiveness of the u-EMS.

Flexible Disjoint Multipath Routing Protocol Using Local Decision in Wireless Sensor Networks (무선 센서 네트워크에서 지역 결정을 통한 유연한 분리형 다중경로 라우팅 프로토콜)

  • Multipath routing is one of challenging issues for improving the reliability of end-to-end data delivery in wireless sensor networks. Recently, a disjointedness and management of path have been studying to enhance the robustness and efficiency of the multipath routing. However, previous multipath routing protocols exploit the disjointed multipath construction method that is not to consider the wireless communication environment. In addition, if a path failures is occurred due to the node or link failures in the irregular network environment, they maintain the multipath through the simple method that to construct a new extra path. Even some of them have no a method. In order to cope with the insufficiency of path management, a hole detouring scheme, to bypass the failures area and construct the new paths, was proposed. However, it also has the problem that requires a heavy cost and a delivery suspension to the some or all paths in the hole detouring process due to the centralized and inflexible path management. Due to these limitations and problems, the previous protocols may lead to the degradation of data delivery reliability and the long delay of emergency data delivery. Thus, we propose a flexible disjoint multipath routing protocol which constructs the radio disjoint multipath by considering irregular and constrained wireless sensor networks. It also exploits a localized management based on the path priority in order to efficiently maintain the flexible disjoint multipath. We perform the simulation to evaluate the performance of the proposed method.

An Efficient m-Healthcare Service Model using RFID Technique (RFID 기술을 이용한 효율적인 m-헬스케어 서비스 모델)

  • Due to a change of food culture, many patients suffering from various diseases such as hypertension, heart disease, stroke, cancer. However, it takes a long time in the hospital for many patients due to the administration before the patient care process. In this paper, we propose a m-Healthcare service model that patients can receive medical services without the inconvenience offers by reducing the administrative hospital treatment that can automatically recognize through the hospital installed RFID readers when the patient patients with various diseases are foreign to the hospital. In particular, the proposed model improves the operational efficiency of the existing healthcare system by shortening the treatment time for medical personnel to help patients in emergency situations can determine automatically the patient's status does not give the disease type and condition of the patient to health care personnel. Test results, service latency, efficiency, etc. patient satisfaction, and evaluate the existing health care system model results, the proposed method was improved service delay existing techniques average 16.5% efficiency was higher 27% of patients service satisfaction was improved by 22.4% on average.

  • Due to the Four Major Rivers Restoration Project, Nakdong River Estuary Barrage's designed flood quantity has been largely increased, and this has caused to construct several drainage gates at the right side of Eulsukdo island to secure the safety of downstream river area. For successful functioning of Nakdong River Estuary Barrage, such as flood control, disaster prevention, and the securing of sufficient water capacity, drainage gates at the both sides of island have to operate systematically and reliably. To manage this under restricted personnel and resources, we have implemented the IOS (Integrated Operation System) by integrating previous facilities and resources via information and communication technologies. The IOS has been designed to have higher availability and fault tolerance to function continuously even with the partial system's failure under the emergency situation like flood. Operators can use the system easily and acknowledge alarms of facilities through its IWS (Integrated Warning System) earlier. Preparing for Integrated Water Resources Management and Smart Water Grid, the architecture of IOS conformed to open system standards which will be helpful to link with the other systems easily.

A Study on the Behavior of an Existing Tunnel and the Safety Implications on its Facilities from a New Tunnel Blasting (신설 터널 발파 시 기존 터널 거동 및 시설물 안전에 관한 연구)

  • In this study, the behavior and safety of an existing tunnel and its facilities are investigated when a new tunnel adjacent to the existing tunnel is blasted. The design of the new tunnel puts priority on stability of the tunnel itself over the safety of the facilities which are installed within the existing tunnel such as jet fans. And thus, a detailed consideration on securing the safety of the existing facilities has been insufficient. An analysis on the types of traffic accidents in the last ten years shows that most incidents were due to the driver's improper response in emergency situations and unexpected obstacles. In consideration of this analysis, the safety of the facilities in the existing tunnel was secured by minimizing the charging amount for each hangfire and changing the excavation method of evacuation communication shelters to the large center hole cut blasting method to reduce blasting vibration. For a more quantitative analysis, measurement devices were installed inside the existing tunnel, at houses adjacent to the new tunnel, near jet fans in the existing tunnel. This enabled real time measurement of displacements of the existing tunnel, adjacent houses, and jet fans without interrupting traffic flow. Therefore, the improvements of charging amount for each hangfire, the blasting method, and the measurement method are suggested in this paper to secure the safety of the facilities in the existing tunnel when a new tunnel, located on a large city and adjacent to an existing tunnel, is designed.

Aortocaval Fistula - A case report - (대동맥-대정맥루 -치험 1예-)

  • Aortocaval fistula is a rare complication of abdominal aortic aneurysm, involving less than $1\%$ of all abdominal aortic aneurysms. A 64-years old man with a long history of hypertension and abdominal aortic aneurysm had chest pain, dyspnea, epigastric discomfort and palpable abdominal pulsating mass. Physical examination revealed hypo­tension with a systolic blood pressure of 70 mmHg, a large pulsatile mass and a systolic abdominal bruit. Laboratory data revealed a hemoglobin values of 11.0 g/dL, blood urea nitrogen (BUN) value of 5 mg/dL, and creatine value of $2.5 mg\%$. Abdominal Angio CT showed a 10cm infrarenal abdominal aortic aneurysm with dilatation of the IVC and aortocaval fistula from the aortic aneurysm, which was confirmed at emergency surgery. When the aneurysm was opened and the thrombus was removed, a 1 cm communication was identified between the aorta and IVC. This was controlled with Foley catheters ballooning, and the fistula was closed by continuous suture placed outside the aneurysm. A bifurcated aorto-iliac graft was used to restore arterial continuity. The patient was discharged home after uncomplicated postoperative course.

  • Existing web based information service system solutions show limitations in mobile information services, as well as problems such as uncertain error messages, and difficulty providing swift assistance or real time emergency support. In order to solve these deficiencies, a realtime wireless remote control system has been designed and implemented in this thesis, which is capable of managing and monitoring remote systems using mobile communication devices (Mobile Phone, PDA, Smart Phone) for realtime control. Proposed systems are applied at remote places, for instance 'office building', and a nursery school like 'kindergarten'. In the case of implemented at office building, it can be managing and controlling at real time all sorts of the sensor information that are installed at office building system environment through wire(web environment) or wireless(mobile device). In the other case at kindergarten system that are providing the real-time wireless remote control and monitoring system can be monitoring activity of kindergarten children with a mobile phone of authentication user. The security functions of proposed systems include mobile device user authentication and target system access control. The proposed systems allow real-time user authentication function and system access control function that improve the security of resource administrators and mobile device users, and provides not only uninterrupted services, but also real time mobile service environments.

  • Periodic and systemic disaster management has become more important than ever owing to the recent continuous occurrence of disasters, such as fires, earthquakes, and flooding. This management goes beyond simple disaster preparedness, which was introduced minimally under the existing legal system. For effective disaster management, facilities should be managed through regular maintenance on a daily basis, and in the case of an emergency, intuitive and accurate communication is essential regarding the situation and purpose. BIM manages the entire building property data using the effective 3D visualization model, so it can be used for various management purposes from design to facility maintenance. In this study, through an expert survey on the use of services in a BIM-based integrated disaster information system, the available areas of BIM data were organized in terms of facility information management, 3D visualization, and disaster control. Later, through the use service and DB definition within the BIM-based disaster integration information system, the main facilities monitoring and response services based on BIM and BIM-based spatial management service are proposed. Based on this study, it is hoped that the BIM-based application service functions within the system will be implemented to enable an effective system response.
