Commerce activities which are free form space and time constraint using a communication network are called Electronic Commerce(EC). Because of sending a commercial information using open network such as Internet in EC, they need the security of commerce information (payment information and purchase information), checking the integrity of transferring data and certifying all parts participated in commerce for a secure commerce. Recently Visa and MasterCard Co. released the Secure Electronic Transaction (SET) Protocol for secure payment card transaction on Internet. This paper proposes a Secure Electronic Commerce Transaction Model(SECTM) using SET in order to support the secure commerce on Internet. The proposed transaction model prevents merchant from abusing the cardholder's payment information (credit-card number etc.) and enables cardholder to shop securely in Electronic Shopping Mall.

본 연구는 전자거래에 대한 직접적 이해관계를 갖고 있지 않은 제3자 보관소 제도를 기반으로 하는 전자거래기록관리체계의 제안을 목적으로 한다. 이를 위해 관련 선행연구를 분석하고 전자거래와 전자거래기록의 개념과 유형 및 단계를 이론적 측면에서 살펴본다. 전자거래기록이 가지는 전자기록과 거래기록으로서의 복합적 속성에 대해 논하고, 전자거래기록관리 과정을 생애주기와 관리, 보관주체를 준거로 구분한다. 이를 통해 본 연구는 전자거래의 분쟁을 방지하고 조정할 수 있는 대안으로 신뢰할만한 제3자의 개입이 필수적임을 확인하고, 제3자 전자거래기록보존소를 중심으로 한 신뢰기반 전자거래기록 관리체계를 제안한다. 전자거래기록의 증거력과 관리환경을 살피고 이를 위해 준수해야 할 사항들을 논하는 한편, 거래 유형별 활용 사례들을 계약거래와 교환거래로 구분하여 제시한다.

The implementation of electronic transaction raises some new legal and institutional problem so it is necessary for us to prepare alternatives. As the development of electronic transaction is difficult without smooth settlement of dispute the pursue of smooth settlement of dispute is very important menu. while the most common method relating to the settlement of dispute is litigation. them relating to the litigation, the subject of governing law so jurisdiction and the subject of governing laws should be resolved above all. Further more in addition, the old act prior act was regarded as insufficient in that it lacked rules on international governing law to adjudicate, or international adjudicatory governing law, where as the expectation of the public was that the private international law should function as the basic law of the legal relational encompassing rules on governing law given the increase of It international disputes. for the move the private international law has also attracted more attention from the korean. Therefore, governing law to application concerned about electronic transaction should be prepared and the environment to keep electronic transaction secure and stable be guaranteed. And we should make plans to protect companies and consumers and should make efforts to expand electronic transaction infrastructure .

신기술에 의한 체제정비가 요구되는 시점에서 1999년 채택된 미국 통일전자거래법은 우리나라에 주는 시사점이 크다. 통일전자거래법은 개인간의 거래에서의 지침에 중점을 두는 반면 우리나라의 전자거래기본법과 전자서명법은 정부의 역할을 중시한 것이 특징이다. 통일전자거래법에는 우리나라와 동일하게 전자기록, 전자서명등에 대한 정의가 있고 자동화된 거래, 컴퓨터 프로그램, 전자대리인, 정보, 정보처리시스템, 보안절차등 우리나라에 없는 정의가 들어 있다. 제16조에서 규정하는 양도가능한 기록(Transferable Record)도 우리나라에 없는 특이한 개념이다. 여기서 명시하고 있는 전자어음은 법제정이 있기도 진에 우리나라에 도입하려고 하는 개념으로 금융산업의 지각변동을 예고하는 조항이기도 하다. 우리나라는 사이버몰, 인증기관을 강조하고 소비자의 보호지침을 도입한 것이 미국과 다른 특징이다. 미국의 경우는 각종 분쟁의 경우 법원의 해석을 강조하여 전통적인 사법부우위의 모습을 보여주고 있다. 향후 예상되는 각종 분쟁에 대한 미국의 판례연구는 한국에서도 신속하게 연구되어 적용되어야 할 분야라 하겠다.

Electronic commerce using internet is rapidly increasing a method to introduce and sell goods. persons who buy products in electronic commerce prefer to make interactive communications by multi users about products rather than show product informations. Reserved interactive transaction system for electronic commerce is electronic commerce system that is able to make a real communication buyers and customers. In this paper, e intend to design and implement reserved interactive transaction system for electronic commerce. it is efficiently used in middle and samll transaction system and able to make similar applications to sell and negotiate products for commercial transaction.

본 연구는 해운산업의 해운 B2B e-marketplace가 네트워크 관점에서 해운 이해관련 당사자들 간에 전자적 신뢰를 도출할 수 있는 운영적 특성과 웹사이트의 특성 그리고 전자적 신뢰를 매개 메커니즘으로 하여 사이트 몰입과 서비스 거래의도에 미치는 영향을 밝히고 나아가 이러한 해운 B2B e-marketplace가 협력적 거래커뮤니티로 발전해나가도록 하는데 목적을 두고 있다. 이를 위해 본 연구는 선행연구를 바탕으로 해운 B2B e-marketplace가 효율적으로 운영되기 위한 기본 변수들을 규명하고자 공변량 구조방정식 모형을 설계하고 이를 실증적으로 검정하였다. 해운 무역업체 직원들을 대상으로 설문조사를 실시하고 자료를 분석한 결과, 웹사이트 특성요인 두 개 중에 지각된 보안성만을 제외하고 지각된 사이트 품질 및 운영특성 요인들은 상호변수들 간에 영향을 미치는 것으로 조사되었다. 외생요인들 중에는 지각된 거래 공정성이 전자적 신뢰를 가장 높이는 것으로 조사되었으며, 이는 거래규칙과 관련하여 상대방 한쪽에만 유리하다면 장기적인 거래가 이루어질 수가 없기 때문에 거래의 일정한 규칙에 대한 이해관련당사자들이 공정성을 제대로 인식한다면 해운 전자시장의 성공적인 운영에 큰 영향을 미칠 것이다. 또한 거래의 지각 효율성도 전자적 신뢰에 영향을 미치는 바, 이는 거래비용의 절감과 상대방과의 거래 관계를 연결시켜주는 거래 프로세스 과정이 신속하고 간소함으로써 기존의 OFF-LINE 보다 더 많은 시간 및 비용을 절감시켜주기 때문이라고 판단하기 때문에 전자적 신뢰에 영향을 미치는 것으로 판단되었다. 또한 거래의 원활한 정보 입수를 위한 거래 참가자들에게 커뮤니티를 개설해줌으로써 이로 인한 정보도 얻고 이들을 유인하는 정보를 제공해줌으로써 전자적인 신뢰를 높이는 것으로 판단되었다. 한편 이러한 전자적 신뢰 형성을 관련 기업들로 하여금 지속적인 참여의지에 영향을 미침으로써 그 사이트에 대한 몰입을 높이는 것으로 판단된다. 또한 전자적 신뢰로 인하여 미래의 관련 기업들이 거래관계를 맺고 관련 기업들과 지속적인 거래를 하기 위한 기반을 조성해준다는 것이다. 결국 이러한 전자신뢰의 형성은 궁극적으로 사이트 몰입과 해운서비스 거래의도에 높은 영향을 미치는 것으로 나타났다. 이러한 결과로 보아 해운 B2B e-marketplace에 참여하는 해운 이해관련 당사자들은 미래에 현재의 거래를 맺고 있는 기업과 지속적인 거래 유지를 위해서는 해운 B2B e-marketplace를 운영하는 가상중개인의 전자적 신뢰형성의 역할이 중요하다는 것을 또 다시 입증시켰다.

This paper shows the architecture of IPS(Intermarket Payment System), an implementation of the electronic payment function for internet-shopping merchant system. Because the original purpose of commerce transaction is the exchange of money for goods or services, it is very important to prepare an exchangeable economic value or method. The electronic payment system is the hardware or software or both to process an electronic payment transaction. It has two type, the broker type and the electronic value type. The broker type means an intermediator between real bank network and internet commerce transaction. The electronic value type means a substitute for money in the real world. This paper shows the architecture and the function to implement the broker type electronic payment system. The system has two parts. One is the mediator part to support multiple payment systems and to offer common access methods for merchant system database. The other is the executor part to implement the payment protocol and to process payment transaction.

Because electronic transaction using electronic documents be carried without direct person to person meeting, there can be the possibility to use other's identity illegally without notice, and very hard to verify authenticity of transaction as well. In addition, it is very hard to find out that the electronic documents on the process of submitting is forged documents or not, and also have much difficulty in maintaining transmitting secret. Therefore, to solve such problems on electronic commerce transactions and electronic documents, the digital signature and certification system with cryptography skill is inevitably necessary. As the wide use of digital signature together with beginning of digital government and financial transaction, not only the issuance of electronic certification, but certification market came to gradually expand. In Korea, after enacting digital signature act in 1999, the act contents were expanded to the wide range of contents complying with global standards from the end of 2001 to April, 2002, including the new clause of certification problems. And the act was put into operation now. Therefore, in this paper, we'd like to suggest development scheme through the investigation on electronic certification related problems, such as, concepts, procedures, service conditions here and abroad.
