Review of the Need for Conversion of Proving Responsibility in Hospital Infection and the Duty of Safety Management as the Basis of it (병원감염 사건에서 사실상 증명책임 전환의 필용성 및 그 근거로서 안전배려의무에 관한 검토)

  • As results of analyzing judicial precedents about infection in hospitals in connection with mistakes and causality in medical litigations shows that the Mitigation of Law Principles To Prove responsibility in medical litigation has not been able to play its role compared to its intended purposes. And Major sentiment from those judgments is that a mistake can't be proved only by the fact that certain infection in hospital occurred in connection with hospital infection. Therefore, the number of indirect facts to deny estimation is overwhelmingly high. Like this, especially for hospital infection which is difficult to prove indirect facts themselves to estimate mistake, major sentiment from those judgments have a problem that impute sharing of losses caused by hospital infection to patient. In accordance with the Principles of equitable and proper sharing of losses, it's required to prepare legal interpretation and theoretical methods to largely mitigate patient's responsibility to prove medical mistakes compared to other medical litigations in connection with existing Mitigation of Law Principles To Prove responsibility and conventional theory of estimation. In connection with this, the results of review that duty of safety management in hospital infection cases can be the base of conversion of proving responsibility, the duty that prevent hospital infection, corresponding the duty of safety management in hospital infection is not conventional duty of safety management based on duty of good faith but secondary obligation of medical contract. The breach of duty preventing hospital infection is the violation of medical contract, but there is no logical necessity that convert proving responsibility from the obligation of contract itself. Therefore, the duty of preventing hospital infection from the obligation of medical contract, corresponding the duty of safety management in hospital infection cases cannot be the base of conversion of proving responsibility alone. But, it's still required to conversion of proving responsibility in hospital infection, we need further studies on cases of Germany which applies legal estimation of proving responsibilities in hospital infection.

Infection Control practices in accordance characteristic of Dental institutions -Daegu and North Gyeongsang Province around- (치과의료기관의 특성에 따른 감염관리실태 -대구, 경북지역을 중심으로-)

  • This study survey research of infection control, wastewater management, and instrument disinfection according to characteristic at Daegu, Gyeongbuk Province In 2012 and 2017, the same 114 dental clinics to identify the infection management behavior and prevent infection of dental medical institutions. Scored mean 3.37 points on 8 items of infection control, 95.5% in "records of the patient's medical history", 1.8% in "presence of a wastewater facility." Scored 94.7% in "disinfection of metal trays", 17.5% in "storage from a spitting receptacle in the waste bin and commissioned management.", Scored higher in of infection control, wastewater management and instrument disinfection according to general characteristics and dental characteristics in 2017 than in 2012. Points were higher dental hygienist, University graduation, Type of duty was counseling and management, hospital or higher, Number of dentist(dental hygienist, chair, patient) was high. Therefore raise a need for infection control into consideration the dental characteristics and education and promotion regardless of the hospital size.

  • Korean dental hygienists perform more tasks in dental clinics than are described in the law. The purpose of this study was to investigate the actual work of Korean dental hygienists in dental clinics using an observational study design. Two dental hygienists observed and recorded the work performed in 1 day from the time of commencement to the time of leaving work by 18 dental hygienists working in the dental clinic in a single area. Data management, prevention of infection, counseling, calculus removal, radiography, assistance of fixed orthodontic treatment, assistance of fixed prosthetic treatment, and preparation for implant surgery were recorded. Among the tasks that take more than 1 min, the most time-consuming tasks were document management, infection control, consultation, calculus removal, preparation for implant surgery, assistance of orthodontic treatment, and assistance of fixed prosthetic treatment. Korean dental hygienists are performing various tasks, such as infection control, dental hospital/clinic management, oral disease prevention, and dental treatment assistants.

Job Description of Nurses in Central Supply Department using DACUM Technique (데이컴 기법을 이용한 중앙공급 간호사의 직무분석)

  • Purpose: This study aimed to use the DACUM analysis technique and identify the job description among nurses of the Central Supply Department, in order to clarify their duty and task descriptions, identify the characteristics of job. Methods: Through a DACUM workshop, job descriptions, and the job duties and tasks were derived. A total of 150 nurses from the Central Supply Departments of medical Institutions over 100 beds were surveyed using drafting and a job analysis table. Individual jobs' frequency, importance and difficulty were measured using a 3-point scale, and the results were analyzed using SPSS. Results: The nurses' job in the Central Supply Department consisted of 13 duties and 64 tasks. Duties with highest importance and difficulty was 'sterilization assurance system', the second was 'employee safety management' and the duty with highest frequency was 'manage packaging before sterilization'. Conclusion: This study clarified the types of nursing jobs in the Central Supply Departments, as well as identified the job characteristics and status in the given setting. Given the sterilization assurance system for preventing hospital infection, and safety management for ensuring work environment safe were found to be important duties, it is suggested for the department to stress those important jobs for managing hospital safety.

An Analysis of Nursing Work of Operating Room Nurses (수술실 간호사의 간호업무 분석)

  • Purpose: The purpose of this study was to identify nurses' duties and tasks for job analysis of the nurses in the operating room. Methods: This study was descriptive investigation research using the 3-point likert scale questionnaires and the level of importance, difficulty and the frequency of each duty and task were analyzed. Data were collected by 422 OR nurses from 57 hospitals. Results: Job of OR nurses included 13 duties and 105 tasks. The 13 duties were 'management of operative patient' 'assistive work for operation' 'supportive work for operation' 'infection control in OR' 'management of equipments and instruments for operation' 'administrating medicine for operation' 'supplies management for operation' 'safety management for operation' 'environmental management for operating room' 'administrative work for operation' 'education for operating room personnel' 'development of operation procedure books' and 'elf development of OR personnel' Conclusion: This study identified duties and tasks performed by OR nurses. Based on these results, the importance, frequency, and difficulty in this study will provide research evidence for developing training programs for OR nurses.

  • The major court rulings delivered in 2017 include the ruling that separated the legal character of denture production agreement signed together with medical care agreement and found a subcontracting dimension in the former, and the ruling that overcame the limitations of the theory of entire appearance of a fetus as discussed in civil law by using the legal principle of insurance which suggests that unborn child insurance takes effect after the contract is signed and the first installment of the premium is paid in. As more court rulings find the medical specialists responsible for accidents and injuries from drugs, some argue that medication counseling by the druggist who makes and dispenses drugs should be upgraded. And with respect to a court ruling that denied the hospital's responsibility for an infection-involving accident even if there were no records on specific measures taken in infection management, some criticized the court for being too conservative in recognizing responsibilities. And with respect to infectious disease management, some criticized the court for its interpretation and application of the facts in the direction of denying the negligence. In addition, some claimed that it is necessary to establish institutional system for hospital infection control and its aid for victims, and to improve the system including the reversal of the burden of proof given the special nature of hospital infections. A number of rulings on the duty to disclose included the one which stated that the specific matter did not require a doctor's explanation as it was explained or the specific medical service would have been performed even if no explanation had been given. There was a greatly controversial ruling over the scope of indemnification, which accepted the occurrence of multiple scars and deformation as disorders while regarding breast as a thoracic organ. And a Supreme Court ruling over interpreting Medical Service Act was criticized as overstepping the boundary allowed in the law.

School Health Teachers' Experience of Coping with the COVID-19 Pandemic (보건교사의 COVID-19상황 대응 경험)

  • Purpose: This study was conducted to describe the experience of school health teachers in regard to the COVID-19 pandemic in South Korea. Methods: We conducted a qualitative study using content analysis. Ten school health teachers were recruited from 6 elementary schools, 2 middle schools and 2 high schools in Seoul, using purposive sampling. They participated in semi-structured in-depth interviews in person or using an online communication system from January to February, 2021. Interviews were transcribed verbatim and analysed using qualitative content analysis. Results: Three main categories and nine generic categories emerged from the analysis. Firstly, it was discovered that school health teachers had psychological and physical stress to cope with COVID-19 due to the 1) fear of the unexpected infectious disease, 2) burden of having to deal with it alone, 3) breakdown of personal life and physical exhaustion and 4) heavy duty as a health teacher caused by the lack of an organic cooperation system with institutions related to school infectious diseases. Secondly, school health teachers had an increased sense of empowerment in regard to infectious disease management as a result of 1) feeling rewarded and appreciated and 2) gaining confidence and trust in infectious disease management. Finally, school health teachers experienced the urgent need for an effective response strategy for infection control because of the 1) confusion over infectious disease response due to lack of practical manuals applicable to the field as well as training, 2) disappointing response system without an expert response team dedicated to managing infectious diseases in schools, and 3) growing awareness of the need for change. Conclusion: It is expected that school health teachers' experience of COVID-19 will be used as important data for building effective and advanced school infectious disease response systems.

Job Analysis of the Nursing Unit Managers of Women's Hospital Using DACUM Analysis (DACUM 직무분석 기법을 이용한 여성병원 간호단위관리자의 직무분석)

  • Purpose: To analyze the job of nursing unit managers working at women's hospital, using DACUM (developing a curriculum), DACUM is a method for analyzing job-focused competency. Methods: This study involved a descriptive survey. A DACUM workshop was held to define women's hospital nursing unit managers' role and identify their duties and tasks. For the workshop, a committee was formed consisting of 5 women's hospital nursing unit managers. Finally, after validation, the developed contents were made into a survey asking about nursing unit manager's duties and tasks. Results: Sixteen duties and 83 tasks were identified on the DACUM chart. The importance, difficulty, and frequency of the tasks were ranked in terms of A, B, and C, with A being the highest degree. Eight tasks received A's all in importance, difficulty, and frequency of performance. The 8 tasks were: 'taking over', 'taking care of seriously ill patients on handover', 'ward rounding', 'analyzing and resolving demands identified during handover and patient tour', 'reporting patient status during rounding', 'promoting breast-feeding', 'uterine contraction, and training for breast-feeding'. The duty with the biggest determinant coefficient (DC) was 'patients complaint management' (DC=7.09). Based on tasks, the one with the biggest DC was 'solving patient and patient guardian's complaints' (DC=7.53), followed by 'making infection control guidelines' (DC=7.5). Conclusion: When expanding the nursing staff of the hospital, women's hospitals nursing unit managers also need to use administrative functions as intermediaries to focus on the operation management of the entire hospital rather than direct nursing to suit their role.

A study on the job analysis of dental hygienist in Gwangju (광주광역시 치과위생사의 직무분석에 관한 조사 연구)

  • Objectives : The purpose of this study was to analyzes the job implementation of dental hygienist at dental hospital(university), dental clinic and general hospital in the city of Gwangju. Methods : The subjects in this study were dental hygienists who worked at dental hospital(university), dental clinic and general hospital in the city of Gwangju. A survey was conducted by post from June 10 to August 10. Out of the collected data, 204 answer sheets were analyzed. Results : 1. 'Medical & Dental history taking', 'Extra & Intra oral examination' and 'Dental hygiene care plane' in dental clinic were significantly higher than dental hospital(university) and general hospital(p<0.001). 'Remove of extrinsic stain' and 'Treatment of hypersensitivity tooth' in dental clinic and general hospital were significantly higher than dental hospital(university)(p<0.001). 'Preventive dental caries treatment' and 'Diet control' were shown the low frequency of job implementation. 2. Almost task elements of dental assistance duty shown that dental hygienists under the 24 years old were significantly higher dental hygienists over the 30 years old(p<0.05) and dental clinic and general hospital were significantly higher than dental hospital(university)(p<0.05) in frequency of job implementation. 3. 'Dental staff supervision', 'Patient management' and 'Dental chart arrangement' shown that dental hygienists over the 30 years old were significantly higher than dental hygienists under the 24 years old in frequency of job implementation(p<0.05). 'Infection control' of dental hygienists over 30 years old was significantly lower than dental hygienists under the 24 years old(p<0.001). Conclusions : The results of this study indicate that a scope of dental hygienists' job need to extend also in order to accomplish a job efficiently, is suggested that the effort is necessary to improve a quality of dental hygienist and to change of recognition of the dentist about dental hygienists' job.

Analysis of Activities and Services of Delivery Room Nurses Based on DACUM Technique (데이컴기법을 활용한 분만실 간호사의 업무활동 분석)

  • Purpose: The aim of this study was to analyze various nursing services of delivery room nurses by hospital level, and identify importance and frequency to provide baseline data to establish delivery room nurses' roles. Methods: Through DACUM analysis technique, service descriptions, duties, and tasks were derived from the literature. A survey was done of 242 nurses from delivery rooms of hospitals, general hospitals, superior general hospitals, and special hospitals. Importance and frequency of each service were measured using a 4point scale, and results were analyzed using SPSS. Results: Nursing services for delivery room nurses consisted of 18 duties and 86 tasks. Duties with the highest importance were 'labor support' and 'infection management', and those with lowest importance were 'collaborative care' and 'communication'. The duty with the highest frequency was 'labor support', and lowest frequency was 'communication'. There were differences between importance and frequency depending on the size of hospitals. Conclusion: Results of this first study on nursing services of delivery room nurses. delivery room nurses are performing a wide range of nursing services and the various types are clarified including importance and frequency.
