Analysis of Ordiances for the Development of Regional Specialized Industries and Implications (드론산업 조례 분석을 통한 지역특화산업 발전 방안)

  • Purpose - The purpose of this study is to compare and analyze the ordinances of local government in Korea to provide improvement plans for the ordinances of Drone industry. To this end, all Drone ordinances in Korea were reviewed. Design/Methodology/Approach - In this study, literature research methods were mainly used for the analysis. Furthermore, it was based on domestic laws and ordinances of local government, and preceding research data regarding government policies. Findings - Based on the analysis of domestic drone industry ordinances, the enactment of drone industry ordinances by local governments was rapidly increasing. In addition, it was urgent to enact ordinances for the use and support of drones in each region. The implication that it is necessary to subdivide the contents according to the characteristics of each region was drawn. In most of the ordinances, provisions on the basic plan and implementation plan of the drone industry could not be found. It was found that it was necessary to foster an efficient drone industry through the establishment and operation of short-term and long-term plans. Implications were drawn that it is necessary to revitalize the drone industry and expand the drone use industry. Research Implications or Originality - This paper suggest the establish an ordinance for utilizing and supporting Drone industry. Additionally, establishment of suitable ordinance for regional characteristics is needed. In future research, detailed data on Yeongwol's Drone industry based on survey should be derived. Moreover, the development plan and implication for drone industry should be derived through analysis of the survey data.

A Discussion on the Legal Definition and Legislation Methods of Drone Taxis (드론 택시의 법적 정의 및 법제화 방안 논의)

  • There are policies that foster the drone industry, which either put a legal precedent on drones through the "Drone Act" or grant a delay or exemption in applying the safety measures of "the Aviation Safety Act". Yet, the definition of a drone is unclear, requiring further discussion on commercial usage. Therefore, we have studied cases domestically and abroad, and also analyzed issues with the current aviation legislation. It was found that a drone is defined as "an unmanned aircraft where a pilot is not on board, and its net weight is 150 kg or less". However, there are several issues, such as that a drone taxi requires a pilot on board, and its weight is 150 kg or more. Thus, we propose to define a drone as "an unmanned aerial vehicle (provided, that its own net weight should be 300 kg or under, or not be limited to weight) under Article 2 (3) of the "Aviation Security Act" as prescribed by Ordinance of the Ministry of Land, Infrastructure, and Transport, which operates either by remote, automatically, or autonomously; or an unmanned aircraft under Article 2 (6) of the "Aviation Security Act".
