According to English law, in a voyage policy there is an implied warranty that at the commencement of the voyage the ship shall be seaworthy for the purpose of the particular adventure to be insured. However, Unites States law affords the implied warranty of seaworthiness a great deal of latitude. In the case of voyage policies, it has been traditionally held that the assured is bound not only to have his vessel seaworthy at the commencement of the voyage but also to keep her so, insofar as this can be achieved by himself and his agents, throughout the voyage. Additionally, a defect in seaworthiness, arising after the commencement of the risk, and permitted to continue from bad faith or want of ordinary prudence or diligence on the part of the insured or his agents, discharges the insurer from liability for any loss consequent to such bad faith, or want of prudence or diligence; but does not affect the insurance contract in reference to any other risk or loss covered by the policy, and which is not caused or exacerbated by the aforementioned defect. One of the most important areas of difference in the marine insurance contract between the U.K. and U.S. is the breach of warranty. Prior to the Wilburn Boat case, the MIA was thought to hold that the effect of a breach of warranty was similar under American law -in that under the general maritime law literal compliance with all promissory warranties is required. In this case, the Court concluded that state law should apply to a marine insurance policy, and found that there was no federal rule addressing the consequences of a breach of warranty in marine polices. However, it is of the utmost importance that this case brought to a close the imperative concordance between English and American law. Meanwhile, in relation to marine insurance contracts in Korea, this insurance is subject to English law and practice;, additionally, the international trade volume between Korea and the United States has assumed a vast scale. Therefore, we believe it is important to understand the differences in marine insurance law between the two countries in terms of marine insurance contracts, and most specifically warranties.
Background : The objectives of this study were to examine patients' satisfaction with the DRG based payment method and its association with their awareness of the method, to examine patient reported changes in doctors' caring attitude, level of their out-of-pocket payments, providers' acceptance of patients' request for additional services after the program, and to examine changes in service utilization recorded in medical records. Method : One hundred-four patients who had cesarean sections before and after the demonstration program at two hospitals located in Seoul participated in the study. Patients were surveyed before discharges when their charges were finalized. Their medical records were reviewed as well to collect data for service utilization during hospital stays. The association between patients' satisfaction with the payment method and their awareness of the method was analyzed by ${\chi}^2$-test, and the significance of changes in providers' acceptance of patients' request for additional services and service utilization after the program were examined by ${\chi}^2$-test and t-test, respectively. Results : A large proportion of patients did not know of the DRG based payment method at the time of survey and a significantly larger proportion of patients who came to the hospitals with the knowledge satisfied with the method. About the same proportion of patients reported improvement and deterioration in doctors' caring attitude compare to the previous hospitalizations and a similar result was found concerning out-of-pocket payments. Providers' acceptance of patients' request for medication, PCA and painless delivery decreased significantly after the program whereas the acceptance for additional hospital days and laboratory and radiology tests did not. Length of stay, the numbers of days on antibiotics and antianemic medication, and the number of blood tests decreased significantly after the program, however, decreases in the rate of antianemic medication and the number of urine analyses were not statistically significant. Re-operation, in-hospital death, and complications were not observed before and after the program. Conclusion : The study findings indicated a need for better patient education and publicity about the newly introduced payment method to improve their satisfaction with the system. Other study findings concerning service utilization and quality of care indicators were consistent with the government funded evaluation studies.
Floating debris was recorded from a training ship, $\sharp$1 Kwanaksan, of Pukyong National University with about 10 knots speed at July 15th and 20th of 1997. The sampled area is the middle of southern sea of Korea, divided into 44 unit segments on survey routes. Debris fabrication materials were categorized with 6 items using the following; man-made or natural wood items, paper and cardboard, nylon netting and rope, styrofoam, plastics, floating metal and glass containers. All identified items within a 100 $\pm$ 2 m wide band were recorded but ignored if beyond this boundary. The results of distribution and transport of floating debris in the area are as follows: 1. The quantities of debris during the survey were distributed from $1.6\~369.7\;items/km^2$. The most obvious trend is the widespread distribution of all debris. The highest densities of all debris were discovered in the coastal waters of Namhae and Yokji island, and of about 50 km off from the southward of Yokji and about 74 km off from the eastward of Komun island. Especially many of small styrofoams within $\phi$20 cm were observed in these segments. 2. Styrofoams and plastics were composed of $83.5\%$ among all debris, next woods items, $9.8\%$. 3. The quantities, distribution shapes and composition of debris were varied as the observed duration and the natures of each items. 4. These phenomena are concluded that firstly they depend on the river discharges included debris due to precipitation falls, secondly inflow or dumping debris are drifting to the off-shore by Kuroshio currents present at their adjacent sea, But on the basis of the observed data it is difficult that source position, quantities and inflow items of debris are identified, and also the transport processes is pursue. further more surveys are continuously being investigated, and from this it is hoped that a much wider coverage can be achieved, perhaps on all sites of the Coast of Korea and contributed to the stationary area, finding of sources, removal method of debris and resistants of marine productivity.
This study was undertaken to determine the normal serial ultrasonographic appearance of the postpartum uterine involution in small pet dogs (Yorkshire terrier and Maltese). Postpartum changes in uterine shape, architecture, echogenicity and diameter were monitored by ultrasonography in 12 small pet dogs. Serial ultrasonographic examinations were done daily during the first week, 3 days interval from 8 to 30 days, and weekly from 31 to 100 days postpartum. The excretory period of vaginal discharge in 12 normal bitches of uterine involution was finished completely within 3 weeks postpartum. The short axis shape of the uterus was initially often flaccid-appearing. It varied from circular to polygonal. This lasted until 15.75$\pm$3.84 days postpartum, during which time the short axis uterine shape gradually changed to circular. Also, the long axis shape of the uterus was a beaded appearance until 30.89$\pm$4.25 days postpartum. After 30 days, it was appeared as tubular shape between placental and interplacental sites. The ultrasonographic image of the postpartum uterus consisted of four echogenicity distinct layers. Uterine wall was represented as very hyperechoic serosa, hypoechoic myometrium, hyperechoic endometrium and anechoic structures of fluid in the uterine cavity until 7 days postpartum. The individual uterine layers were most prominent during the first week postpartum, and they became progressively less distinct throughout the course of uterine involution. The thickness of myometrium was decreased rapidly in the placental sites from 4.47$\pm$1.42 mm at 1 day to 1.92$\pm$0.26 mm at 16 day, and in the interplacental sites from 3.19$\pm$0.61 mm at 1 day to 1.39$\pm$0.61 mm at 16 day. And it was decreased slowly until 94 day and was been minimum thickness at 94 day. The thickness of endometrium was also decreased like that of myometrium. The uterine diameter in the placental sites was decreased from 22.28$\pm$3.01 mm at 1 day to 16.11$\pm$1.46 mm at 7 day, and in the interplacental sites was decreased from 13.65$\pm$2.34 mm at 1 day to 9.41$\pm$1.59 mm at 7 day postpartum. From 7 day to 93 day, the change of diameter was more and more slow. At 94 days postpartum, the uterine diameter was 5~6 mm both placental and interplacental sites, and the uterine horns were uniform hypoechoic, tubular structures without enlargement. Therefore, complete involution of the uterus occurred at 94 days. It was concluded that normal post partum uterine involution in small pet dogs appeared to be completed 94 days postpartum by gross findings such as vaginal discharges, and by ultrasonographic findings, uterine shape and echogenicity.
The impervious surface rate increased by urbanization causes various problems on the environment such as water cycle distortion, heat island effect, and non-point pollutant discharges. The Low Impact Development (LID) techniques are significantly considered as an important tool for stormwater management in urban areas and development projects. The main mechanisms of LID technologies are hydrological and environmental pollution reduction among soils, media, microorganisms, and plants. Especially, the media provides important functions on permeability and retention rate of stormwater runoff in LID facilities. Therefore, this research was performed to assess the pollutant removal efficiency for different types of media such as zeolite, wood chip, bottom ash, and bio-ceramic. All media show high pollutant removal efficiency of more than 60% for particulate materials and heavy metals. Double layered media is more effective in reducing heavy metals by providing diverse sizes of micro-pores and macro-pores compared to the single layered media. The results recommend the use of different sizes of media application is more cost-effective in LID than a single size of media. Furthermore, soluble proportion of total heavy metal in the stormwater is an important component in proper media selection and arrangement.
For improving water quality and hish habitat environment the targeted instream flows added to the field measurement of low flow at each reach along Wonju Cheon are calculated by depth, velocity, and the present lower channel width with considering the landscape, aquatic environment, and natural ecological function. Target instream flow increasing ranged from $0.03m^3/s$ of upstream to $0.90m^3/s$ of downstream according to the proposed depths of 0.10m to 0.30m and velocity of 0.2m/s. The methods for target instream flow increasing are base flow increasing by watershed management, non polluted discharge inflow from valley and combined sewer by sewerage system modification, and discharges from upstream reservoirs and detention basins near-by stream. The possible increasing flow rates are $0.19m^3/s$ to $3.42m^3/s$ which are 1.4 to 2.5 times of low flow to be measured which are the equivalent targeted instream flows along Wonju Cheon. The BOD-based water quality improvement are analyzed by QUAL2E. The habitat suitability indices by PHABSIM of Zacco temmincki as target species at middle stream of Wonju Cheon improve significantly by low flow increasing, which is very important to improve water quality and fish habitat.
In flow velocity measurement of natural rivers, taking images with proper image quality is the fundamental and the most important step. Since flood peaks generally occur in night time, it is very difficult to capture proper images in that time. The present study aims to test a far infra-red camera as a adequate alternative to resolve the various problems in measuring flood discharges. The far infra-red cameras are able to capture images in night time without help of any extra illuminations. Futhermore they are not affected by fog nor smoke, hence they can be adapted for a fixed-type surface image velocimeters. For comparison, a commercial camcorder and a near infra-red cameras were used together. The test images were taken at a day time and a night time, and the image acquisition work were performed at an artificial flow channel of the Andong River Experiment Station. The analyzed results showed that the far infra-red camera would be a good instrument for surface image velocimeters, since they were able to capture regardless light condition. There are, however, a few minor problems in their accuracy of the analyzed results. About their accuracy a more study would be required.
Manning's roughness coefficients for the Han River, the Nakdong River and the Geum River were determined by the hydraulic models using their field measurements. The roughness coefficients of present study were compared with the ones of the conventional references. The hydraulic models, such as HEC-2, HEC-RAS and FLDWAV models, are usually applied to a river flow analysis. In order to compute the accurate flood level with the numerical models, accurate information about river sections, the upstream and downstream boundary conditions, and the appropriate roughness coefficients are indispensable. It is hard to obtain the reasonable roughness coefficient of the river, in the other hand the river cross sectional data and the boundary conditions are relatively easy to acquire. The coefficient values from the references are applied in many applications without considering the variation of locations and discharges of the river, or the values are unreasonably estimated. The final results from this study will give a reasonable and important data to perform the flood routing in the Korea river.
Energy loss at manholes, often exceeding friction loss of pipes under surcharged flow, is considered as one of the major causes of inundation in urban area. Therefore, it is necessary to analyze head losses at manholes, especially in case of surcharged flow. Hydraulic experimental apparatus which can change the manhole shape (square, circular) were installed for this study. In the experiments, two inflows ($Q_1,\;Q_2$) were varied from 0 to $4{\ell}$/sec and 15 combinations were tested in total. The flow ratios $Q_2/Q_3$ were varied from 0 to 1 for a total flow $Q_3$ ($Q_3=Q_1+Q_3$) of 2, 3, and $4{\ell}$/sec, respectively. The variation of head losses were strongly influenced by the lateral inflow because the head loss coefficient increases as the flow ratio $Q_2/Q_3$ increases. There was no significant difference of head loss between square manhole and circular one, and also no large variation of head loss as discharges change. The relation equations between K and $Q_2/Q_3$ were suggested in this paper.
The Keum river has been utilized for drinking water supply of several city including Kunsan city and is deepening pollution state due to numerous municipal and industrial discharges. The concentration BOD in river is affected by the organic loading from a tributary and the algae biomass that largely happen to under eutrophication state. In the eutrophic water mass such as the Keum river, the autochthonous BOD was very important part for making a decision of water quality management, because it was accounted for majority of the total BOD. The predict of water quality has important meaning for management of water quality pollution of the Keum river. The purpose of this study will manage and predict water quality of the Keum river using QUAL-2E model considering the autochthonous BOD. The estimation of autochthonous BOD represented that the relationship between BOD and chlorophyll a. The regression equation was shown to be autochthonous BOD=$\beta$(sub)5$\times$chlorophyll a. The results of this study may be summarized as followed; The QUAL-2E model was calibrated with the data surveyed in the field of the study area in June, 1998. The calculated value by QUAL-2E model are in good agree to measured value within relative error of 7.80~20.33%. Especially, in the case of the considering autochthonous BOD, the calculated value of BOD were fairly good coincided with the observed values within relative error of 15%. But the case of not considering autochthonous BOD, relative error of BOD was shown to be 43.2%. In order to attain II grade of water quality standard in Puyo station which has a intake facility of water supply, we reduced to the pollutants loading of tributaries. In the case of removed 100% BOD of tributaries, the BOD of Puyo station was 4.07mg/$\ell$, belong to III grade of water quality standard. But in the case of removed 88% nutrient of tributaries, it was satisfied to II grade of water quality standard as below 3mg/$\ell$ of BOD. For estimation of autochthonous BOD in Keum river, we are performed simulating in accordance with reduction of nutrient load(50~100%) under conditions removal 90% organic load. Occupancy of autochthonous BOD according to nutrient loading reductions were varied from 25.97~79.51%. Occupancy of autochthonous BOD was shown to be a tendency to increasing in accordance with reduction of nutrient loading. Showing the above results, the nutrient that one of the growing factor of algae was important role in decision of BOD in the Keum river. For the water quality management of the Keum river, therefore, it is necessary to considering autochthonous BOD and to construction of advanced sewage treatment plant for nutrient removal.
