Learning from Successes and Failures of Registration of Patent Applications Based on Physical Ergonomics Research

  • Objective: The present study suggested practical measures for successful patent registration based on a review of success and failure cases of patent application filed based on inventions obtained from physical ergonomics research. Background: The protection of intellectual property (IP) contributes to economic growth and competitiveness and facilitates innovation and creativity. IP rights are pursued on research findings for effective technology transfer and commercialization; however, a patent application can be rejected if patentability requirements such as patent eligible subject matter, utility for industrial application, novelty, or non-obviousness are not satisfied. Method: Three successful and three failed cases of patent applications based on physical ergonomics research were reviewed, critical reasons for their successes and failures were examined, and measures were proposed to avoid failures in patent registration. Results: The following measures were identified based on the patent application case review. First, abstract ideas including logical procedures and/or mathematical formulas need to include use of tangible apparatus and methods in idea realization. Second, the provision of grace period inventor disclosure exception needs to be properly followed in case an invention is disclosed before filing of patent application. Lastly, a comprehensive analysis of prior art published or publicly known anywhere in the world and a claim preparation of distinguished, non-trivial features compared to prior art solutions are needed to avoid possible violation of novelty and non-obviousness. Application: The proposed measures can help to prepare a patent application with patent eligibility.

자세 교정 제품 설계 기술의 한국 특허 출원 경향 (Korean Patent Application Trend of Posture Correction Product Design Technology)

  • This study investigated the technological development of Korean functional product design for posture correction. We analyzed registered and disclosed Korean patents (n=289) of KIPRIS. They were posture correction technology patents filed from 1999 to 2018. Keywords used in patent selection were posture correction, posture correction clothing, posture correction band, rehabilitation clothing, joint protection, protective equipment, and compression wear. These were then analyzed by patent application year, product type, effect pursued, and posture correction body part. The results showed that patent applications related to posture correction technology have increased since 2014. Products subject to patents for posture correction technology were device/brace (59.5%), footwear (22.5%), and clothing (18.0%). Patents for posture correction pursued various wearing effects. The effects pursued were dependent on the product type. The device/brace focused on joint protection (76.7%) and muscle reinforcement (40.7%). Footwear was focused on joint protection (90.8%). The clothes were focused on muscle reinforcement (50.0%) and body shaping (36.5%). The clothing and device/brace for posture correction were worn on various body parts of the upper limbs to feet. The posture correction product design patent was to correct various body parts. Patents pursuing upper body correction focused on spine posture correction (n=99). Patents for foot posture correction have steadily increased (n=102). Patents for posture correction of the pelvis and hip joints were relatively few (n=46). The results of this study implied the necessity to develop technology to correct posture by combining the functions of device/brace and clothing.

컬러 맵과 컬러 칩 추출의 특허 출원과 적용 사례 (Extracting the color map and color chip for a patent and application)

  • The purpose of this study is to obtain the patent for extracting the color map and color chip from the color image source and to develop color image map for fashion design. For this study, fashion image maps were produced from 210 pictures with Adobe Photoshop CS2 program targeting 200 university students from 2004 to 2006. The procedures for extracting the color map and color chip included providing the color image, the filtering phase, the segmentation phase, the extraction phrase, and the arrangement phase. Based on the results of this study, patent application was made to KIPO(Korean Intellectual Property Office) for this invention. The following effects can be expected from the standpoint of design based on the case study. First, it is a straight forward procedure to extract a color chip and color map from a color image. Second, it can be applied to various art works based on the recombination of colors as representative colors can be extracted from the related color image that combines a variety of colors. Third, desired colors can be selected based on the taste cluster classification or sensibility axis of design by extracting the representative color from the color image.

  • Feed drive systems are used to position the machine tool components carrying the cutting tool and workpiece to the desired location. Hence, their positioning accuracy and speed determine the quality and productivity of machine tools. In this paper, technical trend of machine tools feed drive systems are analyzed by patent mapping. And this paper suggested future development direction of feed drive systems. The analysis is carried out by using problem solution map (PSM) for the applied patent during January 2000 and December 2009 in Korea, Japan, EU and U.S.A.

중등단계 직업교육에서의 발명·지식재산 교육내용에 대한 담당 교사의 교육요구도 우선 순위 분석 (An Analysis on the Priority of Educational Needs of Teachers in Charge of Educational Contents of Invention Intellectual Property in Secondary Vocational Education)

  • 본 연구의 목적은 중등단계 직업교육에서의 발명 지식재산 교육내용에 대한 교사의 교육요구도 우선 순위를 분석하여, 중등단계 직업교육에서의 발명 지식재산교육이 효과적으로 이루어 질 수 있는 토대가 되는 교원의 역량 개발을 위한 직무 연수 프로그램 개발에 기초 자료를 제공하는 것이다. 이를 위해서 담당 교사 인식에 기반한 중등단계 직업교육에서의 발명 지식재산 교육내용에 대한 교육요구도와 이러한 교육요구도의 우선 순위를 분석하여 제시하였다. 본 연구의 구체적인 결과를 제시하면 다음과 같다. 첫째, 중등단계 직업교육에서 발명 지식재산 교육내용에 대한 담당 교사의 교육 요구도 평균은 5.02로 나타났다. 교육요구도가 전체 평균보다 높은 교육내용 항목은 23개이고, 이들 항목과 항목별 평균은 F4(특허 청구 범위) 6.72, F5(명세서 수정 및 보충) 6.46, F2(특허 도면 작성) 6.39, F3(특허명세서와 요약서 작성) 6.31, A5(발명 기법과 활동) 6.27, E6(발명 디자인 프로젝트) 6.15, H3(발명품 사업화) 5.97, F1(특허 정보 및 출원) 5.90, E5(디자인 권리화) 5.78, E3(발명 디자인의 디자인 과정) 5.77, A4(발명과 문제 해결) 5.57, G2(특허 조사 및 분류) 5.47, C2(발명 문제 해결 사고 기법) 5.45, E4(발명 디자인 제품 제작) 5.45, B5(발명특허 프로젝트) 5.42, A2(창의성 개발) 5.26, C4(발명 문제 해결 프로젝트) 5.26, H4(발명품 마케팅) 5.26, H2(발명품 사업성 분석) 5.20, D4(발명과 경영) 5.16, C3(문제 해결 활동) 5.14, E2(발명 디자인의 발상과 표현) 5.11, B3(발명기법의 실제) 5.08 순으로 나타났다. 둘째, 중등단계 직업교육에서 발명 지식재산 교육내용에 대한 담당 교사의 교육 요구도 우선 순위는 1순위에 해당하는 교육내용 항목은 13개, 2순위는 10개, 3순위는 17개로 나타났다. 1순위에 해당하는 교육내용 항목은 A4(발명과 문제 해결), A5(발명 기법과 활동), B5(발명특허 프로젝트), C2(발명 문제 해결 사고 기법), C4(발명 문제 해결 프로젝트), E3(발명 디자인 과정), E4(발명 디자인 제품 제작), E5(디자인 권리화), E6(발명 디자인 프로젝트), F1(특허 정보 및 출원), F2(특허 도면 작성), F3(특허명세서와 요약서 작성), H3(발명품 사업화)이다. 2순위에 해당하는 교육내용 항목은 A2(창의성 개발), B3(발명기법의 실제), C3(문제 해결 활동), D4(발명과 경영), E2(발명 디자인의 발상과 표현), F4(특허 청구 범위), F5(명세서 수정 및 보충), G2(특허 조사 및 분류), H2(발명품 사업성 분석), H4(발명품 마케팅)이다. 3순위는 1, 2 순위를 제외한 교육내용이다.

Advanced Information Data-interactive Learning System Effect for Creative Design Project

  • Compared to the significant approach of project-based learning research, a data-driven design project-based learning has not reached a meaningful consensus regarding the most valid and reliable method for assessing design creativity. This article proposes an advanced information data-interactive learning system for creative design using a service design process that combines a design thinking. We propose a service framework to improve the convergence design process between students and advanced information data analysis, allowing students to participate actively in the data visualization and research using patent data. Solving a design problem by discovery and interpretation process, the Advanced information-interactive learning framework allows the students to verify the creative idea values or to ideate new factors and the associated various feasible solutions. The student can perform the patent data according to a business intelligence platform. Most of the new ideas for solving design projects are evaluated through complete patent data analysis and visualization in the beginning of the service design process. In this article, we propose to adapt advanced information data to educate the service design process, allowing the students to evaluate their own idea and define the problems iteratively until satisfaction. Quantitative evaluation results have shown that the advanced information data-driven learning system approach can improve the design project - based learning results in terms of design creativity. Our findings can contribute to data-driven project-based learning for advanced information data that play a crucial role in convergence design in related standards and other smart educational fields that are linked.

Patented Modern Gothic Chair in the Brooklyn Museum of Art by Fredrick W. Krause

  • Fredrick Krause's chair in the Brooklyn Museum of Art (accession no. 87. 19) is a key to the understanding of factory-made, patent furniture, and the Modern Gothic style in the United States. However, research has rarely done for this chair as well as for the designer. Since this piece is incorporating the utility patent, it is a valuable example to understand the nineteenth-century patented furniture. Because of the popularity of Modern Gothic style, the similar style of chairs were often manufactured. This study explores how other examples are related and what the significance of the Brooklyn Museum chair is. The book of Sharon Darling provided especially helpful information about other Krause chairs in Fond du Lac and chair manufactures in Chicago. The interview with John Ebert at Galloway House in Fond du Lac, Wisconsin was especially helpful. Several primary sources proved helpful in researching the chair. The photo archives. of Kimbel and Cabus at the Cooper-Hewitt National Design Museum provides me a key to this research.

  • Recently, a high speed spindle is an essential part of machine tools to satisfy latest demand of high precision product and machining of hard materials. But, there are many disadvantages such as heat generation of built-in-motor, bearing friction, noise, vibration and displacement because of the high speed. Many researches on spindle systems have been conducted for solving these problems. In this study, technical trend of machine tools spindle systems are analyzed with patent PSM, mapping and grouping. The analysis is carried out for the applied patent during January 2000 and December 2009 in Korea, Japan, EU and U.S.A. And development of the direction, strategy and promising technologies of the spindle system are suggested.
