소비자 관점에서 본 주택 및 인테리어 하자 실태 분석 및 인테리어 서비스 평가 (Analysis on Defect Disputes in Housing & Interior Design from Consumers' Perspective and Interior Design Service Evaluation)

  • The purpose of the study was to investigate defect cases in residential interior design, to identify the state of defects, and to categorize types of defect and disputes. In addition, consumer appraisal to residential interior design service were analyzed. The results of this study could provide fundamental information regarding the defects and claims in residential interior design. First, we did literature review for defect disputes in architectural design and interior design. We identify the definition of defects by building life cycle, by state of construction, by activity, and by design performance. Second, we analysed interior design defects cases reported in Korea Consumer Agency & Ministry of Land, Infrastructure and Transport. A total of 49 cases of defect disputes in residential interior design from 2000 to 2015 were investigated. As a result, many defects appeared during the construction stage. A majority of defects cases fall into insulation, water-proofing/leakage work. In terms of design aspects claim, functional and aesthetic defects were claimed. Third, from Consumer Market Evaluation Indicators, raw data from 500 respondents were investigated for the housing repair and interior design. It is found that information comparability, responsiveness to consumer claim, price, and safety are important factors for consumer satisfaction in interior design.

  • 공동주택 하자분쟁을 해결하고자 하는 노력의 일환으로 최근 하자분쟁조정제도가 도입되었다. 하지만, 당해 제도는 현재의 하자분쟁의 쟁점사항과 분쟁 당사자들의 입장을 제대로 반영하고 있지 못하다. 또한, 제도의 내용과 절차에서 많은 미비점이 존재한다. 본 연구에서는 하자분쟁의 여러 내용적인 측면 중에서 기술적 쟁점사항에 대해 정리하고 하자분쟁조정제도가 정착되기 위한 대안마련을 검토하였다. 그 결과 현행 하자분쟁의 판정논리체계요소에 대해 정리할 수 있었고, 이에 효과적으로 대응하기 위한 전략으로서 활성화 방안을 제시하였다. 그 기본 원칙은 조정자와 분쟁 당사자간의 신뢰관계를 구축해야 하는 것이며, 사회적 기대사항에 대한 부합, 제도적 차원의 활성화 방안이 뒷받침되어야 할 것으로 판단된다.

  • The number of defect disputes occurring in apartment houses is increasing year by year, and among them, disputes caused by defects in tiles account for 28.2% of the total, which is an important defect in tiles. A representative tile defect in the defect dispute is the lack of tile backfill. Another dispute occurred that the standards for each organization are different as the 100% standard of the Ministry of Land, Infrastructure and Transport's building construction standard and 80% standard of the Architectural Institute of Korea's Building Technology Guidelines. In this study, it was analyzed the relationship between the amount of tile backfill and the amount of tile defects based on 100 defect litigation court appraisal documents. It was observed that the amount of defect in tile works tended to decrease as the amount of tile backfill increased. By presenting an appropriate amount of mortar to fill behind tiles in a defect dispute, the effect of reducing the defect dispute can be expected.

공동주택 하자소송 사례분석을 통한 분쟁방지 대책에 관한 연구 (A Study of the Prevent Measure by Case Analysis of Apartment Building Defect Lawsuit)

  • 본 연구는 최근 급증하고 있는 공동주택의 하자분쟁과 관련하여 하자소송이 급증한 시점인 2013년을 기준으로 2013년 이전과 이후의 하자소송 판례 24건의 공종별 주요 쟁점사항에 대하여 분석한 결과 세대당 하자적출금액은 2013년 이후는 2013년 이전과 비교하여 약 5% 감소한 세대당 2,572천원이나, 세대당 판결금액은 오히려 약 19%가 증가하여 2013년 이후에는 세대당 1,916천원으로 나타났다. 공종별로 살펴보면 균열에 대한 하자가 2013년 이전과 이후 가장 큰 비율을 차지하였고, 2013년 이전에는 설비, 타일, 창호 순으로 나타났고, 2013년 이후에는 조경, 타일, 단열 및 창호공사 순으로 나타났다. 이러한 하자분쟁 예방을 위해서는 설계단계, 시공단계 및 유지보수단계에서 하자분쟁 방지 노력이 필요할 것이다.

실내디자인 업무의 클레임 현황과 분쟁사례 분석에 관한 연구 - 실내건축가를 대상으로 한 실무사례를 중심으로 - (A Study on the State of Claims and Disputes in Interior Design Projects - Focusing on Practices and Experiences of Interior Designers -)

  • With rapid economic development in Korea, interests in interior design have increased gradually. However, interior design markets were poorly evaluated from 2015 Korean Consumer Evaluation. It is necessary to identify what kinds of problems, defects, and consumer claims have arisen during interior design planning and construction procedures. Therefore the purpose of this study is to investigate claims and disputes in interior design project procedures and to find out when defects or claims take place in those procedures in order to reduce claims or defects. Email questionnaires were distributed to KOSID members (professional interior designers) using Google Survey. In addition, a focus group interview was conducted. A total of 54 responses were collected and analyzed using SPSS 19. As a result, in an agreement stage, alteration in materials is the major source of claim. More than a half of respondents addressed time shortage for programming and planning. During the construction stage, approximately 31% respondents experienced client dissatisfaction with materials and finishes. The reason for project completion delay was due to claims during construction. The claims most frequently appealed by clients were related to painting. The satisfaction with project quality is positively related to the quality and contents of design documents including design drawings and specifications. Regulations and communication with clients are important issues to reduce the gaps between interior designers and clients/ consumers.

  • The latest domestic construction sector is receiving economic damage because of defect litigation. The Concrete Crack among them has the largest component in expense of apartment house defect. Also, contradictory suggestion of appraiser is problem. To improve these problem, need objective plan that people concerned can recognize about decision sequence. Therefore, in this study, compared general defect investigation and defect decision of appraiser taking advantage of Data Dictionary analysis method. Also, deduced current problem and amelioration plan.

  • As the Korean construction market in the apartment housing has changed to a housing consumer focused market, interest and importance on efficient use and management on existing buildings has increased rather than demand for new buildings. Interest of housing consumers on apartment house quality has increased in this market paradigm, and this spontaneously is connected to quality flaw related defect disputes and lawsuits that the importance of defect diagnosis has continuously increased. This defect diagnosis is directly connected to maintenance charges in defect dispute and lawsuit processes that rather objective and highly credible progress of duty is required. However, most defect diagnosis firms today that progress defect diagnosis are using different diagnosis methods and depend on the experience of experienced professionals that there is no standardized defect diagnosis process. Therefore, the purpose of this study is to provide common defect diagnosis process model for defect diagnosis firms utilizing the BPMN (Business Process Modeling Notation) modeling method. It is expected that this will contribute to professional and reliable task performances of concerned defect diagnosis workers. Furthermore, it is expected that design lawsuit damage will be substantially reduced by standardizing defect diagnosis processes.

Analysis of Consulting Reports on Defect Disputes in Apartment Building

  • The main processes involved in a defect dispute are consulting, reviewing, and finally judging as an arbiter. This process of defect consulting produces a defect consulting report, but business practices and standards of judgment will differ among consultants, and have many problems. This study reviews the structure of a defect consulting report and considers the structure's problem, which is that it is not standardized. To achieve this, data of sixteen defect consulting report were collected involving defect lawsuit cases before or after 2010. The structure and index of the defect consulting reports were then reviewed, and the results are as follows. As for a structure based on fourteen index, there are suitable that judge a outline, a cost estimate data and a consulting work item by a consulting standard. Furthermore, analysis by each common parts and private parts is considered as appropriate about consulting items and estimate by standard. However, consulting item in construction progress and responsibility period for security that related on a cause and a responsibility of defect need to complement. Meanwhile, the first thing of issues are connected a defect consulting is urgent a standardization for a defect type.

  • 입주민은 육안으로 구별이 되는 하자를 중심적으로 보며, 건설사는 공동 주택의 구조적, 기능적 문제에 영향이 가는 하자를 중심적으로 본다. 그에 따라, 건설사와 입주민은 공동주택의 하자를 기준으로 서로 다른 관점을 가지고 있다. 이를 해결하기 위해 본 연구에서는 서로 다른 하자의 관점차이로 인하여 발생하는 공동주택 하자분쟁의 쟁점과 개선 방안을 목표로 진행하였다. 먼저, 국토교통부와 법원의 서로 다른 하자판정기준 및 보수기준을 분석하였다. 과거 청구소송 하자판결 사례분석을 통하여 문제점을 도출 하였으며, 여러 건설사의 하자 데이터를 기반으로 건설사와 입주민의 관점차이를 도출 하였다. 이를 해결하기 위해 공동주택 하자 데이터베이스의 개선방안을 제안하였다.

  • 최근 공동주택의 주거 비율이 높아짐에 따라 이에 따른 하자분쟁이 증가하고 있는 추세이다. 이러한 하자들 중에서도 마감공사는 발생빈도가 가장 높으며 이를 보수하기 위한 막대한 비용이 발생한다. 그러므로 이러한 문제를 해결하기 위해 하자 발생빈도 및 보수비용을 활용한 하자위험도를 미리 도출하여 하자순위별로 사전에 예방할 수 있는 관리기법의 개발이 필요하다. 따라서 본 연구에서는 공동주택 마감공사의 하자유형별 분석 및 위험성 평가 방법을 도출하는 것을 목적으로 한다. 이를 위해, 최근 준공된 마감공사 하자사례를 조사하여 하자위험 우선순위를 도출하고 하자관리를 위한 위험성 평가방법을 제시하였다. 본 연구의 결과는 공동주택 마감공사의 품질향상을 위한 관리제도 개선의 근거자료로 활용될 것이다.
