A Study on Applicability of ODR in the Disputes of Overseas Construction Projects (해외건설공사 분쟁에서 ODR의 적용가능성에 관한 연구)

  • Traditionally construction has been an industry that favoured ADR over formal litigation due to the complexity of technical issues. However, over the past decade construction arbitration has come under increasing attack for its rising costs and growing delays, and expansion of arbitration processes to the point that those processes are approaching the more complex and formal processes followed to resolve disputes litigation. As a result, parties are looking for new methods of resolving their disputes in a more efficient and economical manner, such as ODR. A review of the history of ODR and the practical applications of ODR in use today lead to the conclusion that the concept of ODR for construction dispute resolution appears to be possible and realistic. The advantages seem to outweigh the disadvantages, especially given the solutions suggested to overcome many of the disadvantages. While ODR may not be a realistic venue for large complex construction cases, it may be just the ideal venue for smaller and simple construction disputes. In conclusion, given the advantages that ODR arbitration does offer, the most realistic use of ODR in the short term would involve disputes consisting of a simple, one-dimensional dispute within which the parties can stipulate to the facts in the case. In such simple disputes ODR may be not only an appropriate vehicle within which the dispute can be resolved; it might be more easily accepted by the parties as the preferred platform for resolution. Hopefully, international institutions of arbitration will be successful in their development of a international standards and platform fir disputes that can be adapted for use in construction and will serve as the first step in developing ways to handle small construction claims, thereby allowing parties to resolve their disputes in a faster and more economical manner.

  • 4D simulation integrates the 3 dimensional model of a building with the construction schedule, and it leads to the possibility of virtually checking the construction process and the building itself in advance. However, the existing problem of 4D simulation is the difference between the demands of architects, engineers, and construction site workers in 4D simulation. This study suggests the possible way to enhance the availability of 4D simulation, considering more the practical demands from the construction site. In order to conduct this study, we build a 3D BIM model of a business-residential complex and link the model with the pre-defined construction schedule in order to make a 4D simulation. This study concludes with the optimized 4D simulation methodology based on BIM model considering the demands in perspective of the construction site. It would contribute to the harmonic collaboration among architects, engineers, and labors in the construction site when using 4D simulation based on BIM model.

A GIS-Based Planning Methodology to Determine the Haul Route Layout in Complex Construction Projects (GIS를 이용한 토공 운반로 탐색 방법론 - 단지공사 사례를 중심으로 -)

  • The layout of haul routes within a construction site of large complex projects needs to be carefully determined as the productivity of earthwork activity heavily depends on the efficiency of the layout and the routes are not likely to change once they are settled. This paper aims to provide a construction planner with a reliable framework to create an efficient layout of haul routes within a large complex construction site. To construct the framework, five factors affecting haul route layout and the productivity of earthwork activity are described along with the associated rules of thumb recommended by design and field experts. In addition, a methodology based on spatial analysis using raster format in GIS is proposed to further increase haul route efficiency. The proposed planning framework enables a construction planner to easily find a more reliable route layout by thoroughly considering the key factors prior to setting up an earthmoving plan.

  • The growth-share matrix is a portfolio planning tool developed by the Boston Consulting Group (BCG) to assist competitive positioning in the international market including those in the construction industry. This matrix is helpful in balancing the firm's cash-flow, and it can suggest strategic directions for each business unit. However, its effectiveness and applicability have long been debated in the academic field due to the complex and unique industrial context of construction. To solve the dispute, this research clarifies the applicability of theories underlying the growth-share matrix to the construction industry. Empirical research based on actual financial data of Korean construction firms is adopted for the statistical analysis including one-way analysis of variance and correlation analysis. The results of this research show that empirical findings on the relationship between performance variables. In this context, this research can provide important insights on the concept of portfolio management in the construction industry.

Conflict Avoidance in Construction Projects: Six 'C' Rescue Factors

  • Conflict is aroused when different people having different interest work together for fulfilling same the objectives. As the construction field is large, complex, volatile and requires tremendous capital, there are always greater challenges and possibility of risks of conflicts. Poor management practices in construction site and trying to protect risks and threats by contracting parties are the cited sources of the construction conflicts. The best management practice is to resolve the problems before these cultivate as conflicts. This paper has identified six dispute avoidance factors-Convince, Coordination, Consideration, Compromise, Consolation and Coercion. Six 'C' factors described in this paper are the mantra (formula) to execute a conflict free construction project. The conflict avoidance factors have been verified through a successfully executed project called TEVT development project (Technical Education and Vocational Training) during 1993-1998 in Nepal. The results show that the six 'C' factors 'C' considered during the implementation of the project, construction conflicts would be controlled or minimized effectively.

A Descriptive Analysis of Project Participants' Perception about Complaint in Public Construction Projects

  • Conflicts in public construction projects become more serious and complex so that they have a negative effect on performance of projecets. Conflicts in public construction projects are defined as expanding in complaints. This study analyzes the relationship structure and effect on performance between complaints and conflicts. First of all, 219 survey data collected from industry experts were used to derive complaints arising from the project and to understand the characteristics of each complaint. In the case of environmental damages, rather than environmental damage during construction, harmful substances or effects that can occur in completed facilities cause complaints from local residents, and opposition from environmental groups has a great effect on time and cost increase. As for safety damage, civil complaints related to prevention and countermeasures for safety accidents occur frequently, and additional construction affects cost increases. Through this study, it is possible to understand the serious complaints that are prone to conflict in public construction projects, their frequency, and the performance of the project.

  • A nuclear power plant construction is a complex form of construction which comprises various stakeholders and contractors. Therefore, contract disputes will occur due to conflicting interests of contracting parties and unpredictable factors which arise during construction work. Even if the contract is well prepared, it cannot fully prepare for future situations in actuality. Claims management is very important in carrying out construction management. This study intends to define claim, and delve into development of claims management processes from the viewpoint of owners and contractor through consideration on international contract terms on claims management and the details of the claims management of the Construction Extension to the PMBOK. In addition, it is needed to accumulate and manage data on claims that have occurred so that they can be referenced in the future. As information should be accumulated so that type classification can be carried out and that lessons can be learned on claims that have occurred in each business site, study on establishing data-based systems relating to claims processes will be needed in the future.

Regional development through vitalization of agro-industrial complex in seocheongun (농공단지 활성화를 통한 서천군 지역발전방안)

  • The vitalization of Agro-industrial complex could be an alternative to enhance farmers off-farm income and overcome FTA's impacts on the import of agricultural products. However, it is evaluated the governmental policy on the Agro-industrial complex has not been successfully done as expected. The Agro-industrial complex started to be composed in 1984 and the 427 Agro-industrial complex have been composed nationwide by 2011. Meanwhile, three Agro-industrial complex where 61 factories are running have been composed and two Agro-industrial complex are being under construction in Seocheongun as of 2011. It is investigated that there are constraints in the government supporting systems for Agro-industrial complex. They are; Aged and poor infrastructure facilities, Weak marketing competition, Scattered supporting agencies, and Poor loan system, etc. In this respect, the policy of supporting system was suggested and recommended to vitalize Agro-industrial complex in the study. They are; Better loan system, Improving aged facilities, Marketing support, Assisting technology, Suppling labor power, and Forming factory-network, etc.

Analysis on the Observation Environment of Surface Wind Using GIS data (GIS 자료를 활용한 지상 바람 관측환경 분석)

  • In this study, the observation environment of surface wind at an automatic weather station (AWS 288) located at Naei-dong, Mirang-si was analyzed using a computational fluid dynamics (CFD) model and geographic information system (GIS). The 16 cases with different inflow directions were considered before and after construction of an apartment complex around the AWS 288. For three inflow directions (south-south-westerly, south-south-easterly, and north-north-westerly), flow characteristics around the AWS 288 were investigated in detail, focusing on the changes in wind speed and direction at the AWS location. There was marked difference in wind speed between before and after construction of the apartment complex in the south-south-westerly case. In the south-south-easterly and north-north-westerly cases which were frequently observed at the AWS 288, the construction of the apartment complex had no marked influence on the observation of surface wind.

  • In a construction project in which cooperation among project members gets its importance, trust among construction site members should be foundation to enhance team spirit and achievement. This study analyzes the trust network among staff by using social network analysis (SNA) theory for organizations in apartment complex construction sites in Korea. The analysis illustrates higher level of trust for those positioning in the higher positions in hierarchy and having greater experiences. It might be attributable to own features of construction works where skills are acquired by site experience.
