Confidentiality and the Riddick Principle in International Commercial Arbitration

  • This paper seeks to provide a comprehensive review of the international rules of law on the obligations of confidentiality and its exceptions in international commercial arbitration, including the Riddick principle stemming from the common law jurisdiction. To this end, this article examines and analyzes developed countries' arbitration legislation including relevant case laws and the most recent leading institutional rules. Given the fact that the increasing use of discovery in international commercial arbitration and that the parties and practitioners in civil law countries are not familiar with the concept of the Riddick principle and its implied undertaking to a court, this article introduces the concept of the Riddick principle with some analysis for the recent case laws. Finally, this paper makes some suggestions to strengthen the compliance of confidentiality in international commercial arbitration by introducing new rules on confidentiality, inter alia, sanctions for breaching of the obligations of confidentiality.

From Fragmented Development to Three-Dimensional and Coordinated Development - Research on Renewal Strategies of Existing Underground Commercial Space in Harbin

  • In Harbin, a network of underground commercial spaces has been developed to occupy spaces that were originally created as civil defense shelters. With the gradual extension of the local metro rail system, the existing underground commercial space is no longer an isolated regional development, but a space that represents "three-dimensional city" and coordinated development taking place in many Chinese cities. Based on the analysis of the unique development process taken in underground space of Harbin, this paper summarizes three characteristics of its early model of "fragmented development" of underground space. By conducting a comprehensive field research and survey, the researchers analyzed 472 questionnaires related to the development trend, and proposed multi-level synergistic elements for the renewal and development of underground commercial space. The paper concludes by discussing the trend of "three-dimensional and collaborative development," suitable for the development needs of the new era, and the corresponding development strategies for the renewal of underground space.

  • Over the past several years, the building codes that govern commercial building construction have become increasingly prescriptive in nature, specifying detailed information related to the design and installation of the systems, while offering no reasoning behind their prescriptive measures. For example, metal stud framing is commonly used in commercial building construction to create bearing walls and non-bearing partition walls. BIM provides a powerful platform for developing and implementing "pre-planning" tools and methods to facilitate both engineering and administrative controls during construction. This paper discusses the use of BIM to enhance constructability for commercial building construction activities, specifically metal stud framing. Using specific real-world examples this paper demonstrates ways that BIM can be used to foresee potential construction issues and motivates and informs future uses of BIM technologies

  • Nowadays, the music industry is moving from analog to digital. Most of the big portal sites provide commercial online music streaming services according to the tendency. In this paper, we analyze the security of the Korean commercial online music streaming services which are provide by the Korea's major portal sites(Dosirak, Cyworld, and Naver). Moreover, we show attacks on commercial online music streaming services that lead to an infringement of copyright and propose technical countermeasures for online commercial music streaming services, the contributions of the present work are that the measures protect the copyright of the music.

  • This paper reviews the distinctive characteristics between e-Trade and e-Commerce in view of commercial arbitration in Korea and explores several improvements for the role of commercial arbitration. As the volume of e-Trade and e-Commerce has expanded day by day, there will be more disputes between traders no matter where the commerce may occur. But despite increasing of the disputes relating to e-Commerce transaction, it seems that the role of commercial arbitration has been shrunk instead. Korea needs to improve the role of commercial arbitration in order to meet and lead the age of u-Trade Hub(u-TH) service and to adopt an offensive or active attitude when arbitration used. Moreover, it is suggested that the competence of arbitration should not only be intensified more precisely but also be redesigned more systematically. Korea should take advantage of arbitration resources actively such as arbitrators as human resource and experiences as knowledge assets and also prepare the policy for sharing those arbitration resources between arbitrators more effectively.

College Students' Consumption Behavior on Commercial Kimchi in Taejon (대전지역 대학생들의 시판김치 소비형태 조사)

  • The survey was conducted to investigate the consumption aspects of commercial kimchi and the future pattern of kimchi consumption. The college students(473) were randomly selected from six universities in Taejon. Ninety seven percent of students had taken the commercial kimchi. They chose kimchi manufactured by the famous company(62.4%), merchant in market(16.9%), and agricultural corporation(14.4%). In purchasing the commercial kimchi, qualty(76.0%) was considered as the most important factor and then price(13.1%), brand name(5.1%). The main reason for disliking commercial kimchi was indicated as 'different taste from home-made' by the male and 'additives added in kimchi' by the female(p<0.01). The maintenance of aging condition was believed the most essential factor to increase the consumption of commercial kimchi. Two thirds of the subjects anticipated to take home-made kimchi after marriage. Half of them replied to want to take kimchi made by traditional method, even though to buy the sauce for kimchi-making sold in market. More female students were willing to purcase the sauce for kimchi-making than the male(p<0.01).

  • One hand shopping center provides a public space for people, the other hand it is a place for commercial purpose. Although it gives an entertainment, eating and shopping places to people nowaday, owners and tenants aim to make profit from it. According to this demand designers should plan a shopping center for a comfortable place for eating, shopping and playing and they make shops and retails to increase sales by exposing those to more people at the same time. For successful shopping center architects are requested an approach with commercial strategy that shopping center raises exposure of retails and makes stay costumers longer and visit more frequently. Recently space is regarded as a mean of marketing, so-called "place marketing", because it can influence on brand image and improves the image of product. Therefore, it need to be approached with commercial consideration. Analyzing the armature this study will take a look at spatial strategies in shopping centers which especially the Jerde Partnership, one of influential firms on commercial space, designed. And it will examine how spatial strategies can be applied to commercial strategies in relation to customer information process(exposure-attention-interest-comprehension-memory) which marketers are using in advertisement for marketing and what kind of role spatial strategies can be. This study is to be basic considerations when a shopping center project will be planned.

Studies on the Emission control of methanol engine exhaust with modified 3-way catalyst at cold start condition (변형된 삼원촉매에 의한 저온시동조건에서의 메탄올엔진 배가스 정화효과에 관한 연구)

  • As the major methanol fueled vehicle exhaust components, formaldehyde & methanol conversion over the existing commercial 3-way catalyst was examined in a labolatory tains different Ag loadings on commercial 3-way catalyst, and german commercial catalysts for methanol engine exhaust manufactured by a commercial manufacturer. Silver catalysts were prepared by the wet impregnation of silver nitrate solution on commercial 3-way catalyst. These catalysts were characterized with BET Surface area and pore size distribution. In general, the formaldehyde(HCHO) conversion of the tested catalysts was similar to that of methanol$(CH_3OH)$. At 100$^\circ$C, which is equivalent to the cold start condition, 5wt% Ag cat. showed the most excellent HCHO and $CH_3OH$ conversion. The order of activity for conversion of HCHO & $CH_3OH$ to carbon dioxide and water vapor was as follows ; 5wt% Ag/3-way cat.>2wt% Ag/3-way cat.>german cat. front(1) > german cat. rear(2) > 10wt% Ag/3-way cat.> commercial 3-wat catalyst. However there was no significant activity difference between those tested catalysts in the hot run condition of 400$^\circ$C. Therefore, it could be concluded that the Ag-modified 3-way catalyst was the most effective and practical catalyst system which could be capable of removal the HCHO and methanol at the special condition of low temperature such as cold start condition.

Underwater Radiated Noise Analysis for Commercial Ship Using Power Flow Analysis (파워흐름해석법을 이용한 상선의 수중방사소음해석)

  • Recently, the underwater radiated noises generated from large commercial ships have become a globally important issue. Countries with large ports and environmental protection organizations demand strict safety guidelines in relation to underwater radiated noise. In this paper, the coupled PFFE/PFBE method is used to investigate the vibration and underwater radiated noise of a commercial ship. PFFEM is employed to analyze the vibrational responses of the commercial ship, and PFBEM is applied to analyze the underwater radiation noise. The vibrational energy of the structure is treated as an acoustic intensity boundary condition of PFBEM to calculate the underwater radiation noise. Numerical simulations are presented for the commercial ship under various frequencies, and reliable results are obtained.

  • The United Nations Convention on the International Sale of Goods(CISG) leaves a number of aspects concerning commercial sales untouched. In particular, it is not concerned with the validity of the contract or of any of its provisions or of any usage. And UNIDROIT don't deal with all-round validity in International Commercial Contract. Especially, UNIDROIT includes declaration of intention department. The UNIDROIT contains the chapter 3 on the "validity" in terms of the defects of consent such as mistake, fraud, and threat as well as "gross disparity". Notwithstanding these provisions, the Principles did not deal with invalidity arising from the lack of capacity or authority, or immorality or illegality. On the other hand, there are arguments that the corresponding provisions of the Principles of International Commercial Contracts(UNIDROIT Principles; PICC). Therefore, Validity in International Commercial Contract is delegate by Each Country Law. So Trade practicer should know full well about Each Country Law Position. People(human, corporation, company) of position Trade practice classify each country civil law relation to validity of commercial contract. This paper is to examine the Validity of UNIDROIT Principles. Also this paper analyses comparison on each country position relation to capacity of right, capacity to act, illegality of contract, declaration of intention. In conclusion, This paper expect that people of trade practice makes use of analysis knowledge.
