A Comparative Legal Study on the Damages in the International Sale Laws (국제물품매매에서 손해배상청구권에 관한 비교법적 고찰)

  • This study compares the SGA and CISG to find out the difference of the criteria for calculating damages. and it intends to give some important points in trade practice. The damages is intended to compensate the victim for the breach of contract but there are differences between SGA and CISG as follow. First, the SGA and CISG have the same purpose of claiming damages. Both laws and regulations are subject to a full indemnification to compensate for the breach of the contract by the amount equivalent to the loss suffered by the victim. Second, in the general principle related to the calculation of damages, both law enforcement officials are required to be able to predict damages caused by breach of contract. In the case of SGA, however, a foreseeability test or remoteness of damages is required for the relationship between the contract violation and the loss. In other words, it can be said that the causal relation between the contract violation and the damage is strictly applied rather than the CISG. Finally, both laws and regulations of SGA and CISG have a big difference in criteria for calculating damages. In the CISG, after the contract is canceled, it is classified according to the existence of the alternative transaction and the damage amount is calculated based on the contract price. On the other hand, the SGA estimates the loss based on the market price at the delivery of the goods, reflecting the change in the market price instead of the contract price of the goods.

  • The correlations between Large Early Release Frequency (LERF) and Early Fatality need to be investigated for risk-informed application and regulation. In Regulatory Guide (RG) -1.174, while there are decision-making criteria using the measures of Core Damage Frequency (CDF) and LERF, there are no specific criteria on LERF. Since there are both huge uncertainties and large costs needed in off-site consequence calculation, a LERF assessment methodology needs to be developed, and its correlation factor needs to be identified, for risk-informed decision-making. A new method for estimating off-site consequence has been presented and performed for assessing health effects caused by radioisotopes released from severe accidents of nuclear power plants in this study. The MACCS2 code is used for validating the source term quantitatively regarding health effects, depending on the release characteristics of radioisotopes during severe accidents. This study developed a method for identifying correlations between LERF and Early Fatality and validates the results of the model using the MACCS2 code. The results of this study may contribute to defining LERF and finding a measure for risk-informed regulations and risk-informed decision-making.

  • Rating scales for environmental noise are varied in their calculation procedure. Among them WECPNL (weighted equivalent continuous perceived noise level) is the rating scale for aircraft noise currently being used in domestic and applied only for aircraft noise. However $L_{dn}$ calculated from $L_{eq}$ $L_{eq}$ is used as a rating scale for not only aircraft noise but also environmental noise. Besides, it is easy to calculate and internationally preferred. It is, therefore, not adequate for the evaluation of residents' exposure. Moreover it is very difficult to measure the aircraft noise by WECPNL due to the complicated calculating procedures if automatic measuring system is not used. Accordingly. this study aims to propose alternative evaluation procedure for the aircraft noise. To achieve this purpose, the data measured by automatic measuring system were gathered and calculated with three evaluation procedures : WECPNL $L_{eq}$ and $L_{dn}$, and the results calculated from different methods were compared and analyzed.

  • In evaluating explosion-protection capacity, safety distance is broadly accepted as the distance at which detonation of a given explosive causes acceptable structural damage. Safety distance can be calculated based on structural response under blast loading and damage criteria. For the applicability of the safety distance, the minimum required stand-off distance should be given when the explosive size is assumed. However, because of the nature of structures, structural details and material characteristics differ, which requires sensitivity analysis of the safety distance. This study examines the safety-distance sensitivity from structural and material property variations. For the safety-distance calculation, a blast analysis module based on the Kingery and Bulmash formula, a structural response module based on a Single Degree of Freedom model, and damage criteria based on a support rotation angle were prepared. Sensitivity analysis was conducted for the Reinforced Concrete one-way slab with different thicknesses, reinforcement ratios, reinforcement yield strengths, and concrete compressive strengths. It was shown that slab thickness has the most significant influence on both inertial force and flexure resistance, but the compressive strength of the concrete is not relevant.

Robustness Bounds of the Vertical Take-Off and Landing Aircraft System with Structured Uncertainties

  • The purpose of this paper is the application of the techniques for the new estimation of robustness for the aircraft systems having structured uncertainties. The basic ideas to analyze the system which is the originally nonlinear is Lyapunov direct theorems. The nonlinear systems have various forms of terms inside the system equations and this investigation is confined in the form of bounded uncertainties. The number of uncertainties will be the degree of freedoms in the calculation of the robust stability regions called the robustness bounds. This proposition adopts the theoretical analysis of the Lyapunov direct methods, that is, the sign properties of the Lyapunov function derivative integrated along finite intervals of time, in place of the original method of the sign properties of the time derivative of the Lyapunov function itself. This is the new sufficient criteria to relax the stability condition and is used to generate techniques for the robust design of control systems with structured perturbations. Using this relaxing stability conditions, in this paper, the quadratic form of Lyapunov function is utilized. In this paper, the practical system of vertical take-off and landing (VTOL) aircraft is analyzed with the proposed stability criteria based upon the Lyapunov direct method. The application of numerical procedures can prove the improvements in estimations of robustness with structured uncertainties. The applicable aircraft system is assumed to be linear with time-varying with nonlinear bounded perturbations.

A Study on the Revision of the National Fire Safety Codes of Sprinkler System (스프링클러설비 화재안전기준 개정에 대한 고찰)

  • This paper suggested to revise unreasonable national fire safety codes of sprinkler system. Also proposed to modify the definition of "the gridded sprinkler system" and to add "the feed main" in terms of the definition of the pipes. In order to operate the regulations of discharge pressure of the sprinkler head efficiently, this paper checked the minimum criteria of pressure and flow for the pipe schedule sprinkler system of NFPA 13 and suggested to establish the similar minimum demand criteria. It proposed to be amended properly the pressure calculation formular in the pressure tank system and to use the correct K value due to change in pressure unit and to use the [bar] as a unit of pressure for the sake of using the existing K-factor etc.

Analysis of High Burnup Fuel Behavior Under Rod Ejection Accident in the Westinghouse-Designed 950 MWe PWR

  • As there has arisen a concern that failure of the high burnup fuel under the reactivity-insertion accident(RIA) may occur at the energy lower than the expected, fuel behavior under the rod ejection accident in a typical Westinghouse-designed 950 MWe PWR was analyzed by using the three dimensional nodal transient neutronics code, PANBOX2 and the transient fuel rod performance analysis code, FRAP-T6. Fuel failure criteria versus the burnup was conservatively derived taking into account available test data and the possible fuel failure mechanisms. The high burnup and longer cycle length fuel loading scheme of a peak rod turnup of 68 MWD/kgU was selected for the analysis. Except three dimensional core neutronics calculation, the analysis used the same core conditions and assumptions as the conventional zero dimensional analysis. Results of three dimensional analysis showed that the peak fuel enthalpy during the rod ejection accident is less than one third of that calculated by the conventional zero dimensional analysis methodology and the fraction of fuel failure in the core is less than 4 %. Therefore, it can be said that the current design limit of less than 10 percent fuel failure and maintaining the core coolable geometry would be adequately satisfied under the rod ejection accident, even though the conservative fuel failure criteria derived from the test data are applied.

Comparison among diagnostic tools used for differential diagnosis of blood stasis pattern in Korea, China and Japan (한중일 어혈증 감별진단을 위한 도구의 비교)

  • Objectives The purpose of this study is to compare the representative differential diagnosis methods of blood stasis pattern used in Korea, China and Japan, and then to characterize each diagnostic method. Methods Through the journal databases, we have selected representative tools that were developed for differential diagnosis of blood stasis pattern in Korea, China and Japan. In order to characterize the selected check-lists or questionnaires, we investigated the number of items, contents, score calculation method, internal consistency, and accuracy of each selected tool. Results A total of four diagnostic tools were finally selected; quantitative diagnosis scale of blood stasis syndrome (QDSBSS), diagnostic criteria for blood stasis (DCBS), blood stasis questionnaire (BSQ), and blood stasis syndrome questionnaire (BSSQ). The key points in the differential diagnosis for blood stasis were different for each of the diagnostic tool. The key point was oral mucosa (including tongue) status in the QDSBSS. Meanwhile it was abdominal pain/resistance in the DCBS, and general pain in the BSQ. Accuracy of the QDSBSS, the BSQ and the BSSQ were powerful but all of them was not generalized. Conclusions Therefore, it is desirable to select and apply a plurality of appropriate tools according to the characteristics of the blood stasis patients.

  • Optimized capacity of equipments are essential for energy saving and low cost construction and operation. So we must use proper design data for HVAC system design. We investigated for architectural data, equipment capacity, cooling and heating load design criteria of 52 office buildings. Following research results were obtained by carrying out each task. Office building effective area rate is 63%. The average building cooling load of South Korea is $140W/m^2$ and average heating loads in Seoul and Pusan area are $120{\sim}130W/m^2$ and $70{\sim}80W/m^2$. We also analysised HVAC design criteria. Person ratio in effective building area is $0.2person/m^2$, sensitive and latent heat loads of a person are 60W and 65W, light and equipment loads of office buildings are $25W/m^2$ and $20W/m^2$.

  • This study is to develop a Priority Decision System for Redevelopment (PDSR) which is able to decide the priority for redevelopment of agricultural reservoirs. The major scopes of this research are to make the related GIS data like hydrologic unit map and other thematic maps to determine the suggested priority index (PI), and to develop the PDSR handling the GIS data and calculating weighing factors for the PI. In order to make the weighing factor decision module, the AHP technique was adopted. The result of the weighing factor calculation was showed PC (Possibility Criteria) and RC (Restriction Criteria) were 76% and 24% respectively. Which means that most of the specialist selected PC category prior to RC because of whom to mostly of major technique. So, in order to make more objective result, the selection of specialists is important like environmental activists or local residents and so on. The product from this research can provide more scientific support to decide the priority decision.
