Amiable Composition in International Arbitration

  • Amiable composition is a means of dispute resolution based on the arbitrator's authority to base his decision on equity. Although this method has been used frequently in the last decades of the 20th Century, the number of the published awards by amiable compositeur arbitrators is getting lower and lower. The reason(s) for unpopularity of amiable composition should be sought in its very nature, in its relationships with other institutions such as arbitration in law, equity, ex aequo et bono arbitration, other means of dispute resolution and in its role in the development of the rules specific to international commerce. A brief look at the history of law shows that the concept of equity comes to the scene every time that the rigidity of the rules of law challenges the justice. This has been the case in the 20th Century with respect to international commercial law which was deprived of specific rules. The role of amiable composition has been to contribute to the development of the rules specific to international commerce. The progressive codification of such rules in the last decades is also owed to amiable composition, which has accomplished its mission in the evolution of these rules.

Influence on properties of base metal after elimination of lifting-lug member in a dissimilar welding between steel base and steel lifting lug

  • The increasing demands of lifting lugs can be attributed to the rapid advancement of shipbuilding and offshore-structure production technologies and an exponential increase in the size of the block units of ship structures. Therefore, to ensure safety during the transportation and turnover of large blocks, it is important to determine the structural integrity and position of lifting lugs. However, because the manufacturing cost and availability of lugs are important considerations, low cost and easily obtainable steel compositions of grades different from those of the blocks are often used as alternatives. The purpose of this study is to investigate the effect of a lifting-lug metal on the physical properties of a base metal in a dissimilar welding between the base metal and lifting lug. The effect was evaluated by observing the metal microstructures and determining the hardness and dilution values on the cross-sectional surface of the lifting lug. According to the results of the metal microstructures, impact, hardness, and emission spectrochemical analysis at the surface from where the lug was removed confirmed that the chemical composition of the lifting-lug metal did not influence the physical properties of the base metal.

THE CHANCE IN TRANSVERSE STRENGTH OF DENTURE BASE AFTER RELINE PROCEDURE (개상한 의치상의 전단굴곡강도 변화)

  • The purpose of this study was to evaluate the effect of proportional thickness of various reline materials on the transverse strength of denture base. The denture base resin used in this study was Vertex $RS^{(R)}$ (Dentimex Zeist., Holland). The reline resins used were Tokuso $rebase^{(R)}$ normal set (Tokuyama Corp., Japan), $Rebaron^{(R)}$ (GC Corp., Japan), $Kooliner^{TM}$ (GC INC., U.S.A), New $truliner^{TM}$(Harry J. Bosworth Co., U.S.A). The bulk specimens with 2.5mm thickness of denture base were prepared as the control group. Group 1 was fabricated with 2.0mm thickness of denture base and 0.5mm reline material, group 2 with 1.5:1.0mm, group 3 with 1.0:1.5mm, group 4 with 0.5:2.0mm composition. Measurements of transverse strength were taken for each specimens The results were as follows: 1. Regardless of the reline resin type, the transverse strength of denture base was decreased after reline procedure. 2. The transverse strength according to the reline resin type was decreased in the following order : Rebaron, Tokuso rebase, Kooliner, and then New truliner and there was a significant difference among the reline materials (P<0.05). 3. The strength of the relined denture base generally decreased as the proportional thickness of the denture reline material increased. These results suggest that increasing the proportional thickness of the reline material progressively decreased the strength of the relined denture base. Thus, the denture base should not be unnecessarily altered during the reline procedure.

Effect of biofilm formation, and biocorrosion on denture base fractures

  • PURPOSE. The aim of this study was to investigate the destructive effects of biofilm formation and/or biocorrosive activity of 6 different oral microorganisms. MATERIALS AND METHODS. Three different heat polymerized acrylic resins (Ivocap Plus, Lucitone 550, QC 20) were used to prepare three different types of samples. Type "A" samples with "V" type notch was used to measure the fracture strength, "B" type to evaluate the surfaces with scanning electron microscopy and "C" type for quantitative biofilm assay. Development and calculation of biofilm covered surfaces on denture base materials were accomplished by SEM and quantitative biofilm assay. According to normality assumptions ANOVA or Kruskal-Wallis was selected for statistical analysis (${\alpha}$=0.05). RESULTS. Significant differences were obtained among the adhesion potential of 6 different microorganisms and there were significant differences among their adhesion onto 3 different denture base materials. Compared to the control groups after contamination with the microorganisms, the three point bending test values of denture base materials decreased significantly (P<.05); microorganisms diffused at least 52% of the denture base surface. The highest median quantitative biofilm value within all the denture base materials was obtained with P. aeruginosa on Lucitone 550. The type of denture base material did not alter the diffusion potential of the microorganisms significantly (P>.05). CONCLUSION. All the tested microorganisms had destructive effect over the structure and composition of the denture base materials.

A Study on the Impact Toughness and Microstructure change for High Nitrogen TiN Steel Alloy with Welding Heat Input. (용접 입열량에 따른 고질소 TiN 강재의 용접부 충격인성 및 미세조직 변화에 관한 연구)

  • This study was investigated on the impact toughness and microstructure of welded metal and heat affected zone for Hi Nitrogen TiN Steel. With welding procedures, welding heat input applied were 30, 79 and 264 kJ/cm. TiN steel has shown very small prior austenite grain size for all the welding heat input applied, which was considered to result from the effect of TiN particles. In case of single SAW and EGW welding, the dilution rate of base metal into the weld was not high, resulting that there were no significant effects of base metal chemical composition on the mechanical properties of welds. However, TSAW with double Ypreparation carried very high dilution rate so that TiN steel has impaired the toughness of weld metal because N content in the weld was increased through the dilution of base metal.

  • Clad steel has good corrosion resistance and mechanical properties arising from the hot rolling of dissimilar metals, such as carbon steel and stainless steel. However both good corrosion resistance from the cladding plate material(stainless steel) and mechanical properties from the base plate material (carbon steel) are difficult to obtain because the different steels display opposite behaviors during the cladding process. In order to make clad steel for application in the hulls of ships, proper materials selection and heat-treatment conditions are necessary. In this study, mechanical properties of base plate materials with different chemical composition were evaluated according to heat condition of cladding plate material.

  • The metallurgical study of microconstituents in transient liquid phase bonded joints of Ni-base single crystal superalloys, CMSX-2 and CMSX-4 was investigated employing MBF-80 insert metal. TLP bonding of specimens was carried out at 1,373~1,523K for 0~19.6ks in vacuum. Three types of microconstituents ; needle-like constituent, dot-like constituent and abnormal shape constituent were formed in the bonded interlayer during TLP bonding operation. All these microconstituents were identified as boride. Microconstituents contain a large percentage of Cr in the early stage of bonding. As increasing the holding time, the amount of Cr was decreased and the amount of W, Co and Re were increased. From the analysis results of electron diffraction pattern by TEM, composition of elements in microconstituents were into MBlongrightarrowM$_{5}$B$_3$longrightarrowM$_2$B type with the increased in holding time. It can be explained by the fact that the relative amount of boron in microconstituents was decreased when the holding time was increased.d.

Transient-Liquid-Phase Bonding of Fe-Base MA956 ODS Alloy (Fe기 MA956 산화물분산강화합금의 천이액상확산접합에 관한 연구)

  • TLP(Transient-Liquid-Phase) bonding of Fe-base MA956 ODS alloy was performed. As insert metal a commercially available Ni-base alloy(MBF50) and an MA956 alloy with additive elements of 7wt% Si and 1wt% B were used. To confirm the idea that a concurrent use of MA956 powder with Insert metals can enhance the homogenization of constituent elements and thereby reduce the thickness of joint interface, MA956 powder was also inserted In a form of sheet. SEM observation and EDS analysis revealed that Cr-rich phase was formed in the bonded interface in initial stage of isothermal solidification during the bonding process, irrespective of kind of insert metals. Measurement of hardeness in the region of bonded interface and EDS analysis showed that a complete homogenization of composition could not be obtained especially in case of MBF50. Joints using either BSi insert metals only or BSi insert together with MA956 powder interlayer showed, however, a remarkable improvement in a compositional homogenization, even though a rapid grain growth in the bonded interface could not be hindered.

A Study on the Interpretation of Spatial Composition and Location of Traditional Village from the Water of Feng-Shui Theory - in the case of villages of Hawei and Yangdong - (물(水)의 풍수론적 시각에서 본 전통마을의 입지와 공간구성의 해석에 관한 연구 - 하회.양동마을을 중심으로 -)

  • This study, from conditions connected with water in Feng-Shui theory, is to find out their influence of the location and spatial composition of the studied villages, Hawei and Yangdong, and then to offer the result as basic data for the study of the traditional village in the future. The study method is to analyze topography by the map and present state of villages studied, to interprete them on the base of location, spatial composition, and chi, and then to analyze the relevancy of Feng-Shui theory of them. The result of the study are to be following: Houses of Hawei village are situated on the inside of a winding stream of waterway, while those of Yang dong village are located on the outside of a winding stream of waterway. In case of Hawei village, showed the close interrelation between the distribution of present houses and running speed of waterway by positin. Judging from the location, orientation and surroundings of mountains and waterway, topographical composition of Hawei village is Duk su guk, but that of Yang dong village is Juang feng guk. Comparing with Yang dong and Hawei in location and spatial composition, the conditions of waterway as being locational factor, for example, the geomancy of situation, orientation, and phisical phenomena(lenth, width, and depth of waterway in front of village) of waterway, are more importantly considered in Hawei village being situated on even land than in Yang dong located at the foot of the mountain.
