신와르소체제하의 국제항공화물운송인의 손해배상책임 (The Liability of Air Carrier in Relation to the International Carriage of Cargo by Air under New Warsaw System)

  • This paper intends to describe the liability regime of the air carrier under the Montreal Convention of 1999 for the international cargo, comparing to those of the existing Warsaw Convention system. Also this paper deals with main issues of the Montreal Convention which are relevant for the carrier's liability in the carriage by air of cargo. The Warsaw Convention was adopted in 1929 and modified successively in 1955, 1961, 1971, 1975, and 1999. The Montreal Convention of 1999 modernized and consolidated the Warsaw Convention and related instruments. International air carrier is liable by application of principle of strict liability as stated in the Montreal Convention : The carrier is liable for the destruction or loss of, or damage to cargo and delay during the carriage by air, and the carrier's liability is limited to a sum of 17 Special Drawing Rights per kilogramme. However, the Montreal Convention has main outstanding issues with respect to the liability of the air carrier : potential conflicts between the Montreal Convention and the Warsaw Convention, the amounts of limits of the carrier's liability, the duration of the carrier's liability, the exessive litigation, and the aviation insurance. Therefore, the conditions and limits of the carrier's liability under the Montreal Convention should be readjusted and regulated in detail.

국제항공화물의 운송 지연에 대한 항공운송인의 책임 (The Air Carrier연s Liability for Damage Caused by Delay in the Transport of International Air Cargo)

  • Delay in the air transport occurs when passengers, baggage or cargo do not arrive at their destination at the time indicated in the contract of carriage. The causes of delay in the carriage of cargo are no reservation, lack of space, failure to load the cargo on board, loading the cargo on the wrong plane, failure to off-load the cargo at the right place, or to deliver the covering documents at the right place. The Montreal Convention of 1999 Article 19 provides that "The carrier is liable for damage occasioned by delay in the carriage by air of cargo. Nevertheless, the carrier shall not be liable for damage occasioned by delay if it proves that it and its servants and agents took all measures that could reasonably be required to avoid the damage or that it was impossible for it or them to take such measures." The Montreal Convention Article 22 provides liability limits of the carrier in case of delay for cargo. In the carriage of cargo, the liability of the carrier is limited to 17 SDR per kilogram unless a special declaration as to the value of the cargo has been made. The Montreal Convention Article 19 has shortcomings: it is silent on the duration of the liability for carriage. It does not give any indication concerning the circumstances to be taken into account in cases of delay, and about the length of delay. In conclusion, it is desirable to define the period of carriage with accuracy, and to insert the word 'unreasonable' in Article 19.

  • The purpose of this study is to investigate liability risk of air cargo carrier and suggests ideas for solving problems which could be happen to air transporters on the future. because of Air transport remains one of the world's fastest growing and most important industries. And important treaties and contracts specifying transporters' responsibility regarding big scale aircraft accidents are such as Warsaw Convention in 1929, Hague Protocol in 1955, Montreal Convention in 1999. The Montreal Convention, formally the Convention for the Unification of Certain Rules for International Carriage, is a treaty adopted by Diplomatic meeting of ICAO member states in 1999. It amended important provisions of the Warsaw Convention's concerning compensation for the victims of air disasters. In conclusion, suggests to the method of air cargo security and cargo legal liability insurance which is for air cargo carrier's risk management.

  • The juice carrier is the first ship built in korea. Special refrigerator system and cargo hold insulation with stainless steel tank were equipped on cargo hold. We studied optimum design of cargo hold insulation for reducing of ship building schedule and cost including good quality with refrigerating efficiency. From this study, general and newly specified juice carrier, technical method of cargo hold insulation system, air flow with division air wall, K-value calculation have been investigated.

몬트리올 협약상 국제항공화물운송에 관한 연구 - 항공화물운송장과 항공운송인의 책임을 중심으로 - (A Study on the International Carriage of Cargo by Air under the Montreal Convention-With respect to the Air Waybill and the Liability of Air Carrier)

  • The purpose of this paper is to research the air waybill and the carrier's liability in respect of the carriage of cargo by air under the Montreal Convention of 1999. The Warsaw Convention for the unification of certain rules for international carriage by air was adopted in 1929 and modified successively in 1955, 1961, 1971, 1975 and 1999. The Montreal Convention of 1999 modernized and consolidated the Warsaw Convention and related instruments. Under the Montreal Convention, in respect of the carriage of cargo, the air waybill shall be made out by the consignor. If, at the request of the consignor, the carrier makes it out, the carrier shall be deemed to have done so on behalf of the consignor. The air waybill shall be made out in three orignal parts. Under the Montreal Convention, the consignor shall indemnify the carrier against all damages suffered by the carrier or any other person to whom the carrier is liable, by reason of the irregularity, incorrectness or incompleteness of the particulars and statement furnished by the consignor or on its behalf. The air waybill is not a document of title or negotiable instrument. Under the Montreal Convention, the air waybill is prima facie evidence of the conclusion of the contract, of the acceptance of the cargo and of the conditions of carriage. If the carrier carries out the instructions of the consignor for the disposition of the cargo without requiring the production of the part of the air waybill, the carrier will be liable, for any damage which may be accused thereby to any person who is lawfully in possession of the part of the air waybill. Under the Montreal Convention, the carrier is liable by application of principle of strict liability for the damage sustained during the carriage of cargo by air. The carrier is liable for the destruction or loss of, or damage to cargo and delay during the carriage by air. The period of the carriage by air does not extend to any carriage by land, by sea or by inland waterway performed outside an airport. Under the Montreal Convention, the carrier's liability is limited to a sum of 17 Special Drawing Rights per kilogramme. Any provision tending to relieve the carrier of liability or to fix a lower limit than that which is laid down in this Convention shall be and void. Under the Montreal Convention, if the carrier proves that the damage was caused by the negligence or other wrongful act or omission of the person claiming compensation, or the person from whom he derives his rights, the carrier shall be wholly or partly exonerated from ist liability to the claimant to the extent that such negligence or wrongful act or omission caused the damage. Under the Montreal Convention, any action for damages, however founded, whether under this Convention or in contract or in tort or otherwise, can only be brought subject to the conditions and such limits of liability as are set out in this Convention. Under the Montreal Convention, in the case of damage the person entitled to delivery must complain to the carrier forthwith after the discovery of the damage, and at the latest, within fourteen days from the date of receipt of cargo. In the case of delay, the complaint must be made at the latest within twenty-one days from the date on which the cargo has been placed at his disposal. if no complaint is made within the times aforesaid, no action shall lie against the carrier, save in the case of fraud on its part. Under the Montreal Convention, the right to damage shall be extinguished if an action is not brought within a period of two years, reckoned from the date of arrival at the destination, or from the date on which the aircraft ought to have arrived, or from the date on which the carriage stopped. In conclusion, the Montreal Convention has main outstanding issues with respect to the carrier's liability in respect of the carriage of cargo by air as follows : The amounts of limits of the carrier's liability, the duration of the carrier's liability, and the aviation liability insurance. Therefore, the conditions and limits of the carrier's liability under the Montreal Convention should be readjusted and regulated in detail.

항공화물운송에 관한 상법 항공운송편 제정안의 내용 및 쟁점 (Contents and Issues of the Draft Legislation of Part VI the Carriage by Air of Korean Commercial Code in Respect of the Carriage of Cargo by Air)

  • The purpose of this paper is to describe the contents and issues of the draft legislation of Part VI the Carriage by Air of Korean Commercial Code in respect of the domestic carriage of cargo by air, comparing to the related provisions of the Montreal Convention of 1999 for the unification of certain rules for international carriage by air and the related provisions of Korean Commercial Code in respect of the carriage by land and sea. The Montreal Convention in respect of the international carriage by air was adopted in 1999, and Korea has ratified the Montreal Convention in 2007. However, there is now no national legislation in respect of the carriage by air in Korea. Thus, the Ministry of Justice has prepared the draft legislation of Part VI the Carriage by Air of the Korean Commercial Code in July 2008, and the draft legislation is now being reviewed by the National Assembly. The draft provisions of Part VI the Carriage by Air are basically adopting most of the related provisions of the Montreal Convention in respect of the carriage of cargo by air and some draft provisions are applying the related provisions of the Korean Commercial Code in respect of the carriage of cargo by land and sea. In respect of the carriage of cargo by air, the contents of the draft legislation of Part VI the Carriage by Air are composed of the provisions in respect of the liability of the carrier, the rights of the consignor and consignee, the transport document and others. In respect of the carriage of cargo by air, the issues on the draft legislation of Part VI the Carriage by Air are the problems with respect to the extinguishment of the liability of the carrier, the application for the non-contractual claim, the liability limit of the servants or agents of the carrier, the right of disposition of cargo, the effect of breach of the provision in respect of the air transport document, the prescription of claim of the carrier, the immunity reasons from liability of the carrier for the loss or damage of the cargo, the making out of the air waybill, and the effect of the statement of the air transport document. In conclusion, the national legislation of Part VI the Carriage by Air of the Korean Commercial Code will protect the right and interest of the consignor and consignee, and clarify the right and duty of the parties to the air transport. Also it will contribute to the development of the air transport industry in Korea.

국제항공화물운송에 있어서 운송인의 화물인도 의무와 책임 (The Duty and Liability of the Carrier in Relation to Cargo Delivery in the International Air Transport of Cargo)

  • 본고에서는 국제항공화물운송에 있어서 운송인의 화물의 인도의무와 불법인도에 대한 책임에 관하여 몬트리올 협약, lATA 화물운송약관 및 법원판례를 중심으로 고찰하고자 한다. 몬트리올 협약 제13조에 의하면, 수하인은 화물이 도착지에 도착하였을 때에 운송인에 대하여 채무액을 지급하고 운송의 조건에 따랐을 경우에는 자기에게 화물의 인도를 요구할 수 있는 권리를 가지게 된다. 한편 운송인은 별도의 약정이 없는 한 화물이 도착하자마자 수하인에게 통지를 하여줄 의무가 있다. 몬트리올 협약 제18조에 의하면, 운송인은 화물의 파괴, 분실 또는 훼손으로 인하여 입은 손실에 대하여 그 손해의 원인이 되었던 사실이 항공운송 중에 발생되었다는 것을 유일한 조건으로 하여 책임을 부담하게 된다. 여기서 항공운송이라 함은 그 화물이 운송인의 보관하에 있는 기간을 포함한다. lATA 화물운송약관 제11조에 의하면, 운송인은 화물의 운송 중에 파괴, 멸실, 손상 또는 지연의 경우 입은 손해에 대하여 오직 그렇게 입은 손해의 원인된 사고가 제1조에 정의된 운송 중에 발생한 경우에만 송하인, 수하인 또는 기타인에게 책임을 진다. 여기서 운송이라함은 무상이든 또는 보수를 위한 것이든 간에 항공 또는 기타 운송수단에 의한 화물의 운송을 의미한다. 우리 대법원 판례(2004. 7. 22 선고)에 의하면, 운송인으로서 운송주선인은 보세창고에 입고된 화물이 실수입자에게 불법 인도된 경우에 보세창고를 지정한 자는 운송주선인 이나 그의 운송대리점이 아니라 실수입자이며, 운송주선인은 보세창고업자에 대하여 사용자로서의 지위에 있다고 볼 수 없으므로 보세창고업자의 화물의 무단반출에 대하여 손해배상책임을 지지 아니한다고 판시하였다. 결론적으로 운송인 또는 운송주선인이 항공화물의 불법인도로 인한 손해배상책임을 부담하지 않기 위하여는 항상 회물의 동향이나 상태에 대하여 주의를 기울여 화물이 불법인도 되지 않도록 선량한 관리자로서의 주의를 다하여야 할 것이다. 한편 우리 정부는 이미 발효된 몬트리올 협약에 가입하여 국제항공화물운송인의 권리, 의무 및 책임에 관하여 몬트리올 협약이 적용되도록 하여야 할 것이다.

국제항공화물운송에 관한 운송증서의 요건 및 효력 (The Requirement and Effect of the Document of Carriage in Respect of the International Carriage of Cargo by Air)

  • 본 연구의 목적은 몬트리올협약 및 IATA 항공화물운송약관상의 관련규정과 국내 및 외국의 법원판례를 중심으로 국제항공화물운송에 관한 운송증서인 항공화물운송장과 화물수령증의 작성 교부 요건 효력에 관하여 고찰하는데 있다. 몬트리올협약 제4조에 의하면, 항공화물의 운송에 관하여 항공화물운송장을 교부하여야 한다. 한편 이행될 운송에 관한 기록을 보존하는 다른 수단으로 항공화물운송장의 교부를 대체할 수 있으며, 이러한 다른 수단이 사용되는 경우, 운송인은 송하인의 요청에 따라 송하인에게 적송품을 증명하는 화물수령증을 교부하여야 한다. 몬트리올협약 제7조에 의하면, 항공화물운송장은 송하인에 의하여 원본 3통이 작성된다. 제1원본에는 "운송인용"이라고 기재하고 송하인이 서명한다. 제2원본에는 "수하인용"이라고 기재하고 송하인 및 운송인이 서명한다. 제3원본에는 운송인이 서명하고 화물을 인수받은 후 송하인에게 그것을 인도한다. 만약 송하인의 청구에 따라 운송인이 항공화물운송장을 작성하였을 경우, 반증이 없는 한 운송인은 송하인을 대신하여 그렇게 한 것으로 간주한다. 몬트리올협약 제5조에 의하면, 항공화물운송장 또는 화물수령증에는 (1) 출발지 및 도착지의 표시, (2) 출발지 및 도착지가 단일 당사국 영역내에 있거나 약정기항지가 다른 국가의 영역내에 있을 경우 최소한 한곳의 기항지의 표시, (3) 적송품의 중량의 표시 등을 기재하여야 한다. 몬트리올협약 제10조에 의하면, 송하인은 본인 또는 그의 대리인이 제공한 기재사항의 불비, 부정확 또는 불완전으로 인하여 운송인 또는 운송인이 책임을 부담하는 타인이 입은 모든 손해에 대하여 운송인에게 보상한다. 몬트리올협약 제9조에 의하면, 동 협약 제4조 내지 제8조의 운송증서에 관한 요건을 준수하지 아니하는 경우 운송계약의 존재 또는 효력에 영향을 미치지 아니하며, 책임제한에 관한 규정을 포함한 이 협약의 규정들이 적용된다. 항공화물운송장은 유가증권이나 유통증권이 아니다. 몬트리올협약 제11조에 의하면, 항공화물운송장 또는 화물수령증은 계약의 체결, 화물의 인수 및 운송의 조건에 관한 추정적 증거가 된다. 몬트리올협약 제12조에 의하면, 운송인은 항공화물운송장 또는 화물수령증의 제시를 요구하지 아니하고 화물의 처분에 관한 송하인의 지시를 따른 경우, 이로 인하여 항공화물운송장 또는 화물수령증의 정당한 소지인에게 발생된 손해에 대하여 책임을 진다. 우리 대법원 판례에 의하면, 운송인으로서 운송주선인은 보세창고업자가 항공화물 운송장상의 통지처(실수입자)에게 화물을 불법인도한데 대해 책임을 지지 아니하는바, 그 이유는 운송주선인이 보세창고를 지정하지 아니하였으며, 보세창고업자에 대한 고용자의 입장에 있지 않았기 때문이다. 결론적으로, 우리나라 관세청은 항공화물서류의 전자화 사업인 e-Freight를 오는 2012년완결을 목표로 적극 추진해 나갈 계획이다 따라서 향후 항공화물운송에서 전자 운송서류의 사용이 활발해 질 것이므로 운송인 및 운송주선인은 전자 운송서류의 작성요건 및 법적 효력에 세심한 관심을 가져야 할 것이다.

항공화물운송인의 책임에 관한 국제협약과 국내입법의 비교연구 (A Comparative Study between International Convention and National Legislation in Respect of the Liability of the Carrier in the Carriage of Cargo by Air)

  • 우리나라는 항공운송에 관한 사법적 법률관계를 규율하는 법률이 제정되어 있지 아니하므로 항공화물운송을 둘러싼 분쟁을 오로지 항공사의 항공운송약관에 의해 해결을 시도하여 왔다. 그러나 국내항공운송에서 화주의 권익을 보호하고 운송계약당사자의 권리의무를 명확히 하기 위해 항공운송에 관한 법률을 제정할 필요가 있는 것이다. 국제항공운송에 있어서는 1999년에 채택된 몬트리올 협약을 우리나라가 가입하여 2007년 12월 29일 발효되어 있으므로 국제항공운송에 관련된 분쟁에는 몬트리올 협약이 적용된다. 법무부는 2008년에 상법 제6편 항공운송편 제정안을 마련하여 공청회를 거쳐 2008년 12월 31일 국회 제출되어 현재 심의 중에 있다. 상법 항공운송편 제정안은 기본적으로 몬트리올 협약을 근간으로 하고 있으며, 상법의 육상운송 및 해상운송의 제 규정과 위배됨이 없도록 제정목표를 두어 총 3개장 45개 조문 및 부칙으로 구성되어 있다. 상법 항공운송편 제정안가운데 특히 항공화물운송인의 책임에 관한 규정으로 운송인의 책임원인, 비계약적 청구에 적용, 운송인의 책임한도, 운송인의 책임감면, 운송인의 책임소멸, 운송물의 멸실 훼손 등의 통지, 운송인의 사용인.대리인의 책임, 실제 운송인의 책임, 순차운송인의 책임 등에 관한 규정이 있다. 이와 같은 항공화물운송인의 책임에 관한 규정가운데 쟁점사항으로는, 항공운송편 제정안 제913조제1항 단서의 운송인의 면책사유로 몬트리올 협약 제18조제2항에 규정되어 있지 아니한 폭동, 내란, 검역 등이 추가되어 있다는 점, 상법 제121조 및 제147조는 육상운송 및 육상운송주선의 경우 운송인의 책임에 관하여 악의의 경우를 제외하고 1년의 단기 제척기간을 규정하고 있는 반면에 항공운송편 제정안 제902조는 항공운송인의 악의가 있든 없든 2년의 제척기간을 규정하고 있는 점, 항공운송편 제정안 제899조 제3항은 화물운송의 경우 항공운송인의 사용인이나 대리인에게 고의 또는 인식있는 무모한 작위 또는 부작위가 있는 경우에도 사용인이나 대리인인 운송인이 주장할 수 있는 항변과 책임제한을 원용할 수 있다는 점들을 들수 있다. 결론적으로, 상법 항공운송편 제정안에는 당사자 간의 분쟁해결 및 운송인의 책임분산에 관한 규정이 있지 아니한 바 몬트리올 협약 제34조의 중재 및 제50조의 보험에 관한 규정을 수용하여 포함시키는 것이 바람직할 것이다. 또한 상법 항공운송편 제정안이 조속히 국회에서 통과되어 시행될 경우 운송인 등과 화주 간에 화물의 멸실, 훼손 또는 연착으로 인한 손해배상책임에 관한 분쟁을 원활하고 공평하게 해결하는데 기여할 것이다.

국제항공화물운송계약(國際航空貨物運送契約)의 법률관계(法律關係) -화주(貨主)의 권리의무(權利義務)를 중심(中心)으로- (Legal Relations of the Contract of International Carriage of Goods by Air)

  • The purpose of this study is to review the rights and duties of cargo owners, the party to the contract of international carriage of goods by air under the Warsaw Convention System and the IATA conditions. It is generally known that air freight is the most-cost mode of transportation. However, should there be considerations of total distribution cost, the use of air freight leads exporters to be advantageous in physical distribution. The Warsaw Convention System defined and limited the rights and duties of cargo owners and air carriers paticipating in the international carriage of goods, but it does not regulate every aspect of air transportation. Therefore, the unregulated parts are governed by national laws and by individual contracts of carriage. The International Air Transport Association(lATA), a worldwide organization of airlines, has formulated model conditions of contract for the carriage of cargo. These models are not uniformly followed but they serve as a basis for many of the individual standard form of contracts prepared by air carriers. The contract of air carriage of goods is a contract of adhesion, 'the consignor recognizing and accepting the conditions laid down by the carrier'. There are consignors and carriers as the parties to the contract of international carriage of goods. In addition to his basic right, implied in Warsaw Convention Article 18 and 19, to require devery of the goods in good condition and at the date agreed upon, the consignor has the right to dispose the goods in the course of the journey up to the moment when the consignee is entitled to require delivery. If it is impossible to carry out the orders of the consignor, the carrier must so inform him forthwith. The right conferred on the consignor ceases at the moment when that of the consignee begins in accordance with Warsaw Convention Article 13. Nevertheless, if the consignee declines to accept the air waybill or the goods, or if he cannot be communicated with, the consignor resumes his right of disposition. Unless it is otherwise agreed, it is the duty of the carrier to give notice to the consignee as soon as the goods arrive. The consignee is entitled, on arrival of the goods at the place of destination, to require the carrier to hand over to him the air waybill and to deliver the goods to him, on payment of the charges due and on complying with the conditions of carriage set out in the air waybill. The air waybill is supposed to be made out by the consignor. If the carrier makes it out, he is deemed, subject to proof to the contrary, to have done so on behalf of the consignor, whether there is one air waybill or several, each must be made out in three original parts. The first is for the carrier, the second is for the consignee, and the the third is handed to the consignor when the shipment has been accepted. The consignor is responsible for the correctness of the particulars and statement concerning the cargo appearing in the air waybill. Each of the original parts of the air waybill has evidential value and possession of his part is a condition for the exercise by the consignor or consignee of his rights under the contract of carriage. Hague Protocol set forth in Article 9 that nothing in this. Convention prevents the issue of a negotiable air waybill, but Montreal Additional Protocol No. 4 deleted this article. All charges applicable to a shipment are payable in cash at the time of acceptance thereof by the carrier in case of a prepaid shipment or at the time of delivery thereof by the carrier in case of a collect shipment. The carrier shall have lien the cargo for unpaid charges and, in the event of non-payment thereof, shall have the right to dispose of the cargo at public or private sale and pay itself out of the proceeds of such sale any and all such amounts. In conclusion, the Warsaw Convention System has the character of ambiguity in various respects, not only in the part of the forms of documents but also in conditions of contract. Accordingly, the following propositions might be considered: (1) If the carrier does not obey the orders of the consignor for the disposition of the goods without proper reasons, he will be liable strictly for any damage which may be caused thereby to the cargo owner. The special agreement and carrier's conditions of carriage which limit unreasonably the consignor's right of disposition of the goods will be nullified. (2) The instrument of the Warsaw Convention System which is not yet in force(Montreal Additional Protocol No. 4) would considerably simplfy the processing and keeping of computerized records of the carriage. Until this instrument enters into force, the airlines will be faced with practical problems preventing them to substitute computerized data processing techniques for the formal issuance of the documents. Accordingly, Montreal Additional Protocol No. 4 should become effective as soon as posisble. From a practical point of view in the international trade, the issuance of negotiable air waybill should be permitted for the security of the bank.
