A Study on the German Archival Management Law and System through the Analysis of the 「Federal Archives Act」 (독일 「연방기록물관리법」 분석을 통한 독일 기록관리법제 연구)

  • This year marks the 20th anniversary of the enactment of legislation related to records in Korea. The Public Records Management Act of Korea deals with the entire process from production to classification, transfer, and utilization for all records. Recently, the National Archives of Korea is in the process of discussing amending laws to implement records management innovations. It is necessary to take a look at the cases of advanced countries abroad, which have a long tradition of Archival management and focus on preservation records. In this study, Germany's "Federal Archives Act" was targeted. Germany is regarded as a country with a long tradition of managing preservation records. Especially, we have something in common that has experienced the history of division like our country. For the research results, each clause of Germany's "Federal Archives Act" was to be analyzed to understand Germany's Archival Management System. As a country that has experienced the division of Germany and unification, it maintains Archival management after unification. Therefore, we drew on the characteristics of Germany's Archival management law and system and studied what implications could be given to our country.

Study on Public Institution Dataset Identification and Evaluation Process : Focusing on the Case of KR Electronic Procurement System (공공기관 데이터세트 식별과 평가 절차 연구 국가철도공단 전자조달시스템 사례를 중심으로)

  • After the revision of the Enforcement Decree of the Public Records Act, the archives created a management standard table for data set records management and performed management and control. Therefore, in this study, the data set record identification procedure and evaluation index were developed for systematic data set record management of archives. By applying this, a management standard table was prepared after identifying the records of 8 datasets in kr's electronic procurement system, and the evaluation was carried out according to the evaluation index, and the retention period, transfer, and collection were determined. It is hoped that this case study will be of practical use to the archives at a time when concrete examples of procedures for the management of dataset records are lacking.

  • The advent of e-government following the information revolution has affected public records systems. Records management should now be changed into an environment for establishing a national records management system based on the Internet of things (IoT), cloud, big data, and mobile (ICBM), and it is time to make a fresh start toward a next-generation records management system that responds to changes in the environment. Ultimately, it is time for a records management system that ensures a proper way of dealing with new environmental changes. It has been nearly 20 years since the Public Records Management Act was enacted in 1999, and its complete amendment was made in 2006 so that electronic records could be efficiently managed. When recompliance management needs to be rechecked, a full redesign is required to enable the current legal system to respond to the new circumstances in the present day. Therefore, this study is intended to suggest ways to improve the new records management legal system as the environment changes over the next generation and lay the legal groundwork for innovation in the national records management system.

A Study on the Necessity of a Series of Charges in Information Disclosure for Work Improvement: Comparing the Cases of the United States (정보공개 전담 직렬의 필요성과 업무 개선방안에 관한 연구 - 미국의 사례를 중심으로 -)

  • The objective of this research is to search for measures to properly respond to the greatly increasing demands of complex information disclosure. At present, South Korea makes the deployment of records managers at public institutions mandatory through the Records Act. Records disclosure goes beyond simply deciding on the revelation and private usage of records, and requires the professionalism of institutions such as task knowledge and law-related knowledge. However, most records managers lack professionalism in the task of records disclosure despite achieving such in their regular work of managing records. As a countermeasure for such issues, this research is proposing the introduction of a series of exclusive charges in records disclosure named the Government Information Specialist, which professionally manages the records disclosure of the US government. In addition, to understand the demand of such, surveys and interviews of records managers who undertake both records management and records disclosure tasks at a South Korean public institution was also conducted.

Current Status and Improvement Plan for Personnel Verification Records Management (인사검증기록물관리 현황 및 개선방안 연구)

  • In the Republic of Korea, which has adopted a strong president-centered system as a political system, comprehensive personnel verification of work ability, reputation, and misconduct for positions where the president has personnel rights is not only fundamental to the administration of the country, but is also very important for maintaining the democratic system. As the records containing the personnel verification process produced during this process also has a wide range of data on important people in the country, they themselves are very important national-level information, and there is a great possibility that they will be used as useful materials for studying current national management in future generations. Therefore, it is assumed that after the enactment of the "Act on the Management of Presidential Records" in 2007, Senior Secretary for Civil Affairs of the Office of the President, which were responsible for the personnel verification, designated a wide range of personnel verification records as presidential designated records and transferred them to the Presidential Archives. However, with the launch of the 20th government, the agency responsible for personnel verification changed from Senior Secretary for Civil Affairs of the Office of the President to the "Personnel Information Management Team" of the Ministry of Justice from June 2022, a major change occurred in the personnel verification process that had been maintained and the preservation of related records. This paper examined what personnel verification records are and how they have been preserved and managed, and proposed what issues have arisen at the record management level due to this change in the agency in charge of personnel verification, and how those issues should be resolved on a practical and institutional level.

  • Since the legislation of the act for public records, there has been a remarkable growth in records management in Korea. Recently, how to efficiently handle digital records has become an urgent issue in Korea. However, the appraisal process for (selection) archives seems inappropriate. This study reviewed the problems of each archiving process for records created by police departments and prosecutors' offices. Based on the results of the review, I proposed an improvement plan for the selective and appraisal acquisition of records.

Redesign of the Records Management Process at the Production Stage for Long-Term Electronic Records Preservation: A Focus on Cloud On-Nara System (전자기록의 장기보존을 위한 생산단계의 기록관리 프로세스 재설계: 클라우드 온-나라 시스템을 중심으로)

  • Deficiencies are present in records management during the production stage of long-term electronic records preservation. As such, this study seeks to address these issues by introducing Cloud On-Nara System (On-Nara Document 2.0) at records management sites and providing various systems and linked services. In particular, the factors that degrade the continuity of long-term preservation in the records management process, from the production to the utilization of electronic records, in On-Nara Document 2.0 were identified, and the causes were analyzed in compliance with ISO 15486-1:2016 and the Public Records Act. As a result, in redesigning the records management procedure, the organization of the records management hub between systems and the conversion of the document preservation format for long-term preservation were proposed. Moreover, the application of consistent production format selection criteria and the reinforcement of the production and management of granular metadata were recorded. These measures were proposed in an effort to reestablish management methods.

A Study on Systematizing Production and Access of the Public Institution's Conference Records -Focused on The Government in the Sunshine Act in USA - (공공기관의 회의록 생산·공개 제도화 연구 -미국의 회의공개법에 대한 분석을 중심으로-)

  • Although a few years have passed since the importance of the public record management became the subject, the management of the minutes which is produced from the deliberation and decision-making process of an important policy relatively was been neglected the while. When institutionally inspecting at present, the minutes production is based upon Record Management Law, and the minutes opening is based upon Freedom of Information Act. Although the minutes must be made out according to Record Management Law, it is not well operated. So, the minutes formally is made out and there was actually the important minutes excepted from the management object. Opening of the minutes made by Article 9 of Freedom of Information Act has the problem that be used as a basis of dividing unfairly into closed opening because the reason of the closed opening is vague. This study analyzes the problem of production and opening of the current minutes. It also considers Sunshine Act in USA and suggests a institutional ways for production and opening of Korean minutes. We can think of two institutional ways for production and opening of the minutes. One is making a separate law like Sunshine Act in USA. The other is revising the existing laws. In reality it's very difficult to make a new law for minute production and opening. Therefore, the purpose of this study is to suggest the way for revising Record Management Law and Freedom of Information Act that include minutes related regulations. The record must be fundamentally produced and opened for a nation and people as public records is the records of the nation and people as well as an authority which produced those records. If the minutes is produced and opened from a institutional change through the revision of Record Management Law and Freedom of Information Act, the minutes can not only help the responsible administration to realize but be utilized to important historical records as a basis data of an important policy decision-making.

Analysis of Reform Model to Records Management System in Public Institution -from Reform to Records Management System in 2006- (행정기관의 기록관리시스템 개선모델 분석 -2006년 기록관리시스템 혁신을 중심으로-)

  • Externally, business environment in public institution has being changed as government business reference model(BRM) appeared and business management systems for transparency of a policy decision process are introduced. After Records Automation System started its operation, dissatisfaction grows because of inadequacy in system function and the problems about authenticity of electronic records. With these backgrounds, National Archives and Records Service had carried out 'Information Strategy Planning for Reform to Records Management System' for 5 months from September, 2005. As result, this project reengineers current records management processes and presents the world-class system model. After Records and Archives Management Act was made, the records management in public institution has propelled the concept that paper records are handled by means of the electric data management. In this reformed model, however, we concentrates on the electric records, which have gradually replaced the paper records and investigate on the management methodology considering attributes of electric records. According to this new paradigm, the electric records management raises a new issue in the records management territory. As the major contents of the models connecting with electric records management were analyzed and their significance and bounds were closely reviewed, the aim of this paper is the understanding of the future bearings of the management system. Before the analysis of the reformed models, issues in new business environments and their records management were reviewed. The government's BRM and Business management system prepared the general basis that can manage government's whole results on the online and classify them according to its function. In this points, the model is innovative. However considering the records management, problems such as division into Records Classification, definitions and capturing methods of records management objects, limitations of Records Automation System and so on was identified. For solving these problems, the reformed models that has a records classification system based on the business classification, extended electronic records filing system, added functions for strengthening electric records management and so on was proposed. As regards dramatically improving the role of records center in public institution, searching for the basic management methodology of the records management object from various agency and introducing the detail design to keep documents' authenticity, this model forms the basis of the electric records management system. In spite of these innovations, however, the proposed system for real electric records management era is still in its beginning. In near feature, when the studies is concentrated upon the progress of qualified classifications, records capturing plans for foreign records structures such like administration information system, the further study of the previous preservation technology, the developed prospective of electric records management system will be very bright.

  • The purpose of this study is to explore ways to resolve the conflicting issues that are currently applied in medical Act and medical privacy Act through the comparative Analysis of the Privacy Act and the Medical Information Protection Act foreign. the results run to establish the Public Health Act coming for the protection of health information is a characteristic of many countries, France in Europe, the United States and Canada had been running an independent medical information laws are enacted. Prescribes penalties of up to a fairly systematic method from the case records of patients would not have occurred in the management and implementation of the law and the protection of the author of the book focuses on the subject of medical records and physician records between patient confidentiality and privacy it can be seen that the method defined in. This indicates the need for the establishment of an independent medical information laws to protect all records relating to the patient systematically Korea also.
