Presidentialism and Consensual Politics: The Problems of South Korea and the US and Chile's Alternative Party Systems (대통령제와 협치가능성: 한국의 문제점과 미국 및 칠레의 대안적 정당체계들)

  • This paper aims to explain why severe political conflicts and confrontation between the ruling and opposition forces have been continuously caused, focusing on the institutional combination of presidentialism and the two-party system with strong party disciplines, after democratization in South Korea. And this also presents the US as a case in which presidentialism and a two-party system with weak party disciplines were combined once, and the Chile as another case in which presidentialism and a multi-party system with strong party disciplines is combined, respectively, and further analyzes how the chance of consensual politics could be raised in both the countries. In addition, this study suggests a practical implication that, in South Korea also, the political reforms for changes in party system such as the decentralization or democratization in party organizations to enhance the autonomy of individual legislators, or the introduction of runoff system in presidential elections or proportional representation system in parliamentary elections to product a multi-party system, are required for a high chance of consensual politics.

The Anticipatory Governance of Emerging Technologies (떠오르는 기술들에 대한 예비 협치)

  • The Center for Nanotechnology in Society at Arizona State University (CNS-ASU) is a Nano-scale Science and Engineering Center (NSEC) funded by the US National Science Foundation (NSF). It implements an agenda of "real-time technology assessment" (RTTA) in pursuit of a strategic vision of the "anticipatory governance" of nanotechnologies. To achieve this vision, CNS-ASU unifies research programs not only across several universities but also across three critical, component activities: foresight (of plausible future scenarios), integration (of social science and humanities research with nano-scale science and engineering), and engagement (of publics in deliberations). CNS-ASU also performs educational and training activities as well as public outreach and informal science education. This paper elaborates the Center's strategic vision of anticipatory governance and its component activities, especially in the context of extending the concerns of societal dimensions research beyond the traditional risk paradigm.

입법에서의 협치 확대를 위한 고찰

  • 국민들과 주민들의 입법참여를 위한 여러 방안들을 제도화 한 것은 의견을 수렴하기 위한 것에서 나아가 주권자인 국민과 대의기관이 협력하여 협치를 이루기 위한 것으로 볼 수 있다. 이미 제도화된 입법예고와 공청회 청문회를 비롯하여 입법청원과 주민의 조례의 제정 개폐청구권 등은 일방적으로 법을 입법하여 수범자에게 제시되는 것이 아니라, 국민들의 의견을 반영하고 협력하여 '좋은 법' 내지 '준수가능한 법'을 만들기위한 것이다. 또한 제도화되지는 않았거나 본질상 제도화될 수는 없는 것이지만 사회적 자율과 국가적 강제를 조화시키는 장점을 지니는 국민발안과 협상에 의한 규칙제정 그리고 시민입법 및 연성법 등도 협치라고하는 시대정신에 상응하는 입법경향에 해당하는 것이라고 볼 수 있다. 현행 제도인 입법청원이나 입법예고를 포함하여 법안심사 과정중에 공청회 청문회를 실질화하여 국민들의 의견을 입법에 적극 반영하는 것이 국가와 국민의 협치를 강화하는 것이며 조례의 제정이나 개폐 청구를 실질화하여 주민들의 의견을 자치입법에 적극 반영하는 것이 지방자치단체와주민의 협치를 강화하는 것이다. 또한 제도화는 안 되어 있지만 국민소환과 함께 도입이 주장되고 있는 국민발안제도 혹은 시민입법도 입법과정에서의 일방성을 시정하기 위한 협치의 한 방안이고 협상에 의한 입법이나 연성법의 활용도 협치적 요소를 강화하기 위한 방안이라고 볼 수 있다. 법률 행정입법 자치입법의 입법을 포함하여 연성규범에 있어서, 즉입법과정에서 공식적이건 비공식적이건 간에 협치의 의미를 실현하고 이를 적용할 영역은 이와 같이 다양하게 생각해 볼 수 있다. 입법을 통한방식의 국가의사 결정에 있어서 기존처럼 일방적인 방향성을 지니는 패러다임에서, 이제는 쌍방적인 방향성을 지니는 패러다임의 전환이 바람직하다고 할 수 있다. 특히 법률에 의한 행정과 재판이 법치주의의 본질적내용이기 때문에 국가작용에서 입법은 특히 중요하며, 입법과정에서 국민을 참여시키고 의견을 수렴하고자 하는 협치적 요소를 입법과 관련한 제도개선에 적극적으로 반영할 필요가 있다.

An Analysis of Residents and Experts' Perception on Conservation and Utilization of Urban Rivers (도시하천의 보전 및 이용에 관한 주민과 전문가 인식 분석)

  • Urban river have been a key pillar in citizens' lives through the healthy urban environment of ecological nature along with the function of this dimension. On the other hand, conflicts are occurring in terms of conservation and use of rivers in the region along with the expansion of infrastructure due to urban densification. Appropriate agreement and coordination are needed for sustainable streams. This study aims to analyze various opinions through public discussion of residents' proposals through the resident participation cooperation budget. User awareness surveys and expert interviews were conducted on six rivers in Eunpyeong-gu. Through this, stable and sustainable preservation of local and small rivers and appropriate and balanced use measures were proposed.

Why Again Record Management Innovation? : Towards Communication, Technology, and Governance (왜 다시 기록관리 혁신인가? 소통, 기술, 협치를 향해)

  • This paper will address why records management innovation needs to be considered and sought again in 2017 when Korea's new government was inaugurated, and it suggests the direction and strategies of the innovation. Now is time to inherit the innovative spirit of Roh's Participatory Government based on new methods and contents with immanent criticism. This paper proposes the innovation for the "records management by everyone," where everyone involved needs to participate in and proceed with the innovation for the sake of democracy. Not just government offices but also corporations and even ordinary people need to participate in the process of records management and share the results. Records management is necessary and required in places where democracy is practiced, where historical events occur, and where technologies are continuously innovated around the world. This paper proposes 12 strategies and 35 tasks in 6 sectors where records management is required at present. In addition, it also suggests a methodological innovation for using the latest technologies, communicating with every entity, and governing decision-making.

낙동강권역의 문화관광자원 분포 특성에 관한 연구

  • 우리나라 4대 강 중에서 낙동강 권역은 관광자원 측면에서 볼 때 다양한 관광자원을 보유하고 있음에도 불구하고, 기존 연구는 수자원의 산업적 이용과 상수원 확보 차원에서 수질보전과 유지에 대한 환경학적 연구가 주종을 이루었다. 따라서 본 연구는 문화관광학적 관점에서 낙동강 권역을 조명하고 문화재의 분포특성을 분석하였으며, 다음과 같은 연구결과를 도출하였다. 첫째, 지방분권시대의 도래를 앞두고 낙동강 권역의 협치(governance)에 의거 연구대상 범위를 낙동강유역환경청과 대구지방환경청의 관할구역에 따라 연구범위를 설정하였다. 둘째, 본 연구분석 대상으로 문화관광자원 중 국가지정문화재 시도지저문화재 문화재자료 등 문화재 등을 대상으로 하였다. 셋째, 문화관광자원의 지리적 분포는 다음과 같은 특성을 나타내었다. 관할구역에 따른 문화관광자원의 분포는 대구지방환경청이 낙동강유역환경청보다 양적 우세성을 보였다.

A Study on the Change Features and Counter Measures of Rural Development Policy System in Korea (한국 농촌개발정책 체제 변화와 대응과제)

  • The objectives of this study were 1) to explore the change features of rural development policy system, and 2) to get some policy counter measures for construction of desirable rural development policy system. First, the change features of rural development policy system are 1) to expand the rural development organization of local government, 2) to strengthen the finance basis for rural development policy, 3) to attempt building the cooperation network between the various local groups. And the policy counter measures derived from this study are 1) to convert the rural development policy system to that of local leading system, 2) to expand the actual rural inhabitant participation in policy making & performance process, 3) to prepare the effective governance system in local level.

  • This Study aims to criticize national pension fund governance reform plan of Korea government and to search for an alternative direction of the reform. Firstly, I examine the theoretical basis of the Korean government reform plan by clarifying limits of application of agency theory to the public pension fund governance. Secondly, I try to reconstruct principles of the public pension fund governance with an alternative theoretical view emphasizing democracy principle. Thirdly, I evaluate the government reform plan with the basis of reconstructed pension fund governance principles. The government reform plan is expected to cause retrenchment of democracy and even political autonomy. It also would make worse the problem of pension fund autonomy from the financial market and the risk of the pension fund caused by market turbulence. Finally I suggest alternative direction of the pension fund governance reform emphasizing the democracy principle. This direction contains constructing co-determination structure of the state and the civil society, escalating controling power of the governing body to the administration body, setting the limits of the roles of the state, attaining of the autonomy from the financial market, strengthening organizational and social accountability.

  • The purpose of this study is to analyze governance in the business processes of Jeju's proposed 'Happy Living Area.' This study found Jeju's 'Happy Living Area' plans for governance were realized and conflicts may frequently occur in future business processes. Furthermore, roles and support systems were measured for the development council of 'Happy Living Area.' This paper reports findings from a case study on community planning for a public art project. This study recommends public-private governance in terms of process factors as well as role considerations. With respect to process factors, administrative agencies and citizen participation are examined. Second, the Living Area Council should play a mediating role between central and local governments as well as residents. Third, Happy Living Zones' Advisory Centre should undertake an advisory role. Fourth, consultation between public and private sectors is needed to establish evaluation criteria for reviewing proposals from subordinate administrative agencies. Fifth, local government systems should be managed by autonomous municipalities. Concerning role considerations, a new 'Personality for Governance' position should be established for performing different roles in the project implementation stage.
