Development of the improved Ex-post management of Public-Private Partnership Infrastructure projects in korea (국내 사회기반시설 민간투자사업의 사후적 관리 개선 방안 개발)

  • In the current Public-Private Partnership, Applying Ex-post management is rising after the completion of construction. So, Advanced countries of construction are getting additional profit from Re-financing while repairing system about Re-financing. But within the our country positive introduction is difficult because of insufficient of social sympathy about Re-financing, shortage of support from government and imperfection of detail regulation. So this study analyzes the cases of Ex-post management Which are applied to Public-Private Partnership that is adopted by project financing in domestic and overseas field and considers plans which can apply more efficiently in Public-Private Partnership. We anticipate that the results of this study can be utilized for materials that can help people who want to understand hereafter introduction of Ex-post management in domestic Public-Private Partnership and expect that the materials can be used for data developing system of Ex-post management.

  • Korean construction firms have been continuing investment of IT for last ten years. However, manager did not support a decision-making of IT because there is no evaluation and feedback system of IT investment. This study is a preceding research of making IT evaluation model as a part of MOCT(the Ministry of Construction and Transportation)'s construction CALS/EC policy and makes a basic frame through a trend and state of IT survey. As a result of survey, To encourage them, IT development to be balanced in each members for successful stabilization of CALS/EC as well as IT evaluation will be conducted in accordance with one's environment, such as a role and level of companies.

The research which it sees it leads and it induces it is quantitative/that there is a possibility of being sufficient it sees the quality increase of Middleware software and the demand which is qualitative.

A Case Study on the Online Fractional Investment Securitization Platform (온라인 분할 투자 증권화 플랫폼 사례 연구)

  • With the development of information and communication technology, online fractional investment platforms have emerged through the convergence of online platform technology and new investment techniques for asset-backed derivatives. In this study, the concept and previous studies of the online fractional investment platform business, commercialization models and service processes, market status, and pending discussions and alternatives were presented. Recently, the Securities and Futures Commission's decision on securitization of split ownership has become an important guide to the stable business sustainability of platform operators, but academic research is needed according to the current status and case analysis. To identify specific market issues, examples of representative online fractional investment securitization platform businesses such as "MusiCow" for music copyright, "Tessa" based on art, "Kasa" for real estate, "Piece" based on real assets, and "BangCow" for Korean beef shipments were analyzed. Through the case analysis of this study, the characteristics of the business model according to the basic assets of the online fractional investment platform were compared and presented. Since most business models are judged to be securitic, they must comply with the provisions of the Capital Markets Act or be recognized as the target of innovative financial services. From a practical point of view, it is meaningful in that it presented improvement directions that online fractional securitization platform operators should consider and organized institutional considerations for investor protection.

Current Trend of European Competition Damage Actions (유럽 경쟁법상 손해배상 청구제도의 개편 동향과 그 시사점)

  • This Article discusses the current trend of European competition damage actions focused on the recent Damage Directive and its transposition by the United Kingdom and Germany. The relevant Directive was signed into law in November 2014, and it requires the EU Member States to adopt certain measures to support competition damage actions. The required measures and principles by the Directive include right to full compensation, rebuttable presumption of harm, extensive disclosure of evidence, use of pass-on for defense and indirect purchaser suits. Although many Member States did not meet the deadline to transpose the Directive, the end of 2016, it is reported that 23 Member States have now, as of September 2017, made enactments according to the Directive. When we look at the transposition done by the United Kingdom and Germany, the revisions on their competition laws closely follow the contents of the Directive. However, it will take quite a long time before the amended provisions apply to actual cases since most of the new provisions apply to the infringement that take place after the date of the amendment. A similar situation regarding application time may happen in some other Member States. Furthermore, even if the terms of the competition laws of the Member States become similar following the Directive, the interpretations of the laws may differ by the courts of different countries. EU also does not have a tool to coordinate the litigations that are brought in different Member States under the same facts. It is true that the EU made a big step to enhance competition damage actions by enacting Damage Directive. However, it needs to take more time and resources to have settled system of competition private litigation throughout the Member States. Korea has also experienced increase in competition damage actions during the last fifteen years, and there have been some revisions of the relevant fair trade law as well as development of relevant legal principles by court decisions. Although there are some suggestions that Korea should have more enactments similar to the EU Directive, its seems wiser for Korea to take time to observe how EU countries actually operate competition damage actions after they transposed the Directive. Then, it will be able to gain some wisdom to adopt competition action measures that are suitable for Korean legal system and culture.

  • Domestic and international laws and regulations on design of residential environment are adopted, revised and supplemented to solve the problems such as access, safety and privacy in the residential space of the elderly and the disabled. This study is an comparative analysis of Korea and Japan, USA, UK laws and regulations on environment design by literature review. The purpose of this study is to present the basic materials required for development of the standard that would supports the undiscriminatory physical environment for the socially weak who are experiencing aging and disability, due to the restricted scope of entrance, bathroom and kitchen spaces with high frequency of safety accident. The results of this study are as follows. (1) Design guidelines on residential environment were compared under five residential factors for aging in place: safety, accessibility, amenity, usability and privacy. (2) The guidelines of each country applied to the entrance, bathroom and kitchen space were compared. (3) The results showed present guidelines should be completed with 'safety', 'accessibility', 'amenity', 'usability' and 'privacy' for Aging in place.

  • Recently, The government is actively transit road-oriented Traffic System to the eco-friendly and high-efficiency railroad-oriented transportation system for the sustainable green growth. The second plan of Nationwide Railway Network which has been officially announced rearrange to integration, multi-core, open architecture country by the railway network and integrate to the one mega city that rink an important city in one hour 30 minute. But the railroad industry is disadvantageous when it compares with the road industry on the ground that railroad industry peculiarities(a cost-benefit analysis, an environment value, etc) have not reflected in the (preliminary) feasibility study for SOC industry. The government establish Improved methodology of Rail Investment Rating System and improved preliminary feasibility study in railroad project by introduction many content(analysis periods, rate of discount, the benefits of shortening of transit hours, the estimation of traffic accident reduction benefits, investment cost of vehicle substitution and operation and maintenance cost of high speed rail) about the Improved methodology of Rail Investment Rating System. This study is intended to consideration the key content that was included in the Improved methodology of Rail Investment Rating System. In addition, the points to be considered for additional study have been reviewed in this study. We hope we will carry out make a reasonable and objective Rail Investment Rating System and to perform the railway industry of the virtuous cycle such improvement plans are reflected at a hereafter railroad section.

Risk Analysis of Highway Investment by Private Sectors (민자유치대상고속도로 투자의 위험도분석)

  • 본 논문은 도로투자 사업성분석시 사업주체의 현금흐름을 결정하는 항목들을 고정값(Deterministic Value)이 아닌 확률적으로 추정함으로써, 사업의 재무적 변동으로 인한 위험도를 민간사업자의 견지에서 사업성분석과정에 내재화하는 모형을 개발하는 것이다. 즉, 확률적 비용추정기법으로 국소적으로 활용되던 위험도분석을 재무모형에 내재화함으로써 사업의 재무적 변동을 보다 포괄적으로 분석할 수 있는 틀을 제공한다. 본 연구에서는 몬테카를로 시뮬레이션기법을 이용한 위험도분석(Risk Analysis)을 적용하여 사업성 평가지표와 비용의 확률밀도함수(Probability Density Function : PDF), 누적확률분포함수(Cumulative Distribution Function : CDF)를 산출하고, 그 결과로 해당 사업의 위험도를 고려하여 사업성을 평가한다. 이 모형은 사업의 모든 변동요인을 복합적으로 추정하여 사업기간 내 사업주체의 현금흐름을 분석할 수 있다. 따라서 사업주체는 효용에 따라 합리적인 위험도 관리 목표값(Target Value)을 선정하고, 사업의 위험도를 고려하여 건설비, 예비비를 결정할 수 있다. 본 연구에서 정립된 모형을 서울외곽순환고속도로(일산-퇴계원 구간)와 대전당진고속도로를 대상으로 사례분석을 수행하였다. 그 결과, 대전당진고속도로의 경우 사업성이 없으며, 서울외곽순환고속도로의 경우, 일부 위험도 발생변수를 합리적으로 관리한다면, 사업성이 충분한 것으로 분석되었다. 본 사례분석은 사업의 위험도를 반영한 사업성분석 방법으로 우리나라 민자유치대상고속도로의 사업성분석의 하나의 지침이 될 것이다.

  • Preliminary feasibility study(PFS) was introduced in 1999 by financial authority to encourage a cautious approach to new large-scale public investment project. As it applied cost-benefit analysis as prime measure for decision-making, various issues have been arisen concerning feasibility analysis on R&D programs. This work is intended to suggest standard approaches to be established in PFS on R&D program as follows: 1. The issue questions can be induced in a standard way by 15 representative questions and their correlation with evaluation criteria. 2. The analyzing strategy can be standardized by establishing standards for classification of R&D effects and R&D logic analysis.

Quantitative Analysis of Safety Improvement on Smart Roads (스마트도로 안전성 향상 효과의 정량화 연구)

  • Intelligent transport services on smart roads tend to have a problem at the stage of benefit-cost analysis that can not secure economic feasibility of the new services which increase early investment cost on building its infrastructure. It is expected that the number of road accidents, 'Incident/Accident', will decline through various safety services using intelligent safety facilities, intelligent transport management and so on, and that traffic congestion will also decrease. The effect of traffic congestion reduction could be the benefit by safety improvement, however current investment-analysis process in Korea does not appropriate it as a benefit. This study estimated road blocking time with 'Incident/Accident' classification and highway accident data of past three years. It also developed a generalized model by a regression analysis with a microscopical simulation. Furthermore, it suggested necessary units on quantitative analysis in order to make the developed model applicable to investment evaluation. As a result of applying the developed model to Smart-Highway Project, it showed that total safety improvement benefit is about 139 billion dollars over 30 years when it is supposed that accident decreasing rate by smart safety facilities is 10%.
