A Study of the Unilateral Trade Policy of the United States: A Case Study of the Automobile Industry (미국의 일방주의 통상정책 사례에 대한 연구: 자동차 산업을 중심으로)

  • The United States is often perceived as a free-trading nation as it significantly contributed to the establishment of the GATT and WTO in the 20th century. With the inauguration of the Trump Administration in 2017, however, trading partners of the United States are faced with great concerns over the 'new' aggressive, protectionist and above all, unilateral trade threats posed by the United States under the name of 'America-First' trade policy. However, the recent unilateral trade actions by the United States are not new, but has historically and continuously been used to protect its key industries, like the automobile sector. This paper analyzes the historical cases of the unilateral trade policy of the United States in the automobile industry, targeting Korea and Japan in the 1980s, 1990s and 2010s. Then, we draw future implications for other key industries of the United States such as IT, intellectual property, services and agricultural sectors. This study evaluates whether such unilateral practices have brought successful and expected outcomes in favor of the United States.

  • This paper conducts a comparative analysis of the KORUS FTA and the TPP Agreement to assess the current state of affairs in international trade rules for the pharmaceutical industry. Intellectual property rights as well as public health related regulations have evolved to strengthen the position of innovator drug companies. In particular, the TPP Agreement which adopted data exclusivity for biologics for the first time, will set the standard for the future. Apart from this however, the TPP Agreement has not gone further than the KORUS FTA and in some respects, even contains greater policy flexibilities and provisions for market access than the KORUS FTA. Korea should take advantage of such differences when and if she must engage in negotiations to join the TPP Agreement or a renegotiation of the KORUS FTA.

  • This study examines the dispute resolution culture and negotiation strategy in Vietnam. We adopt area studies methodology in order to analyze dispute resolution and negotiation strategy in Vietnam, since the dispute resolution and negotiation strategy are keenly connected with the culture, law, institution, and economic system of the society. Our findings are as follows. First, Vietnamese society has the culture that has the characteristics of maternal society and patrilineal society. Vietnamese women has traditionally participated in the economic activity. Second, Vietnamese people showed loyalty to the nation. Third, Vietnamese society is shown to belong to the culture of collectivism. In addition, we investigate the multi-faced characteristics of Vietnamese dispute resolution culture and negotiation strategy. Our findings are as follows. First, Vietnamese people utilize middlemen in implementing dispute resolution and negotiation. Second, Vietnamese people prefer long-term negotiation style. Third, Vietnamese people is accustomed to face-saving culture. Fourth, Vietnamese people prefer the indirect communication style. Fifth, Vietnamese people prefer written document instead of oral agreement in contract. Sixth, Vietnamese people and firms prefer ADR to formal law.

A Two-level Game Theoretic Approach to the Successful Korea-China FTA Negotiations (2단계 게임이론에 의한 우려나라의 한.중 FTA협상 성공전략)

  • The study analyzes the optimum Korea-China FTA negotiations by utilizing the Putnam's two- level game theoretic approach. According to the Putnam's theory, the size of the win-set depends on the strategies of the Level 1 negotiators. The size of the win-set depends also on the level 2 political institutions and the distribution of power, preferences, and possible conditions among Level 2 constituents. The basic principles for the successful future Korea-China FTA negotiations should be based on comprehensiveness, substantial liberalization and gradual liberalization with consideration of sensitive sectors. This study concludes that mid-level FTA strategy with comprehensive but low tariff reduction would be of best strategy for Korea. This study also suggests the utilization of the EHP(Early Harvest Program) for the successful Korea-China FTA negotiations.

  • The purpose of this study was to identify the issues which how situational constraints of negotiation affect outcomes. To achieve the purpose of this research, a multiple regression model was set up to identify the relationships between situational constraints of negotiation and negotiation outcome on international trade contracts. To implement the study, empirical questionnaires were collected from Korean business men who have actually conducted international trade with foreign firms. Reliability analysis and factor analysis were used to assess the reliability and validity of research variables. and multiple regression analysis were used for testing the relationships between situational constraints of negotiation and negotiation outcome. From this study, following results were identified; i) situational constraints of negotiation effects on negotiation outcomes ii) arbitrary and continuous situations affect significantly positive on negotiation outcomes iii) submissive situations affect significantly negative effects on negotiation outcomes In conclusion, participant of negotiation and their managers try to promote negotiation situation toward to arbitrary and continuous situations if they have any availability.
