Shipowner's Lost Profit and Its Claim resulted from Delay in Redelivery under Time Charter (정기용선계약에서 반선지연에 의한 선주의 상실수익과 손해배상청구)

  • The purpose of this study aims to explore shipowner's lost profit and its claim resulted from delay in redelivery under time charter with the Achilleas case. In this case, the charterers submitted that there was an established prima facie measure of damages in cases of late delivery, namely the difference between the market rate and the charter-party rate for the period from the time when the vessel should have been delivered until the time of her actual redelivery. An award for lost profit in respect of a subsequent charter could only be made under the second limb because the charterers had not been told, at or before the making of the addendum, that the owners were going to enter into a subsequent fixture and that it was critical that redelivery take place on time. However, the owners said their losses that was a not unlikely consequence of the charterers' breach. There was no special rule that the first limb could only lead to damages calculated by taking the difference between the market and the charter-party rate for the overrun. To award damages in the Achilleas case on the basis of the difference between the market and the charter rate for the overrun would compensate the owners for only a fraction of the true loss caused by the breach.

  • The loss of potential opportunity profit which is consisting in the partial markups of the corporation would taking placed in related with the time-delay deeply, has customarily disregarded in contract adjustment under the principles of denial of cost accounting method, declined conjecture in the point of benefits and protection of the law in scope of compensation and the restricted conditions of constant contract. It is being resulted from that the policies of the general principles of accounting standards which is subjected to ask an objective data and evidence, and the denial system as a debt derived from imperfect legal theory applied by current law. Therefore, it is necessitated to find if any irrationality in the positive system is and further to draw an improved reasonable measures to adopt by review of constant system preparing tile reasonableness with the method of suitable quantification devices provided that any time-delay is induced by the party.

  • 4차 산업혁명과 더불어 급격하게 성장하고 있는 우리나라 항공운송산업은 다른 교통 및 운송수단에 비교하였을 때 항공운송이 갖는 고유한 특성인 안전성, 경제성, 국제성 등의 장점으로 인하여 꾸준히 성장을 거듭하고 있는 것이 사실이다. 하지만 이러한 성장과정 속에서 우리가 예상 할 수 없이 갑작스럽게 벌어지는 항공기 엔진 결함으로 지연 및 항공기 추락사고 등으로 발생되는 법률적인 분쟁도 지속적으로 증가해 가는 것도 틀림이 없다. 한편 그동안 항공사고를 둘러싼 인명피해나 재산상 손해에 대한 법률적인 분쟁에 있어서 국제항공운송과 관련해서는 국제조약으로 국내항공운송은 각 항공사가 제시한 항공운송약관 및 민법, 상법 등으로 해결을 해왔었다. 따라서 본 연구에서는 항공기사고와 관련한 항공운송인의 손해배상책임에 대한 쟁점사항을 살펴보고 그에 대한 합당한 개선방안을 적시하고자함이 본 연구의 목적이다.

  • It has been over seven years since Maritime Code of the Peoples Republic of China (hereinafter called the Code) came into force on July 1st 1993. During this period it has played a very important roll in governing Chinas ocean shipping. However, owing to the defects of the Code, many problems have arisen in the performance of the Code, among which is the problem related to delay in delivery. Therefore, it is necessary and inevitable to revise the Code. This study is limited to a rough study on the regulations related to delay in delivery in the Code, such as the definition of delay in delivery, the carriers responsibility for delay in delivery, the carriers exemption from responsibility for delay in delivery, the limitation of responsibility, the procedures of claims for delay in delivery and the difference of the Code from the Korea Commercial Law, the Hague Rules, the Hague-Visby Rules and the Hamburg Rules. Furthermore, some defects in the Code are pointed out and suggestions are provided for the revision of the Code.

  • With the opening in construction market, more diversified and internationalized construction culture is imported, but the level of our construction culture and policy is still not met the international standards. For example, there is a difference in the liquidated damages at delay due to the reason of builder imputation during the public construction project comparing the international standards like damages. It may lead to the potential claim. In this study, via comparing and analysis on the relevant international standards and extension expense for terms of work, actual compensation is selected, and improvement of liquidated damages like damages is presented.

  • 모바일 컴퓨팅 환경에서 Invalidation Report(IR)의 사용은 무선대역폭과 배터리 사용 측면에서 효율적인 방법임이 증명되어 왔다. 그러나, IR기반의 방법은 긴 응답시간과 낮은 캐쉬 가용성을 가지며, 또한 클라이언트가 충분한 캐쉬를 가지고 있다고 해도 짧은 응답시간을 요구하는 응용프로그램에는 적합하지 않다는 단점을 가진다. 본 논문에는 이러한 문제를 해결하기 위해 효율적인 캐쉬 사용이 가능한 프로토콜을 제안하였다. 제안한 기법에서 클라이언트는 수동적으로 IR을 기다려 캐쉬를 사용하지 않고 보다 능동적으로 캐쉬를 사용한다. 이러한 기법을 통해 우리는 필요 없는 응답시간 지연을 야기하는 " false alarm"를 제거 할 수 있었다. 제안된 한계치 기반 방법을 통해 우리는 약간의 데이터 현재성을 손해 보았지만, 응답시간을 최적화 할 수 있었다. 제안한 기법을 평가하기 위한 시뮬레이션 결과는 우리가 제안한 기법의 아주 적은 현재성 손해를 보지만. 응답시간을 크게 줄일 수 있다는 것을 보여준다.

A Study of Delay Interest in International Arbitral Awards (국제중재판정의 지연이자에 관한 고찰)

  • Awarding interest in international arbitration remains one of the most challenging areas for tribunals and parties given the myriad of issues that arise. This article seeks to provide an overview of how international arbitral tribunals grant delay interest. It reviews the various issues that international arbitral tribunals face concerning pre-award and post-award interest, determining the appropriate interest rate, surrounding simple or compound interest, and the complex issue of choice of law. A comparative context is provided by surveying the laws of major jurisdictions from both the common law and civil law and the regulations of leading arbitral institutions. It concludes with a review of the law, jurisprudence, and practice in Korea related to delay interest and how Korean tribunals under the KCAB Domestic and International Rules have determined delay interest in recent years.
